A PROCLAMATION TO PROVIDE FOR COFFEE
MARKETING AND QUALITY CONTROL
በዓለም አ ቀፍ ገ በያ ተ ወዳ ዳ ሪ የ ሆነ በ ጥ ሬ ውና እ ሴት
WHEREAS it has become necessary to establish a sustainable
የ ተ ጨመረ በ ት የ ቡና ምር ት በ ጥራ ት ና በ ከ ፍተኛ መጠን ፣ ቀ ጣይ ነ ት
and traceable coffee marketing and quality control system which
ባ ለ ውና የ ምር ት ዱካ ውን በ ጠበ ቀ ሁኔ ታ ለ ማቅ ረ ብ የ ሚያ ስ ች ል የ ቡና
enables supply of quality, voluminous and competitive unfrosted and
ግ ብይ ት ና ጥ ራ ት ቁ ጥ ጥ ር ሥር ዓ ት መዘ ር ጋ ት በ ማስ ፈ ለ ጉ ፣
value added coffee to the global market;
የ ቡና ግ ብይ ት ን ዘ መና ዊ ነ ት ፣ ህ ጋ ዊ ነ ትና ፍ ት ሃ ዊ ነ ት በ ማሻ ሻ ል
የ ቡና አ ምራ ቾ ች ፣ የ ግ ብይ ት ተዋን ያ ን ና የ ሀ ገ ሪ ቱን ተ ጠቃሚነ ት
WHEREAS, it has been found necessary to establish modern,
በ ላ ቀ ደ ረ ጃ ማሳ ደ ግ የ ሚያ ስ ች ል የ ተ ለ ያ የ አ ማራ ጭ ያ ለ ው የ ግ ብይ ት
legal and fair alternative coffee transaction system, in order to boost
ሥር ዓ ት መዘ ር ጋ ት አ ስ ፈ ላ ጊ ሆኖ በ መገ ኘ ቱ ፣
the benefits of coffee producers, transaction actors and the country;
በ ኢት ዮ ጵ ያ ፌዴራ ላ ዊ ዴሞክ ራ ሲያ ዊ ሪ ፐ ብሊክ ህገ መን ግ ሥት
አ ን ቀ ፅ ፶ ፭ (፩ ) መሠረ ት የ ሚከ ተ ለ ው ታውጇል ፡ ፡
NOW, THEREFORE, in accordance with Article 55 (1) of the

Constitution of the Federal Democratic Republic of Ethiopia it is
hereby proclaimed as follows:

2. ት ር ጓ ሜ GENERAL PROVISIONS
›
1. Short Title
የ ቃሉ አገ ባብ ሌላ ት ር ጉ ም የ ሚያ ሰ ጠው ካ ል ሆነ በ ስ ተቀ ር
This Proclamation may be cited as the “Coffee Marketing and
በ ዚ ህ አ ዋ ጅ ውስ ጥ ፡ -
Quality Control Proclamation No.1051/2017”.
1/ “ቡና ” ማለ ት በ ማን ኛ ውም ዓ ይ ነ ት ና የ ዝ ግ ጅት ደረ ጃ
የ ሚገ ኝ የ ቡና ተ ክ ል ፍ ሬ ወይ ም የ ፍ ሬ ው ክ ፍ ል ነ ው፤ 2. Definition
2/ “ቀ ይ እ ሸ ት ቡና ” ማለ ት በ ተ ፈ ጥ ሮ የ ብስ ለ ት ደ ረ ጃ ላ ይ
ደ ር ሶ የ ተ ለ ቀ መ እ ና ያ ል ተ ፈ ለ ፈ ለ የ ቡና ፍ ሬ ነ ው፤ Unless the context requires otherwise, in this Proclamation:
3/ “ጀ ን ፈ ል ቡና ” ማለ ት ቀ ይ እ ሸ ት ቡና በ ወቅ ቱ ተ ለ ቅ ሞó
በ ማድረ ቂ ያ አ ል ጋ ወይ ም ከ ሲሚን ቶ በ ተ ሰ ራ አ ውድማ ላ ይ
1/ “coffee” means the fruit of a coffee tree or parts of such fruits
ወይ ም በ ተ ፈ ቀ ደ ሌላ ማድረ ቂ ያ ላ ይ የ ደ ረ ቀ ና ያ ል ተ ቀ ሸ ረ
in whatever form and processing;
የ ቡና ፍ ሬ ነ ው፤
4/ “የ ታጠበ ቡና ከ ነ ገ ለ ፈ ቱ " ማለ ት በ ባ ለ ሥል ጣኑ ወይ ም
አ ግ ባ ብ ባ ለ ው የ ክ ል ል አ ካ ል በ ተ ፈ ቀ ደ የ ቴ ክ ኒ ክ አ ሰ ራር 2/ “red cherry coffee” means the red fruit of a coffee tree picked
ቀ ይ እ ሸ ት ቡና በ መፈ ል ፈ ል ፣ በ ማቡካ ት ወይ ም ሳ ይ ቦ ካ after it is naturally ripened but not pulped;
በ መዘ ፍ ዘ ፍ ፣ በ ማጠብና በ ማድረ ቅ ተ ዘ ጋ ጅቶ ከ ነ -ሸ ሚዙ
ያ ለ ቡና ነ ው፤ 3/ “coffee with pulp” means a red cherry coffee picked timely
and dried in bed or a place made by cement or in other
5/ “የ ታጠበ ቡና ” ማለ ት በ ባ ለ ሥል ጣኑ ወይ ም አ ግ ባ ብ ባ ለ ው
የ ክ ልል አካል በ ተፈ ቀ ደ የ ቴክ ኒ ክ አ ሰ ራር ተ ዘ ጋ ጅቶ
technically allowed means but not hulled;
ገ ለ ፈ ቱ ና ስ ስ ል ባ ሱ የ ወጣለ ት ቡና ነ ው፤
6/ “በ ከ ፊ ል የ ታጠበ ቡና ” ማለ ት በ ባ ለ ሥል ጣኑ ወይ ም
አ ግ ባ ብ ባ ለ ው የ ክ ል ል አ ካ ል በ ተ ፈ ቀ ደ የ ቴ ክ ኒ ክ አ ሠራ ር 4/ “washed coffee with parchment” means red cherry coffee
ቀ ይ እ ሸ ት ቡና በ መፈ ል ፈ ል ከ ነ ል ጋ ጉ በ ማድረ ቅ የ ተ ዘ ጋ ጀ which has been pulped, fermented or not washed and dried
ቡና ነ ው፤ with its husk through allowed technical procedures set by the
Authority or relevant regional states;
7/ “ተ ፈ ጥሯዊ ወይ ም ያ ል ታጠበ ቡና ” ማለ ት በ ባ ለ ስ ል ጣኑ
ወይ ም አ ግ ባ ብ ባ ለ ው የ ክ ል ል አ ካ ል በ ተ ፈ ቀ ደ የ ቴ ክ ኒ ክ
አ ሠራ ር ጀን ፈል ቡና ን በ መቀ ሸ ር ና በ ማበ ጠር የ ተዘ ጋ ጀ
ቡና ነ ው፤
5/ “washed coffee” means red cherry coffee which has been
removed its sticky mucilage and parchment through allowed
8 / “ል ዩ ቡና ” ማለ ት በ አ መራ ረ ቱ ፣ በ አ ዘ ገ ጃጀቱ እና
technical procedures set by the Authority or relevant regional

6/ “semi-washed coffee” means dried and pulped red cherry

coffee with its sticky mucilage through allowed technical
9/ “አ ቅ ር ቦ ት ቡና ” ማለ ት በ አ ምራ ች አካባቢ ባሉ
procedures set by the Authority or relevant regional states;
ኢን ዱስ ት ሪ ዎ ች ተ ዘ ጋ ጅቶ ለ ኢት ዮ ጵ ያ ምር ት ገ በ ያ ወይ ም
ለ ኤ ክ ስ ፖር ት ማዘ ጋ ጃ ኢን ዱስ ት ሪ ዎ ች በ ቀ ጥታ የ ሚቀ ር ብ
ቡና ነ ው፤
7/ “natural or sun dried coffe ” means coffee with pulp hulled,
፲ / “የ ወጪ ገ በ ያ ቡና ” ማለ ት የ አ ገ ሪ ቱ ን የ ወጪ ገ በ ያ ቡና

cleaned and sorted through allowed technical procedures set

የ ጥራት ደረ ጃ መስ ፈ ር ት ና የ ገ ዢውን ፍላ ጎ ት በ ጠበ ቀ
by the Authority or relevant regional states;
መል ኩ በ ጥ ሬ ው፣ ተቆ ልቶ፣ ተ ፈ ጭቶ ወይ ም በ ሌላ መል ኩ
እ ሴት ተ ጨምሮ በ ት የ ተ ዘ ጋ ጀ ቡና ነ ው፤
፲ ፩ / “ተ ረ ፈ ምር ት ቡና ” ማለ ት ቡና ን በ ማዘ ጋ ጀ ት ሂ ደት
8/ “special coffee” means coffee certified in its special
የ ሚወጡ ያ ል ፈ ረ ጠሙ ወይ ም ል ቃሚ ወይ ም ሰ ባ ራ እ ና ገ ለ ባ
production, process and quality by standards of relevant organ
ያ ሉበ ት ን ቡና ያ ጠቃል ላ ል ፤
and sell in a better price than the other coffees;
፲ ፪ / “የ ሀ ገ ር ውስ ጥ ፍ ጆ ታ ቡና ” ማለ ት ቡና ሲዘ ጋ ጅ የ ሚወጣ
ተ ረ ፈ ምር ት ቡና ወይ ም የ ጥ ሬ ና ጣዕ ም ምር መራ ውጤቱ ከ
9/ “supply coffee” means coffee processed by industries located
፲፭ በ መቶ ያ ል በ ለ ጠ ን ጹህ ቡና ሆኖ ለ ወጪ ገ በ ያ
የ ማይ ላ ክ ቡና ነ ው፤
in the production area for delivery directly to the Ethiopia
Commodity Exchange or export processing industries;
፲ ፫ / “መር ቡሽ ቡና ” ማለ ት በ ሙቀ ጫ ወይ ም በ ድን ጋ ይ ወፍ ጮ
ወይ ም በ ሌላ ኋላ ቀር በ ሆነ መን ገ ድ የ ተዘ ጋ ጀና
የ ኤ ክ ስ ፖር ት ደ ረ ጃ የ ማያ ሟላ ቡና ነ ው፤ 10/ “export coffee” means raw, roasted, roasted and grinded or
፲ ፬ / “ቡና አ ቅ ራ ቢ” ማለ ት አ ግባ ብ ካ ለ ው የ ክ ልል አካል processed in other value added form in compliance with the
የ ብቃት ማረ ጋ ገ ጫና የ ቡና ን ግ ድ ፈ ቃድ የ ተ ሰ ጠው ቀ ይ country’s export quality standard and buyer needs for export;
እ ሸ ት ወይ ም ጀ ን ፈ ል ቡና በ ተፈ ቀ ደ የ መገ በ ያ ያ ስ ፍራ
ወይ ም ህ ጋ ዊ የ ል ማት ና ግ ብይ ት ት ስ ስ ር ከ ፈ ጠሩ አ ር ሶ
አ ደ ሮ ች በ መግ ዛ ት ወይ ም ከ ራ ሱ ማሳ ወይ ም ህ ብረ ት ሥራ 11/ “coffee by product” means coffee mixed with light, broken,
ማህ በ ር ከ ሆነ ከአባላት በ መሰ ብሰ ብና በ ማዘ ጋ ጀ ት under developed coffee and coffee husk;
ለ ኢት ዮ ጵ ያ ምር ት ገ በ ያ ወይ ም በ ህ ግ አ ግ ባ ብ በ ቀ ጥታ
የ ግ ብይ ት ት ስ ስ ር ለ ላ ኪ ወይ ም ለ ውጭ ገ በ ያ የ ሚያ ቀ ር ብ
12/ “domestic consumption coffee” means coffee not exportable,
ሰ ው ነ ው፤
consisting a total of 15% pure coffee and coffee by product.
፲ ፭ / “ቡና አ ል ሚ እ ና ላ ኪ” ማለ ት አ ግ ባ ብ ካ ለ ው መን ግ ሥታዊ
አ ካ ል የ ብቃት ማረ ጋ ገ ጫና የ ቡና ላ ኪነ ት ን ግ ድ ፍ ቃድ
የ ተ ሰ ጠው ሆኖ በ ማሳ ው ያ መረ ተ ውን ወይ ም በ ህ ግ አ ግ ባ ብ
የ ል ማት ና ግ ብይ ት ት ስ ስ ር ከ ፈ ጠሩ አ ር ሶ አ ደ ሮ ች ወይ ም
13/ “traditionally processed coffee” means coffee processed using
ከ ህ ብረ ት ሥራ ማህ በ ር አ ባ ላ ት የ ተ ሰ በ ሰ በ ን ቡና ለ ውጪ
outdated methods of wood or stone grinder, which does not fit
ገ በ ያ በ ሚመጥ ን ደ ረ ጃ አ ዘ ጋ ጅቶ የ ሚል ክ ሰ ው ነ ው፤

