COMPROMISE AGREEMENT
[With Waiver, Release and Quitclaim]
KNOW ALL MEN BY THESE PRESENTS:

This COMPROMISE AGREEMENT [With Waiver, Release and Quitclaim], executed this 22 nd day
of October 2023 in Abuyog, Leyte, Philippines by and among:

____________________ of legal age, Filipino, married, with residence address at

______________________, father and guardian of the minor victim ____________________
hereinafter referred to as the FIRST PARTY; and

_________________________ of legal age, Filipino, single, with residence address at

____________________________, hereinafter referred to as the SECOND PARTY;

The parties hereto mutually agreed to the following terms and conditions for the settlement of
all damages and expenses caused by a vehicular accident between all the PARTIES, to wit:

WITNESSETH: THAT

WHEREAS, that at about 5:20 PM on October 21, 2023, a vehicular accident transpired in Brgy.
__________________, Leyte involving XRM 125 color _____ with MV File number
______________, engine number __________________ which was driven by the SECOND
PARTY PARTY who is 30 years of age, single, unemployed and has no driver’s license.

WHEREAS, the vehicle of the SECOND PARTY was traversing the National Road in Brgy.
________________ when he eventually reach the place of the incident that he hit/bumped the
victim, son of the FIRST PARTY by his vehicle who was crossing the said road;

WHEREAS SECOND PARTY sustained light injuries particularly on his knee;

WHEREAS the son of the FIRST PARTY, the victim himself who is thirteen years of age, sustained
physical injuries because of the said accident, the victim was initially brought to
____________________ and is now being transferred and treated at the
_______________________;

WHEREAS the SECOND PARTY has already extended financial help in favor of the FIRST PARTY
during the victims hospitalization in _____________________ in the sum of ONE THOUSAND
EIGHT HUNDRED PESOS ( P1,800.00) Philippine Currency;

WHEREAS, both parties are desirous of settling amicably the incident and thereby avoiding a
long and costly litigation;

NOW, THEREFORE, in consideration of the foregoing premises, the parties hereby undertake as
follows:

1. The SECOND PARTY shall voluntarily undertake to give financial aid in favor of the FIRST
PARTY to answer for the FIRST PARTY son’s medical needs and whatever damages he may have
sustained due to the said accident net of the deduction from hospital bills the FIRST PARTY may
avail from PhilHealth and Malasakit Center:
This Compromise Agreement entered into by the PARTIES will serve as a proof of their mutual
understanding and, in view of the understanding the same, the matter has been clearly
threshed out and there is no more need to press/file any complaint.

This agreement shall not in any way be construed as an admission on the part of any party of
any fault, negligence or liability, of whatever kind and nature, in connection with the
aforementioned accident.

That the PARTIES shall abide with the provisions of this compromise agreement in utmost good
faith.

That in violation of the terms and conditions of this Compromise Agreement, either Party may
seek to redress to the proper court of law, however, at this moment, BOTH PARTIES, by this
agreement, shall waive any right against each other.

This agreement shall take immediately upon signing unless sooner revoked or rescinded by the
another instrument.

ACKNOWLEDGEMENT

BEFORE ME, a Notary Public for and in _______________, personally appeared

__________ and _______________ with their valid identification cards, known to me and to me
known to be the same persons who executed the foregoing instrument and acknowledged to
me that the same are their free act and voluntary deed.

This instrument, consisting of two (2) pages, including the page on which this
acknowledgment is written, has been signed on the left margin of each and every page thereof
by the concerned parties and their witnesses, and sealed with my notarial seal.
