Dear Ms. Martinez Miguez:

Enclosed is the permit cited above to construct five Class V, Group 6 Stormwater Drainage
Wells, for the use of stormwater drainage only, issued pursuant to Chapter 403, Florida
Statutes (F.S.).

The Florida Department of Environmental Protection (Department or FDEP) Southeast District’s


proposed action shall become final unless a timely petition for an administrative hearing is filed
under Sections 120.569 and 120.57 of the Florida Statutes before the deadline for filing a
petition. The procedures for petitioning for a hearing are set forth below.

A person whose substantial interests are affected by the Department’s proposed permitting
decision may petition for an administrative proceeding (hearing) under Sections 120.569
and 120.57 of the Florida Statutes. The petition must contain the information set forth below and
must be filed (received) in the Office of General Counsel of the Department at 3900
Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000. Petitions filed by
the applicant, any of the parties listed below or by any other person must be filed within fourteen
days of receipt of this written notice. A petitioner other than the applicant shall mail a copy of
the petition to the applicant at the address indicated above at the time of filing. The failure of
any person to file a petition within the appropriate time period shall constitute a waiver of that
person’s right to request an administrative determination (hearing) under Sections 120.569
and 120.57 of the Florida Statutes, or to intervene in this proceeding and participate as a party
to it.

Any subsequent intervention (in a proceeding initiated by another party) will only be at the
discretion of the presiding officer upon the filing of a motion in compliance with
Rule 28-106.205 of the Florida Administrative Code (F.A.C.).

A petition that disputes the material facts on which the Department’s action is based must
contain the following information:

1. The name, address, and telephone number of each petitioner; the name, address, and
telephone number of the petitioner’s representative, if any; each the Department case or
identification number and the county in which the subject matter or activity is located;
2. A statement of when and how each petitioner received notice of the Department action;
3. A statement of how each petitioner's substantial interests are affected by the Department
action;
4. A statement of all disputed issues of material fact. If there are none, the petition must so
indicate;
5. A statement of facts that the petitioner contends warrant reversal or modification of the
Department action;
6. A concise statement of the ultimate facts alleged, as well as the rules and statutes which
entitle the petitioner to relief; and
7. Demand for relief (sought by the petitioner, stating precisely the action that the petitioner
wants the Department to take).

A petition that does not dispute the material facts on which the Department’s action is based
shall state that no such facts are in dispute and otherwise contain the same information as set
forth above, as required by Rule 28-106.301.

Because the administrative hearing process is designed to formulate final agency action, the
filing of a petition means that the Department final action may be different from the position
taken by it in this notice. Persons whose substantial interests will be affected by any such final
decision of the Department on the petitions have the right to petition to become a party to the
proceeding, in accordance with the requirements set forth above.
Mediation is not available for this proceeding.

A party to this order has the right to seek judicial review of it under Section 120.68 of the Florida
Statutes, by filing a notice of appeal under Rule 9.110 of the Florida Rules of Appellate
Procedure with the clerk of the Department in the Office of General Counsel, Mail
Station 35, 3900 Commonwealth Boulevard, Tallahassee, Florida 32399-3000, and by filing a
copy of the notice of appeal accompanied by the applicable filing fees with the appropriate
district court of appeal. The notice must be filed within thirty days after this order is filed with
the clerk of the Department.

This permit is issued under the provisions of Chapter 403, Florida Statutes (F.S.) and
Chapter 62-528, Florida Administrative Code (F.A.C.). The above-named permittee is hereby
authorized to perform the work or operate the facility shown on the application and approved
drawing(s), plans, and other documents attached hereto or on file with the Department and made
a part hereof and specifically described as follows:

TO CONSTRUCT AND OPERATIONALLY TEST: Five Class V, Group 6 Stormwater


Drainage Wells for the disposal of stormwater drainage only, to be located in the vicinity of
Building 4.

The construction of the stormwater drainage wells is part of a larger effort to redevelop the site,
which was a former construction and demolition landfill. The proposed drainage system consists
of a combination of exfiltration trenches interconnected with the proposed drainage wells; the
drainage wells are to act as a secondary drainage system to serve storm events larger than the 5
year - 1 hour storm event. An extraction well system along the eastern and southern boundaries
of the Countyline Corporate Park site is designed to capture the flow of landfill-impacted
groundwater throughout the vertical depth of contamination. The system is also intended to
provide full capture of the rainfall discharges from the exfiltration trenches and stormwater
drainage wells. As the open holes of the stormwater drainage wells will be constructed into G-II
groundwater, a zone of discharge under Rule 62-520.465(2)(b), F.A.C, is established for this
project. Compliance with the zone of discharge shall be determined through piezometer
monitoring at the property border in the downgradient direction.