፲ ፮ / “ቡና ላ ኪ” ማለ ት አ ግባ ብ ካ ለ ው መን ግ ስ ታዊ አካል
የ ብቃት ማረ ጋ ገ ጫና የ ቡና ላ ኪ ን ግ ድ ፍ ቃድ የ ተ ሰ ጠውና
በህግ አ ግባ ብ በ ተ ፈ ጠረ የ ግ ብይ ት ትስ ስ ር ወይ ም 14/ “coffee supplier” means a person who,is certified and
ከ ኢት ዮ ጵ ያ ምር ት ገ በያ የ ገ ዛ ውን ቡና ለ ውጪ ገ በ ያ licensed to trade coffee by the appropriate regional states,
በ ሚመጥ ን ደ ረ ጃ አ ዘ ጋ ጅቶ የ ሚል ክ ሰ ው ነ ው፤ upon meeting the required criteria, collects prepares and
፲ ፯ / “የ መጀ መሪ ያ ደ ረ ጃ የ ቡና ግ ብይ ት ማዕ ከ ል ” ማለ ት በ ቡና processes coffee with pulp or red cherry coffee from auction
አ ምራ ች አ ካ ባ ቢዎ ች አ ግባ ብ ባለው የ ክ ልል አካል centers or producers integrated with legal and developmental
የ ተፈ ቀ ደ ቀ ይ የ እ ሸ ት ወይ ም የ ጀ ን ፈ ል ቡና መገ በ ያ ያ auctions or from his own farm or from members of
ሥፍ ራ ነ ው፤ cooperatives for delivery to the Ethiopia Commodity
Exchange or directly to exporters with lawful transaction line
፲ ፰ / “ሌሎች የ ቡና ግ ብይ ት አ ማራ ጮች ” ማለ ት የ ቡና ጥራት
or export market;
በ ማሻ ሻ ል ና የ ተሻ ለ ዋጋ በ ማስ ገ ኘ ት አ ምራ ቾ ች ን ና [
የ ግ ብይ ት ተዋ ን ያ ን ን ተ ጠቃሚ የ ሚያ ደ ር ግ መሆኑ
በ ባ ለ ሥል ጣኑ ተ ረ ጋ ግ ጦ የ ሚፈ ቀ ድ ከ ምር ት ገ በ ያ ው ውጪ
15/ “coffee producer and exporter” means a person who has
የ ሚካ ሄ ድ የ ቡና ግ ብይ ት መድረ ክ ነ ው፤
obtained certificate of competence and coffee export
፲ ፱ / “የ ቡና ግ ብይ ት ” ማለ ት ህጋዊ የ ግ ብይ ት ሥር ዓ ት ን business license from appropriate government organ either
በ መከ ተ ል በ መጀ መሪ ያ ደ ረ ጃ ግ ብይ ት ማዕ ከ ላ ት ፣ በ ምር ት by collecting from his own farm or out growers in
ገ በ ያ ው፣ በ ውጪ ገ በ ያ ወይ ም በ ሌሎች የ ግ ብይ ት አ ማራ ጮች accordance with law, and coffee cooperatives collected from
በ አ ምራ ቾ ች ፣ በ አ ቅ ራ ቢዎ ች ፣ ላ ኪዎ ች ፣ እ ሴት በ ሚጨምሩ its members and exports coffee in compliance with the
ኢን ዱስ ት ሪ ዎ ች ና የ ውጭ ቡና ገ ዢ ኩባ ን ያ ዎ ች እ ን ዲሁም export quality and standards;
በ ጅምላ ነ ጋ ዴና ቸ ር ቻሪ መካ ከ ል የ ሚከ ና ወን የ ቡና ግ ዢና
ሽ ያ ጭ ሂ ደ ት ነ ው፤
16/ “coffee exporter” means a person who, upon being licensed
፳/ “የ ቡና ጥራ ት ቁ ጥጥር ” ማለ ት ቡና የ ተ ፈ ጥሮ ባ ህ ሪ ውን ና to trade coffee by the appropriate government organ, and
ጣዕ ሙን እ ን ደ ጠበ ቀ ለ ተ ጠቃሚው ለ ማቅ ረ ብ ከ ምር ት upon purchasing coffee from the transaction integrated
መሰ ብሰ ብ ጀ ምሮ በ ግ ብይ ት ፣ በ ምር ት ዝ ግ ጅት ፣ lawful line or the Ethiopian Commodity Exchange,
በ አ ከ መቻቸ ት ፣ በ መቁ ላ ት ወይ ም በ መቁ ላ ት ና በ መፍ ጨት ፣
processed and exports coffee in compliance with the export
በ ማሸ ግ ና በ ማጓ ጓ ዝ ሂ ደት በ ተፈ ቀ ደ የ አ ሠራ ር ሥር ዓ ት
quality and standards;
እና የ ጥራት ደረ ጃ መስ ፈ ር ት መሠረ ት ስ ለ መከ ና ወኑ
በ የ ደ ረ ጃ ው የ ሚፈ ጸ ም የ ቁ ጥ ጥ ር ተ ግ ባ ር ነ ው፤ 17/ “first level coffee transaction center” means a center of
፳ ፩ / ‘‘ቡና ማዘ ጋ ጀ ት ’’ ማለ ት በ ሀ ገ ሪ ቱ በ ተ ፈ ቀ ደ የ ጥ ራ ት ና
transaction for red cherry coffee or coffee with pulp
ደረ ጃ የ ቴክ ኒ ክ አ ሰ ራር መሰ ረ ት በ መጀ መሪ ያ ደረ ጃና
transaction upon being authorized by appropriate
በ ኤ ክ ስ ፖር ት ማዘ ጋ ጃ ኢን ዱስ ት ሪ ዎ ች የ ታጠበ ቡና ፣ government organ of the coffee producing areas;
በ ከ ፊ ል የ ታጠበ ቡና ወይ ም ተ ፈ ጥ ሯዊ ወይ ም ያ ል ታጠበ
18/ “other alternative coffee transaction” means a special coffee
ቡና በ ጥ ሬ ው የ ማዘ ጋ ጀ ት ሂ ደ ት ን ያ ጠቃል ላ ል ፤
transaction option which is different from Ethiopian
፳፪ / ‘‘እ ሴ ት የ ሚጨምሩ ኢን ዱስ ት ሪ ዎ ች ’’ ማለ ት ቡና ን Commodity Exchange transaction, verified and authorized
ቆ ል ተ ው ወይ ም ቆ ል ቶ ውና ፈ ጭተ ው ወይ ም በ ተ ለ ያ ዩ መል ኩ by the Authority in accordance with law to enable
አ ቀ ና ብረ ው ለ ሃ ገ ር ውስ ጥ ወይ ም ለ ውጭ ገ በ ያ የ ሚያ ቀ ር ቡ improvement of coffee quality and helps to obtain better
ኢን ዱስ ት ሪ ዎ ች ና ቸ ው፤ price and benefits to producers and transaction actors;
፳ ፫ / ‘‘እ ሴት የ ተ ጨመረ በ ት ቡና ማዘ ጋ ጀ ት ’’ ማለ ት በ ተ ፈ ቀ ደ 19/ “coffee transaction” means the lawful buying and selling of
የ ቴክ ኒ ክ አ ሰ ራር መሠረ ት ጥ ሬ ቡና ን ቆ ልቶ፣ ቆ ልቶና coffee in first level coffee transaction centers, exchange
ፈ ጭቶ ወይ ም ወደ ተ ለ ያ የ ዓ ይ ነ ት ምር ቶ ች የ ማቀ ነ ባ በ ር market, foreign market or in other alternative transactions
ሂ ደ ት ነ ው፤
፳ ፬ / ‘‘የ ቡና አ ምራ ቾ ች ’’ ማለ ት አ ነ ስ ተ ኛ ይ ዞ ታ ያ ላ ቸ ው
options between producers, suppliers, exporters, value
ቡና አ ምራ ች አ ር ሶ አ ደ ሮ ች ፣ የ ቡና አ ምራ ች ህ ብረ ት ሥራ
added industries and foreign coffee importer companies as
ማህ በ ራ ት እ ና አ ል ሚ ባ ለ ሀ ብቶ ች ና ቸ ው፤ well as wholesaler and retailers;
፳ ፭ / ‘‘የ ቡና ጥ ራ ት ምር መራ ና ደ ረ ጃ ምደ ባ ማዕ ከ ል ’’ ማለ ት
የ ብቃት ማረ ጋ ገ ጫና የ ሥራ ፈ ቃድ በ ባ ለ ሥል ጣኑ ተ ሰ ጥ ቷ ቸ ው
የ አ ቅር ቦ ት ቡና ጥራት ና ጣዕ ም በ መመር መር ደረ ጃ
20/ “coffee quality control” means inspection and control of the
ለ መመደ ብ በ ቡና አ ምራ ች አ ካ ባ ቢዎ ች አ ገ ል ግ ሎት እ ን ዲሰ ጥ
picking, transaction, processing, storage, roasting or
የ ተ ቋ ቋ መ መን ግ ስ ታዊ ወይ ም የ ግ ል ድር ጅት ነ ው፤
roasting and grinding, packaging and transportation of
፳ ፮ / “የ ቡና ጥ ራ ት ምር መራ ና ሰ ር ተ ፊ ኬሽ ን ማዕ ከ ል ” ማለ ት
coffee, in accordance with acceptable norms and quality
ለ ውጭ ሀ ገ ር ገ በያ በ ጥ ሬ ው፣ ተ ቆ ል ቶ ወይ ም ተ ቆ ል ቶ ና
standards, to ensure delivery of coffee to consumers in its
ተ ፈ ጭቶ የ ሚቀ ር ብ ቡና የ ጥራ ት ደረ ጃ በ ማረ ጋ ገ ጥ
natural state;
የ ምስ ክ ር ወረ ቀ ት ና የ ምር ት ሀገ ር ሰ ር ተ ፍ ኬት የ ሚሰ ጥ

processing industries in accordance with the country’s
ከ አ ምራ ቾ ች በ መግ ዛ ት ወይ ም በ ማምረ ት አ ዘ ጋ ጅቶ
quality and grade requirements and the buyers’ needs as per
ለ ኢት ዮ ጵ ያ ምር ት ገ በ ያ ማቅ ረ ብን ፣ በ ጥ ሬ ው ወይ ም ቆ ል ቶ

በ መግ ዛ ት በ ተ ፈ ቀ ደ ለ ት አ ካ ባ ቢ ለ ሚገ ኙ የ ቡና ቸ ር ቻሪ ዎ ች 23/ “value added coffee processing” means the process of

፴ ፩ /“የ ወጪ ቡና ቆ ዪ ” ማለ ት አ ግ ባ ብ ካ ለ ው የ መን ግ ሥት አ ካ ል
የ ወጪ ቡና ቆ ዪ ነ ት የ ብቃት ማረ ጋ ገ ጫና የ ን ግ ድ ፈ ቃድ
የ ተ ሰ ጠው ከ ኢት ዮ ጵ ያ ምር ት ገ በ ያ ፣ ከ ራ ሱ ማሳ አ ምር ቶ 25/ “coffee quality inspection and grading center” means a
ወይ ም በ ሌሎች የ ግ ብይ ት አ ማራ ጮች ቡና በ መግ ዛ ት ቆ ል ቶ public or private enterprise established in the coffee
ወይ ም ቆ ልቶና ፈ ጭቶ ለ ወጪ ገ በ ያ በ ሚመጥ ን ደረ ጃ producing areas and issued with certificate of competence
አ ዘ ጋ ጅቶ የ ሚል ክ ሰ ው ነ ው፤ and business license by the Authority to inspect quality and
፴ ፪ / “የ ሀ ገ ር ውስ ጥ ቡና ቆ ይ ” ማለ ት አ ግ ባ ብ ካ ለ ው የ ክ ል ል to grade supply coffee;
አካል የ ሀገ ር ውስ ጥ ቡና ቆ ይ ነ ት የ ብቃት ማረ ጋ ገ ጫና
ን ግድ ፈ ቃድ የ ተ ሰ ጠው ለ ሀ ገ ር ውስ ጥ ገ በያ ሊውል
የ ሚች ል ቡና ከ ኢት ዮ ጵ ያ ምር ት ገ በ ያ ገ ዝ ቶ ቆ ል ቶ ወይ ም
26/ “coffee quality inspection and certification center” means a
ቆ ልቶና ፈ ጭቶ ለሀገ ር ውስ ጥ ገ በያ የ ሚያ ቀ ር ብ ሰው
center established to inspect level of quality and issues
ነ ው፤
certificates of quality and county of origin for raw, roast or
፴ ፫ / “የ ል ማት ና ግ ብይ ት ት ስ ስ ር ” ማለ ት የ ቡና አ ል ሚነ ት roast and grind export coffee;
ፈ ቃድ በ ተ ሰ ጠው ባ ለ ሀ ብት እ ና ኩታገ ጠም ወይ ም በ ዙሪ ያ ው
የ ሚገ ኙ የ ቡና አ ምራ ች አርሶ አ ደ ሮች መካ ከ ል የ ጋራ
ፍ ላ ጎ ት ና ተ ጠቃሚነ ት ላ ይ የ ተ መሠረ ተ ሆኖ በ ኤ ክ ስ ቴ ን ሸ ን 27/ “coffee transaction centers” include first level coffee
አ ገ ል ግ ሎት ና የ ቴ ክ ኖ ሎጂ አ ቅር ቦ ት ትስ ስ ር በ ማድረ ግ transaction centers and the Ethiopian Commodity Exchange;
ምር ታማነ ት ና የ ምር ት ጥ ራ ት ለ ማሻ ሻ ል እ ና ለ መገ በ ያ የ ት
የ ሚፈ ጠር ህ ጋ ዊ ግ ን ኙነ ት ነ ው፤ 28/ “coffee trade” means acts including buying coffee from

የ ሚያ ስ ች ል ብቃት ያ ለ ው መሆኑ ን የ ሚያ ረ ጋ ግ ጥ አ ግ ባ ብ license from the appropriate government organ;

ባ ለ ው የ መን ግ ስ ት አ ካ ል የ ተ ሰ ጠ ህ ጋ ዊ ሰ ነ ድ ነ ው፤
፴ ፭ “ቡና የ ማሸ ግ ሥራ ” ማለ ት ቡና ከ አ ን ድ ቦ ታ ወደ ሌላ
ቦታ ለ ማጓ ጓ ዝ በ ባ ለ ስ ል ጣኑ ወይ ም በ ክ ልል አካል
በ ተ ፈ ቀ ደ የ ቴ ክ ኒ ክ አ ሰ ራ ር የ ተ ዘ ጋ ጀ ቡና ን ከ ብክ ነ ት ና
29/ “domestic consumption coffee wholesaler” means a person
ጥራት መጓ ደ ል ለ መጠበ ቅ ተ ስ ማሚነ ቱ ተረ ጋ ግ ጦ
who, upon being licensed to trade coffee by the appropriate

ደ ረ ቅ ሽ ፋ ን ሆኖ እ ስ ከ አ ን ድ በ መቶ ን ፁህ ቡና ሊኖ ር በ ት
የ ሚች ል የ ቡና ተ ረ ፈ ምር ት ነ ው፤ 30/ “coffee retailer” means a person who has obtained

