JUDICIAL AFFIDAVIT OF EDITHA T. GALDO

(Plaintiff)

Purposes:

The testimony of this witness is formally offered to prove the following matters:

a) That she is the PLAINTIFF in this complaint;

b) That she personally knows the defendant JOSEFINA G. AURE;
c) That sometime on February 29, 2020 defendant obtained nineteen (19) sacks of
rice (tapol) through credit from plaintiff. For several occasions, defendant
again received sacks of rice from plaintiff through credit.
d) That plaintiff notified the defendant to return the amount of P 87, 400.00 which
the latter promised. However, defendants paid such indebtedness through small
amounts or thru installment but the last balance has reached to P 38, 000.00
which remained unpaid until now;
e) That she will identify documents in her Judicial Affidavit in relation to this
case;
f) Other matters.

I am EDITHA T. GALDO, Filipino, of legal age with permanent address at Brgy.

Divisoria, Bontoc, Southern Leyte, I am testifying as the eye witnesses in the above-
entitled case, and, fully conscious and aware that I answer the questions propounded
under oath and may thus be held criminally liable for false testimony or perjury, under
oath, hereby depose and state:

Q1 - Who is the lawyer conducting this examination and please state the place where
this examination is being conducted?

A - Atty. Jose Ramil G. Golo and the examination is being held at his office at the
Zone V, Sogod, Southern Leyte.

Q2 - In what manner has Atty. Golo conducted the examination, as regards the questions
asked and the answers you gave?

A - Atty. Golo has prepared the questions and read them to me, and asked me to
answer each and every question he asks.

Questions and Answers:

1. Q: What is your name?

A: I am EDITHA T. GALDO Filipino, of legal age with permanent
address at Brgy. Divisoria, Bontoc, Southern Leyte;

2. Q: Do you know the defendant in this case?

A: Yes, I know her because we know we live in same municipality;
3. Q: Why do you file this collection of money case against the defendant?

A: Because of the defendants’ refusal to return the amount of

THIRTY-EIGHT THOUSAND PESOS (P 38, 000.00) to me despite repeated demands.
Such amount is the remaining balance of her original loan which is P 87, 400.00;

4. Q: Did she execute a document/s relative to such indebtedness?

A: Yes, we have a private document which is the computation of her
obligation until the remaining unpaid amount of P 38, 000.0o which is attached herein as
Annex “A”;

5: Q: Then, did you demand for payment of the P 38, 000.00?

A: I summoned her to the barangay at the Office of the Lupon ng
Tagapamayapa and we forged an Amicable Settlement dated February 5, 2022 which is
attached as Annex “B”;

6. Q: Did she make good of her promise?

A: No, that is why I again summoned her before the Lupon ng
Tagapamayapa of Brgy. Union, Bontoc, So. Leyte but during our confrontation she still
promised but I no longer need her promises. I was issued a copy of the Certificate to File
Action is hereto attached as Annex “C:;

7. .Q: What do you want this Honorable Court to do in your complaint?

A: I only wanted that the amount of P38, 000.00 be return to me
nothing more, nothing less because that is my money.

9. Q: Are these all you wanted to state in this Judicial Affidavit?

A: If there are other things that I was not able to explain or state in this
Judicial Affidavit, I would declare it before the Court.