DRAINAGE WELLS DIMENSIONS: The proposed stormwater drainage wells shall each be
constructed with 24-inch diameter steel casing. According to the application for Building 4, the
final casing depth of each well will be seated a minimum of 35 feet below land surface (bls;
approximately -20 feet relative to NGVD) and the total well depth of each well will be
approximately 65 ft bls.

GENERAL CONDITIONS:

The following general conditions shall be applicable to this permit per the requirement of
Rule 62-528.307, Florida Administrative Code (F.A.C.):

1. The terms, conditions, requirements, limitations and restrictions set forth in this permit are
"permit conditions" and are binding and enforceable pursuant to section 403.141, F.S.

2. This permit is valid only for the specific processes and operations applied for and indicated
in the approved drawings or exhibits. Any unauthorized deviation from the approved
drawings, exhibits, specifications, or conditions of this permit may constitute grounds for
revocation and enforcement action.

3. As provided in subsection 403.087(7), F.S., the issuance of this permit does not convey any
vested rights or exclusive privileges. Neither does it authorize any injury to public or private
property or any invasion of personal rights, nor infringement of federal, state, or local laws
or regulations. This permit is not a waiver of or approval of any other Department permit
that may be required for other aspects of the total project which are not addressed in this
permit.

4. This permit conveys no title to land, water, does not constitute State recognition or
acknowledgment of title, and does not constitute authority for the use of submerged lands
unless herein provided and the necessary title or leasehold interests have been obtained from
the State. Only the Trustees of the Internal Improvement Trust Fund may express State
opinion as to title.

5. This permit does not relieve the permittee from liability for harm to human health or
welfare, animal, or plant life, or property caused by the construction or operation of this
permitted source, or from penalties therefrom; nor does it allow the permittee to cause
pollution in contravention of Florida Statutes and Department rules, unless specifically
authorized by an order from the Department.

6. The permittee shall properly operate and maintain the facility and systems of treatment and
control (and related appurtenances) that are installed and used by the permittee to achieve
compliance with the conditions of this permit, or are required by Department rules. This
provision includes the operation of backup or auxiliary facilities or similar systems when
necessary to achieve compliance with the conditions of the permit and when required by
Department rules.

7. The permittee, by accepting this permit, specifically agrees to allow authorized Department
personnel, upon presentation of credentials or other documents as may be required by law
and at reasonable times, access to the premises where the permitted activity is located or
conducted to:

a. Have access to and copy any records that must be kept under conditions of this permit;
b. Inspect the facility, equipment, practices, or operations regulated or required under this
permit; and
c. Sample or monitor any substances or parameters at any location reasonably necessary
to assure compliance with this permit or Department rules.

Reasonable time will depend on the nature of the concern being investigated.

8. If, for any reason, the permittee does not comply with or will be unable to comply with any
condition or limitation specified in this permit, the permittee shall immediately provide the
Department with the following information:

a. A description of and cause of noncompliance; and


b. The period of noncompliance, including dates and times; or, if not corrected the
anticipated time the noncompliance is expected to continue, and steps being taken to
reduce, eliminate, and prevent the recurrence of the noncompliance. The permittee shall
be responsible for any and all damages which may result and may be subject to
enforcement action by the Department for penalties or for revocation of this permit.

9. In accepting this permit, the permittee understands and agrees that all records, notes,
monitoring data and other information relating to the construction or operation of this
permitted source which are submitted to the Department may be used by the Department as
evidence in any enforcement case involving the permitted source arising under the Florida
Statutes or Department rules, except where such use is proscribed by sections 403.111
and 403.73, F.S. Such evidence shall only be used to the extent it is consistent with the
Florida Rules of Civil Procedure and appropriate evidentiary rules.

10. The permittee agrees to comply with changes in Department rules and Florida Statutes after
a reasonable time for compliance; provided, however, the permittee does not waive any
other rights granted by Florida Statutes or Department rules.

11. This permit is transferable only upon Department approval in accordance with
rules 62-4.120 and 62-528.350, F.A.C. The permittee shall be liable for any non-
compliance of the permitted activity until the transfer is approved by the Department.

12. This permit or a copy thereof shall be kept at the work site of the permitted activity.

13. All applications, reports, or information required by the Department shall be certified as
being true, accurate, and complete.

14. Reports of compliance or noncompliance with, or any progress reports on, requirements
contained in any compliance schedule of this permit shall be submitted no later than 14 days
following each scheduled date.

15. In accordance with Rule 62-528.307(1)(p), F.A.C., any permit noncompliance constitutes a
violation of the Safe Drinking Water Act and is grounds for enforcement action; for permit
termination, revocation and reissuance, or modification; or for denial of a permit renewal
application.

16. It shall not be a defense for a permittee in an enforcement action that it would have been
necessary to halt or reduce the permitted activity in order to maintain compliance with the
conditions of this permit.

