WHEREAS, Section 16 of Republic Act No. 7160 or the Local Government Code of
1991 states that "Within their respective territorial jurisdictions, local government units shall
ensure and support, among other things, the promotion of health and safety, enhance the right of
the people to a balanced ecology, encourage and support the development of appropriate and
self-reliant, scientific and technological capabilities.";
WHEREAS, Section 17 of the same Code states that the Local Government Units shall
endeavor to be self-reliant and shall continue exercising the powers and discharging the duties
and functions currently vested upon them
WHEREAS, Section 2 of Republic Act No. 10068 or the Organic Agriculture Act of
2010 declared to promote, propagate, develop further and implement the practice of organic
agriculture in the Philippines that will cumulatively condition and enrich the fertility of the soil,
increase farm productivity, reduce pollution and destruction of the environment, prevent the
depletion of natural resources, further protect the health of farmers, consumers, and the general
public, and save on imported farm inputs.

WHEREAS, The Municipality of Libmanan is rich in vast lands that we can freely
utilize and maximize in our quest for self-reliance primarily addressing food sufficiency and
security;
WHEREAS, to attain resilient communities, one way is to involve and empower each
households in the production of their own food and be able to maximize their available
resources;
WHEREAS, utilizing the natural or organic method of planting or farming would result
in the production of healthy food on the table without harming the environment;
WHEREAS, there is a need to equip and prepare our people in times of calamities,
uncertainties and pandemics, adversely affecting our livelihood and hampering our access to
food;
SECTION 1. Title. This Ordinance shall be known as the Libmanan Organikong Gulay,
Sumpay- Buhay Ordinance of 2020.
SECTION 3. Purpose. The enactment of this Ordinance shall ensure the preservation and
promotion of producing and securing our own food, thus restoring an age-old tradition of
utilizing each own backyard and developing available vacant lands to make it useful and
beneficial in terms of producing safe and healthy supply of food. This shall ensure the
Local Government’s support in promoting backyard gardening by providing technical
knowledge and capacity building in establishing a backyard garden. Also, this Ordinance
shall direct the support and cooperation of each Barangay through the Barangay Council
to oversee and ensure the implementation of this Ordinance.
SECTION 4. Definition of Terms. For the purpose of this Ordinance, the following terms shall
be understood in this manner:
a. BACKYARD GARDEN – a small area or a piece of ground or receptacle such as, but
not limited to clay pot, plastic container or sack, in the backyard or premises of a
household dedicated for planting herbs, vegetables and edible plants;
c. EDIBLE PLANTS – plants that are safe to be consumed which can either be used for
cooking or can be eaten raw.

d. HERBS – are plants whose roots, stems, leaves, flowers, seeds and other parts are used
for medicines, food, and flavoring;
g. VEGETABLES – are plants or part of a plant used for food such as but not limited to
eggplant, lady fingers (okra), bitter gourd (ampalaya), upland kangkong, tomato, sweet
potato (kamote), snow cabbage (pechay) etc.; and

SECTION 8. COMPOSITION OF MUNICIPAL PROMOTION AND MONITORING TEAM -
The MPMT shall be composed of the following:
SECTION 10. IMPLEMENTING RULES AND REGULATIONS AND INCENTIVES – Upon the
approval of this Ordinance, the Municipal Promotion and Monitoring Team (MPMT) shall
promulgate the Implementing Rules and Regulations (IRR) of this Ordinance providing,
among others, incentives to ensure compliance by all concerned and successful execution
thereof.
SECTION 11. PERIODIC MONITORING – MPMT shall conduct monitoring at least once every
quarter of the year in the implementation of this Ordinance by all concerned.
SECTION 13. APPROPRIATION – The Municipal Government shall allocate One Million Pesos
(₱1,000,000.00) as initial funding for the operation, logistics and activities of the MPMT.
The budget shall be taken from the allocated fund of the Municipal Agriculture Office. The
MPMT shall ensure that the amount needed in the implementation of this Ordinance for the
year thereafter shall be included in the Annual Appropriations of the LGU.
All barangays in the Municipality of Libmanan are hereby mandated to allocate the necessary
fund on their Annual Barangay Budget for this purpose.
SECTION 14. SEPARABILITY CLAUSE. – If, for any reason or reasons, any part or provision of
this Code shall be declared invalid or unconstitutional, other parts or provisions hereof which
are not affected thereby shall continue to be in full force and effect.

SECTION 16. EFFECTIVITY CLAUSE. - This Code shall take effect immediately upon its approval
by the Municipal Mayor.
