APPLICATION UNDER SECTION 151 CPC

It is submitted on behalf of the Applicant/Decree Holder

above named that this Hon’ble Court may be pleased to grant
Police aid with lady Searcher to facilitate the Bailiff of this
Hon’ble Court to execute the Warrant of Attachment of the
moveable properties of the Judgment Debtor issued by this
Hon’ble Court in the above noted execution, as in view of the
Bailiff’s Report, it is not possible to execute the Warrant of
Attachment without the Police aid with lady Searcher as the
Judgment Debtor/her son and other person has refused to allow
the Bailiff to enter into the house and to execute the Warrant of
Attachment and has tried to create the situation of law and
Order.

AFFIDAVIT

I, Mian Abdul Qadir son of Moulvi Karam Elahi (Late),

Muslim, adult, resident of Karachi, Attorney of the Decree
Holder above named, do hereby state on oath as under :-

1. That I am Attorney of the Applicant/Decree Holder in the

above noted Execution, as such, fully conversant with the facts
of the case.

2. That the accompanying application under section 151

CPC for grant Police aid with lady Searcher has been drafted
under my instructions, the contents of the same are correct and
the same may be treated as part of this affidavit.

3. That I accompanied the Bailiff of this Hon'ble Court to the

residence of the Judgment Debtor for execution of the Warrant
of Attachment issued by this Hon’ble Court in the above noted
execution and on my pointation, the Bailiff knocked the gate of
the house of the Judgment Debtor, her son came out and did
not allow the Bailiff to enter into the house and to execute the
Warrant of Attachment, as such, the Bailiff returned the
Warrant of Attachment to this Hon'ble Court as un-executed.
4. That in the above circumstances unless the accompanying
application is allowed, the applicant/Decree Holder shall be
seriously prejudiced.

5. That whatever has been stated above is true and correct to

the best of my knowledge.