17. The permittee shall take all reasonable steps to minimize or correct any adverse impact on
the environment resulting from noncompliance with this permit.

18. This permit may be modified, revoked and reissued, or terminated for cause, as provided
in 40 C.F.R. sections 144.39(a), 144.40(a), and 144.41 (1998). The filing of a request by the
permittee for a permit modification, revocation or reissuance, or termination, or a
notification of planned changes or anticipated noncompliance, does not stay any permit
condition.

19. All reports and other submittals required to comply with this permit shall be signed by a
person authorized under rules 62-528.340(1) or (2), F.A.C. All reports shall contain the
certification required in rule 62-528.340(4), F.A.C.

20. The permittee shall notify the Department as soon as possible of any planned physical
alterations or additions to the permitted facility.

21. The permittee shall give advance notice to the Department of any planned changes in the
permitted facility or injection activity which may result in noncompliance with permit
requirements.

22. The permittee shall report any noncompliance which may endanger health or the
environment including:

a. Any monitoring or other information which indicates that any contaminant may cause an
endangerment to an underground source of drinking water; or
b. Any noncompliance with a permit condition or malfunction of the injection system
which may cause fluid migration into or between underground sources of drinking
water.

Any information shall be provided orally within 24 hours from the time the permittee
becomes aware of the circumstances. A written submission shall also be provided within 5
days of the time the permittee becomes aware of the circumstances. The written submission
shall contain a description of the noncompliance and its cause, the period of noncompliance,
including exact dates and times, and if the noncompliance has not been corrected, the
anticipated time it is expected to continue; and the steps taken or planned to reduce,
eliminate, and prevent reoccurrence of the noncompliance.

23. Proper operation and maintenance includes effective performance, adequate funding,
adequate operator staffing and training, and adequate laboratory and process controls,
including appropriate quality assurance procedures.

SPECIFIC CONDITIONS:

I. GENERAL REQUIREMENTS

1. This permit is for Countyline Building 4, LLC to construct and operationally test five
Class V, Group 6 stormwater drainage wells and an associated monitoring well system to be
constructed in the vicinity of Countyline Corporate Park, Building 4. This permit does not
authorize the construction or operational testing of any other well or wells.

2. No underground injection is allowed that causes or allows movement of fluid into an


underground source of drinking water (USDW) if such fluid movement may cause a
violation of any Primary Drinking Water Standard outside a permitted Zone of Discharge or
may otherwise affect the health of persons.

3. If injection is to continue beyond the expiration date of this permit the permittee shall apply
for, and obtain an operation permit. If necessary to complete the operational testing period
as referenced in Rule 62-528.450(3)(e), F.A.C., the permittee shall apply for renewal of the
construction permit at least 60 days prior to the expiration date of this permit.

4. In accordance with Rule 62-528.645, F.A.C., the owner/permittee or operator of any


Class V well shall apply for a plugging and abandonment permit when the well is no longer
used or usable for its intended purpose or other purpose as approved by the Department. The
application, FDEP Form 62-528.900(6), F.A.C., shall include the proposed plugging plan
and justification for abandonment. Plugging shall be performed by a Florida Licensed Water
Well Contractor.

5. The owner/permittee shall obtain all necessary permits or letters of exemption from the
Florida Department of Environmental Protection (FDEP), South Florida Water Management
District (SFWMD) or other County Permitting Authorities.

6. The owner/permittee may contact the following individuals for more information:

7. This permit does not eliminate the necessity to obtain any required federal, state, local and
special district authorization prior to the start of any activity approved by this permit.

8. For any stormwater drainage well located seaside of the Coastal Construction Control Line
(CCCL), the permittee shall obtain all necessary permits from the Florida Department of
Environmental Protection, Division of Water Resources, located at 2600 Blair Stone Road,
Mail Station 3522, Tallahassee, Florida 32399-3000.

9. No construction of the stormwater drainage wells shall begin until all necessary permits or
letter of exemption have been obtained.

10. Zone of Discharge

a. A zone of discharge under Rule 62-520.465(2)(b), F.A.C, is established for this


injection project. The zone of discharge extends to the permittee’s property
boundary.

b. Compliance with the zone of discharge shall be determined at the piezometers


identified prior to operational testing authorization.

c. Should piezometer monitoring during operational testing indicate non-compliance


with the zone of discharge, the permittee shall, upon the Department’s request,
submit a report to address steps being taken to come into compliance. The report
shall be submitted to the Department no later than 90 days after the request and shall
include a discussion of the water quality sampling observed in (or sampling results
observed for) the extraction wells for parameters exceeding maximum contaminant
levels.

