Re: Offer To Buy The 105 Sq. Meters Of Lot No.


482- G Part For Road Opening Project

Sir:

This has reference to Lot No. 482-G Part located in Purok 5, Barangay ____________________,
under your ownership as reflected in Tax Declaration No. 20-04-02647 with OCT/TCT/CLOA
No. 113-2017000099.

Please be informed that the LGU will implement a Road Opening Project on the aforestated area
that will traverse in Lot Nos. 482-H Part, 482-I Part, 482-J Part, 482-K Part, 475- Part, 709-Part,
609- Part, including Lot No. 482-G Part. Based on the actual ground survey, the area consisting
of 105 square meters of your property will be affected. The same is also true to the portions of
the mentioned Lot Nos. Notwithstanding, the owners of these Lot Nos. are very much willing to
donate the affected part of their properties just to proceed with the Project.

In this regard, the LGU hereby offers you to buy the 105 square meters of Lot No. 482-G Part
within the existing zonal value of P 100.00 per square meter, or in the amount of P 10, 500.00.

In the event of your refusal for this offer shall be made, or otherwise this offer will not be
entertained by you within 30 days upon receipt hereof, we will be opted to proceed the
expropriation of your property pursuant to Section 19 of the Local Government Code, which
states:

“Section 19. Eminent Domain. – A local government unit may, through its chief executive and
acting pursuant to an ordinance, exercise the power of eminent domain for public use, or
purpose or welfare for the benefit of the poor and the landless, upon payment of just
compensation, pursuant to the provisions of the Constitution and pertinent laws: Provided,
however, That the power of eminent domain may not be exercised unless a valid and definite
offer has been previously made to the owner, and such offer was not accepted: Provided, further,
That the local government unit may immediately take possession of the property upon the
filing of the expropriation proceedings and upon making a deposit with the proper court of at
least fifteen percent (15%) of the fair market value of the property based on the current tax
declaration of the property to be expropriated…”