መዳ ረ ሻ ሀ ገ ራት ቡና ሲሸ ጥ በ ዋጋ፣ በ መጠን ፣ በ ምር ት consumption coffee and purchases this coffee only from
ዓ ይነ ትና ጥራት ደ ረ ጃ ፣ የ መላ ኪያ ጊ ዜ፣ የ ክ ፍያ ሁኔ ታ wholesaler engaged in domestic consumption coffee
ዝ ር ዝ ር ከ ውጭ ሀ ገ ር ቡና ገ ዢ ደ ን በ ኛ ው ጋ ር በ መፈ ራ ረ ም business;
በ ኢት ዮ ጵ ያ ብሔራ ዊ ባንክ ዕ ውቅ ና አ ግኝቶ የ ተ መዘ ገ በ
31/ “export coffee roaster” means a person who has obtained
የ ተ ፈ ጻ ሚነ ት ግ ዴታ ያ ለ ው ሰ ነ ድ ነ ው፤
certificate of competence and business license from
፴ ፰ /“የ ቅ ይ ጥ ቡና ዝ ግ ጅት ” ማለ ት ባ ለ ስ ል ጣኑ በ ሚፈ ቀ ደ ው appropriate government organ to purchase export coffee
የ ቴ ክ ኒ ክ አ ሠራ ር መሠረ ት የ ተ ለ ያ የ ባ ህ ሪ ያ ላ ቸ ው ቡና ዎ ች from the Ethiopia Commodity Exchange, or from other
በ ማቀ ላ ቀ ል በ ተለ የ ራ ሱን የ ቻለ መለ ያ ስ ም የ ሚዘ ጋ ጅ transaction options or collects from his own farm and roasts
በ ጥ ሬ ወይ ም እ ሴት የ ተ ጨመረ በ ት ቡና ነ ው፤ or roasts and grinds coffee for export market by maintaining

ማረ ጋ ገ ጫና የ ን ግ ድ ፈ ቃድ ወስ ዶ በ ቡና ማጠብ፣ መፈ ል ፈ ል ፣ 32/ “domestic coffee roaster” means a person who has obtained
ማበ ጠር ፣ ውጪ ን ግ ድ ቡና ማዘ ጋ ጀ ት ፣ መቁ ላ ት ፣ መፍ ጨት ፣ a certificate of competence and business license from

፵ / “አ ሳ ሳ ች ድር ጊ ት ” ማለ ት የ ቡና ዓ ይ ነ ት ፣ ዋጋ፣ መጠን ፣
Exchange, and roasts or roasts and grinds coffee for sale in
የ ጥራት ደረ ጃ፣ ዝ ግ ጅት ፣ ማከ ማቸ ት ወይ ም ማጓ ጓ ዝ

የ ተ ቋ ቋ መ የ ኢት ዮ ጵ ያ ቡና ና ሻ ይ ባ ለ ስ ል ጣን ነ ው፤
34/ “competence certificate” means a legal document issued by
፵ ፫ / “አ ስ ፈ ጻ ሚ አ ካ ል” ማለ ት ሚኒ ስ ቴ ሩ ፣ ባ ለ ሥል ጣኑ ፣
the appropriate government organ that certifies the ability of

a person to carry out coffee transaction, process, store, roast,

፵ ፬ / ‘‘አ ግ ባ ብ ያለው የ ክ ልል አ ካ ል ’’ ማለ ት የ ክ ልል
የ ቡና ና ሻ ይ ባ ለ ሥል ጣን ወይ ም ተ መሳ ሳ ይ ሥል ጣን ና ተ ግ ባ ር
35/ “coffee packaging” means a packaging of processed coffee

41/“seal” means an act of sealing, closing or packing of coffee
with a device or substance into a sack or a container or a

44/ “relevant regional organ” means regional Coffee and Tea
አ ከ ባ ቢዎ ች ይ ሸ ኛ ል ፤ መድረ ሱን ም ይ ከ ታተ ላ ል ይ ቆ ጣጠራ ል ፡ ፡
Authority or other organ designated with the same power
7/ ባ ለ ሥል ጣኑ ለሀገ ር ውስ ጥ ና ለ ወጪ ገ በ ያ በ ተዘ ጋ ጀ ቡና and function;
በ ተ ሰ ጠ የ ጥራት ፣ ምር መራ ና የ ደ ረ ጃ ምደ ባ ላ ይ በ ሚቀ ር ቡ
45/ “regional state” means any State referred to in Article 47 of

ባ ላ ቸው አ ር ሶ አ ደ ሮች ወይ ም አ ል ሚ ባ ለ ሀ ብቶ ች ወይ ም
46/ “Ministry” or “Minister” means the Ministry or Minister of

SECTION TWO
5/ በ ኢት ዮ ጵ ያ ምር ት ገ በ ያ የ ሚፈ ጸ ም የ አ ቅ ር ቦ ት ቡና ግ ብይ ት
COFFEE QUALITY CONTROL AND MARKETING PROCESS
በ ምር ት ገ በ ያ ወይ ም በ ባ ለ ስ ል ጣኑ በ ተፈ ቀ ደ ላ ቸው የ ግ ል
የ ቡና ጥ ራ ት ምር መራ ና ደ ረ ጃ ምደ ባ ማዕ ከ ላ ት በ ተ ሰ ጠው 4. Coffee Quality Control Process
የ ጥ ራ ት ደ ረ ጃ ና ባ ለ ቤ ት ነ ት ን ገ ላ ጭ የ ሆነ በ ተ ሟላ መረ ጃ
መሰ ረ ት ፤ 1/ The legally designated regional quality control organ shall:
6/ በ ዚ ህ አ ን ቀጽ ን ኡስ አ ን ቀጽ (2)፤ (3) እ ና (4)

a) Inspect transaction of red cherry coffee and coffee with
የ ተ ደ ነ ገ ገ ው እ ን ደ ተ ጠበ ቀ ሆኖ በ ሌሎች የ ግ ብይ ት አ ማራ ጮች

7/ በ ኢት ዮ ጵ ያ ምር ት ገ በ ያ ሆነ በ ሌሎች የ ግ ብይ ት አ ማራ ጮች
የ ተ ሸ ጠ የ አ ቅ ር ቦ ት ቡና ለ ውጪ ገ በ ያ ዝ ግ ጅት ከ ዝ ር ዝ ር b) Inspect and supervise competence of coffee processing
መረ ጃ ው ጋ ር ወደ ቡና ማዘ ጋ ጃ ኢን ዱስ ት ሪ ይ ሸ ኛ ል ፤ industries and supervise the handling, storing and
8/ የ አ ቅ ር ቦ ት ቡና ደ ረ ጃ ከ ወጣለ ት ቀ ን ጀ ምሮ በ ኢት ዮ ጵ ያ processing are carried out in accordance with appropriate

ባ ለ ቤት ነ ት ን ገ ላ ጭ በ ሆነ አ ግባ ብ በ ማቆ የ ት ለገ በያ
ይቀ ር ባ ል፤
፲/ የ ሀገ ር ውስ ጥ ፍ ጆ ታ ቡና በ ኢት ዮ ጵ ያ ምር ት ገ በ ያ ብቻ
2/ The coffee quality inspection and grading center shall
ለ ጅምላ ነ ጋ ዴዎ ች ወይ ም ለሀገ ር ውስ ጥ ቡና ቆ ዪዎች
verify that the coffee arrived is properly sealed and grade
በ ጨረ ታ ይ ሸ ጣል ፤
through an appropriate examination based on a

በ ሚወጣው ደን ብ መሠረ ት የ ል ማት ና ግ ብይ ት ትስ ስ ር
3/ The Authority shall send the sealed graded coffee to the

ያ ዘ ጋ ጁት ን ቡና ለ ውጭ ሀ ገ ር ቡና ገ ዢዎ ች በ መሸ ጥ የ ሽ ያ ጭ 4/ The Authority shall inspect that the coffee is prepared in

5/ The Authority shall send to the port for consignment, the

ማስ ገ ባ ት ይ ች ላ ሉ፡ ፡
6. የ ቡና ገ ለ ባ ግ ብይ ት
6/ other inspection center allowed by the Ethiopian

shall follow up to its final destination.
ለ ሀ ገ ር ውስ ጥ ወይ ም ለ ውጪ ገ በ ያ ሊያ ቀ ር ብ ይ ች ላ ል ፡ ፡
2/ በ ዚ ህ አ ን ቀጽ ን ዑስ አ ን ቀጽ ( 1) የ ተገ ለ ጸ ው
እ ን ደ ተ ጠበ ቀ ሆኖ አ ግባ ብ ካ ለ ው የ መን ግ ስ ት አካል 7/ The Authority shall decide on complaints presented in

ቀ ይ ሮ ጥ ቅ ም ላ ይ ማዋ ል ይ ቻላ ል ፡ ፡
5. Coffee Transaction Process
Coffee transaction shall take place as follows:

1/ red cherry coffee or coffee with pulp between small scale
ክ ፍል ሶ ስ ት farmers or commercial growers, coffee suppliers or co-
የ ግ ብይ ት ተ ሳ ታፊ ግ ዴታዎ ች operative associations or out growers or value adding
7. በ ቡና ግ ብይ ት ሥራ የ ተ ሰ ማራ ሰ ው ግ ዴታዎ ች industries;
ማን ኛ ውን ም በ ቡና ግ ብይ ት የ ተ ሠማራ ሰ ው:-

1/ የ ቀ ይ እ ሸ ትና ጀን ፈል ቡና ግ ብይ ት በ ተፈ ቀ ዱ የ ቡና
ማዘ ጋ ጃ ኢን ዱስ ት ሪ ዎ ች ወይ ም አ ግ ባ ብ ባ ለ ው የ ክ ልል 2/ if supply coffee is intended for export, between a coffee
አ ካ ል በ ተ ፈ ቀ ደ የ መገ በ ያ ያ ስ ፍ ራ ብቻ የ ማካ ሄ ድ፤ supplier and a coffee exporter or a coffee supplier and an
2/ የ አ ቅ ር ቦ ት ቡና ግ ብይ ት በ ኢት ዮ ጵ ያ ምር ት ገ በያ ውጪ export coffee roaster;
በ ተ ፈ ቀ ዱ ሌሎች የ ግ ብይ ት አ ማራ ጮች የ ሚፈ ጸ ም ከ ሆነ የ ቡና
3/ if supply coffee does not fit for export level, between a coffee
ዓ ይነ ት፣ መጠን ፣ ጥራት ደ ረ ጃ ፣ ዋጋና ጊ ዜ በ ባ ለ ስ ል ጣኑ
supplier and a wholesaler or between a domestic coffee
በ ማስ መዝ ገ ብ የ መፈ ጸ ም፤ roaster;
3/ የ አ ቅ ር ቦ ት ቡና በ ሀ ገ ር ውስ ጥ ለ ግ ብይ ት ከ መቅ ረ ቡ በ ፊ ት
በ ልዩ ሁኔ ታ በ ባ ለ ስ ል ጣኑ የ ተ ፈ ቀ ደ ለ ት ካ ል ሆነ በ ስ ተቀ ር 4/ if it is coffee by product, between an exporter and a domestic
በ ቡና ጥራት ምር መራ ና ደረ ጃ ምደ ባ ማዕ ከ ል አ ስ መር ምሮ consumption wholesaler or a domestic coffee roaster and a
የ ምስ ክ ር ወረ ቀ ት የ ማግ ኘ ት ፤ wholesaler or between a domestic coffee roasters in
4/ የ አ ቅ ር ቦ ት ወይ ም የ ውጪ ቡና ከ መጫኑ በ ፊ ት አ ሽ ከ ር ካ ሪ ውና transaction centers;
ተ ሽ ከ ር ካ ሪ ውን የ ብቃት መስ ፈ ር ት አ ሟል ቶ መሰ ማራ ቱ ን 5/ supply coffee transaction in the Ethiopia Commodity

የ ማረ ጋ ገ ጥ ፤ Exchange shall be carried out on the basis of the grade and
5/ በ ባ ለ ሥል ጣኑ ወይ ም አ ግ ባ ብ ባ ለ ው የ ክ ል ል አ ካ ል የ ተ ሰ ጠ point issued by private coffee quality inspection and grading
የ ብቃት ማረ ጋ ገ ጫ ምስ ክ ር ወረ ቀ ት የ ማቅ ረ ብ፤ centers and based upon complete ownership descriptions;
6/ ለ ግ ብይ ት ካ ዘ ጋ ጀው ቡና ለ ጥራት ምር መራ አ ገ ል ግ ሎት
የ ሚውል ና ሙና እ ን ዲሰ ጥ ሲጠየ ቅ 9 : ;:

7/ ማን ኛ ውን ም ቀ ይ እ ሸ ት ወይ ም ጀ ን ፈ ል ቡና ከ ባ ለ ሥል ጣኑ (4) of this Article, supply coffee transaction in other

8/ ማን ኛ ውን ም የ አ ቅ ር ቦ ት ወይ ም የ ወጪ ገ በ ያ ቡና ከ ማጓ ጓ ዙ 7/ coffee sold in the Ethiopia Commodity Exchange or other
በ ፊ ት በ ፕ ሎምፕ ማሳ ሸ ግ ና በ ተ ቆ ጣጣሪ ው የ ተ ሰ ጠውን መሸ ኛ transaction options shall be sent to the processing industries
የ መያ ዝ ፤ for export preparation with the details of relevant

information;
9/ ዕ ለ ታዊ የ ቡና ግ ዢና ሽ ያ ጭ መጠን ፣ ደ ረ ጃ ፣ ዋ ጋ ና ሌሎች
ዝር ዝር መረ ጃ ዎ ች መዝ ግ ቦ የ መያ ዝ ና ለ ባ ለ ሥል ጣኑ ወይ ም
8/ supply coffee starting from the date of grading shall be sold
ለ ሚመለ ከ ተ ው ተ ቆ ጣጣሪ የ ማሳ ወቅ ፣ ወይ ም በአካል

on vehicle in accordance with permitted procedures of the

8. የ ቡና አ ምራች ግ ዴታዎ ች
ማን ኛ ውም የ ቡና አ ምራ ች ፡ - 10/ coffee for domestic consumption shall be traded for

wholesalers or domestic coffee roasters only in the
1/ ከ አ ር ሶ አ ደር በ ስ ተቀ ር ፣ ከ ሚመለ ከ ተ ው የ መን ግ ስ ት አካል

2/ በ ዚ ህ አ ዋ ጅ አ ን ቀ ጽ 5 ን ኡስ አ ን ቀ ጽ (1) የ ተ ጠቀ ሰ ው 11/ cherry coffee or coffee with pulp transaction shall be made