II. CONSTRUCTION AND TESTING REQUIREMENTS

A. General

1. Any construction, modification, repair, or abandonment of a well shall be performed by a


Florida licensed water well contractor, licensed under Chapter 62-532, F.A.C., to engage in
the business of construction, modification, repair, or abandonment of a well.

2. Well construction shall follow the requirements of Rule 62-532.500 for Water Well
Construction Standards.

3. The Department shall be notified 7 days prior to the mobilization of drilling operations to
the site.

4. No drilling operations shall begin without an approved disposal site for drilling fluids,
cuttings, or waste. It shall be the permittee’s responsibility to obtain the necessary
approval(s) for disposal prior to the start of construction. A detailed disposal plan shall be
submitted to the Department prior to the commencement of drilling activities for the
injection and monitoring wells.

5. After the construction of each well, a bar screen seal having mesh openings no larger
than 1.5-inches O.C. will be securely attached to the top of the well casing, to prevent the
introduction of foreign material.

6. A water sample shall be collected from each stormwater drainage well after the completion
of construction. The water sample shall be properly collected and the analysis performed by
a Florida Certified Laboratory. The water sample collected from each stormwater drainage
well shall be analyzed for Total Dissolved Solids (TDS) and submitted to the Department
within thirty (30) days with the well completion report.

7. In accordance with Rule 62-532.500(4)(a), F.A.C., whenever there is an interruption in work


on a stormwater drainage well, such as overnight shutdown, the well opening shall be sealed
with a tamper resistant cover. Any unused well shall be capped in a watertight manner with
a threaded, welded, or bolted cover or valve.

8. In accordance with Rule 62-532.500(3)(i)4, F.A.C., for any part of a well casing with an
outside diameter of four inches or larger intended to be installed in a borehole which is
larger in diameter than the outside diameter of the casing, the annular space shall be filled
from bottom to top with not less than a nominal two-inch thickness of neat cement grout.
Grouting of the annular space shall be completed using the tremie pipe or other equivalent
method approved by the permitting authority. The grouting method and the number of bags
or volume of cement grout shall be recorded on the Well Completion Report for each well.

B. Evaluation and Testing

1. The construction and geologic logging programs shall be implemented in accordance with
this permit and as proposed in the following submittals:

• Application received October 18, 2017;


• Other approved submittals received by the Department.

2. No injection test shall be performed prior to the Department approval. However, pump out
tests can be performed to estimate the wells capacity. The pumped-out water can be
disposed of in accordance with the requirements of the county in which the wells are
located.

3. The permittee has indicated that they desire to construct monitoring wells and to start
collecting pre-operational background, ambient and water level data from these monitoring
wells as soon as possible.

Because the permittee has expressed their desire to start the collection of pre-operational
background data as soon as possible, the permittee may submit a monitoring plan to
the Department for review prior to finalizing installation of all of the stormwater
drainage wells. The plan should include monitoring well locations and interval(s) to be
monitored, and provide construction details for any previously installed wells that are
proposed (i.e., wells installed for Miami-Dade RER). The Department may then provide a
partial approval of the monitoring plan, authorizing installation of monitoring wells and
initiation of background, ambient and water level monitoring. Final approval of the plan
will be made after the well completion information from the stormwater drainage wells is
received by the Department for review. The permittee should be aware that final review
and determination may require the construction of additional monitoring wells and/or
additional monitoring intervals.

The monitoring plan submitted for partial approval shall address the criteria stated below:

a. Ambient Monitoring Well(s) to be located within the property


i. Monitoring Well location(s)
1. Well(s) shall be located in line with the direction of groundwater flow from the
planned stormwater wells to the extraction well(s) for monitoring ambient
conditions and conditions following initiation of operation (operational testing)
of the stormwater drainage well system.
ii. Vertical Position of Monitoring Zones
1. Each monitoring well shall include a minimum of two monitoring zones.
2. Each monitoring zone shall be completed within the highly permeable interval
that the open holes of the stormwater drainage wells are anticipated to be
completed within. To the extent possible, each of the two monitoring zones
should be placed to minimize the influence of exfiltration trench stormwater
effluent on the monitoring results.
3. Adequate vertical separation shall be established between the two monitoring
zones to avoid empirically monitoring the same interval.

b. Piezometer(s)
i. Monitoring Well location(s)
1. To assess compliance with Zone of Discharge requirements, piezometer(s) shall
be installed to confirm that the extraction well system is effectively capturing
and containing the groundwater flow at the site.
ii. Vertical Position of Monitoring Zones
1. Each piezometer shall be constructed such that it is possible to monitor the
fluctuation of groundwater levels at any time during the permit period.

c. Upgradient (Background) Monitoring Well(s)


i. Monitoring Well location(s)
1. Upgradient (background) monitoring well(s) should be located at location(s) to
be proposed to the Department to directly monitor the highly permeable interval
in location(s) upgradient from the permit site.
2. Monitoring well(s) should also be located as far upgradient as possible from the
locations of planned extraction wells, exfiltration trenches and stormwater
drainage wells planned in this permit and for future buildings (beyond
Building 4).
ii. Vertical Position of Monitoring Zones
1. Each upgradient monitoring well shall include a minimum of two monitoring
zones.
2. The same considerations apply as stated in this Specific Condition, sections a.ii.2
and 3.

d. Sampling Parameters for wells described in a. and c. of this condition – See Specific
Condition V.B.3. (same).

