.Dear Sir,
Having examined the terms and conditions of tender, scope of work, and all addenda etc, we
the undersigned, offer to execute the work of Sweeping & Cleaning work at East area under
PGMTD, Jaipur, at the rates quoted by us.
[1] We undertake, if our bid (Tender Quotation) is accepted, we will submit all sureties as
mentioned in the tender and also that, we will execute the work only at the approved rates.
We will execute work in accordance with the scope of work, terms and conditions stipulated
in the tender document, and also as per the instructions/orders issued by the competent
authorities of PGMTD, Jaipur from time to time.
[2] We agree to abide by this Bid (Tender Quotation) for a period of 150 days from the date
of opening of qualifying bid, and also agree that the bid (Tender Quotation) may be accepted
at any time before expiry of bid validity period.
[3] Until a formal Agreement is prepared and executed, this bid together with the
writtenacceptance thereof in your notification and award shall constitute a binding contract
between us.

of Directors of the bidder in this regard, on behalf of the company/ institution/ Body

1. ELIGIBILITY OF BIDDERS/TENDERERS:
1.1 No party who has any relatives working in Jaipur Telecom District shall submit the
tender. (Tenderer should give the certificate as per the format mentioned. The near
relatives for this purpose are defined as:

total estimated value of the Tender in minimum one year from in Government/Semi-
Govt./Reputed Public & Private Limited Companies/Co-operative organizations etc
during last five financial years for similar nature work are eligible to participate in the
tender. Experience certificate duly issued by the competent issuing authority may be

3.2 The AGM (Plg),Jaipur may, at its discretion, extend this deadline for the submission
of bids by amending the Bid Documents in which case all rights and obligations of the
PGMTD,Jaipur and bidders previously subject to the deadline will thereafter be
subjected to the extended deadline.
5.1 The bidder may modify, revise or withdraw his bid after submission prior to deadline
prescribed for submission of bid.
5.2 The bidder’s modification, revision or withdrawal shall have to be online and digitally
authenticated.
5.3 No bid shall be modified subsequent to the deadline for submission of bids.
6.1 The date fixed for opening of bids, if subsequently declared holiday by the BSNL/
submission of Bids not possible due to unavoidable circumstances, the bid will be
opened on the following working day,time and venue remaining unaltered unless the
revised date of opening of bids is notified before opening of tender
6.2 During the entire evaluation process, if it is observed that the downloaded is exactly
not as per the original tender document, and /or it is tampered / changed /altered
/modified in any way, the bid will be rejected.