12/ coffee exporters shall register to National Bank of Ethiopia
3/ በ ዚ ህ አ ን ቀ ጽ ን ዑስ አ ን ቀ ጽ (1) የ ተ ጠቀ ሰ ው እ ን ደ ተ ጠበ ቀ
and notify to the Authority, the export coffee contracts of
ሆኖ በ ኢት ዮ ጵ ያ ምር ት ገ በያ ወይ ም በ ሌሎች የ ግ ብይ ት
coffee purchased from the Ethiopia commodity Exchange
አ ማራ ጮች በሀገ ር ውስ ጥ የ ሚገ በ ያ ይ ከ ሆነ ለ ቡና ጥራት
or in other alternative transaction or produced in their own
ምር መራ ና ደ ረ ጃ ምደ ባ ማዕ ከ ል አ ቅ ር ቦ ደ ረ ጃ የ ማሰ ጠት ፤
farm and coffee roasted, roasted and grinded sold in
foreign market;
4/ ቡና አ ል ሚ ባ ለ ሀ ብት አ ነ ስ ተ ኛ ይ ዞ ታ ካ ላ ቸ ው ቡና አ ምራ ች
አርሶ አ ደ ሮች በ ል ማት ና ግ ብይ ት ትስ ስ ር ቡና ለ መግ ዛ ት 13/ graded and value added export coffee only can be sold in
የ ኤክ ስ ቴ ን ሽ ን ና የ ቴ ክ ኖ ሎጂ አ ቅር ቦ ት ድጋ ፍ የ ማድረ ግ ፣ foreign exchange in domestic market to promote the

5/ ተ ረ ፈ ምር ት ቡና በ ቡና ጥራት ምር መራ ና ደረ ጃ ምደ ባ
ማዕ ከ ል አ ስ መር ምሮ ሲፈ ቀ ድ ብቻ በ ኢት ዮ ጵ ያ ምር ት ገ በያ 14/ industries engaged in value addition may import raw coffee
የ መሸ ጥ ፤ from abroad in accordance with a regulation to be issued
following this Proclamation.
6/ ያ መረ ተ ውን ወይ ም በ ል ማት ና ግ ብይ ት ት ስ ስ ር የ ገ ዛ ውን ቡና

6. Coffee Husk Transaction
አ ማራ ጭ የ ምር ት ዘ መኑ ሳ ያ ልፍ የ መሸ ጥ ወይ ም ወደ ውጭ
1/ In accordance with the certificate of competence provided by
አ ዘ ጋ ጅቶ የ መላ ክ ግ ዴታዎ ች አ ሉበ ት ፡ ፡
the appropriate regional body or the Authority, any coffee
9. የ ቡና አ ቅ ራቢ ግ ዴታዎ ች
producer or processor or a person who legally buys coffee,
ማን ኛ ውን ም ቡና አ ቅ ራ ቢ፡ - may deliver the processed coffee parchment to domestic or
1/ ቀ ይ እ ሸ ት ወይ ም ጀ ን ፈ ል ቡና በ ተ ፈ ቀ ደ ለ ት አ ካ ባ ቢ ብቻ foreign market.
የ መግ ዛ ት ፣ የ ማዘ ጋ ጀ ት ፣ የ ማጓ ጓ ዝ ፣ የ በ ቀ ለ በ ትን አካባቢ
ቡና ባ ህ ሪ ና ስ ያ ሜ የ መጠበ ቅ ፣ ከ ሌላ ሥነ -ምህ ደ ር ዓ ይ ነ ት 2/ Without prejudice to the sub-article (1) of this Article, a
ቡና ጋ ር ሳ ይ ቀ ይ ጥ ወይ ም ከ ማን ኛ ውም ሌሎች ባ ዕ ድ ነ ገ ሮ ች person who has a license from relevant government organ
ሳ ይ ደ ባ ለ ቅ የ ማቅ ረ ብ፣ may use coffee husk for making natural fertilizer or changing
2/ የ ገ ዛ ውን ቀ ይ እ ሸ ት ቡና ን በ ደ ን ቡ በ ባ ለ ሥል ጣኑ በ ተ ፈ ቀ ደ it to other products.
የ ቴ ክ ኒ ክ አ ሠራ ር ና ጊ ዜ መሠረ ት የ ታጠበ ቡና ከ ነ ገ ለ ፈ ቱ ፣
በ ከ ፊ ል የ ታጠበ ቡና ወይ ም ተ ፈ ጥ ሯዊ ቡና የ ማዘ ጋ ጀ ት ፣
3/ የ ሚያ ዘ ጋ ጀ ውን የ አ ቅር ቦ ት ቡና በ ኢት ዮ ጵ ያ ምር ት ገ በያ
ወይ ም በ ሌላ ህጋዊ የ ግ ብይ ት አ ማራ ጭ የ ምር ት ዘ መኑ
ሳ ያ ል ፍ የ መሸ ጥ ወይ ም ወደ ውጭ አ ዘ ጋ ጅቶ የ መላ ክ ፣
4/ ለ ቡና ጥራ ት ምር መራ ና ደ ረ ጃ ምደ ባ ማዕ ከ ላ ት የ ሚያ ቀ ር በ ው
ወይ ም በ ቀ ጥ ታ ለ ላ ኪ የ ሚሸ ጠውን ወይ ም በ ራ ሱ አ ዘ ጋ ጅቶ
ቀ ጥታ ወደ ውጭ የ ሚል ከ ውን የ አ ቅር ቦ ት ቡና ጥራቱ ን SECTION THREE
የ ጠበ ቀ ና የ እ ር ጥበ ቱ መጠን ወይ ም ይ ዘ ት ይህ ን ን አ ዋጅ OBLIGATIONS OF TRANSACTING ACTORS
ተከ ትሎ በ ሚወጣው ደን ቡ በ ሚወሰ ነ ው መሠረ ት መሆኑ ን 7. Obligations of Person Involved in Coffee Transaction
የ ማረ ጋ ገ ጥ ፣
Any person involved in coffee transaction shall:
5/ በ ቡና ጥራት ምር መራ ና ደረ ጃ ምደ ባ ማዕ ከ ል ተ መር ምሮ
ለ ውጭ ገ በ ያ ብቁ የ ሆነ የ አ ቅ ር ቦ ት ቡና በ ኢት ዮ ጵ ያ ምር ት 1/ conduct a transaction of red cherry coffee and coffee with
ገ በ ያ የ መሸ ጥ ወይ ም pulp only in transaction centers or coffee processing
6/ አ ስ ቀ ድሞ በ ሌላ አ ማራ ጭ የ ግ ብይ ት ት ስ ስ ር የ ተ ሸ ጠ ከ ሆነ industries which are allowed by the appropriate regional
ለ ገ ዥው የ ማስ ረ ከ ብ ወይ ም organ;
7/ የ ተ ሻ ለ ዋ ጋ ለ መጠበ ቅ ያ ሰ በ እ ን ደ ሆነ በ ቡና ግ ብይ ት 2/ if supply coffee transaction takes place in other alternative
ባ ል ተ ሰ ማሩ ህጋዊ የ ማከ ማቻ አ ገ ል ግ ሎት የ መስ ጠት ፍ ቃድ transaction options outside Ethiopia Commodity Exchange,
ባ ላ ቸ ው ድር ጅቶ ች የ ማከ ማቸ ት ፣ the coffee type, quality standard, quantity, price and date

shall be registered and carried out in the Authority
8/ የ ምር ት ዘ መኑ የ ቡና ግ ብይ ት ከ መጀ መሩ በ ፊ ት አ ስ ፈ ላ ጊ ውን
ቅ ድመ ዝ ግ ጅት ስ ለ ማጠና ቀ ቁ ከ ሚመለ ከ ተ ው የ ክ ል ል አካል
3/ unless it is allowed in special directive by the Authority,
የ ብቃት ማረ ጋ ገ ጫ የ መያ ዝ ግ ዴታዎ ች አ ሉበ ት ፡ ፡
acquire a certificate from the coffee quality inspection and
0. የ ቡና ላ ኪ ግ ዴታዎ ች grading center before submitting supply coffee to domestic
coffee transaction;
ማን ኛ ውም ቡና ላ ኪ፡ -
1/ ከ ሚመለ ከ ተ ው የ መን ግ ስ ት አ ካ ል የ ተ ሰ ጠ የ ፀ ና የ ብቃት
ማረ ጋ ገ ጫ እ ና ን ግ ድ ፈ ቃድ የ መያ ዝ ፤ 4/ ensure, before loading supply or export coffee for
2/ ወደ ውጪ የ ሚል ከ ውን ቡና የ አ ገ ሪ ቱን የ ጥራት ደረ ጃ transportation, that a vehicle and its driver comply with
መስ ፈ ር ት ጠብቆ የ ማዘ ጋ ጀ ት ፣ competence standard;
3/ በ ባ ለ ስ ል ጣኑ በ ልዩ ፍ ቃድ ካ ስ መዘ ገ በ ው የ ቅ ይ ጥ ቡና
5/ submit competence certificate issued by the Authority or the
ዝ ግ ጅት ውጭ ቡና ው በ ተ መረ ተ በ ት አ ካ ባ ቢ ባ ህ ሪ ና ስ ያ ሜ
appropriate regional organ;
ጠብቆ ለ ውጭ ገ በ ያ የ ማቅ ረ ብ፣
4/ የ ውጪ ቡና ሽ ያ ጭ ውል ስ ምምነ ት ከ ፈ ፀ መ ፳፬ ሰዓት 6/ submit a representative sample from the coffee prepared for
ባ ልበ ለ ጠ ጊዜ ውስ ጥ በ ኢት ዮ ጵ ያ ብሔራ ዊ ባንክ transaction when so requested for quality inspection
የ ማስ መዝ ገ ብ እ ን ዲሁም ለ ባ ለ ስ ል ጣኑ በ ሦስ ት የ ስ ራ ቀ ና ት purposes;
ውስ ጥ የ ማሳ ወቅ ፣
7/ get a legal letter of release before transporting any red cherry
5/ በ ማና ቸ ውም የ ግ ብይ ት አ ማራ ጮች የ ገ ዛ ውን ወይ ም coffee and coffee with pulp from the transaction center
ያ መረ ተ ውን ወይ ም ህ ብረ ት ስ ራ ማህ በ ር ከ ሆነ የ ቡና ማሳ permitted by the Authority or appropriate regional organ to
ካ ላ ቸው አ ባ ላ ቱ የ ሰ በ ሰ በ ውን ቡና ምን ም ሳ ያ ባክን ና pulp or hull coffee industries;
የ ጥ ራ ት ደ ረ ጃ ው ሳ ይ ጓ ደ ል በ ምር ት ዘ መኑ ለ ውጭ ሀ ገ ር
ገ በ ያ የ መሸ ጥ ፣
6/ ለ ውጪ ገ በ ያ በ ማዘ ጋ ጀ ት ሂ ደ ት የ ሚወጣ ተ ረ ፈ ምር ት ቡና
ወደ ኢት ዮ ጵ ያ ምር ት ገ በ ያ በ ማቅ ረ ብ የ መሸ ጥ ፣
8/ have appropriate executive body seal and issue a letter of
7/ አ ሳ ማኝ ምክ ን ያ ት መኖ ሩ በ ባ ለ ሥል ጣኑ ተረ ጋ ግ ጦ
release when transporting any supply or export coffee;
በ ኢት ዮ ጵ ያ ብሔራ ዊ ባንክ መራ ዘ ሙ እ ን ደ ተ ጠበ ቀ ሆኖ
ከ ገ ዢዎ ች ጋር የ ገ ባ ውን ውል በ ውሉ ጊዜ ውስ ጥ
9/ maintain a register of the daily coffee exchange quantity,
የ መፈ ጸ ም፣
grade, price and list of purchase and disclose such register to
8/ በ ቡና ጥራ ት ምር መራ ና ደ ረ ጃ ምደ ባ ማዕ ከ ል ተ መር ምሮ the Authority or relevant inspection and cooperate when
ለ ውጪ ገ በያ ብቁ የ ሆነ ቡና በ ልዩ ምክ ን ያ ት
physical presence for site visit or inventorying is required;
በ ባ ለ ሥል ጣኑ ካ ልተፈ ቀ ደ በ ስ ተቀ ር በ ኢት ዮ ጵ ያ ምር ት
ገ በያ ወ ይ ም በ ሌላ የ ግ ብይ ት አ ማራ ጭ በ አ ገ ር ውስ ጥ
ለ ግ ብይ ት ያ ለ ማቅ ረ ብ ግ ዴታዎ ች አ ሉበ ት ፡ ፡ 10/ refrain from all acts that may damage the good name of the
፲ ፩ .የ ሀ ገ ር ውስ ጥ ፍ ጆታ ቡና ጅምላ ነ ጋ ዴ ግ ዴታዎ ች country’s coffee and respect the quality standards of the
country;
ማን ኛ ውም የ ሀ ገ ር ውስ ጥ ፍ ጆ ታ ቡና ጅምላ ነ ጋ ዴ፡ -
‹‹ 11/ comply with and cause to implement all regulations,
1/ ከ ሚመለ ከ ተ ው የ መን ግ ስ ት አ ካ ል የ ተ ሰ ጠ የ ፀ ና የ ብቃት
directives and procedures enacted by the appropriate body for
ማረ ጋ ገ ጫ እ ና ን ግ ድ ፈ ቃድ የ መያ ዝ ፤
the proper execution of this Proclamation.
2/ የ ሀ ገ ር ውስ ጥ ፍ ጆ ታ የ ሚሆን ቡና ከ ኢት ዮ ጵ ያ ምር ት
ገ በ ያ ብቻ የ መግ ዛ ት ፣ 8. Obligation of Coffee Producers
3/ የ ውጪ ገ በ ያ ቡና አ ለ መግ ዛ ት ወይ ም አ ለ ማጓ ጓ ዝ ወይ ም Any coffee Producer shall:

አ ለ መሸ ጥ ፣
1/ except farmer, hold valid competence certificate and trade
4/ የ ሀ ገ ር ውስ ጥ ፍ ጆ ታ ቡና ን በ ጅምላ ለ ማከ ፋ ፈ ል ን ግ ድ license from appropriate government organ,
ፈ ቃድ በ ወሰ ደ በ ት ክ ል ል ወይ ም ዞ ን ወ ይ ም ከ ተ ማ ብቻ
የ መሸ ጥ ፣
2/ without prejudice sub-article (1) Article 5 of this
5/ የ ሀ ገ ር ውስ ጥ ፍ ጆ ታ ቡና ን ከ ኢት ዮ ጵ ያ ምር ት ገ በ ያ ወደ
Proclamation, have the right to directly export coffee from
ተ ጠቃሚ ክ ልል ወይ ም ዞን ወይ ም ከ ተማ ሲያ ጓ ጉ ዝ
his own farm, only after submitting the same to the coffee
በ ባ ለ ስ ል ጣኑ የ ሽኝት ሠራ ተ ኞ ች በ ፕ ሎምፕ ማሳ ሸ ግ ፣
quality inspection and grading center for grading before and
የ መሸ ኛ ሠነ ድ የ መያ ዝ ና ሲጠየ ቅ የ ማሳ የ ት ፣ እ ን ደ ታሸ ገ
after processing for export;
መድረ ሱን ም ከ ሚመለ ከ ተ ው አካል ማረ ጋ ገ ጫ የ መውሰ ድና
ለ ባ ለ ስ ል ጣኑ የ ማቅ ረ ብ፣
6/ የ ዘ መኑ የ ቡና ግ ብይ ት ከ መጀ መሩ በ ፊት አ ስ ፈ ላ ጊ ውን
ቅ ድመ ዝ ግ ጅት ስ ለ ማጠና ቀ ቁ ከ ሚመለ ከ ታቸ ው የ መን ግ ሥት 3/ without prejudice sub-article (1) of this Article, if
አ ካ ላ ት የ ብቃት ማረ ጋ ገ ጫ የ መያ ዝ ግ ዴታዎ ች አ ሉበ ት ፡ ፡ transaction takes place in domestic market in the Ethiopia
Commodity Exchange or other alternative transaction center
፲ ፪ .የ ሀ ገ ር ውስ ጥ ፍ ጆታ ቡና ቸ ር ቻሪ ነ ጋ ዴ ግ ዴታዎ ች
shall cause to grade by the Coffee quality inspection and
ማን ኛ ውም የ ሀ ገ ር ውስ ጥ ፍ ጆ ታ ቡና ቸ ር ቻሪ ነ ጋ ዴ፡ - grading center;
1/ ከ ሚመለ ከ ተ ው የ መን ግ ስ ት አካል የ ተሰ ጠ የ ፀ ና የ ብቃት

ማረ ጋ ገ ጫ እ ና ን ግ ድ ፈ ቃድ የ መያ ዝ ፤
4/ buy coffee from small-scale farmers through development
2/ የ ሀ ገ ር ውስ ጥ ፍ ጆ ታ የ ሚሆን ቡና ከ ሀ ገ ር ውስ ጥ ፍ ጆ ታ
and transaction relation, provide extension technology
ቡና ጅምላ ነ ጋ ዴ ወይ ም የ ሀ ገ ር ውስ ጥ ቡና ቆ ዪ ብቻ
support, pay better price or share profit after sale in
የ መግ ዛ ት ፣
accordance with their contract;
3/ የ ወ ጪ ገ በ ያ ቡና አ ለ መግ ዛ ት ወይ ም አ ለ ማጓ ጓ ዝ ወይ ም
አ ለ መያ ዝ ወይ ም አ ለ መሸ ጥ ፣
4/ የ ሀ ገ ር ውስ ጥ ፍ ጆ ታ ቡና ን በ ች ር ቻሮ ለ መሸ ጥ ን ግ ድ ፈ ቃድ
5/ sell coffee by product in the Ethiopia Commodity Exchange,
በ ወሰ ደ በ ት መቸ ር ቸ ሪ ያ ሱቅ ወይ ም ቦ ታ ብቻ የ መሸ ጥ ፣
only after having examined by coffee quality inspection and
5/ የ ሀ ገ ር ውስ ጥ ፍ ጆ ታ ቡና ን የ ሚቸ ረ ች ር ነ ጋ ዴ የ ቡና ግ ዢና grading centers;
ሽያ ጭ መረ ጃ የ መያ ዝ ና ሲጠየ ቅ የ ማቅ ረ ብ ግ ዴታዎ ች
6/ coffee bought in the Ethiopia Commodity Exchange or other
አ ሉበ ት ፡ ፡
alternative transaction centers, and or the coffee produced
፲ ፫ .የ ውጪ ቡና ቆ ይ ግ ዴታዎ ች by self or collected from out growers scheme shall be
exported within in determined period of time,
ቡና ቆ ል ቶ ወይ ም ቆ ል ቶ ና ፈ ጭቶ ወደ ውጭ ሀ ገ ር በ መላ ክ ሥራ
ላ ይ የ ተ ሰ ማራ ማን ኛ ውም ሰ ው፡ -
1/ ከ ሚመለ ከ ተ ው የ መን ግ ስ ት አካል የ ተሰ ጠ የፀና የ ብቃት 9. Obligation of Coffee Suppliers
ማረ ጋ ገ ጫ እ ና ን ግ ድ ፈ ቃድ የ መያ ዝ ፤ Any coffee supplier shall:
2/ ለ ግ ብዓ ት ነ ት የ ሚጠቀ መው ቡና ከ ራ ሱ ማሳ ያ መረ ተ ውን ወይ ም 1/ purchase, process, transport and keep the natural state and
ከ ኢት ዮ ጵ ያ ምር ት ገ በያ ወይ ም በ ቀ ጥ ታ ከ አ ቅ ራ ቢ ወይ ም origin of red cherry coffee or coffee with pulp only in the
ከ አ ምራ ች የ መግ ዛ ት ፣ area designated and shall not mix it with coffee of other
agro ecologies;
3/ ለ ውጭ ገ በ ያ ቆ ልቶ ከ ሚያ ዘ ጋ ጀ ው ቡና የ ግ ብዓ ት ና ውጤት
ምጣኔ እ ን ደ ተ ጠበ ቀ ሆኖ በ ጥ ሬ ውና ከ ተቆ ላ በ ኋላ የ ሚወጣ
2/ within 8 hours, process red cherry coffee into washed
ተ ረ ፈ ምር ት ቡና ቆ ል ቶ ወይ ም ቆ ል ቶ ፈ ጭቶ ለ ሀ ገ ር ውስ ጥ
parchment coffee, semi-washed coffee, or sun dried coffee
ቸ ር ቻሪ ዎ ች ወይ ም የ ተፈ ላ ቡና አ ዘ ጋ ጅተ ው ለ ሚሸ ጡ
in accordance with the technical process required by the
አ ገ ል ግ ሎት ሰ ጪዎ ች የ ማቅ ረ ብ፣
Authority;
4/ በ ባ ለ ሥል ጣኑ ካ ስ መዘ ገ በ ው የ ቅ ይ ጥ ቡና ዝ ግ ጅት ና የ ን ግ ድ
ስ ያ ሜ መብት ውጭ አ ን ዱን ዓ ይ ነ ት ቡና ከ ሌላ ዓ ይ ነ ት ጋ ር 3/ deliver processed supply coffee to the Ethiopia Commodity

ሳ ይቀ ይጥ ወይ ም ሳ ይ ደ ባ ል ቅ ቡና ው የ ተ መረ ተ በ ት አካባቢ Exchange or other alternative transaction center for sale or
ባ ህ ሪ ና ስ ያ ሜ ጠብቆ ለ ውጭ ገ በ ያ የ ማቅ ረ ብ፣ export before the next harvest;
5/ ተ ቆ ል ቶ ና ተ ፈ ጭቶ የ ተ ሸ ጠ ቡና ውል በ ፳ ፬ ሰ ዓ ት ውስ ጥ
ለ ብሔራ ዊ ባንክ የ ማስ መዝ ገ ብ እ ን ዲሁም ለ ባ ለ ስ ል ጣኑ 4/ ensure that the supply coffee submitted to coffee quality
በ ሦስ ት የ ሥራ ቀ ና ት ውስ ጥ የ ማሳ ወቅ ፣ inspection and grading center or sold directly to the exporter
6/ አ ስ ገ ዳ ጅ ሁኔ ታ መፈ ጠሩ በ ባ ለ ሥል ጣኑ ተ ረ ጋ ግ ጦ ካ ል ተ ፈ ቀ ደ or exported directly by himself, complies with quality
በ ስ ተቀ ር ወደ ውጭ የ ሚላ ከ ው የ ተ ቆ ላ ወይ ም ተቆ ልቶ standards and has a moisture amount or content to be
የ ተ ፈ ጨ ቡና በ ሀ ገ ር ውስ ጥ ገ በ ያ አ ለ መሸ ጥ ፣ determined in-accordance with a regulation to be issued
7/ ተ ቆ ል ቶ ወይ ም ተ ፈ ጭቶ ወደ ውጭ የ ሚላ ከ ው ቡና እ ሽ ግ ላ ይ following this proclamation.
የ ተ መረ ተ በ ት ሀገ ር፣ የ ጥራት ደረ ጃ፣ ይዘ ት፣
የ ተ መረ ተ በ ት ና የ መጠቀ ሚያ ጊ ዜ፣ የ ቡና ው ዓ ይ ነ ት እና
የ ን ግ ድ ስ ያ ሜ የ መገ ለ ፅ ፣
5/ sell in the Ethiopia commodity exchange ,if it is export
8/ ወደ ውጭ የ ሚላ ከ ው የ ተ ቆ ላ ወይ ም ተ ቆ ል ቶ የ ተ ፈ ጨ ቡና
coffee graded by the coffee quality liquoring and inspection
እና ማሸ ጊ ያ ው በ ሀ ገ ሪ ቱ የ ጥራት ደረ ጃ መስ ፈ ር ት እና
centers;
በ ቡና ገ ዥ ኩባ ኒ ያ ፍ ላ ጎ ት መሠረ ት የ ማዘ ጋ ጀ ት ፣
9/ አ ሳ ማኝ ና በቂ ምክ ን ያ ት መኖ ሩ በ ባ ለ ሥል ጣኑ ተረ ጋ ግ ጦ 6/ hand over to the buyer ,if it is sold in other alternative

በ ኢት ዮ ጵ ያ ብሔራ ዊ ባንክ መራ ዘ ሙ እ ን ደ ተ ጠበ ቀ ሆኖ transaction;
ከ ገ ዢዎ ች ጋ ር የ ገ ባ ውን የ ውል ግ ዴታ የ መፈ ጸ ም፣
7/ store in licensed commercial warehouses not involved in the
፲ / የ ቡና ግ ዢ፣ ዝ ግ ጅት ና ሽ ያ ጭ መረ ጃ መዝ ግ ቦ የ መያ ዝ ና coffee trading business in case he wants to wait for better
በ ባ ለ ሥል ጣኑ ና በ ሌሎች የ ሚመለ ከ ታቸ ው አካላት ሲጠየ ቅ price;
የ ማቅ ረ ብ፣ እ ና
፲ ፩ / ይ ህ ን ን አ ዋ ጅ ተ ከ ት ሎ በ ሚወጣው ደ ን ብ መሠረ ት ጥ ሬ ቡና 8/ hold certificate of competence showing his readiness from
ከ ውጭ ሀ ገ ር የ ማስ ገ ባ ት the relevant regional organs, before the beginning of the
ግ ዴታዎ ች አ ሉበ ት ፡ ፡ new transaction year.
፲ ፬ . የ ሀ ገ ር ውስ ጥ ቡና ቆ ዪ ግ ዴታዎ ች
የ ሀገ ር ውስ ጥ ቡና ቆ ል ቶ በ መሸ ጥ ላ ይ የ ተ ሰ ማራ ማን ኛ ውም 10. Obligations of Coffee Exporters
ሰ ው፡ - Any coffee exporter shall:

1/ ከ ሚመለ ከ ተ ው የ መን ግ ስ ት አካል የ ተሰ ጠ የ ፀ ና የ ብቃት 1/ hold valid competence certificate and trade license from
ማረ ጋ ገ ጫ እ ና ን ግ ድ ፈ ቃድ የ መያ ዝ ፤ appropriate government organ;
2/ ለ ሀ ገ ር ውስ ጥ ገ በ ያ የ ተ ፈ ቀ ደ ውን ቡና ከ ኢት ዮ ጵ ያ ምር ት 2/ process export coffee in accordance with the country’s
ገ በያ ገ ዝ ቶ ቆ ል ቶ ወይ ም ቆ ል ቶ ና ፈ ጭቶ ለ ሀ ገ ር ውስ ጥ quality standard, for export;
ገ በ ያ ብቻ የ ማቅ ረ ብ፣
3/ maintain the name ,characteristics and place of origin of
3/ ከ ኢት ዮ ጵ ያ ምር ት ገ በ ያ የ ገ ዛ ውን የ ሀ ገ ር ውስ ጥ ፍ ጆ ታ export coffee, except in cases of mixing processes, registered

በ ላ ይ አ ለ ማከ ማቸ ት ፣ working days;
5/ ተ ቆ ል ቶ ወ ይ ም ተ ቆ ል ቶ ና ተ ፈ ጭቶ ለሀገ ር ውስ ጥ ፍ ጆታ
የ ተዘ ጋ ጀ ቡና እሽግ ላይ ያ መረ ተ ው ድር ጅት ፣ የ ጥራት 5/ export before the next harvest, coffee collected from any
ደረ ጃ፣ ይዘ ት፣ የ ተ መረ ተ በ ት ና የ መጠቀ ሚያ ጊ ዜ ፣ የ ቡና ው alternative transactions or his own farm or if it is co-
ዓ ይ ነ ት እ ና የ ን ግ ድ ስ ያ ሜ የ መገ ለ ፅ ፣ operative association collected from the members farm,
6/ ከ ሚመለ ከ ተ ው የ መን ግ ስ ት አ ካ ል የ ብቃት ማረ ጋ ገ ጫ የ ማግ ኘ ት without wastages and keeping quality;
እ ና በ ጊ ዜ ው የ ማሳ ደ ስ ፣
7/ ለ ሀ ገ ር ውስ ጥ ፍ ጆ ታ የ ተ ቆ ላ ወይ ም ተ ቆ ል ቶ የ ተ ፈ ጨ ቡና
እ ና ማሸ ጊ ያ ው በ ሀ ገ ሪ ቱ የ ጥ ራ ት ደ ረ ጃ መስ ፈ ር ት መሠረ ት
6/ sell coffee by product leftover from export coffee in the
የ ማዘ ጋ ጀ ት ፣
auction centers or in the Ethiopia Commodity Exchange;
8/ የ ቡና ግ ዢ፣ ዝ ግ ጅት ና ሽ ያ ጭ መረ ጃ መዝ ግ ቦ የ መያ ዝ ና
በ ባ ለ ስ ል ጣኑ ና በ ሌሎች የ ሚመለ ከ ታቸ ው አ ካ ላ ት ሲጠየ ቅ 7/ without prejudice to the extension of a contract permitted by
የ ማቅ ረ ብ፣ the National Bank of Ethiopia upon showing of sufficient
ግ ዴታዎ ች አ ሉበ ት ፡ ፡ reasons, perform the contract on the due date;
8/ not submit export coffee graded by the coffee quality

inspection and grading center, for domestic sale in the
፲ ፭ . ቡና በ ምግ ብነ ት ወይ ም በ መጠጥነ ት አ ዘ ጋ ጅቶ የ መሸ ጥ
Ethiopian Commodity Exchange or in other alternative