4. Department approval is required prior to the commencement of operational testing.


(See Specific Condition V.A.3.)

C. Surface Equipment

1. The integrity of the monitoring zone sampling systems shall be maintained at all times.
Sampling lines shall be clearly and unambiguously identified by monitoring zone at the
point at which samples are drawn. All reasonable and prudent precautions shall be taken to
ensure that samples are properly identified by monitoring well name or zone and that
samples obtained are representative of those zones. Sampling lines and equipment shall be
kept free of contamination with independent discharges and no interconnections with any
other lines.

2. The surface equipment and piping for the monitoring wells shall be kept free of corrosion at
all times.

III. QUALITY ASSURANCE/QUALITY CONTROL

1. The permittee shall ensure that the construction and operational testing of this injection well
system shall be as described in the application and supporting documents. Any proposed
modifications to the permit, construction procedures, testing procedures, completion
procedures, operation procedures, or any additional work not described in the application or
supporting documents shall be submitted in writing to the Southeast District office of the
Florida Department of Environmental Protection for review and clearance prior to
implementation. Changes of negligible impact to the environment and staff time will be
reviewed by the program manager, cleared when appropriate and incorporated into this
permit. Changes or modifications other than those described above will require submission
of a completed application and appropriate processing fee as per Rule 62-4.050, F.A.C.
2. Proper operation and maintenance include effective performance and appropriate quality
assurance procedures; adequate operator staffing and training; and adequate laboratory and
process controls.
3. All water quality samples required by this permit shall be collected in accordance with the
appropriate Department Standard Operation Procedures (SOP), pursuant to Chapter 62-160,
F.A.C., Field Procedures. A certified laboratory shall conduct the analytical work, as
provided by Chapter 62-160, F.A.C., Laboratory Certification. Department approved test
methods shall be utilized, unless otherwise stated in this permit. All calibration procedures
for field testing and laboratory equipment shall follow manufacturer’s instrumentation
manuals and satisfy the requirements of the Department SOPs. A listing of the SOPs
pertaining to field and laboratory activities is available at the FDEP website
at: http://www.dep.state.fl.us/water/sas/sop/sops.htm.

4. All indicating, recording and totalizing devices associated with the stormwater drainage well
and associated monitor system shall be maintained in good operating condition and
calibrated annually at a minimum, using standard engineering methods.

5. All reports submitted to satisfy the requirements of this permit shall be signed by a person
authorized under Rule 62-528.340(1), F.A.C., or a duly authorized representative of that
person under Rule 62-528.340(2), F.A.C. All reports required by this permit which are
submitted to the Department shall contain the following certification as required by
Rule 62-528.340(4), F.A.C.:

I certify under penalty of law that this document and all attachments were prepared under
my direction or supervision in accordance with a system designed to assure that qualified
personnel properly gather and evaluate the information submitted. Based on my inquiry
of the person or persons who manage the system, or those persons directly responsible for
gathering the information, the information submitted is, to the best of my knowledge and
belief, true, accurate, and complete. I am aware that there are significant penalties for
submitting false information, including the possibility of fine and imprisonment for
knowing violations.

6. Analyses shall be conducted on unfiltered samples, unless filtered samples have been
approved by the Southeast District as being more representative of ground water conditions.

7. A professional engineer registered pursuant to Chapter 471, F.S., shall be retained


throughout the construction period to be responsible for the construction operation and to
certify the application, specifications, completion report, and other related documents. The
Department shall be notified immediately of any change of engineer.

IV. REPORTING REQUIREMENTS

1. The drilling and construction schedule shall be submitted to the Department during site
preparation but prior to drilling operation commencement for the stormwater drainage well
system.

2. Any construction, modification, repair, or abandonment of a well shall be performed by a


Florida Licensed Water Well Contractor (“Contractor”), licensed in accordance with
Chapter 62-531, Florida Administrative Code (F.A.C.), to engage in the business of
construction, modification, repair or abandonment of a well. The stormwater drainage wells
shall be constructed in accordance with the plans and specifications submitted to the
Department by the Contractor.

