Explain the rights provided in nikkah (wedlock) clauses?
Nikkah:
The Nikah is a religious ceremony for a Muslim couple to be legally wed under Islamic law,
and is when the couple officially says “I accept.”
Wedlock (clauses):
In wedlock, also known as marriage, the rights and responsibilities of both partners are
typically outlined in a marriage contract or agreement.
Common clauses may include rights such as
● companionship,
● support, and mutual respect.
● Dowry:
The document may specify the amount and terms of the dowry, which is a gift given by the
groom to the bride as a symbol of financial security.
● Custody of Children:
If the couple has children, the Nikah Nama may address custody arrangements, visitation
rights, and financial support for the children in case of separation or divorce.
● Right to companionship:
Both the husband and the wife have the right to companionship and emotional support from
each other. They should strive to build a loving and caring relationship based on mutual
understanding and compassion.
● Mahr clause:
This clause specifies the amount of the dowry (mahr) that the husband agrees to give to the
wife. The mahr is a gift or financial payment that is given to the wife as a symbol of commitment
and support.
● Divorce clause:
This clause outlines the conditions and procedures for divorce, including the right to divorce
initiated by either the husband or the wife. It may also include provisions regarding financial
settlements and custody of children.
● Custody clause:
This clause can address the issue of custody and guardianship of children in the event of
divorce or separation.
● Maintenance clause:
This clause establishes the husband's obligation to financially support the wife and provide
for her basic needs, including housing, food, clothing, and other necessities.
● Polygamy clause:
This clause may address the issue of polygamy, stating whether the husband has the right to
take additional wives or if the wife has the right to object to such a decision. It may include
conditions or limitations on the practice of polygamy.
It is important to note that the specific clauses and rights in a Nikkah contract may vary, and it is
recommended that individuals consult with their religious leaders or legal advisors to ensure that
their contract reflects their specific needs and preferences, while also adhering to the principles
of Islamic law.
