BYE-LAWS OF ANJALI APARTMENT HOUSING

1. NAME OF ASSOCIATION: “ANJALI APARTMENT HOUSING”


2. REGISTERED OFFICE: Shibnagar, College Road, Agartala, West Tripura, Pin – 799004.
3. APPLICATION: The provisions of these Bye-laws apply to all the Apartment Owners &
Residents of ANJALI APARTMENT HOUSING.
4. OBJECTS OF ASSOCIATION: The objects of the Association shall be –
 to act as the Association of Apartment owners of the building called Anjali Apartment
Housing (hereinafter called the said building).
 to invest, to acquire legal activity or deposit monies to the advantage of the
Owners, notwithstanding, the profits and income derived from the above objects shall
be utilized for the development and improvement of the association and shall not be
distributed among the members.
 to provide for maintenance, repair and replacement of common areas and facilities by
contributions from the apartment owners and if necessary, by raising loans for that
purpose;
 to do all things necessary or otherwise provide for their welfare expedient for the
attainment of the objects specified in these bye-laws.
 To frame rules, with the approval of the general body of the Association, to administer
the building and common facilities.
 The Association shall not act beyond the scope of its objects without duly amending the
provisions of these bye-laws for the purpose.
 to do such other things as may be considered incidental or conducive to the attainment
of the aforesaid objectives;
 The affairs of the association shall be governed by a board and elected by the members
by simple majority in the general body meeting.
5. MEMBERS OF ASSOCIATION:
 All persons who have purchased apartments in Anjali Apartment Housing and
executed a deed of apartment, shall automatically be the members of the Association
and Each apartment owner shall receive a copy of the byelaws.
 Upon the sale, bequest or transfer of apartment, the purchaser of the apartment or the
grantee or legatee or the transferee shall automatically become the member of the
Association and shall be admitted as member of the Association.
 Cessation of Membership: A person shall cease to a member of the Association in
following ways:
i. By voluntary resignation;
ii. By Death;
iii. By insolvency or unsoundness of mind or by conviction by a court of law for
any offence involving moral turpitude;
iv. By resolution of the general body;
v. By resolution of the Executive Committee if a member is found by the
committee to have acted in a manner inimical or prejudicial to the Association
or its interests provided always that the members concerned shall be given
reasonable opportunity of being heard.
vi. Upon transfer or sale, the membership will cease.

 Re-Admission: Any member who has one cease to be a member for arrears of
subscription and who wishes to rejoin the Association may be allowed to do so on
application in writing to the secretary subject to the approval of the Executive
Committee.
6. RIGHTS OF THE RESIDENTS IN AN APARTMENT SOCIETY:
 Every apartment owner is obliged to be a member of the apartment association which
is formed for the welfare of the people.
 Every apartment owner will be bound by the bye-laws.
 Residents of apartment are either apartment owners or tenants.
 All apartment owners are termed as members of society or association and all tenants
who are staying in the apartment on a rented basis are termed as associate members.
 A resident has the right to attend the general assembly meeting and discuss the
subjects.
 A resident should not be imposed with unlawful restrictions.
 A resident has the right to get attended or addressed about his complaints and
grievances.
 A resident has the right to take decision on the rate of contribution regarding the
maintenance fee, maintenance and repair fund and sinking fund etc.
 A resident has the right to take decision about the penalty to be charged on members,
violating by-laws of the society and to determine its amount.
 A resident has the right to participate in all activities of the society.
 A resident has the right to seek information from the society.
 A resident has the right to get the minutes of meeting.
 A resident has the right to know about the affairs of the society.
 A resident has the right to transfer/inherit the property.
 A resident has the right to use the common area as needed.
7. DUTIES OF THE RESIDENTS:
 A resident has to follow the regulations created in the general body meeting or
managing committee meeting.
 A resident has to provide the necessary information and documents to the registrar or to
the society.
 A resident has to follow the rules of the association and obey the bye-law.
 A resident should ensure that they maintain cleanliness in the common areas.
 A resident should respect their neighbours and their privacy.
 A resident should maintain good relationship with their society members.
8. RIGHTS AND DUTIES OF A TENANT IN AN APARTMENT:
A. Rights of the tenants:
 The tenants have the right to get the tenancy agreement.
 The tenants have the right to get proper receipt for the deposit, rent and maintenance
paid.
 The tenants have the right to get a copy of bye-law and rules of association.
 The tenants are the associate members of the apartment association.

