MEMORANDUM OF UNDERSTANDING

OF THE LOCAL GOVERNMENT UNIT OF ______


AND ______________________

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Understanding (hereinafter referred to as


“MOU”) is made and entered into by and between:

The LOCAL GOVERNMENT UNIT OF ___________________


herein represented by its Local Chief Executive_______________,
hereinafter referred to as the “_________________”

The LOCAL GOVERNMENT UNIT OF __________________


likewise represented in this undertaking by its Local Chief Executive, the
_______________, hereinafter referred to as the “________________”

-WITNESSETH-

WHEAREAS, the _____________ and the __________________


desire to promote and implement a comprehensive National Disaster Risk
Reduction and Management Plan that aims to strengthen the capacity of
both local government units together with partner stakeholders, to build the
disaster resilience of their respective communities.

WHEAREAS, both parties seek to institutionalize arrangements and


measures for reducing disaster risks, including projected climate risks, and
enhancing disaster preparedness and response capabilities at all levels.

WHEAREAS, both parties seek to achieve interoperability outside


their respective Area of Responsibility in mobilizing the resources of their
respective Local Government Units, Civic Society Organizations, Private
Groups, volunteers, and their resources during emergencies or disasters.

NOW, THEREFORE, for and in consideration of the foregoing and


the mutual covenants of the parties hereinafter specified, the parties have
agreed as follows:

1. PURPOSE – The purpose of this Agreement is to ensure the


continuation of necessary resources in the event a participating

local government unit requests aid to assist in its provision of
municipal resources in times of crisis or emergency.

Each party to this Agreement recognizes that it may need to


call upon another party to assist in its own need to provide
ongoing municipal services, to respond to catastrophes,
emergencies, natural disasters, or the like.

2. DEFINITIONS

a. “Assistance” shall mean all acts of Assisting Municipality


conducted for or on behalf of a Requesting Municipality,
including but not limited to travel to and from the site of
the emergency, incurring of Expenses and all activities
conducted from the time employees of Assisting
Municipality begin travel to the site of the emergency until
travel from the site of the emergency to the headquarters
of Assisting Municipality is complete.

b. “Assisting Municipality” shall mean the local


government unit participating in this Agreement which has
determined to provide assistance as set forth in
Paragraph No. 3 below, and which actually provides
Assistance to a Requesting Municipality.

Employees of Assisting Municipality shall at all times


during Assistance continue to be employees of Assisting
Municipality and shall not be deemed to be employees of
Requesting Municipality for any purpose.

c. “Requesting Municipality” shall mean a municipality


which requests Assistance from another municipality.

3. REQUEST FOR ASSISTANCE - Any party to this Agreement


shall contact the Local Chief Executive or any authorized
representative of the other party to request assistance under
this Agreement.

The parties expressly understand that any party requested to


provide assistance shall not be obligated to do so until
authorized by the Local Chief Executive, and the decision to do
so shall be in the sole discretion of the municipality to which the
request has been made.

Once a municipality assumes the responsibilities of the
Assisting Municipality, it shall be obligated to
provide Assistance in accordance with this Agreement.

Notwithstanding the foregoing, the Assisting Municipality shall


retain the authority to instruct its employees to return to its
headquarters whenever management of Assisting Municipality
deems it to be necessary or desirable.

This Agreement is non-exclusive and nothing in this Agreement


shall be construed as prohibiting a municipal party to this
Agreement from directly arranging for Assistance on its own
with other municipalities, outside the parameters of this
Agreement

4. OBLIGATIONS OF REQUESTING MUNICIPALITY - In


connection with emergency assistance, a Requesting
Municipality shall have the following obligations with regard to
the Assisting Municipality:

a. To provide its best estimate or assessment of the type


of support needed and the estimated duration of the
Assistance.

b. To designate a person to work with each employee or


group of employees of Assisting Municipality who is
familiar with Requesting Municipality’s systems or
methods of work, and who has direct access to
Requesting Municipality’s computer networks or
communication system.

c. To provide a description of the Requesting


Municipality’s systems or operational plan, applicable
standard operating procedures, standing directives,
and other useful information, as applicable.

5. OBLIGATIONS OF ASSISTING MUNICIPALITY - Assisting


Municipality shall have the following responsibilities:

a. Allow or authorize the Requesting Municipality to


mobilize the private sector and civil society
organizations in accordance with the coordination
mechanism and policies set by the National Disaster
Risk Reduction Management Council and concerned
Local Disaster Risk Reduction Management Councils.

b. Establish its own mechanism for distribution of relief
goods, medical services, psychosocial support which
shall be made available to the other in times of
emergency or crisis.

c. Provide other necessary support to the party in crisis or


in a state of emergency such as, but not limited to,
mobilizing volunteers and gathering resources in aid of
the Requesting Municipality.

6. LIMITATIONS – Any party to this Agreement may withhold


resources to the extent necessary to provide reasonable
protection and services for its own jurisdiction. In the event of a
response hereunder, the Assisting Municipality’s personnel
shall continue to be under the command and control of the
Assisting Municipality, to include standard operating procedures
and medical protocols, but shall be under the Requesting
Municipality’s operational control. Assets and equipment of the
Assisting Municipality shall remain under its ultimate control, but
shall be under the Requesting Municipality’s operational control
during the time of any response hereunder.

7. PERIOD – Unless sooner terminated by either party, this


agreement shall commence on ____________ to
__________________. Any party who decides to terminate the
agreement must notify the party at least one (1) month before
the intended date of termination.

8. SEVERABILITY - Should any portion of this MOU be judicially


determined to be illegal or unenforceable, the remainder of the
MOU shall continue in full force and effect, and either party may
renegotiate the terms affected by the severance.

9. AMENDMENT – This Agreement may be amended or revised


mutually by the parties concerned upon such terms and
conditions mutually agreed upon.
