12. F.I.R. Contents (Attach separate sheets, if required): On the morning of 08.09.2023,
Hugh Jackman was placed at his residence at Greens Avenue along with his wife (Melissa
Jackman), son (Dylan Jackman) and daughter (Viola Jackman). At around 1030 Hrs, Viola
Jackman told Hugh Jackman that she was going out to the nearby park to play. At around
1045 Hours Dylan
Jackman left the residence in order to look for his sister however he could not find her. He saw
a suspicious looking Recreational Vehicle (RV) parked on the east side of the playground.
Dylan heard some strange noises coming from the RV. Dylan then quickly informed his parents
Hugh and Melissa that he was unable to find Viola in the playground and also about the RV.
Hugh and Melissa then proceeded to look for Viola in the neighbourhood and asked passersbys
near the playground whether they saw their daughter. Unable to locate Viola, Hugh reached
Knowledge Park PS to report the incident. Viola is aged about 13 years. Ash blonde hair.
Height is about 4
feet 10 inches. Brown eyes. Birthmark on right elbow. Last seen wearing light blue t-shirt,
purple jacket, blue jeans and black color shoes. Last seen leaving her residence at A-47 Greens
Avenue Sector-150 NOIDA.

Hrs Today at the noted time, information was received regarding a missing child
08.09.23 named Viola Jackman. The missing person was reported by Hugh Jackman f/o the
victim. The following details, as mentioned under, are provided by the informant:

1. At around 1030 Hrs, Viola Jackman told Hugh Jackman that she was
going out to the nearby park to play. At around 1045 Hours Dylan
Jackman left the residence in order to look for his sister however he could
not find her. He saw a suspicious looking Recreational Vehicle (RV)
parked on the east side of the playground. Dylan heard some strange
noises coming from the
RV. Dylan then quickly went back to his residence and informed his
parents Hugh and Melissa that he was unable to find Viola in the
playground and
also about the RV. Hugh and Melissa then proceeded to look for Viola in
the neighbourhood and asked passersbys near the playground whether they
saw their daughter. Unable to locate Viola, Hugh reached Knowledge Park
PS to report the incident.
2. Viola is aged about 13 years. Ash blonde hair. Height is about 4 feet 10
inches. Brown eyes. Birthmark on right elbow. Last seen wearing light
blue t-shirt, purple jacket, blue jeans and black colour shoes. Last seen
leaving her residence at A-47 Greens Avenue Sector-150 NOIDA.
3. As on the basis of this information received, the case was registered at

Knowledge Park PS and a copy of FIR No. 23/2023 was attached to the CD.
4. During the course of the investigation, the investigating officer visited the
spot of incidence at the playground in Sector-150 and inquired with the
people at the playground. The IO was able to gather information regarding
the RV parked nearby from one such person named Randy Lahey s/o Jim
Lahey. His statement was recorded u/s 161 of CrPC.
5. Randy Lahey in his statement disclosed that he was walking his dog at the
playground around 1030 Hrs when he saw the suspicious RV parked near
the east end of the playground. He was able to provide the licence plate
number of the RV i.e. UP16FA4280.
6. Based on the above statement, the RV bearing licence number
UP16FA4280 was identified to belong to one Ms. Jennifer May r/o Flat
4133 Twin Towers Sector-148 NOIDA.

Hence, CD for the day is closed and investigation remains in progress.

Hrs Today at around 1100 Hrs, a team of 2 police officers of PS Knowledge Park
09.09.23 went to the residence of Ms. Jennifer May. Upon questioning the following
information was received:

1. Ms. Jennifer May was interrogated about her whereabouts on the morning
of 08.09.2023. Her statement was recorded u/s 161 of CrPC. Ms. May
revealed that she works as a teacher and was present at ABC Public School
NOIDA that day. She left her residence at 0800 Hrs and came back home
at around 1500 Hrs, as usual. The school was asked to produce the
attendance report to verify her statement and the same was verified.
2. Also present at Ms. Jennifer’s residence was her son, Mr. Kanye West. Mr.
Kanye West was unable to comprehend and answer any questions put up
by the officers upon which Ms. Jennifer revealed that her son is mentally
challenged. However, it was confirmed that he was placed within the area of
incidence on the morning of 08.09.2023.

