B. GENERAL REQUIREMENTS:
The Castable refractory shall be dry air setting or hydraulic setting type that ensure setting
and hardening at room temperature & should have possess following general properties.
1) Low shrinkage while drying at ambient temperature, as well as low firing shrinkage
while firing at working temperature without any cracking tendency.
2) Development of sufficient cold strength in a short time after application in position and
should also possess good resistance to flue gas action and good hot strength.
3) Good workability and consistency when mixed with water for application.
4) Ease with application in all position horizontal, inclined & vertical.
5) Requirement will be given through authorized letter as & when required by GSECL in
Lots/Batches so party has to prepare the Lots/Batches as per requirement of GSECL.
6) Party shall have to supply material along with materials test certificate (Physical

 &Chemical) within 15 Days from date of issue of Dispatch Instruction. (Min. 15 MT
Approx. quantities are considered as one lot).
7) GSECL may get supplied material tested at CGCRI (Central Glass & Research
Institute, Ahmadabad) / GIRDA or any other reputed Govt. approved laboratory for
physical properties / chemical analysis or both of the supplied material. Sample for
testing will be drawn after lot supply at destination randomly by corporation’s
representative from each batch / lot of bulk supply. You will be invited for joint
sampling. If your representative fails to remain present at the time of drawing of
sample, sample will be drawn without waiting for your representative. Based on the test
results so received, supplied material will accepted / rejected. Any dispute in this
regard will not be entertained.
8) Party shall have to complete all procedure (Joint sampling, Material testing/verification
& submission of test results/certificate) within 15 days on receipt of material at main
store of Ukai TPS.
9) Party shall have to submit the shelf life certificate of supplied material along with supply
of Lot/Batch.
10) The charges for testing of each lot will have to be borne by party, i.e. sample as well as
bulk supply.
11) After testing, if result is not matched with ordered specification, the same rejected lot
should be shifted within one month. If party fails to lift rejected materials/lot in stipulated
time, the GSECL will be the custodian of that rejected materials.
12) Order validity: Total purchase order validity is for 24 months from date of issue of
Order.
13) Required Packing: Weather proof HDPE Bags. The thickness of polyethylene bag will
at least 0.2 mm and sealed by machine stitching. Each bag shall contain 50 kg material
with marking of all required details like Suppliers Name, Product Name, Weight, Lot
Number, Manufacturing date and Caution etc.
14) You shall have to submit the detail procedure for preparation, method of application of
supplied refractory & also for preparation of test cubes.
15) Weight tolerance +/- 2 % is acceptable on ordered Quantity.
16) You shall have to submit 10% PBG of P.O.Value (end cost), it will be refunded only
after satisfactory performance and as per GSECL Standard norms i.e. 18 months from
the date of receipt and 12 months from date of application whichever is earlier.

Special Notes:
(1) Tenderer’s have to submit their offers in two parts viz. (a) Technical Bid & (b) Price bid in two separate sealed
envelopes, super scribing Technical bid for ______________________ (Subject) or Price bid for
________________________ (Subject) as the case may be.
(2) Please submit photocopy of Sch-B duly signed by you, along with technical bid, without stating prices.
(3) Tender shall not be opened without payment of E.M.D. & Tender Fee. Please furnish details of EMD & Tender Fee
paid on cover.
(4) If any deviation in your offer with respect to tender specification, then please mention clearly in separate deviation
sheet annexure-12, otherwise we will consider your offer is exactly as per our Tender/Enquiry specification.
(5) GSECL reserves rights to place the order on technically qualified bidders foritem wise lowest quoted party.
(6) GSECL reserves the right to terminate the Contract (i.e. Purchase order) at any time, without assigning any reasons,
whatsoever, by giving a notice period of ONE month from the date of Notice of termination of the Contract. Suppliers will
not be entitled for any compensations/damages/losses, whatsoever, on account of such termination of the Contract.
(7) If participating bidder/agency have stake in one or more other agencies/bidders who are participating in same tender and
on account of submission of wrong information/declaration in the tender/enquiry certificate – A, then the bidder will be
declared as disqualified automatically and EMD/SD will be forfeited, Further, GSECL shall take stern action including Stop
dealing with their firms
(8) Repeat Order: GSECL reserves rights for the placement of repeat order @ 25 % of the order quantity/value within 4
(Four) months of the order.
(9) PENALTY: Any delay that may take place in supply and / or erection, testing and commissioning activities beyond
Contractual cutoff date/stipulated period in the order shall be subjected to penalty (not liquidated damages) at the rate of
1/2 % of the contract price/order price per week or part thereof plus GST as applicable on delayed portion or part thereof
subject to a maximum of 10 % plus GST as applicable of the total contract value/order value on delayed portion (i.e. End
cost including GST & Cess as applicable).
(10) It is to be noted that GSECL, Ukai TPS is establishing and implementing occupational Health & Safety Management
System complying with OHSAS 18001:2007. You as a part of the GSECL Ukai team and as defined by the scope of
mentioned standard, all contractors are required to comply with and participate to prevent the occupational Health and
Safety hazards and risks including observation of safety rules. Further you are also to comply with all applicable legal
requirements while executing the supply/work, in case the job is assigned to you.
(11) Payment Term: You shall have to accept GSECL Standard Payment Terms and Conditions i.e. 80% FOR Destination
Price from the date of receipt of material against TRC within 30 (Thirty) days on verifying required documents as per A/T
conditions, amount of GST and applicable cess will be kept under retention till submission of documentary proof of
payment of GST or till reflection of payment of GST pertain to respective bill amount in GST Return for concern Order
after due verification and balance 20% of FOR Destination Price within 45 (Forty Five) days on receipt of Store Receipt
(SR) Note from the consignee.
(12) Delivery Period:Party shall have to supply material along with materials test certificate (Physical & Chemical)
within 15 Days from date of issue of Dispatch Instruction.(Min. 15 MT Approx. quantities are considered as
one lot) and total purchase order validity is for 24 months from date of issue of Order.
(13) Please note that conditionally offers will liable to be ignored.
(14) Tender Fee/EMD/SD will be accepted by RTGS / NEFT also and copy of the same is require to be attached with

