CIVIL MOOT PROPOSITION

STATEMENT OF FACTS:
● Kumar, a Hindu from Jalandhar, is a software engineer by profession and works
in a Multinational Company.
● Divya, a Hindu is born and brought up in Delhi. She was pursuing her MBBS
when her father suddenly fell ill and expressed his last wish was to see her get
married. Even though Divya was not mentally prepared for marriage, she gave in
to her father's wishes and consented to getting married with Kumar . Their
marriage was solemnized in 2010 at Delhi, as per Hindu rites and rituals under
Hindu Marriage Act 1955.
● Meanwhile Kumar gets a job offer from the USA. Divya by this time had
completed her education and landed a resident position at a local hospital.
● Both of them moved to the USA in 2011. Kumar joined his new job. Divya on the
other hand was not qualified to practice in the USA unless she clears her US
medical Board Exam. The fee for her course was beyond their ability to finance.
Divya on Kumar's insistence asks her widowed mother in India to arrange for the
sizable amount needed for her course. Divya over the next few months qualifies
all pertinent examinations, allowing her to work and practice in the USA. She
lands a job with a hospital in the city.
● With her life getting a little settled she had developed a keen realization that it is
the appropriate time for her to have a child which she starts discussing frequently
with Kumar. Kumar believes it is too soon for them to have a child as they are
financially not settled in a new country. This leads to frequent quarrels among
them.
● Over the next couple of years both of them reach substantially sound positions at
their jobs and also manage to obtain citizenship of the USA in 2019. Having
settled in properly they begin their attempts at starting a family which somehow
doesn't work out for them. They seek medical help, which yields no results for
them. Upon prolonged consultation with the family they planned to travel to India
and get their child born through surrogacy and eventually bring him/her with them
to the USA.
● In 2020 after arriving in India they find a surrogate candidate that both of them
approve of. In May, an artificial fertilization was carried out on the surrogate
mother (Ms.Kavya).
● At the time the fertilization procedure was being executed it was decided verbally,
between Kumar, Divya and Kavya that Kavya would have no right over the child.
● In 2021, a baby girl was born to the surrogate mother in Delhi. Kumar and Divya
returned to India and were present at the hospital at the time of the birth of the
baby. Having been born a few weeks premature the doctors advised the parents
that the baby should not be made to travel for the first few months. Divya leaves
for the USA as she is required to join back at work. Whereas Kumar stayed back
in Delhi with Kavya, as he is allowed to work from home.
● As Kumar's relationship with Kavya develops, his emotional dependence on
Divya starts to fade. Divya decides to visit India to meet their daughter and clarify
things with Kumar about the change in his behavior. This leads to heated
arguments and fights between them.
● Kumar reached the conclusion that the relationship he had with Divya was now
over and filed a petition for divorce on the ground of irretrievable breakdown of
marriage. Divya also filed a separate suit for Restitution of Conjugal rights and
Custody of Child in the Family Court of Delhi.

ISSUES:
1. Whether Mr. Kumar is entitled to file the divorce?
2. Whether Restitution of Conjugal rights and custody of the child should be passed
in favor of Mrs. Divya ?