The officers also found that the RV bearing licence number UP16FA4280 was
parked in the basement of her residence. A search was conducted of the said RV
by virtue of Section 165 of CrPC and within the vehicle, a blood-stained sock was
found. The police officers seized the sock so found and arrested Mr. Kanye West.

Mr. Kanye West was then transported and detained at PS Knowledge park at
around 1430 Hrs. The blood-stained sock was sent off to the laboratory for
forensic analysis.

Medical Examination of the accused Mr. Kanye West was conducted by Dr. Travis
Scott at around 1530 Hrs. The examination revealed that Mr. Kanye West is indeed
suffering from severe mental illness. Based on this diagnosis, Dr. Travis Scott is of
the opinion that it is highly unlikely that Mr. Kanye West has the mental capacity
to plan and abduct any person.

03/Insp. This morning the forensic report was received at PS Knowledge Park. According to
Time the forensic report, the sock recovered from the RV was covered with blood from
1730 two different individuals. DNA analysis of the blood samples matched Mr. Kanye
Hrs West and Ms. Viola Jackman.

Attendance of Mr. Hugh Jackman was requested at the PS u/s 160 of CrPC.
Mr. Hugh Jackman identified the sock to be the possession of his daughter
Viola.

As investigation was still under progress at this stage, Mr. Kanye West was
forwarded to the nearest Judicial Magistrate (JMFC at Dadri) along with copies of
the above diary entries, forensic reports, medical reports and other evidentiary
documents. Based on the DNA matches and other circumstantial evidence, it was
concluded by the Ld. Magistrate that the grounds for accusation are well founded
and authorised further detention for 14 days.

Attendance of Ms. Jennifer May was requested at the PS u/s 160 of CrPC. Ms. May
was further questioned about who else might have access to the RV. Ms. May
suspected that her estranged ex-husband Mr. Howard West was the one
who originally purchased the RV and might have spare keys for the vehicle.

Based on the above information, search for Mr. Howard West has

begun. CD for the day is closed and investigation remains in progress.

04/Insp. A police informant reported this morning that Mr. Howard West is residing in a
Time farmhouse at Link Road, Pari Chowk. A team of 3 police officers went to question
1700 Mr. Howard West at his residence at around 1000 Hrs this morning. Upon arrival
Hrs of the police officers, Mr. Howard West fled from the back entrance of his
11.09.23 farmhouse and a chase took place on foot. However, police officers caught up with
Mr.
Howard West and apprehended him. A thorough search of his residence was
done. Spare keys for the RV were found in his bedroom. Moreover, a secret
passageway to the basement of the farm house was discovered. The passageway
was locked.
The police officers broke open the lock and investigated the basement. In the
basement, the police officers found 4 children who appeared to be drugged, sedated
and unconscious. One of these children was identified by the police officers to be
Viola Jackman. Immediately following this discovery, an ambulance was called
and the children were transferred to nearby Felix Hospital where they received
intensive care. Mr. Howard West was arrested and transported to PS Knowledge
Park.
Mr. Howard West refused to give any statement to the police.

At around 1600 Hrs, Viola Jackman gained consciousness. She made a statement
to the police u/s 161 at the hospital. According to the victim, she was at the
playground on the morning of 08.09.23. She was asked by a man aged about fifty,
around 5’8 in height with a crooked back and short grey hair to help her with some
work. She followed the man into the RV where she was forcefully tied up and was
injected with some unknown fluid by the man. She tried to fight him back and
scratched his eyes. She cannot recall much after this incident. She only has a
blurry, fading memory of being trapped in a dark unlit place. She tried to pry open
a doorway but could not open it.

Mr. Hugh Jackman was then duly given the custody of Ms. Viola.

The other three children who were rescued from Mr. Howard West’s basement
are also forwarded to the concerned Juvenile Care authorities. Efforts for
identifying these children are underway.

