MOST RESPECTFULLY SHEWETH: 1 The Petitioner states that the Respondent no. 1 is the Deputy Director of Education, Kolhapur Region, Kolhapur and second Respondent is the Education Officer (Secondary) of Zillah Parishad, Satara. The third Respondent is an educational trust running and managing three schools, of which Respondent no. 4 is one secondary school. The said school is recognized and receives grant-in-aid for some divisions. 2. The Petitioner was BA (2007) and B.Ed. (2012). He hails from OBC category being Hindu Dhangar by caste. The Petitioner's caste certificate has been duly validated by the Caste Scrutiny Committee. Hereto annexed and marked as Exhibit 'A' colly are the copies of educational qualification and caste validation certificate of Petitioner. 3. ‘The Petitioner came across advertisement dated 25.6.2013 issued by Respondent no, 3 and 4 in daily newspaper for filling a post of Assistant teacher for standard 9" and 10" in Respondent no. 4 school. The post had fallen vacant due to retirement of a teacher in New English School, Salve, Taluka Patan, District Satara, The Petitioner was qualified and eligible for the said post. He therefore applied for the same and afterundergoing due selection process, he came to be selected. The Petitioner was accordingly appointed as assistant teacher by Respondent no. 3 vide appointment order dated 1.7.2013 in the said New English School, Salve. Hereto annexed and marked as Exhibit 'B' is the copy of Petitioner's appointment order dated 1.7.2013. The said appointment was on probation for two years and the Petitioner joined from 3.7.2013. 4. ‘The Petitioner’s appointment was approved by Respondent no. 2. Hereto annexed and marked as Exhi is the copy of approval dated 31.10.2013 issued by Respondent no. 2. The Petitioner states that his appointment in New English School was legal and valid since it was for standard IX and X and therefore his qualification of BA, B.Ed. was sufficient as per the MEPS Act. He completed the probation period successfully and was confirmed in employment. Around 1.7.2022 the Petitioner was transferred to another school i.e. Respondent no. 4 school also for teaching English to the students of standard IX and X. 5. The Central Government enacted the Right of Children to Free and Compulsory Education Act, 2009 (hereinafter referred to as, “the RTE Act”, for brevity), which came into force from 2010. The said RTE Act applies to and lays down various conditions for the employees to be appointed for standard I to VIII. The National Council for Teacher _E@ucation, issued notification dated 23.8.2010 and laid down minimumqualifications for appointment of teachers for standard I to VIII. It mandated passing of Teacher Eligibility Test (TET, for short) to be conducted by appropriate government in accordance with the guidelines framed by NCTE for the purpose. The NCTE under notification dated 11.2.2011 also specified the structure and content of TET. 6. The opportunities to pass the said TET were extended from time to time, It is initially fixed for five years i.e. up to 2015. In 2017, the teachers appointed before 31.3.2015 and not possessing minimum qualification were given period of four years from 1.4.201Si.. till 31.3.2019. %. The Petitioner states that all the aforesaid orders, notifications etc. mandated thai teachers appointed to teach from standard Ito VIII are required to pass TET. This Hon'ble Court in its Judgment and order dated 20.1.2020 in Writ Petition No. 747 of 2020 and companion Petitions has held that TET is mandatory for primary teachers i.e. for standard I to VIII, as per the RTE Act. The Petitioner craves leave to refer to and rely upon the said Judgment and Orderwhen produced. 8 ‘The Petitioner reiterates that he was appointed for students of Standard IX and X and it was therefore not obligatory upon Petitioner to pass TET. However, despite this, the Petitioner voluntarily opted toundertake the said test and appear for TET held in January 2019. The Petitioner passed the said test as per the results declared in 2020. 9. However, surprisingly the Respondent no. 2 issued letter dated 4.2.2020 intimating the Pay and PF Committee, Satara that it was mandatory for teachers appointed for standard I to VIII to pass TET and that it has been directed to delete the names of teachers who have not passed the same, from the Shalarth ID. And that the Pay Bills with the names of such teachers should not be accepted. The name of Petitioner and Respondent no. 4 school were mentioned in the said letter. Hereto annexed and marked as Exhibit 'D' is the copy of said letter. However, the name of Petitioner was not deleted from shalarth ID, immediately. Apparently, this was for two reasons. Firstly, the Petitioner was appointed for standard IX and X and secondly because he had passed TET, though not necessary or mandatory. 10. But the Petitioner's salary was suddenly stopped and withheld from August 2022. When the Petitioner enquired about the reason for the same, nothing was communicated to him. Suddenly, Respondent no. 1 issued letter dated 4.10.2022 informing the Petitioner and Respondent nos. 3 and 4 that they should attend the hearing on 17.10.2022. It was notified that the said hearing was for giving opportunity to the teachers whose names in shalarth ID were to bedeleted. The Petitioner and Respondent nos. 3 and 4 were directed to produce the appointment order, approval order and submissions. Hereto annexed and marked as Exhibit 'E' is the copy of letter dated 4.10.2022 issued by Respondent no. 1. 11. The Petitioner learnt that the results of the TET examination held in January 2019 were recalled on the allegations that there were malpractices in the said examination. It was apparent that the said decision was the reason for issuance of said letter dated 4.10.2022 to the Petitioner. The Petitioner made a detailed representation stating facts and asserting that he was appointed for Standard IX and X and that TET was not mandatory for him. He had attempted the said examination only with a view to better his qualification. The result of the examination was immaterial and should not affect his appointment or continuation. He also asserted that he had not indulged in any malpractices. The Petitioner also produced numerous documents before the Respondent no. 1. The Petitioner produced his appointment order, approval order, qualification certificates, caste validity certificate. He also produced the inspection reports made by Respondent no. 2 and other relevant documents. Hereto annexed and marked as Exhil Cay, representation and documents produced by Petitioner. are the copies of Petitioner’s12. The Respondent no. 3 and 4 also appeared and filed their statement before the Respondent no. 1. They also produced innumerable documents like time table, attendance record, work allotment of Petitioner, log book, documents showing the Petitioner’s attendance as Specialized teacher for revised evaluation training held by Board for Secondary and Higher Secondary Education, Pune, for IX, X and XT standards. Hereto annexed and marked as Exhibit 'G colly are the copies of Petitioner’s representation and documents filed by Respondent no. 4. 