3. Change of Water Well Contractor after permit issuance: If the owner/permittee wishes to
utilize the services of another Florida Licensed Water Well Contractor (“Contractor”), the
owner/permittee shall submit, in writing, a letter requesting the change in Contractor. The
request for the change of Contractor will constitute the issuance of a minor modification to
the existing permit and shall be accompanied by the appropriate fee for the request. The
following procedure should be followed when requesting a change in Contractor:

a. The completed application, FDEP Form 62-528.900(3), F.A.C., shall be submitted


prior to the commencement of any construction of the stormwater drainage wells; or
b. In all other cases, where the commencement of construction of the stormwater
drainage wells has started, but the owner/permittee decides to utilize the services of
another Contractor, the completed application, FDEP Form 62-528.900(3), F.A.C.,
shall be submitted within three business days of the hiring of the new Contractor.
c. If a contractor has not been selected at the time of permit issuance: The wells shall
be constructed by a Contractor in accordance with the plans and specifications
submitted to the Department. Before start of any well construction, the permittee
shall provide the Department with Page 1 of FDEP Form 62-528.900(3), completed
and signed by the Contractor, as selected by the permittee; and shall provide the
Department with a cover letter with the following information concerning the
Contractor: (a) name; (b) title; (c) direct e-mail address; (d) Florida State License
number; (e) company name and mailing address; and (f) direct phone number.

4. In accordance with Rule 62-528.635(3), F.A.C., upon completion of the construction of the
drainage wells, the Contractor shall certify with the Department that the wells have been
completed in accordance with the approved construction plan. The Contractor shall develop
each well and shall submit the following information within thirty (30) days after
completion of the wells to the FDEP Southeast District office before the wells can be put
into service:

a. A Certification of Class V Well Construction Completion, FDEP


Form 62-528.900(4), F.A.C.;
b. A copy of the South Florida Water Management District, Well Completion Report,
Form Number 0124, Revised November 1990 or a copy of the State of Florida
Completion Report, Form LEG-R.005.02 (June 2010);
c. Additional submittals may be required for the individual County permitting
authorities or the South Florida Water Management District;
d. A water quality analysis report from a Florida Licensed Laboratory, see Specific
Condition II.A.6. above;

e. A “Certificate” in accordance with Rule 62-528.340(4), F.A.C., to read as stated


below:

“I certify under penalty of law that this document and all attachments were
prepared under my direction or supervision in accordance with a system designed
to assure that qualified personnel properly gather and evaluate the information
submitted. Based on my inquiry of the person or persons who manage the system,
or those persons directly responsible for gathering the information, the information
submitted is, to the best of my knowledge and belief, true, accurate, and complete.
I am aware that there are significant penalties for submitting false information,
including that possibility of fine and imprisonment for knowing violations.”

f. The above documents shall be sent to the Florida Department of Environmental


Protection, Southeast District, Underground Injection Control Program, 3301 Gun
Club Road, MSC 7210-1, West Palm Beach, Florida 33406-3007.

5. The conditions for the operational testing period may be modified by the Department
following receipt of the well completion reports for the stormwater drainage and
monitoring wells, and during operational testing.

V. OPERATIONAL TESTING AND MONITORING REQUIREMENTS

A. Operational Testing

1. The permittee shall conduct operational testing of the stormwater drainage wells to
demonstrate that the wells can operate in compliance with Department rules and permit
conditions including Zone of Discharge requirements (see Specific Condition I.10.) prior
to granting approval for operation.

2. Prior to operational testing, the permittee shall comply with the requirements of
rule 62-528.450(3)(a)1. and (c), F.A.C.

3. The operational testing of the Class V stormwater drainage well system under this permit
shall not commence without written authorization from the Department. No fluid shall
be discharged into the stormwater drainage wells prior to this Authorization.

4. Prior to operational testing approval, the following items must be submitted with the
request for operational testing approval for Department review and approval:

a. All information required by Specific Conditions II.A.6. and IV.4;


b. Report on monitoring well installations including lithologic logging;
c. An evaluation of the monitoring zones established taking into account the logging and
testing entailed above as well as the lithologic and specific capacity testing
information compiled during construction and testing of the stormwater drainage
wells;
d. Receipt of the signed and sealed plan drawings related to the drainage system with the
approval stamp from RER included for these plan drawings, and Inspection Report on
Class V Well completed by RER on DEP Application Form 62-528.900(3);
e. Signed and sealed record "as-built" engineering drawings of the stormwater drainage
well system and the associated monitoring well system, including all well
construction, subsurface and surface piping and equipment, and appurtenances (see
Specific Condition V.A.5.);
f. Weir as-built information and demonstration that the top of weir elevation represents
a 5 year - 1 hour storm event;
g. Information regarding monitoring at the weir, including specifications on flow
measuring device, sampling protocol and appurtenances;
h. Certification of completion of well construction from water well contractor and
certification by the Engineer of Record that permit conditions are met;
i. Surface equipment (including piping, pressure gauges and flow meters, and all
appurtenances) completion certified by the Engineer of Record;
j. Updated draft operation and maintenance manual;

