Case Flow and Summary of Order of Submission of Pleadings with the First and

Second Level Courts under the Regular Procedure provided in the Rules of Court

Civil Cases-

1. Complaint of plaintiff;
2. Service of Summons by the court;
3. Defendant files an Answer which may contain a counterclaim and/or crossclaim;
4. Court issues a Notice of Pre-trial;
5. Both parties file their Pre-trial Briefs and judicial affidavits of their witnesses;
6. Court conducts Pre-trial Conference;
7. Court issues a Pre-trial Order and Notice of Trial, if necessary;
8. Court conducts trial;
9. After parties present their respective evidence, they will submit their respective
memorandum when required by the court.

Criminal Cases-

1. Criminal information is filed by the public prosecutor with the court;


2. Court may issue a warrant of arrest; issues notices of arraignment and pre- trial
conference;
3. Prosecution and Accused submit their Pre-trial Briefs when required by the court and
judicial affidavits of their witnesses;
4. Court conducts Pre-trial Conference;
5. Trial of the criminal case;
6. After termination of presentation of evidence by both parties, they will submit their
respective memorandum when required by the court.

Note: Court of Appeals and Supreme Court usually require parties to submit their
respective memorandum before the case is submitted for decision.
