APPLICATION FOR SERVICE OF SUMMONING TO RESPONDENT/

COMPANY VIA SPEED POST/ REGISTERED POST AT THEIR
HEAD OFFICE (HYDERABAD)

MOST RESPECTFULLY SHOWETH:

1. That the above noted matter was pending before this Hon’ble Court and
is fixed for today.

2. That the service of summons in this matter have been issued to

Respondent/ Company at their registered office located at Plot No. 31,
Dharuhera, Rewari, Haryana and were returned unserved with the
remark that the above-said Respondent/ company is not working and is
shut off and according to report of Process Server, the above-said
Respondent/ Company is also shut off.

3. That the facts and circumstances for filing the present application are
that the due to cunning and unreasonable behaviour of the
Respondent/Company, they deliberately shut down their company
permanently from Dharuhera Branch but their Head Office which is
situated in Office No. 1-2 , L-7 Floor SLN Terminus, Survey No. 133
Near Botanical Gardens, Gachi Bowli, Hyderabad TG-500032 is
still working and Respondent/ Company running their business
successfully.
4. That the applicant/workmen is not in the knowledge of that why the
Respondent/company shut down their Dharuhera branch Plot No. 31,
Dharuhera, Rewari, Haryana. Hence, the Respondent/company be
served through registered post/ speed post to their Head Office which is
situated in Hyderabad.

5. That the Applicant/ workman submits that he was a good prima facie
case on merits and there is every possibility to succeed therein. He has
already spent a huge amount and this Hon’ble Court keeping in view of
the facts and circumstances of the case, it is well settled law that for the
fault of Respondent/ Company, the litigant should not suffer.

PRAYER

It is therefore, most respectfully prayed that the service of the

Respondent/company may kindly be effected though Registered post/
speed post to Respondent/ Company’s Head Office located at Office
No. 1 -2, L-7 Floor SLN Terminus, Survey No. 133 Near Botanical
Gardens, Gachi Bowli, Hyderabad TG-500032, in the interest of
justice, equity and fair play, and he be permitted to contest the case on
merits.
Any other order(s) which this Hon’ble Court deems fit and proper may
also be passed in favour of the applicant/workman.