k. Water quality data from all zones of all the monitoring wells associated with the
stormwater drainage well system, unless the data for a zone is waived by the
Department, analyzed for primary and secondary drinking water standards (62-550,
F.A.C.) excluding PCB’s, asbestos and dioxin (parameters listed in Exhibits A and B
of submittal received June 8, 2017; see attachments).
l. A stormwater effluent analysis for the same parameters as in Specific
Condition V.B.3. This analysis shall be submitted within 90 days after the date of
operational testing approval by the Department. These samples shall be collected at
the W-2 (Bldg4) drainage well structure, but can be obtained from a storm event that
does not discharge over the weir.
m. Other data obtained during well construction needed by the Department to evaluate
whether the injection well system will operate in compliance with Department rules;
n. A drawing indicating the exact location of all wells authorized by this permit, and
specifying those which will be used for sampling described in Specific
Condition V.B.3.

5. Prior to operational testing approval and pursuant to Rule 62-528.450(2)(j), F.A.C.,


submit engineering drawings of the surface and subsurface construction details of the
system. These drawings shall be a minimum size of 18 x 24 inches and a maximum size
of 36 x 42 inches but photographically reproduced drawings with a reduced size as small
as 11 inches by 17 inches are acceptable if the original drawings are drawn to a scale that
will permit all necessary information to be plainly seen on the reduced-size
reproductions. The drawings shall be signed and sealed by a professional engineer
registered in the State of Florida as required by Rule 62-528.440(5)(b), F.A.C.

The engineering drawings, each signed and sealed by the professional(s) who prepared or
approved them, should include, but not be limited to, the following:
• Drawings showing the location of all stormwater drainage and associated
monitoring wells and piezometers, including latitude-longitude coordinates for the
wells in degrees, minutes and seconds to two decimal places;
• Stormwater drainage well box and drainage wells construction, including but not
limited to weirs and appurtenances related to flow measurements, and stormwater
drainage system (trench/drainage wells) layout;
• Monitoring wells construction;
• Location of sampling points for the stormwater effluent to the drainage well(s);
• Monitoring well(s) purge piping, sample points and separation of sampling lines
from other lines to prevent cross connection and intended disposal method of
purge water.
• Instruments and other devices, including flow measuring devices at Drainage
Well W-2 (Bldg4).

The drawings shall be legible and shall give sufficient detail to clearly appraise the
Department of the work to be undertaken.

6. Prior to the authorization of operational testing by the Department, the permittee shall
contact the Southeast District office to arrange a site inspection. The inspection will
determine if the conditions of the permit have been met and to verify that the injection
well system is operational. During the inspection, reporting requirements shall be
reviewed.

7. The permittee/owner or designated operator of the Class V stormwater drainage wells


shall properly operate and maintain the wells, method of treatment and control in such a
manner that the wells operate efficiently at all times. The permittee/owner or designated
operator shall make an inspection on a regular basis to ensure the wells are operating
properly. All debris from the well structure/settling tank (e.g. leaves, sand, branches and
oil) should be removed and disposed of properly. The Department shall be notified of
any modification or repair to any part of the stormwater drainage well system.
B. Monitoring
1. The permittee shall submit quarterly to the Department the results of all stormwater drainage
monitoring system data required by this permit no later than the last day of the month
immediately following the month of record. The report shall include:
a. A cover page summarizing the current status of all monthly activities, including the
certification and signature required in Specific Condition IV.4.e.;
b. Operational and water quality data in a tabular format. The following identifying
information must be included on each data sheet:
i. Facility Name
ii. Well Name
iii. UIC Permit Number
iv. WACS Facility ID
c. Laboratory pages and supporting documentation.

2. The report may be sent via electronic mail in Adobe™ (.pdf) format to the following

3. The stormwater drainage monitoring system shall monitor extraction well(s); the weir at the
stormwater drainage well indicated below; and the ambient and background monitoring wells
approved in the pre-operational testing plan. The permittee shall submit for approval, the
location of the extraction well(s) to be monitored. The following drainage well performance
data and monitoring zone data shall be recorded and reported in the Quarterly Operating Report
as indicated below for the operational testing period. Samples and measurements taken for the
purpose of monitoring shall be representative of the monitored activity.