 The tenants have no right to vote or in an association decision making.
 The tenant should respect their neighbour’s privacy and follow the apartment bye-
laws.
 The tenant has the right to use common areas and notify the landlord about any
issues.
 The tenant should follow the guidelines for inviting guests and use the common
areas.
 The tenant will not be discriminated between the members of the association and
themselves.
 The tenants will not have any unlawful restrictions on them.
 The tenants have the right to invite the guests and use the common area or
amenities.
 The tenants have the right to use parking area.
 The tenants have the right to get apartment staff help like plumber, electrician,
carpenter, pest control, etc.
B. Duties of a tenant:
 The tenants are the members of the association and are bound by the bye-laws.
 A tenant should follow the rules and regulations created by the association.
 A tenant should regularly pay the maintenance charges in order to use the common
are facilities.
 A tenant has to maintain the common areas clean.
 Tenants are responsible for the actions of their guests.
9. QUORUM: For a Meeting, 1/3rd of the members or their duly authorized person can constitute
a Quorum. Communication about the new time of the meeting will be put on notice board. If at
any meeting, there is less than a quorum present, the majority of those present may adjourn the
meeting to a subsequent time and date. If at such an adjourned meeting also no quorum is
present, any business which was tabled for discussion at the meeting may be taken up, without
further notice, and the decisions arrived at shall be binding on all.
10. MEETING: Meeting shall hold during any day of every month. The Meeting may also
transact such other business of the Association as may be properly brought up before it.
11. NOTICE OF MEETING: It shall be the duty of the Secretary to circulate a notice of each
meeting stating the purpose thereof and the agenda for the meeting as well as the date, time and
place where it is to be held, to each Apartment Owner, at least 7 days prior to the date of such
Meeting.
12. SPECIAL MEETINGS OF MANAGEMENT COMMITTEE: Special Meetings of the
Management Committee may be called by the President/Secretary on 3 days’ notice to each
Committee Member. The period of notice for such a meeting shall be decided by the President;
dependant on the urgency of the matter to be discussed at such meeting. Special Meetings of
the MC shall be called by the President, or Secretary, in like manner, and on like notice, on the
written request of at least 1/3rd Members.
13. SUPERVISOR/ GUARD: The Management Committee may employ, for the Association, a
Guard / Supervisor and the other subordinate workers at remuneration determined by the
Management Committee to perform such duties and services as the Management Committee
may authorize. The Management Committee may, by a Resolution, remove, dismiss, or
suspend any employee of the Association.

14. PRESIDENT: The President shall be the head of the Association, and shall guide and
supervise its various activities. He/she shall preside over the Annual General, Special, and
other MC Meetings, the proceedings of which shall be conducted under his direction, and
general supervision. His/her rulings shall be final at all such meetings.
15. SECRETARY: The Secretary shall be responsible for all day-to-day activities relating to the
proper apartment management system, maintenance, and upkeep. He shall:
 Look after the administration and other affairs and attend to all correspondence;
 Keep accurate minutes of the proceedings of all meetings of the society, and of the
Meetings;
 Give effect to the directions and decisions taken at such meetings;
 Collect all dues to the Association and ensure through the Treasurer, where
appointed, that proper accounts are maintained of all financial
transactions relating to the Association
 Manage, and control the staff, and take disciplinary action where necessary;
 Maintain a Register of Members
16. TREASURER: The Treasurer shall be responsible for the Association funds and securities and
shall also be responsible for keeping full and accurate accounts of all receipts and
disbursements in the books belonging to the Association. He/she shall be responsible for the
deposit of all money and other effects in the name and to the credit of the Association in such
depositories as may from time to time be designated by the Management Committee. In the
absence of Treasurer, the Secretary will perform his /her duties.
17. AMENDMENT OF BYE-LAWS FOR HOUSING SOCIETY: These Bye-laws for housing
society may be amended by the Association in a duly constituted Meeting for such purpose and
no amendment shall take effect unless approved by the Owners representing at least one-third
(1/3rd) of the Apartment Owners present at the meeting. Rules framed by the resident’s core
committee is in the general interest of residents as a guiding factor and the committee alone has
the right to amend or alter the same.