13, The Petitioner and Respondent no. 3 and 4, thus, demonstrated that the Petitioner was appointed as assistant teacher for standard IX and X and was under no obligation to undertake or pass TET for being entitled to be continued as assistant teacher. The said test was mandatory for teachers in primary schools ie. for teachers teaching standard I to VIII. 4 The Petitioner states that the Respondent no. 1 did not communicate any decision of the hearing. But as stated above, the Petitioner’ salary was withheld and not paid from August 2022, even today. The said action of not paying salary of the Petitioner was sudden, arbitrary, illegal and without any rhyme or reason. The said decision is patently illegal and unsustainable in law.15. Being aggrieved by the arbitrary and illegal act of removing name of Petitioner from Shalarth ID and not paying/stopping Petitioner’s salary, by Respondent no. 1 and 2, the Petitioner begs to approach this Hon'ble Court under Article 226 of the Constitution of India, on following amongst other grounds, each being contended without prejudice to the other, as hereunder: GROUNDS:- a. That the Respondent no. 1 and 2 have acted arbitrarily and high- handedly in stopping, withholding Petitioner's salary and removing his name from Shalarth ID. b. That the Respondent no. 1 has not decided the issue whether the Petitioner is under any legal obligation to pass TET to continue as assistant teacher in Respondent no. 4 school. c. That the Respondent no. 1 and 2 could not remove Petitioner's name from Shalarth ID and/or stop payment of salary without affording any opportunity to the Petitioner. The action is thus in breach of principles of natural justice. d, That the provisions of RTE Act are applicable to teachers in primary school i.e. teaching students in standard I to VIII. The passing of TET is also mandatory for them. The Petitioner has not been appointed for standard I to VIII bit only for standard IX andX. Hence, treating the Petitioner as primary teacher and stopping salary for not passing TET is ex facie illegal and bad in law. e. That the Respondent no. 1 and 2 are statutory authorities and are under obligation to pass speaking order after hearing the parties. The Respondent nos. 1 and 2 have avoided, neglected doing so. The action is thus illegal and liable to be set aside. f. That the occasional teaching of Petitioner to the students of standard VIII is inconsequential and irrelevant. The Petitioner is essentially and regularly appointed for standard IX and X. His appointment has been so approved by Respondent no. 2. The voluminous documents produced by Petitioner and Respondent nos. 3 and 4 prove this fact. Hence, the Petitioner could not be put to any prejudice for not passing TET. g. That the Respondent nos. | and 2 need to be directed to re-insert the name of Petitioner in Shalarth ID and start paying his salary regularly, together with the arrears from August 2022. h, That the action of the Respondent nos. 1 and 2 is otherwise also illegal and bad in law. i. That the action of the Respondent nos, | and 2 is against equity, good conscience and fair play. The Petitioner craves leave to add to, alter and amend the aforesaid grounds if and when necessary.11 16. The Petitioner states that the withholding of salary of Petitioner is inhumane and perverse act of Respondent no. 1. The same has no sanction of law and the Respondent no. 1 is acting beyond its powers and authority. The Petitioner’s right to receive salary is seriously prejudiced and jeopardized by such illegal act of Respondent no. 1.The Petitioner is married and has the family to support. The Petitioner is solely dependant upon the salary he eas, But only because of the arbitrary, illegal and high handed action of the Respondent no, 1 and 2, he is being deprived of the salary despite working his heart out in the school. The Petitioner is a confirmed employee and is entitled to his salary as of right. The Petitioner has good case on merits but the hearing of the Petition may take long time and the Petitioner cannot sustain without salary. The Petitioner therefore deserves and prays for ad interim, interim relief against Respondent no. 1 and 2. The Petitioner prays that the Respondent no. 1 and 2 be directed to release Petitioner's monthly salary from August 2022, and henceforth month to month, every month, pending hearing and final disposal of the main Petition. The Respondents shall not, suffer any loss or prejudice if such relief is granted but the Petitioner shall suffer irreparable loss, prejudice and inconvenience if the same is not granted. The balance of convenience is therefore in favour of Petitioner. 17. The Petitioner has approached this Hon'ble Court as expeditiously as possible as can be seen and verified from the facts stated{2 12 hereinabove. The Petitioner therefore states that there is no unreasonable delay and/or latches on its part to approach this Hon'ble Court and if there be any, the same may kindly be condoned in peculiar facts and circumstances of the matter. 18. The Petitioner has no other affordable, urgent, alternate and efficacious remedy than to approach this Hon'ble Court for redressal of their grievance &relief’s prayed for, if granted will be sufficient and adequate. 19, The Petitioner states that the cause of action has arisen at Satara and as such this Hon’ble Court has jurisdiction to try and entertain this Petition in Civil Appellate side. 20. The Petitioner has not filed any other application or Petition either in this Hon'ble Court or Hon'ble Supreme Court of India. 21. The Petitioner has not received any caveat from Respondents. 2.
