PLAINTIFF ARNEL P. BENAVIDES, by counsel, to this Honorable

Court, most respectfully state:

1. Plaintiff received a Court Order dated March 16, 2023, which was
received on October 17, 2023;

2. The Court ordered plaintiff to submit to this Court the Amended

Complaint in compliance to Sec. 6 of Rule 7 of the Amended Rules on Civil
Procedure and submit an Original and/or Certified True Copy of the Special Power
of Attorney;

3. Plaintiff has submitted the Amended Complaint this 6 th day of November

2023;

4. Plaintiff has exerted earnest efforts to locate the whereabouts of Spouses

Dominador Jovellanos and Matilde Jovellanos, but proved unavailing. As such,
herein plaintiff brings the instant complaint on his own right. It also renders him
impossible to submit an Original and/or Certified True Copy of the Special Power
of Attorney;
