Question Paper Specific Instructions


Please read each of the following instructions carefully before attempting questions:

There are FOUR questions in all and printed ONLY in ENGLISH.

• Candidate has to attempt THREE questions in all.


• Question no. 1 is compulsory and out of the remaining, TWO are to be attempted.
• The number of marks carried by a question /part is indicated against it.
• Answers must be written in the medium authorized in the Admission Certificate which
must be stated clearly on the cover of this Question-cum- Answer (QCA) Booklet in the
space provided.
• No marks will be given for answers written in a medium other than the authorized one.
• Word limit in questions, wherever specified, should be adhered to.
• Attempts of questions shall be counted in sequential order. Unless struck off, attempt of a
question shall be counted even if attempted partly. Any page or portion of the page left
blank in the question-cum-Answer Booklet must be clearly struck off.

Q1. Answer the following in about 150 words each : 10x5=50

a) All culpable homicide are not murder, examine the circumstances under which a culpable homicide
amounts to murder .
b) Write a short note : Criminal Conspiracy
c) The expression "waging war" means and can only mean waging war in the manner usual in war”
Explain the key elements of the offence of “waging war” and its scope.
d) Define and Differentiate : Kidnapping and Abduction
e) Explain the offence of causing death by Negligence.

Q2.Answer the following :

a) Explain the following :


i. Constituent elements of Abetment (5m)
ii. Abettor (5m)
iii. Kinds of Abetment (5 m)
iv. Abetment to suicide (7½ m)
b) It’s a well-settled legal principle that in cases relating to outraging the modesty of a woman, it’s the
intention of the person in question that matters. A mere touch won’t constitute an offence unless it’s
made with an explicit sexual intention. Staring at a woman can be deemed offensive under Section
354-D of the IPC. (15 m)
c) " Helplessness in the face of inevitable compulsion cannot be considered to be consent as understood
in law." Comment and substantiate answer with the help of relevant case laws with respect to Section
375 IPC. (15m)
Q3. Answer the following :

a) “A fight suddenly takes place, for which both parties are more or less to be blamed and death of a
person caused in a ‘sudden fight’ is not murder” Examine the statement under IPC. (15 m)
b) Examine the Criminal Liability of X : “ T went inside her house to alight the lamp, she found the X
inside her room, he was smoking, he demanded water and while T was giving water X caught hold of
her, threw her down and removed his clothes and also her clothes, and inserted his male organ into
her private part, at that time, her mother called her on which the X left her” (15m)
c) Sedition’ is an offence incorporated into the Indian Penal Code (IPC) which government or Ministers
or politicians in power have found handy to silence or discipline critics. Critically analyse the need for
sedition in 21st century. (20m)

(c) Define Unlawful Assembly. When is a member of an unlawful assembly constructively liable for
the offence committed by another member? (15m)