የ መያ ዝ እ ና በ ጊ ዜ የ ማሳ ደ ስ ፣
Any domestic consumption coffee wholesaler shall:
2/ በ ባ ለ ስ ል ጣኑ በ ል ዩ ሁኔ ታ ካ ል ተ ፈ ቀ ደ በ ስ ተቀ ር ሕጋ ዊ ]
[
1/ hold valid competence certificate and trade license from

ከ ሆነ ከሀገ ር ውስ ጥ ፍ ጆ ታ ቡና ጅምላ ነ ጋ ዴ ወይ ም
appropriate government organ;
ቸ ር ቻሪ ወይ ም ቆ ል ቶ ወይ ም ቆ ል ቶ ና ፈ ጭቶ አ ከ ፋ ፋ ይ ብቻ
የ መግ ዛ ት ፣ 2/ only purchase domestic consumption coffee from the
Ethiopia Commodity Exchange;
3/ በ ባ ለ ሥል ጣኑ በ ል ዩ ሁኔ ታ ካ ል ተ ፈ ቀ ደ በ ስ ተቀ ር የ ውጪ
ገ በ ያ ቡና አ ለ መግ ዛ ት ወይ ም አ ለ ማጓ ጓ ዝ ወይ ም አ ለ መያ ዝ 3/ not purchase, sell or transport export coffee;
ወይ ም አ ለ መጠቀ ም፣
4/ only sell domestic consumption coffee in the region or
4/ የ ቡና ግ ዢ፣ ዝ ግ ጅት ና ሽ ያ ጭ መረ ጃ መዝ ግ ቦ የ መያ ዝ ና
zone or city where he is licensed for wholesaling;
በ ባ ለ ስ ል ጣኑ ወይ ም በ ሌሎች የ ሚመለ ከ ታቸ ው አካላት
ሲጠየ ቅ የ ማቅ ረ ብ፣
5/ transport and sell domestic consumption coffee purchased
ግ ዴታዎ ች አ ሉበ ት ፡ ፡
from the Ethiopia Commodity Exchange to the domestic
፲ ፮ . የ ቡና ማዘ ጋ ጃ ና ማከ ማቻ አ ገ ል ግ ሎት ሰ ጪ ግ ዴታዎ ች
consumers region or zone or city, cause the coffee to be
በ ቡና ማዘ ጋ ጃ ና ማከ ማቻ አ ገ ል ግ ሎት በ መስ ጠት ሥራ ላይ sealed , obtain a letter of release , show on demand, obtain
የ ተ ሰ ማራ አ ገ ል ግ ሎት ሰ ጪ፡ - assurance from the relevant organ and provide it to the
1/ የ ሚመለ ከ ተ ው አ ካ ል ያ ወጣውን መስ ፈ ር ት በ ማሟላ ት የ ብቃት Authority that the coffee has reached sealed;
ማረ ጋ ገ ጫ መያ ዝ ና በ ጊ ዜ የ ማሳ ደ ስ ፣
2/ የ ተ ረ ከ በ ውን ቡና በ ሀ ገ ሪ ቱ የ ጥራ ት ደ ረ ጃ መስ ፈ ር ት ና በ ውሉ
6/ obtain certificate of competence showing his readiness
መሠረ ት አ ዘ ጋ ጅቶ ስ ለ ቡና ው ዓ ይ ነ ት ፣ መጠን ና ጥ ራ ት ደ ረ ጃ ው
from the relevant regional organs, before the beginning of
ከ ሚገ ል ጽ ማስ ረ ጃ ጋ ር የ ማስ ረ ከ ብ፣
the new transaction year.
3/ ለ ማከ ማቸ ት የ ተ ረ ከ በ ውን ቡና በገ ባው የ ውል ስ ምምነ ት
መሠረ ት በ አ ግ ባ ቡ የ ማከ ማቸ ት ፣
4/ በ ባ ለ ስ ል ጣኑ ወይ ም አ ግ ባ ብነ ት ባለው አካል ሕጋ ዊ ነ ቱ 12.Obligations of Domestic Consumption Coffee Retailers

ተ ረ ጋ ግ ጦ ያ ል ተ ሸ ኘ ቡና ያ ለ መረ ከ ብ እ ና ያ ለ ማዘ ጋ ጀ ት ፣
Any domestic consumption coffee wholesaler shall:
5/ ቡና በ መፈ ል ፈ ል ፣ በ ማበ ጠር ፣ ለ ውጪ ን ግ ድ በ ማዘ ጋ ጀ ት ፣
በ መቁ ላ ት ወይ ም ቆ ልቶ በ መፍ ጨት የ ተ ሰ ማራ ከ ሆነ
1/ hold valid competence certificate and trade license from
ከ ሚመለ ከ ተ ው የ አ ካ ባ ቢ ጥ በ ቃ መስ ሪ ያ ቤት ከ አ ካ ባ ቢ ብክ ለ ት
ነ ፃ ስ ለ መሆኑ የ ምስ ክ ር ወረ ቀ ት የ መያ ዝ ፣
2/ only purchase domestic consumption coffee from
domestic consumption wholesaler or domestic coffee
፲ ፯ .ቡና የ ማጓ ጓ ዝ አ ገ ል ግ ሎት ሰ ጪ ግ ዴታዎ ች
roaster;
ቡና የ ማጓ ጓ ዝ አ ገ ል ግ ሎት በ መስ ጠት ላ ይ የ ተ ሰ ማራ ማን ኛ ውም
3/ not purchase, or transport, or hold export coffee;
አሽከርካሪ ወይ ም የ ተሸ ከ ር ካ ሪ ባ ለ ቤት ወይ ም ወኪል
እ ን ደ አ ግ ባ ቡ፡ -
1/ ባ ለ ሥል ጣኑ ከ ሚመለ ከ ተ ው አ ካ ል ጋ ር በ መተ ባ በ ር በ ሚያ ወጣው
4/ only sell domestic consumption coffee in retail shop or
ደ ን ብና መመሪ ያ በ ተ መለ ከ ተ ው መስ ፈ ር ት መሠረ ት
place licensed for retail;
ስ ለ ተ ሸ ከ ር ካ ሪ ው የ ብቃት ማረ ጋ ገ ጫ የ መያ ዝ ና የ ማሳ ደ ስ ፣
2/ ቡና
‹‹ ጭኖ ሲጓ ዝ ብል ሽ ት ያ ጋ ጠመው ወይ ም ወን ጀ ል
የ ተ ፈ ጸ መበ ት እ ን ደ ሆነ በ አ ካ ባ ቢው ለ ሚገ ኝ ሥል ጣን ላለው 5/ maintain a register of coffee transaction and disclose on
አ ካ ል በ ዕ ለ ቱ የ ማመል ከ ት ና ማስ ረ ጃ የ ማቅ ረ ብ፣ demand.
3/ ቡና ው ከ መጫኑ በ ፊ ት ቡና ው በ ዚ ህ አ ዋ ጅ መሰ ረ ት ለ መጓ ጓ ዝ
የ ተ ዘ ጋ ጀ ና ሕጋ ዊ መሆኑ ን የ ማረ ጋ ገ ጥ ፣
13. Obligations of Export Coffee Roasters
4/ ከ ቦ ታ ቦታ እ ን ዲያ ጓ ጉ ዝ የ ተ ሰ ጠውን ቡና ፕ ሎምፕ ‹
Any person who engages in the roasting or roasting and grinding

ሳ ይ በ ጠስ ፣ ሸራ ሳ ይቀ ደ ድ ጥራቱ ን ጠብቆ ወደ
of export coffee shall have obligation to:
ተ ሸ ኘ በ ት አ ካ ባ ቢ በ ት ክ ክ ል የ ማድረ ስ ፣
5/ እ ን ዲያ ጓ ጉ ዝ ከ ተፈ ቀ ደ ለ ት ቡና ውጪ በ ማን ኛ ውም 1/ hold valid competence certificate and trade license from

የ ተሸ ከ ር ካ ሪ አካል ላይ ተ ጨማሪ ቡና ና ሌሎች የ ቡና ውን appropriate government organ;
ጥ ራ ት ሊያ ጓ ድሉ የ ሚች ሉ ነ ገ ሮ ች ያ ለ መያ ዝ ፣
2/ obtain his input coffee from his own farm or purchase from
6/ ተ ሸ ከ ር ካ ሪ ውን ለ ሌላ ወገ ን በ ኪራ ይ ውል ስ ምምነ ት ወይ ም
the Ethiopia Commodity Exchange or directly buy from
በ ሌላ አ ኳኃ ን ሲያ ስ ተ ላ ለ ፍ ተሽ ከ ር ካ ሪ ው በ ሕገ ወጥ supplier or producer;
ድር ጊ ት እ ን ዳ ይ ሰ ማራ የ መቆ ጣጠር ፣
3/ without prejudice to the input and output ratio of the processed

roasted export coffee, provide coffee byproduct leftover of
raw and roasted export coffee to the domestic roaster or
ክ ፍ ል አ ራት grinder retailers or service providers of hot coffee;
ል ዩ ል ዩ ድን ጋ ጌ ዎ ች
፲ ፰ . የ ባ ለ ሥል ጣኑ ሥል ጣን እ ና ተ ግ ባ ር
ባ ለ ሥል ጣኑ በ ሌሎች ሕጎ ች ና በ ዚ ህ አ ዋ ጅ የ ተ ሰ ጠው ሥል ጣን 4/ except in cases of mixed coffee processes and trade mark

እ ን ደ ተ ጠበ ቀ ሆኖ ፡ - registered by the permission of the Authority, export coffee
without mixing with different types of coffee by maintaining
1/ አ ግ ባ ብ ካ ላ ቸ ው የ ክ ል ል አ ካ ላ ት ጋ ር በ መተ ባ በ ር የ ቡና the nature and name production place or origin;
ግ ብይ ት ና ጥ ራ ት መከ ታተ ያ ና መቆ ጣጠሪ ያ ቦ ታዎ ች በ ጥ ና ት
የ መለ የ ት ፣ ተ ቆ ጣጣሪ በ መመደ ብ የ ማስ ተ ዳ ደ ር ወይ ም ውክ ል ና
የ መስ ጠት ፣
5/ register at the National Bank of Ethiopia within 24 hours and
to notify to the Authority within three working days, the
2/ በ ቡና ግ ብይ ት ለ ሚሳ ተ ፉ አካላት በ ደ ን ብና መመሪ ያ
conclusion of a contract of sale of roasted and ground coffee;
በ ሚወጡ መስ ፈ ር ቶ ች ላይ ተ መስ ር ቶ የ ብቃት ማረ ጋ ገ ጫ
የ ምስ ክ ር ወረ ቀ ት የ መስ ጠት ፣ የ መከ ታተ ል ና የ መቆ ጣጠር ፣
3/ ማን ኛ ውም ለ ውጭ ገ በ ያ የ ተ ዘ ጋ ጀ ቡና የ ጥራ ት ምር መራ ፣ 6/ not to sell the export roasted or grinded coffee to the domestic

የ ሰ ር ተ ፊ ኬሽ ን ፣ የ ሽ ኝ ት አ ገ ል ግ ሎት እ ና የ ምር ት ሀ ገ ር market; unless it is permitted by the Authority on grounds of
ሰ ር ተ ፊ ኬት የ መስ ጠት ፣ force measure;
4/ ለ ና ሙና ወይ ም ለ ን ግ ድ ት ር ኢት ጉ ዳ ዮ ች ቡና ወደ ውጭ
ሀ ገ ር እ ን ዲላ ክ የ መፍ ቀ ድ፣
7/ label on the packaging of the processed export roasted and
ground coffee the name of country of production, quality
5/ ይ ህ ን አ ዋጅ ወይ ም አ ዋ ጁን ለ ማስ ፈ ጸ ም የ ሚወጡ
level, content, production and expiring date, type of coffee and
ደ ን ቦ ችን ና መመሪ ያ ዎ ች መከ በ ራ ቸ ውን ለ ማረ ጋ ገ ጥ
the trade mark;
ከ ሚመለ ከ ታቸ ው የ ፍ ት ህ ና ፀ ጥ ታ አ ካ ላ ት ጋ ር በ መተ ባ በ ር
ሕገ -ወጥ ቡና ሊገ ኝ በ ት ይችላ ል ተ ብሎ በ በ ቂ ሁኔ ታ 8/ prepare the packaging and the export roasted or roasted and
በ ባ ለ ሥል ጣኑ ወይ ም አ ግባ ብ ያለው የ ክ ልል አካል grinded coffee by maintaining appropriate quality standards of
ሲጠረ ጠር ማን ኛ ወን ም ቦ ታና ተሸ ከ ር ካ ሪ በ ፍር ድ ቤት the country and needs of the buyer company;
ትዕ ዛ ዝ ወይ ም አ ስ ቸ ኳይ ሁኔ ታ ሲኖ ር ያ ለ ፍ ር ድ ቤት
ትዕ ዛ ዝ በ ወን ጀ ለ ኛ መቅ ጫ ሥነ -ሥር ዓ ት ሕጉ መሠረ ት 9/ without prejudice to the extension of a contract by the
የ መፈ ተ ሽ ፣ የ ማሸ ግ ፣ የ ማገ ድ፣ የ መያ ዝ ፣ ተ ጣር ቶ ሕገ - National Bank of Ethiopia upon permission by the Authority
ወጥ ሆኖ ሲገ ኝ የ ቡና ው ባ ለ ቤት ለ ፍ ር ድ ቤት ቅ ሬ ታውን based on sufficient grounds, perform the contract he concludes
የ ማቅ ረ ብ መብቱ እ ን ደ ተ ጠበ ቀ ሆኖ የ መውረ ስ ና የ መሸ ጥ with the buyers on the due date;
ውሳ ኔ የ መስ ጠት ፣ 10/ maintain a register of purchase of coffee, process and sell and
provide them when requested by the Authority and other
6/ በ ዚ ህ አ ን ቀጽ ን ኡስ አ ን ቀጽ ( 5) የ ተገ ለ ፀ ው
relevant organs.
እ ን ደ ተ ጠበ ቀ ሆኖ ባ ለ ስ ል ጣኑ ወይ ም አ ግባ ብ ያለው
የ ክ ል ል አ ካ ል በ ማን ኛ ውም ሁኔ ታ በ ጥ ር ጣሬ በ ተ ያ ዘ ቡና 11/ import raw coffee from abroad in-accordance with a
ከ መል ቀ ቁ ወይ ም ከ መወረ ሱ በ ፊ ት አ ጣር ቶ የ መጨረ ሻ ውሳ ኔ regulation to be issued following this Proclamation.