(15) TDS under GST shall be applicable as per GST Regulations.
(16) The new section 194Q (introduced vide the Finance Act, 2021) imposes requirement to deduct tax at source @
0.1% on the purchase of goods subject to meeting the specified thresholds provided under the said section.
Correspondingly, it is also provided that, where TDS under the above section 194Q is deductible and is so
deducted, the tax collection at source (TCS) under section 206(1H) shall not be applicable to the seller on sale of
goods.

IMPORTANT:
All the bidders are requested to read and verify the documents of Commercial Terms & Condition of
Tender & Supply (i.e. Clause No.1 to 71) of GSECL, UKAI, TPSand confirm that all the above
documents are verified & certify by you as below.

“I/we read the above documents and agree for the Conditions of Tender & Supply (i.e. Clause
No.1 to 71) of GSECL, UKAI, TPSand accordingly submitted my/our offer”.

(1) For Page No. 1 to 37 of terms &condition: Party can give acceptance of clause No.1 to 71 on a
single paper instead of all 37 pages.

(2) For Page No. 42 to 57, 58 & 67: Please note that you have to furnish the details in all Annexure-1
to 15,Certificate-A&Integrity Pact i.e. dully filled, stamped and signed otherwise your offer is likely
to be ignored out rightly.

(3) In case of Ex-works Prices, you have to mention item wise Pkg. & Fwd., Freight, insurance charges
in Annexure-10 otherwise it will be considered as per GSECL procedure for evaluation.

(4) Whichever terms conflict with “COMMERCIAL TERMS AND CONDITIONS” the terms mentioned in
“NIT” will be applicable.

(5) SECURITY DEPOSIT (SD) TOWARDS EXECUTION PERIOD

1. The successful Tenderer’s will be required to pay an amount equivalent to 10% of the value of the
Order (End Cost) against letter of intent as per GOG guideline as a Security Deposit for
satisfactory execution of the contract. Such security deposit will be payable either in form of
D.D./Bank Guarantees or accepted by NEFT/RTGS. Bank Guarantees will be acceptable from the
Nationalized Banks or any other Banks, as Notified by the Finance Department, Govt. of Gujarat
from time to time. The Bank Guarantees will be executed on the standard form prescribed by the
GSECL.

Bank Guarantee with validity period of additional 01 (One) month i.e. more than actual delivery
period to safeguard GSECL’s interest in case any eventuality happening on the last day of the
delivery period after office hours of the Bank or Bank holidays. Bank Guarantees for interim
period will not be allowed. If by any reasons the supply period is extended then supplier
should undertake to renew the Bank Guarantee at least 01 Month before the expiry of the
validity failing which GSECL will be at liberty to encash the same.
2. Security Deposit is to be paid @4% of the Order End Cost for Udyam Registration Certificate and
subsequent NSIC/CSPO/DGS&D Registration Certificate of Gujarat state for the item under tender.
No relaxation shall be given to the bidders having only one registration numbers from Government
of Gujarat but no subsequent registration with CSPO/NSIC/DGS&D registration certificates for the
item under tender.
3. S.D. should be paid within 07 (Seven) days after receipt of the LOI.
(6) PBG TOWARDS WARARANTY/GURANTEE:Applicable in this Tender:
Performance bank guarantee for your product valid for 18 months from the date of receipt of
materials or 12 months from the date of commissioning whichever is earlier, and bank guarantee
for 10 % of the order end cost value against standard performance guarantee shall be submitted
on non-judicial stamp paper of Rs.300.00 as per the prescribed form enclosed herewith.