7.1 EMD can be paid in the form of Demand Draft/ Bankers Cheque issued by a
Schedules bank drawn in favor of ‘Account Officer Cash Collection HQ BSNL Jaipur.’
payable at Jaipur. The tender, which is not accompanied by the requisite EMD, shall
be summarily rejected.
7.2 Concessions to MSE Units/NSIC: As per guidelines, issued by Ministry of Micro,
Small & Medium Enterprise (MSME), Government of India regarding concessions for
Micro & Small Enterprise Units registered with District Industries Centers or Khadi &
Village Industries Commission or Khadi & Village Industries Board or Coir Board or
National Small Industries Corporation(NSIC) or Directorate of Handicrafts &
Handloom or MSME units who have Udyog Aadhaar Memorandum(UAM) or any other
body specified by Ministry of Micro, Small & Medium Enterprise, shall be allowed the
following concessions:
7.2.1 The units registered under single point registration scheme of NSIC /MSE units for
OF Cable laying works are exempted from depositing the price of tender document
and from payment of earnest money deposit (EMD). Such bidder shall have to
upload the document in proof of registration of valid NSIC/MSE for carrying out of
the similar nature (tendered item) of work along with bid document.
7.2.2 A proof regarding current registration with bodies as detailed in para 7.1 above for
the tendered items will have to be attached along with the bid.
8.1 Cost of bidding: The bidder shall bear all costs associated with preparation and
submission of the bid. The BSNL will in no case be responsible or liable for these
costs, regardless the conduct or outcome of the bidding process.
8.2 The prospective tenderer should carefully readout the tender document and go
through all general terms and conditions; special terms and conditions, scope,
specification of work; approximate quantum of work; schedule of rates; check-list etc
and then only should fill up the tender quotation form.
9.1 Firm shall have valid GST registration, if applicable. The firm shall quote rates for all
items inclusive of all but exclusive of GST. No Concessional form in any shape shall
be issued by the BSNL. The firm shall claim GST with the bill clearly furnishing the
complete details of GST (number, amount, rate etc.) to be paid along with
documentary proof of applicable rate of GST. The documentary proof of GST
payment to be submitted with in stipulated period as per GST rules. BSNL, under no
circumstances, will consider any claim of GST not included in the bill. It will be the
firm’s responsibility to settle GST with GST authorities. All the GST rules updated
from time to time by Government of India & Rajasthan state shall be final in any
dispute regarding GST.
9.2 The contractor should keep a proper and clear record of all taxes & levies paid by
him. Especially the records of payment of GST should always be kept ready and
updated timely.
10.1 Bid shall remain valid for 150 days from the date of opening the Technical [Qualifying
bid].A Bid valid for a shorter period shall be rejected by the BSNL as Non –
Responsive.
10.2 The BSNL reserves the right to request the bidder to extend the bid validity for period
of further 90 days and the bidder has to necessarily extend the bid validity.Refusal to
extend the bid validity will result in forfeiture of the bid security/The bidders will be
debarred from any further work/contract by BSNL(PGMTD, Jaipur BA) for one year
from the date of issue of such order.A bidder accepting the request and extending
the bid validity will not be permitted to modify his bid.
11.1 Preliminary, BSNL shall evaluate the tenders / bids to determine whether they are
complete, whether all required sureties have been furnished, whether the essential
documents are enclosed.
11.2 BSNL may waive any minor irregularity or non-conformity in a bid, which does not
constitute a material deviation, provided such waiver, does not prejudice or affect the
relative ranking of the bidders.
11.3 After the preliminary [Technical] evaluation, further evaluation and comparison of
responsive/ technically & commercially eligible bids/tender quotations will be done on
the basis of lowest quotes in the financial bids. The financial bids will be evaluated
on composite basis only (i.e. amount involved for complete work of Two year).