4. The piezometer monitoring data, obtained from the piezometers approved in the
pre-operational testing plan, shall be recorded and reported in the Quarterly Operating
Report for the operational testing period. Monitoring frequency for each piezometer shall
daily for the first week, weekly for the first month, and monthly thereafter. Readings
shall be taken concurrently or over a reasonably short time interval. An alternate plan for
piezometer monitoring, supported by site specific data and containing appropriate
stability criteria, may be submitted by the permittee for approval. Measurements taken for
the purpose of monitoring shall be representative of the monitored activity.

5. After data has been collected from the stormwater drainage monitoring system, and
piezometers for at least twelve months, the permittee may submit a request for a
reduction in sampling frequency. The request shall include monitoring data for
Department review and approval, which justifies the request to reduce the sampling
frequency. The request for reduction in sampling frequency shall be accompanied by
technical justification and interpretation of the data.

6. Monitor well purging and field stabilization parameter measurement is required prior to
the collection of laboratory samples for the Quarterly Operating Reports. Purging is not
required for the extraction well sampling. The facility shall conduct the monitor well
sampling following the monitor well sampling protocols taken from FS 2200-
Groundwater Sampling in the DEP-SOP-001/01 Standard Operating Procedures for Field
Activities. The following protocol for UIC monitor wells is based on this standard and
the facility shall follow this purging protocol. The results of the purging techniques and
field stabilization parameters shall be provided on DEP Form FD 9000-24 (see
attachment) or a similar alternative approved by the Department, and the completed
forms shall be submitted to the Department with the Quarterly Operating Reports.
a. Calculate the volume of water in the well casing (or sample pipe if installed), and the
monitoring interval. For dual zone monitor wells, calculate the upper monitor zone
volume with allowance for reduced volume due to the hollow cylinder created by the
lower zone tubing. Purge until the water level has stabilized (when the well recovery
rate equals the purge rate), purging a minimum of one well volume, and then collect
the first set of stabilization parameters.

b. Thereafter, collect stabilization parameters after every ¼ well volume beyond the
initial one volume.

c. Purging shall be complete when three consecutive readings of the parameters listed
below are within the following ranges [1] and a minimum of 1.5 well casing volumes
of fluid since the beginning of purging have been evacuated from the monitoring
well:

 pH ± 0.2 Standard Units


 Specific Conductance ± 5.0% of reading
 Temperature ± 0.2% C
 Dissolved Oxygen ≤ 20% Saturation
 Turbidity ≤20 NTU

d. If necessary, continue to take the above readings every additional ¼ well volume until
three consecutive readings meet the above criteria.

e. Typical field conditions may not allow the temperature parameter to be met. If all the
other purging criteria have stabilized, the sampling team leader may decide whether
to collect a sample if the temperature criteria has not been met (DEP SOP FS2212
Section 3.6). Documentation as to why the sample was collected without meeting a
field parameter must be recorded in the groundwater sampling log.

f. If three consecutive ¼ well volume readings have not reached the stabilization criteria
listed above by the time the fifth well volume has been reached, the monitoring well
sample shall be taken, and document the reason(s) in the groundwater sampling log.
g. If a sampling pipe is used for purging, the sampling pipe volume will substitute for
the well casing volume.
The Department will consider an alternate purging method meeting monitor well
sampling protocol in DEP-SOP-001/01 FS 2200 Groundwater Sampling where the above
procedure causes a hardship to the facility. The permittee shall request an alternate
method and receive written Department approval before implementing it.

7. The flow from the monitoring zones during well evacuation and sampling must not be
discharged to surface waters or aquifers containing an underground source of drinking
water (USDW).
8. If the concentration for any parameter in the natural background quality is greater than
the associated standard which is listed in Rule 62-520.420(1), F.A.C., or in the case of pH
is also less than the minimum, the representative natural background water quality shall
be the prevailing standard, to be considered against the results from the extraction wells.
When, and if, the extraction well sample water quality data are indistinguishable when
compared to the background sample data, an assessment of continued operation of the
extraction well pumps can be performed.

Provided dissolved oxygen in the groundwater of the zone being monitored is ≤ 20% of saturation for the

measured temperature and turbidity is ≤ 20 NTUs.

VII. ABNORMAL EVENTS


1. In the event the permittee is temporarily unable to comply with any of the conditions of a
permit due to breakdown of equipment, power outages or destruction by hazard of fire,
wind, or by other cause, the permittee of the facility shall notify the Southeast District
office.
2. Notification shall be made in person, by telephone, or by electronic mail (e-mail)
within 24 hours of breakdown or malfunction to the Southeast District office.

3. A written report of any noncompliance referenced in Specific Condition VII. 1. above


shall be submitted to the Southeast District office and the Tallahassee office within five
days after its occurrence. The report shall describe the nature and cause of the
breakdown or malfunction, the steps being taken or planned to be taken to correct the
problem and prevent its reoccurrence, emergency procedures in use pending correction of
the problem, and the time when the facility will again be operating in accordance with
permit conditions.
