III. FACTS OF THE CASE:

5. About 10: 00 o’clock in the evening of October 10, 2023 this office received
information through cellular phone from Emergency Hotline 911 by 2198,
informing that there was an alleged found robbed and burned property at Alviola
Village Baan Km3, Butuan City. Immediately, PSSg Alivar A. Tose the
investigator and Cpl. Jaynard J. Labadia,Patrol driver and BFP Butuan Team
responded.

IV. INVESTIGATION/FINDINGS:
6.Upon further investigations, investigator from BCPS1 and BFP Butuan have found
the motive of business partnership complication of the incident. That based on the
mere facts and testimony of the complaint and witnesses identified as 1. Anthony G.
Abay-Abay 21 years old, married and Hanna Keziah B. Po the complainant’s wife
and their two children a resident of Alviola Village Baan Km3, Butuan City. This office
come up and found probable cause that Bheps Bryan M. Amor, Jr. 21 years old,
single, male, bank employee and a resident of P-2 Taguibo, Butuan City ,has an
intent to ransack the following mention : watch, laptop and money cost of
₱100,000.00 and burned the property of the said victims using 1 gallon of gasoline
inflicted in victims resulting to their property loss.

km.3 Butuan city around 10:30 in the evening of October 10, 2023 . Be informed
that the victim’s family is now at outside of their house

3. The victim Mr. & Mrs. Anthony Abay-Abay ,Robbery with Arson on October 10,
2023 cause of fire gasoline.

FACTS OF THE CASE:

In 10 o’Clock in the evening when the crime was happened at the house of
Mr./Mrs. Abay-Abay was totally burned and destroyed. The fire started due to
gasoline spilling on the floor due to a robbers that occurred in the home of Mr. and
Mrs. Abay-Abay, There was no immediate help because the fire was easily spread
and they are panicking already of the sudden event that they did not expect to
happened. The damage of the property estimated ₱ 1.5 Million.

DISCUSSION:
Upon the arriving at the located area of the fire was already consumed the
most part of the establishment. The fire responder was arduous to extinguish the fire
due to limited supply amount of water they are capable of and the lack of fire hydrant
in the area. Another factor that challenged the fire fighters was the heavy dark
smoke produced by burning materials inside. The flashover that immediately spread
around the establishment gives difficult situation.
Furthermore, the cause of the fire was greatly relied upon the testimony of
the witness and victims however, The investigation is still on-going.

1. Mr. Anthony Abay- Abay a 21 years old, married, resident of Alviola Village Baan
Km3, Butuan City was celebrating his promotion on that day at around 10 o’clock in
the evening with his wife, daughter, and son in Alviola Village Baan Km3, Butuan
City. Later, the suspect and his people took advantage of the opportunity to
ransack/rob their home and also tried to beat him up and threaten his two children.
2.They called the Responding Team of Butuan City Police Station 1, JC Aquino
Ave., comer AD Curato St. Butuan City right away with the help of the BFP located in
J&T EXPRESS R calo Branch, Butuan City, as soon as they were outside their
house and nearly choked on the smoke from the fire inside.
3. The victims Anthony G. Abay-Abay his wife Hanna Keziah B. Po and their two
children.
4. The motive behind the incident is still unknown.

A. : On the aforesaid date at about 10 o’clock in the evening, I was with my
family my wife, daughther and son in Alviola Village Baan Km3, Butuan City in
our resident location. Celebrating my promotion in my workplace so we
celebrate that special ocassion after that we peacefully get to sleep, later on
the suspect and his people took the opportunity to ransack/robbed our house
threaten my two children using a knife that made them silent as they were
intimidated also tried to enter in my wife’s bedroom as my wife suddenly
noticed that there’s someone sneak inside in our bed room and she
immediately wake me up and I tried to get after him and he beat me up and
intentionally burned our house as they eventually escaped.

A. :Immediately, we rushed to get outside of our home as we almost suffocate
of the dark smoke caused by burning in our house and immediately called the

Curato St.,Butuan City with the assistance of the BFP located in J&T
EXPRESS R. calo Branch, Butuan City.