It is ascertained that accused Mr. Kanye West is not involved in commission of

any offence. Evidence pointing towards any guilt on part of Mr. Kanye West is
insufficient. Therefore the accused is released from custody by virtue of Section
169.

7. REPORT OF MEDICAL EXAMINATION OF ACCUSED – Medical Examination of

accused Mr. Kanye West was conducted by Dr. Travis Scott on 10.09.23. The essential findings
of Dr.
Travis Scott, in his expert opinion, are listed as follows:

1) The accused suffers from Asperger’s Syndrome.

2) The accused displays a high degree of anti-social
behaviour. 3) The accused shows signs of autism disorder.
4) The accused scored poorly on an IQ test. The IQ of the accused ranges from 25-35. This
range of IQ can be categorised as a very low score.
5) The accused is suffering from a range of mental issues and illnesses.
6) It is highly unlikely that the accused would be able to develop intricate plans and execute
them on his own.
7) It would be very unlikely that the accused could develop any criminal intent.

9. REPORT OF MEDICAL EXAMINATION OF VICTIM’S INJURIES (IF APPLICABLE) -

Medical Examination of Ms. Viola Jackman was conducted at Felix Hospital on 11.09.23 by Dr.
Frank Ocean. The essential findings of this examination, in Dr. Ocean’s expert opinion, are
listed as follows:

1) Wrists of the patient indicate ligature marks, which indicate that the patient was tied
up using a wire-type material.
2) The patient has a fractured right ankle. This fracture is indicative of a physical struggle or
fight.
3) The blood test of the patient revealed a combination of non-lethal doses of LSD and
Ketamine. These drugs are responsible for hallucinations, memory loss, and
unconsciousness of the patient.

10. FORENSIC REPORT/BALLISTIC REPORT (IF ANY) – A blood-stained sock was

recovered from an RV in the possession of Ms. Jennifer May. The impugned sock was sent to
the forensic laboratory for analysis. The essential findings of the laboratory are as follows:

1) The sock is 25 cm in length. This would mean that the wearer of this sock would
typically wear a UK 4 size shoe.
2) The sock is covered in the blood of two different individuals.
3) One of these blood samples matched with the DNA sample of Ms. Viola
Jackman. 4) The second blood sample matched with the DNA sample of Mr. Kanye
West.

15. Brief facts of the case (Add separate sheet, if necessary) : Information was received at
Knowledge Park PS about a missing child named Viola Jackson aged about 13 years
at 1130 Hrs on 08.09.2023. She disappeared from a playground near her residence in
Sector-150 NOIDA. Upon investigation, a Randy Lahey s/o Jim Lahey informed the
police about a suspicious looking Recreational Vehicle (RV) parked on the east side of the
playground bearing licence number UP16FA4280. The police was able to locate the owner
of this RV as Ms. Jennifer May d/o Norman May. Ms. May had a strong alibi however
her mentally challenged son, Kanye West was confirmed to be in the area of the
incidence.
Upon search of the RV, a white coloured sock covered in blood stains was recovered. The
forensic analysis report revealed that the blood stains matched with the DNA samples of
Viola Jackman and Kanye West. Nonetheless, medical examination of Kanye West
revealed he does not possess the mental capacity or ability to develop criminal intent.
Further interrogation of Ms. May revealed that Mr. Howard West s/o George West is her
estranged ex-husband who originally purchased the RV around 15 years ago and might
have spare keys for the same. Police officers then reached the residence of Mr. Howard
West to question him. Howard West started running upon seeing the officers however the
officers apprehended him. A search of his residence was conducted and a secret
passageway to a basement was found. Behind the locked door of this basement, the
unconscious bodies of 4 children, including Viola Jackman, were found. Howard West was
immediately arrested and transferred to a holding cell at Knowledge Park PS. He did not
make any statement to the police. A DNA sample of Howard West also matched with the
blood stains found on the sock seized from RV.

Therefore the Ld. Public Prosecutor be pleased to frame the

following charges before this Hon’ble Court.