14. Obligations of Domestic Consumption Coffee Roasters
የ ሚያ ዛ ባ ድር ጊ ት መፈ ፀ ሙ ወይ ም የ ብቃት ጉ ድለ ት
Any person who engages in domestic roasting and grinding of
ስ ለ መከ ሰ ቱ ሲረ ጋ ገ ጥ በ ሚወጣው ደ ን ብና መመሪ ያ መሠረ ት
coffee for selling shall have the obligation to:
የ ብቃት ማረ ጋ ገ ጫ በ ማገ ድ ወይ ም በ መሰ ረ ዝ አ ገ ል ግ ሎት
እ ን ዳ ያ ገ ኝ ለ ሚመለ ከ ታቸ ው አ ካ ላ ት የ ማሳ ወቅ ፣ 1/ hold valid competence certificate and trade license from
8/ የ ቡና ሕገ -ወጥ ግ ብይ ት ፣ ዝ ውውር ና ክ ምች ት ለ ሚጠቁ ሙ
እና ለ ሚይ ዙ አካላት የ ኮ ሚሽ ን አበል ክ ፍያ መጠን ና 2/ purchase coffee permitted for domestic consumption from the
አ ፈ ፃ ፀ ም በ ደ ን ብ የ ማስ ወሰ ን ና የ ማስ ፈ ጸ ም፣ Ethiopia Commodity Exchange and roast or, roast and grind

and supply only for domestic market;
ሥል ጣን ይ ኖ ረ ዋ ል ፡ ፡
3/ purchase coffee permitted for domestic consumption from the
፲ ፱ .ስ ለ ተ ከ ለ ከ ሉ ተ ግ ባ ራት ና ቅ ጣቶ ች
Ethiopia Commodity Exchange and roast or, roast and grind
1/ ማን ኛ ውም ቡና አ ዘ ጋ ጅ ቡና ሲያ ዘ ጋ ጅ በ ባ ለ ሥል ጣኑ ወይ ም
and wholesale on the current domestic market price;
በ ክ ል ል አ ግ ባ ብ ያ ለ ው አ ካ ል ከ ተ ፈ ቀ ደ የ ቴ ክ ኒ ክ አ ሠራ ር
ውጭ በ ማዘ ጋ ጀ ት በ ቡና ው ጥ ራ ት ላይ እና በ አ ካ ባ ቢው
4/ not store the roasted or, roasted and grinded coffee more than
ማህ በ ረ ሰ ብ ላይ ጉዳት ያ ደረሰ እ ን ደ ሆነ ፣ ማዘ ጋ ጃ
its consumption period;
ኢን ዱስ ት ሪ ው መታሸ ጉ ና ምር ቱ ለ ግ ብይ ት እ ን ዳ ይቀ ር ብ
መደ ረ ጉ እ ን ደ ተ ጠበ ቀ ሆኖ ፣ ከአን ድ ዓ መት በ ማያ ን ስ ና 5/ label on the packaging of the processed domestic consumption
ከ ሦስ ት ዓ መት በ ማይ በ ል ጥ እ ስ ራ ት እ ና ከ ብር ፳ ሺ እ ስ ከ roasted and ground coffee the name of enterprise produced,
፵ ሺ ( ከ ብር አስር ሺ እስከ አርባ ሺ)በ ሚደ ር ስ መቀ ጮ quality level, content, production and expiring date, type of
ይ ቀ ጣል ፡ ፡ coffee and its trade mark;
2/ ማን ኛ ውም በ ቡና ግ ብይ ት የ ተ ሰ ማራ ሰ ው ከ ኢት ዮ ጵ ያ ምር ት
ገ በያ ወይ ም ባ ለ ሥል ጣኑ ከ ሚወስ ና ቸ ው ሌሎች የ ግ ብይ ት
6/ obtain certificate of competence from the appropriate
አ ማራ ጮች ና ስ ፍ ራዎ ች ውጪ ሲሸ ጥ ም ሆነ ሲገ ዛ የ ተገ ኘ
government organ and renew it on time;
እ ን ደ ሆነ ፣ ቡና ው መወረ ሱ እ ን ደ ተ ጠበ ቀ ሆኖ ከ አ ን ድ ዓ መት
በ ማያ ን ስ ና ከ ሦስ ት ዓ መት በ ማይ በ ል ጥ እ ስ ራ ት እ ና ከ ብር 7/ prepare the packaging and the export roasted or, roasted and

የ ተገ ኘ እ ን ደ ሆነ ፣ ቡና ው መወረ ሱ እ ን ደ ተ ጠበ ቀ ሆኖ ፣ relevant organs.

የ ሚመጥ ን ቡና ን በ ሀ ገ ር ውስ ጥ ገ በ ያ በ ጥ ሬ ውም ሆነ ቆ ልቶ
15.Obligations of Service Provider Engaged in Processing and
ወይ ም ቆ ል ቶ በ መፍ ጨት ያ ለ ባ ለ ሥል ጣኑ ልዩ ፈ ቃድ የ ሸ ጠ
Selling Coffee as a Food or Drink
እ ን ደ ሆነ ፣ ቡና ው መወረ ሱ እ ን ደ ተ ጠበ ቀ ሆኖ ፣ ከ ሦስ ት

ሰ ው ሆን ብሎ ወይ ም በ ቸልተ ኝ ነ ት አ ለ አ ግባ ብ ጥቅ ም 2/ buy the coffee only from domestic consumption coffee
ለ ማግ ኘ ት ወይ ም ለ ማስ ገ ኘ ት በ ቡና ጥ ራ ት ም ይ ሁን ግ ብይ ት wholesaler or retailer or distributer of roasted or, roasted

and grinded coffee; unless permitted in special condition by

the Authority;
ከ ብር ፷ ሺ እ ስ ከ ፻ ሺ (ከ ብር ስ ል ሳ ሺ እ ስ ከ መቶ ሺ)
3/ not to purchase or transport or hold or use export coffee;
በ ሚደ ር ስ መቀ ጮ ይ ቀ ጣል ፡ ፡
unless permitted by the Authority in special condition;
6/ ማን ኛ ውም ሰ ው ከ ባ ለ ሥል ጣኑ ወይ ም አ ግ ባ ብ ካ ለ ዉ የ ክ ል ል
አካል ከ ተፈ ቀ ደ ለ ት ቦታ ውጪ ቡና ን አ ከ ማች ቶ የ ተገ ኘ
እ ን ደ ሆነ ፣ የ ቡና ው መወረ ስ እ ን ደ ተ ጠበ ቀ ሆኖ ፣ ከሶስት 4/ maintain a register of purchase of coffee, process and sell
ዓ መት በ ማያ ን ስ ና ከ አ ምስ ት ዓ መት በ ማይ በ ል ጥ ጽ ኑ እ ስ ራ ት and provide them when requested by the Authority and

other relevant organs.

7/ ማን ኛ ውም ሰ ው ከ ባ ለ ሥል ጣኑ ወይ ም አ ግ ባ ብ ካ ለ ዉ የ ክ ል ል
16. Obligations of Coffee Processing and Warehousing Service
አካል ከ ተፈ ቀ ደ ለ ት አ ድራ ሻ ና የ ጉዞ መስ መር ውጪ ቡና
Providers
ሲያ ጓ ጉ ዝ የ ተ ገ ኘ እ ን ደ ሆነ ፣ ቡና ውና ተ ሽ ከ ር ካ ሪ ው መወረ ሱ
እ ን ደ ተ ጠበ ቀ ሆኖ ፣ ከሶስት ዓ መት በ ማያ ን ስ ና ከ አ ምስ ት Any service provider who engages in coffee processing and
ዓ መት በ ማይ በ ል ጥ ጽ ኑ እ ስ ራ ት እ ና ከ ብር ፷ ሺ እ ስ ከ ፻ ሺ warehousing shall obligations to:
( ከ ብር ስ ልሳ ሺ እስከ መቶ ሺ) በ ሚደ ር ስ መቀ ጮ 1/ have certificate of competence upon fulfilling requirements
ይ ቀ ጣል ፡ ፡ issued by relevant organ and renew on time;
8/ ማን ኛ ውም ቡና ከ ቦ ታ ቦ ታ ለ ማጓ ጓ ዝ የ ተ ረ ከ በ አ ሽ ከ ር ካ ሪ 2/ properly process the coffee received in accordance with the
የ ቡና ው ፕ ሎምፕ ተ በ ጥ ሶ ወይ ም ሸ ራ ተ ቀ ዶ ጥ ራ ቱ ና ዓ ይ ነ ቱ quality standards of the country and as per the terms of the
ተ ቀ ይ ሮ ወይ ም መጠኑ ተ ጨምሮ ወይ ም ተ ቀ ን ሶ ወደ ተ ሸ ኘ በ ት contact entered and deliver same to the owner with evidence
አካባቢ እ ን ድጓ ጓ ዝ ያ ደረ ገ እ ን ደ ሆነ ከሶስት ዓ መት of appropriate type, quantity, quality and grade of the coffee;
በ ማያ ን ስ ና ከ አ ምስ ት ዓ መት በ ማይ በ ል ጥ ጽ ኑ እ ስ ራት እ ና 3/ store coffee received for storage in accordance with the
ከ ብር ፷ ሺ እ ስ ከ ፻ ሺ (ከ ብር ስ ል ሳ ሺ እ ስ ከ መቶ ሺ) contract entered into;
በ ሚደ ር ስ መቀ ጮ ይ ቀ ጣል ፡ ፡ 4/ ensure the legality of the coffee received for processing and
9/ ማን ኛ ውም አ ሽ ከ ር ካ ሪ እ ን ዲጭን ከ ተፈ ቀ ደ ለ ት ቡና ውጪ not to receive and process coffee released without
በ የ ት ኛ ውም የ ተ ሸ ከ ር ካ ሪ ው አ ካ ል ላ ይ ተ ጨማሪ ቡና ወይ ም recognition of the Authority or relevant organ;

ወይ ም ምር ት መወረ ሱ እ ን ደ ተ ጠበ ቀ ሆኖ ከ ስ ድስ ት ወር
from appropriate environmental pollution control office if it
በ ማያ ን ስ ና ከ ሶ ስ ት ዓ መት በ ማይ በ ል ጥ እ ስ ራ ት እ ና ከ ብር
is engaged in coffee pulping, cleaning and sorting, export
፲ሺ እስከ ፵ሺ ( ከ ብር አስር ሺ እስከ ሰላሳ ሺ)
coffee processing, roasting or roasting and grinding.
፲/ ማን ኛ ውም ሰው ሕገ ወጥ ቡና በ መሸ ጥ ፣ በ መግ ዛ ት ፣
በ ማከ ማቸ ት ና ማዘ ጋ ጀ ት ፣ በ መቁ ላ ት ና በ መፍ ጨት ፣ በ ማጓ ጓ ዝ
17. Obligations of Coffee Transport Service Providers
ቡና እ ን ዲሠወር ወይ ም እ ን ዲበ ላ ሽ ያ ደ ረ ገ ወይ ም የ ተ ባ በ ረ
እ ን ደ ሆነ ከአን ድ ዓ መት በ ማያ ን ስ ና ከ ሦስ ት ዓ መት Any owner of a vehicle or driver or agent engages in coffee
በ ማይ በ ል ጥ እ ስ ራት እ ና ከ ብር ፳ ሺእ ስ ከ ፵ ሺ ( ከ ብር transport service shall, as appropriate, have obligations to:
አ ስ ር ሺ እ ስ ከ አ ር ባ ሺ) በ ሚደ ር ስ መቀ ጮ ይ ቀ ጣል ፡ ፡
1/ have certificate of competence for the vehicle pursuant to the

requirements provided in regulation and directives issued by
፲ ፩ / የ ታጠበ ቡና ማዘ ጋ ጃ ኢን ዱስ ት ሪ ዎ ች ባ ሉባ ቸ ዉ
the Authority in collaboration with relevant organ and renew
አ ካ ባ ቢዎ ች በ ባ ለ ሥል ጣኑ ወይ ም አ ግባ ብ ባለዉ የ ክ ልል
on time;
አ ካ ል ሳ ይ ፈ ቀ ድ ቀ ይ እ ሸ ት ቡና ን ለ ጀ ን ፈ ል ቡና ዝ ግ ጅት
የ መግ ዛ ት ና የ ማበ ጠር አ ገ ል ግ ሎት የ ሰጠ ማን ኛ ውም ሰው 2/ on that day report to a lawful organ of the locality and
ከአን ድ ዓ መት በ ማያ ን ስ ና ከ ሦስ ት ዓ መት በ ማይ በ ል ጥ produce evidence if a vehicle sustained malfunctions or

ለ ባ ለ ስ ል ጣኑ ወይ ም አ ግ ባ ብ ላ ለ ው ክ ል ል አካል አ ቅር ቦ 4/ transport the coffee he received from its place of
ሳ ያ ስ ፈ ቅ ድ በ ውክ ል ና ያ ሰ ራ እ ን ደ ሆነ ፣ የ ብቃት ማረ ጋ ገ ጫ consignment to its destination without breaking the seal and

5/ not to hold on the parts of the vehicle additional coffee or
ከ ብር ፳ ሺ እ ስ ከ ፵ ሺ (ከ ብር አ ስ ር ሺ እ ስ ከ አ ር ባ ሺ)
other substance that may affect the quality of coffee, other
than those permitted to transport;
፲ ፫ / ማን ኛ ውም ሰ ዉ በ ውጪ ን ግ ድ ቡና ግ ብይ ት ና ዝ ግ ጅት ላ ይ
በ ዉክ ል ና ለ መስ ራ ት የ ሚያ ስ ች ል ብቃት ያ ለ ው ስ ለ መሆኑ 6/ supervise the vehicle from illegal acts if transfer in contracts

MISCELLANEOUS PROVISIONS

ከ አ ምስ ት ዓ መት በ ማያ ን ስ ና ከ አ ስ ር ዓ መት በ ማይ በ ል ጥ ጽ ኑ 18. Power of the Authority
እ ስ ራ ት እ ና ከ ብር ፻ ሺ እ ስ ከ ፪ ፻ ሺ (ከ መቶ ሺ እ ስ ከ Without prejudice to the powers vested in it under other laws

ሁለ ት መቶ ሺ) በ ሚደ ር ስ መቀ ጮ ይ ቀ ጣል ፡ ፡ and the provisions of this Proclamation, the Authority shall have

22. የ ተ ሻ ሩ ና ተ ፈ ጻ ሚነ ት የ ማይ ኖ ራቸ ው ሕጎ ች the existence of illegal coffee with the view to ensure
compliance with this Proclamation or regulations and
፩ / የ ቡና ጥራት ቁ ጥጥር ግ ብይ ት አ ዋ ጅ ቁ ጥ ር ፮ ፻ ፪ /፪ ሺ
በ ዚ ህ አ ዋ ጅ ተ ሸ ሯል ፡ ፡ directives; and subject to the right of the owner of the coffee
፪/ የ ዚህ ን አ ዋ ጅ ድን ጋ ጌ ዎ ች የ ሚቃረ ን ማን ኛ ውም አ ዋ ጅ፣ to appeal to the court; confiscate and sale such coffee where
ደ ን ብ፣ መመሪ ያ ወይ ም የ አ ሰ ራ ር ል ምድ በ ዚ ህ አ ዋጅ such coffee is ascertained illegal;

23. የ መሸ ጋ ገ ሪ ያ ድን ጋ ጌ
1/ የ ዚ ህ አ ዋ ጅ አ ን ቀ ጽ ፳ 1 ን ዑስ አ ን ቀ ጽ (1) ድን ጋ ጌ

፳ 4. ደ ን ብና መመሪ ያ የ ማውጣት ሥል ጣን 7/ suspend or revoke certificate of competence of coffee

transaction actor, who is found distorting the transaction
1/ የ ሚኒ ስ ት ሮ ች ምክ ር ቤት ለ ዚህ አ ዋጅ አ ፈፃ ፀ ም
process or who lacks competence, pursuant to regulations and
የ ሚያ ስ ፈ ል ጉ ደ ን ቦ ች ን ሊያ ወጣ ይ ች ላ ል ፡ ፡
directives issued to prevent him from receiving the service
2/ ባ ለ ሥል ጣኑ ለ ዚ ህ አ ዋ ጅና በ ዚ ህ አ ን ቀ ጽ ን ዑስ አ ን ቀ ጽ

19. Prohibitions and Penalties
የ ኢት ዮ ጵ ያ ምር ት ገ በ ያ ቦ ር ድ እ ና የ ኢት ዮ ጵ ያ ምር ት
ገ በ ያ ባ ለ ሥል ጣን ሊያ ወጡ ይ ች ላ ሉ፡ ፡ 1/ Any coffee processor who fails to comply with technical
procedure provided by the Authority or an appropriate
regional body and thereby causes damage to the quality of the
coffee or to the local community shall, without prejudice to
the closure of his processing plant and prohibition of his
product not to be supplied for transaction, be punished with
rigorous imprisonment not less than one year and not
exceeding three years and a fine from Birr 20,000 to Birr

the Ethiopia Commodity Exchange or other optional

ዶ/ር ሙላ ቱ ተ ሾ መ exceeding three years and a fine from Birr 20,000 to Birr
40,000.

ፐብሊክ ፕሬ ዝ ዳ ን ት
3/ Any person who is engaged in coffee transaction and stores
coffee out of the specified time and place without prejudice
regulation, to the confiscation of his coffee, be punished with
exceeding three years and a fine from Birr 20,000 to 40,000.
4/ Any person who sells coffee or processed roasted and grinded

coffee of an export standard in the domestic market without
special permit of the Authority shall, without prejudice to the
confiscation of the coffee, be punished with rigorous
imprisonment not less than three years and not exceeding five
years and a fine from Birr 60,000 to 100,000.
5/ Any person who commits deceiving act in relation to coffee

quality or marketing directly or indirectly, intentional or by
negligence to procure to himself or to another person illegal
benefit shall be punished with rigorous imprisonment not less
than three years and not exceeding five years and a fine from
Birr 60,000 to Birr 100,000.
6/ Any person, who stores coffee in places other than those

allowed by the Authority or an appropriate regional body
shall, without prejudice to confiscation of the coffee, be
punished with rigorous imprisonment not less than three years
and not exceeding five years and a fine from Birr 60,000 to
Birr 100,000.
7/ Any person who transports coffee other than the rout line
leads to destination and permitted by the Authority or an
appropriate regional body shall, in addition to confiscation of
the coffee and the vehicle, be punished with rigorous
8/ Any transporter who received coffee to transport and breaks

the seal or tears the canvas or change the quality and types of
coffee or reduce its amount shall be punished with rigorous
9/ Any driver who loads, on the parts of the vehicle, additional

coffee or any other product or mixes coffee with other
commodity shall, without prejudice to confiscation of the
additional coffee and other product or commodity, be
punished with simple imprisonment not less than six months
and not exceeding three years and a fine from Birr 10,000 to
40,000.
10/ Any person who is engaged in coffee transaction or directly or

indirectly connected to coffee transaction is sells, buys, stores
and process, roast and grind, transport illegal coffee or

cooperate with and thereby hides or damages coffee shall be
punished with rigorous imprisonment not less than one year
not exceeding three years and a fine from Birr 20,000 to
40,000.
11/ Any person who engages in buying of red cherry coffee with
pulp for cleaning and sorting, without permission of the
Authority or an appropriate regional body, in the places where
washing coffee processing industries are found shall be
punished with rigorous imprisonment not less than one year
and not exceeding three years and a fine from Birr 20,000 to
40,000.
12/ Any coffee transaction actor who has been issued with
certificate of competence, if assigns an agent to act on his
behalf by claiming force majeure, without approval of the
Authority or an appropriate regional body shall, without
prejudice to the revocation of his certificate of competence,
shall be punished with rigorous imprisonment not less than
one year and not exceeding three years and a fine from Birr
20,000 to 40,000.
13/ Any person who acts as agent and engages in transaction

activity without obtaining certificate of competence to engage
as agent from the Authority or an appropriate regional body
shall be punished with rigorous imprisonment not less than
one year and not exceeding three years and a fine from Birr
20,000 to 40,000.
14/ Any transporter who diverts coffee legally release not to reach
its destination of processing industries, or to the Ethiopia

Commodity Exchange warehouse or to port or reduces or add
its volume or type or quality shall be punished with rigorous
imprisonment not less than five years and not exceeding ten
and a fine from Birr 100,000 to 200,000 .
15/ Any person who is engaged in the coffee trading business or

directly or indirectly connected to the coffee trading business
if uses the confidential information he obtained due to his
official or employee position that may distort coffee
transaction or quality, to procure illegal benefit for himself or
to other person, shall be punished with rigorous imprisonment
not less than one year and not exceeding five years and a fine
from Birr 20,000 to 40,000.
20. Punishment Applicable to Legal Persons
A legal person which participates in the commission of criminal

offence stipulated under Article 19 of this Proclamation, as
provided in Article 34 of the Criminal Code, shall be punishable
in accordance with Article 90 of the Criminal Code.
21. Jurisdiction
1/ The Federal First Instance Court shall have jurisdiction on

criminal matters provided under article 19 and 20 of this
proclamation.
2/ The Federal First Instance Court shall have jurisdiction on

coffee civil matters.
22. Repealed and Inapplicable Laws
1/ The Coffee Quality Control and Marketing Proclamation

No. 602/2008 is hereby repealed.
2/ No proclamation, regulation, directive or customary

practices shall, in so far as they are inconsistent with the
provisions of this Proclamation, have effect on matters
provided under this Proclamation.
23. Transitory Provisions
1/ Notwithstanding sub-article (1) of Article 21 of this

Proclamation, pending cases shall be finalized pursuant to the
provisions of the previous Proclamation.
2/ Any certificate of competency issued before the coming into
force of this Proclamation shall be deemed to have been issued
as per this Proclamation, until replaced by a new certificate of
competency issued by the competent authority in accordance
with the provisions of this Proclamation.
24. Power to Issue Regulations and Directives
1/ The Council of Ministers may issue regulation necessary for

the implementation of this Proclamation.
2/ The Authority may issue directives necessary for the

implementation of this Proclamation and regulations issue
pursuant to sub-article (1) of this Article.
3/ The Regional States may issue laws necessary for the

implementation of this Proclamation.
4/ The Ethiopia commodity Exchange and Ethiopia

Commodity Exchange Authority may issue directives
necessary for the implementation of this Proclamation and
regulations issued pursuant to sub-article (1) of this Article
with respect to coffee trading on the Ethiopia Commodity
Exchange.
25. Effective Date
This Proclamation shall enter into force up on the date of

publication in the Federal Negarit Gazette.

የ ምስ ክ ር ወረ ቀ ት የ ማግ ኘ ት ፤ wholesaler or between a domestic coffee roasters in

4/ የ አ ቅ ር ቦ ት ወይ ም የ ውጪ ቡና ከ መጫኑ በ ፊ ት አ ሽ ከ ር ካ ሪ ውና transaction centers;

ተ ሽ ከ ር ካ ሪ ውን የ ብቃት መስ ፈ ር ት አ ሟል ቶ መሰ ማራ ቱ ን 5/ supply coffee transaction in the Ethiopia Commodity

የ ሚውል ና ሙና እ ን ዲሰ ጥ ሲጠየ ቅ 9 : ;:

8/ ማን ኛ ውን ም የ አ ቅ ር ቦ ት ወይ ም የ ወጪ ገ በ ያ ቡና ከ ማጓ ጓ ዙ 7/ coffee sold in the Ethiopia Commodity Exchange or other

የ መያ ዝ ፤ for export preparation with the details of relevant

ለ ሚመለ ከ ተ ው ተ ቆ ጣጣሪ የ ማሳ ወቅ ፣ ወይ ም በአካል

ለ መጎ ብኘ ት ወይ ም ክ ምች ት ለ መቁ ጠር ሲፈ ለ ግ የ መተ ባ በ ር ፤ Ethiopian Commodity Exchange or store and with

፲ / የ አ ገ ሪ ቱን የ ቡና ጥራት መስ ፈ ር ት የ ማክ በ ር ና እና description of ownership;

ማን ኛ ውም የ ቡና አ ምራ ች ፡ - 10/ coffee for domestic consumption shall be traded for

6/ አ ስ ቀ ድሞ በ ሌላ አ ማራ ጭ የ ግ ብይ ት ት ስ ስ ር የ ተ ሸ ጠ ከ ሆነ industries which are allowed by the appropriate regional

7/ የ ተ ሻ ለ ዋ ጋ ለ መጠበ ቅ ያ ሰ በ እ ን ደ ሆነ በ ቡና ግ ብይ ት 2/ if supply coffee transaction takes place in other alternative

ባ ል ተ ሰ ማሩ ህጋዊ የ ማከ ማቻ አ ገ ል ግ ሎት የ መስ ጠት ፍ ቃድ transaction options outside Ethiopia Commodity Exchange,

ባ ላ ቸ ው ድር ጅቶ ች የ ማከ ማቸ ት ፣ the coffee type, quality standard, quantity, price and date

3/ የ ውጪ ገ በ ያ ቡና አ ለ መግ ዛ ት ወይ ም አ ለ ማጓ ጓ ዝ ወይ ም Any coffee Producer shall:

1/ ከ ሚመለ ከ ተ ው የ መን ግ ስ ት አካል የ ተሰ ጠ የ ፀ ና የ ብቃት

1/ ከ ሚመለ ከ ተ ው የ መን ግ ስ ት አካል የ ተሰ ጠ የፀና የ ብቃት 9. Obligation of Coffee Suppliers

ማረ ጋ ገ ጫ እ ና ን ግ ድ ፈ ቃድ የ መያ ዝ ፤ Any coffee supplier shall:

ሳ ይቀ ይጥ ወይ ም ሳ ይ ደ ባ ል ቅ ቡና ው የ ተ መረ ተ በ ት አካባቢ Exchange or other alternative transaction center for sale or

ባ ህ ሪ ና ስ ያ ሜ ጠብቆ ለ ውጭ ገ በ ያ የ ማቅ ረ ብ፣ export before the next harvest;

9/ አ ሳ ማኝ ና በቂ ምክ ን ያ ት መኖ ሩ በ ባ ለ ሥል ጣኑ ተረ ጋ ግ ጦ 6/ hand over to the buyer ,if it is sold in other alternative

ሰ ው፡ - Any coffee exporter shall:

8/ not submit export coffee graded by the coffee quality

1/ ከ ሚመለ ከ ታቸ ው የ መን ግ ስ ት አካል የ ብቃት ማረ ጋ ገ ጫ 11.Obligations of Domestic Consumption Coffee Wholesalers

1/ hold valid competence certificate and trade license from

4/ በ ባ ለ ስ ል ጣኑ ወይ ም አ ግ ባ ብነ ት ባለው አካል ሕጋ ዊ ነ ቱ 12.Obligations of Domestic Consumption Coffee Retailers

Any person who engages in the roasting or roasting and grinding

5/ እ ን ዲያ ጓ ጉ ዝ ከ ተፈ ቀ ደ ለ ት ቡና ውጪ በ ማን ኛ ውም 1/ hold valid competence certificate and trade license from

3/ without prejudice to the input and output ratio of the processed

3/ ማን ኛ ውም ለ ውጭ ገ በ ያ የ ተ ዘ ጋ ጀ ቡና የ ጥራ ት ምር መራ ፣ 6/ not to sell the export roasted or grinded coffee to the domestic

አ ፈ ፃ ፀ ም በ ደ ን ብ የ ማስ ወሰ ን ና የ ማስ ፈ ጸ ም፣ Ethiopia Commodity Exchange and roast or, roast and grind

3/ ማን ኛ ውም በ ቡና ን ግድ የ ተ ሰ ማራ ሰ ው ቡና ን በ ክ ምች ት 8/ maintain a register of purchase of coffee, process and sell and

እ ና ከ ብር ፷ ሺ እ ስ ከ ፻ ሺ (ከ ብር ስ ል ሳ ሺ እ ስ ከ መቶ a food or drink for domestic consumption shall have the