For composite basis evaluation purpose, approx. quantity as mentioned in the tender
will be taken into consideration.
11.4 BSNL is not bound to accept the lowest quotes. Reasonableness of the lowest
quoted rates will also be examined and verified.
12.2 Any effort by the tenderer/bidder to modify his bid or influence BSNL in the bid/tender
evaluation/ comparison or the contract award decision, shall be liable for rejection of
bid and forfeiture of EMD/Bid Security/Security deposit or The bidders will be
debarred from any further work/contract by BSNL(PGMTD, Jaipur BA) for one year
from the date of issue of such order.
13.2.1 Security Deposit of the contractor(s) who has/have successfully executed the work
as per the issued Work Orders will be refunded after deducting all costs, damages
and other expenses that the BSNL may have incurred for making good any loss due
to any action of the contractor and which BSNL is entitled to recover from the
contractor. Normally Security Deposit will be released/ refunded on expiry of the
tender period and also on receipt of ‘No Dues Certificates’ and Satisfactory
Performance Reports from the concerned officer(s).
13.2.2 The Security Deposit, if the amount of which is paid by the successful bidder(s) in
cash or DD, will not bear any interest, i.e., refund of the Security Deposit will be
without any interest amount on it.
Security Deposit is liable for forfeiture in the event of or for the reasons detailed
hereunder:-
Breach of any items of terms and conditions (General) of the tender /contract by the
contractor.….The contractor fails to execute and complete the work within the
stipulated period of time, as specified in the detailed work order(s).….Quality of the
work is not satisfactory, and the work is not re-executed even after bringing the fact
to the notice of the contractor.…..Decision of PGMTD, Jaipur in this regard will be
final and binding on the contractor(s).
14.1 Tender will be valid for a period of Two years in total from the date of award of work,
extendable by a further period of One year in spells of six month at a time without
any consent of the contractor.
17.0 In general, the tenders will be received, opened, evaluated, finalized and awarded as
per the procedure given in the above clauses/paragraphs of Section-V: General
Terms & Conditions specified in the tender. In case of any ambiguity, PGMTD,Jaipur
reserves the right to fix any criteria/procedure or to make a slight change if required
any. Decision taken by PGMTD,Jaipur will be final in the matter.
18.1 Rates once approved shall remain valid during the entire period of tender contract
and also during the extension period, if granted so after expiry of tender period.
PGMTD,Jaipur will not be responsible for any escalation in cost of materials/labour
rates or any increase in duties, taxes, levies etc.
18.2 Prices charged by the contractor(s) for the works performed under the contract shall
not be higher than the rates quoted by the tenderer(s)/bidder(s) and approved by the
competent authority of BSNL
The contractor(s) shall not assign, sub contract or sublet the whole or any part of the
works covered by the contract, under any circumstances.
The contractor will have to execute the work as per the instructions of Incharge of
Building/ Premises. The work will be commenced only after receipt of tender award
copy / work order issued by the competent authority. Three work orders will be
issued for three areas and Tenderer have to submit three bills for payment.
22.1 The contractor shall obtain a valid labour license under the Contract Labour (R&A)
Act 1970 and the Contract Labour (Regulation & Abolition) Central Rules 1971,
before commencement of work and continue to have a valid license during the
validity of contract and renewal if any can be made.
22.2 During the performance of the works the contractor shall at his own cost and initiative
fully comply with the provisions of all acts and laws as regards to the engagement of
labour, payment of minimum wages and EPF, insurance etc.
22.3 No minor labour, i.e. below the age of eighteen (18) years or a labour with a criminal
record shall be employed on the work.
22.4 The contractor shall maintain all records relating to engagement of labours, payment
of wages to them, EPF & insurance etc. and make available the records to the BSNL
field Officers / Labour Enforcement Officer, whenever asked for.
23.1 Payment will be made for the areas where the work has actually been done to the
satisfaction of the In-charge of building/premises. Area of the work will be measured
by authorized field Officer, appointed by cancerned DGM and the payment shall be
made based on the actual measurement taken at the time of commencement of
work.
23.2 Contractor shall submit printed bills per month for the actual work done during the
month.
23.3 Bill should be submitted in terms of charges for actual work done & not in terms of
labour supplied/engaged
23.4 Bills for the work carried out will be settled on monthly basis i.e. bills for the works
carried out during the month will be submitted to the controlling officer. Contractor will
be responsible to submit the bills prepared, accurately & intime by observing all the
formalities.
23.5 Printed bills for the work carried out shall be submitted within 30 days from the date
of completion. In other words bill should be submitted not later than the last date of
the next month. Detailed justification shall invariably be given to each delayed bill and
the same shall be got approved by the concerned AGM/DE.
23.6 If bill not submitted within three months penalty will be imposed @ 2% of the amount
ofthe total monthly bill.
23.7 Bills submitted for payment shall be supported with proper tender award copy, due
certificate given by the in-charge of work regarding area of the Indoor/Out-door area
etc.
23.8 Firm shall submit the GST number printed bill/invoice with mentioning applicable
GST rate and amount of GST separately. BSNL GST number must be mentioned on
the bill/invoice as input TAX Credit of GST will be claimed by BSNL.If GST
number/GST rate and GST amount is not mentioned in bill/invoice, BSNL is not liable
to pay separate amount of TAX/GST.
23.9 On expiry/termination of the contract, all pending bills against this contract should be
submitted within a period of not more than 45 days after expiry/termination of the
contract.
23.13 PGMTD,Jaipur reserves the right to recovery compensation for damages caused by
the contractor to the BSNL properties or third party properties, while executing the
work. Such recoveries will be made from the bills submitted by the contractors and as
per the prevailing procedure, norms laid down by the BSNL.Decision of cancerned
DGM in this regard will be final and binding on the contractors.
28. ARBITRATION:
In the event of any question, dispute or difference arising under this agreement or in
connection there-with except as to matter the decision of which is specifically
provided under this agreement, the same shall be referred to sole arbitration of the
Principal General Manager Telecom District ,Jaipur or in case his designation is

changed or his office is abolished then in such event to the sole arbitration of the
officer for the time being entrusted whether in addition to the functions of the PGMTD
or by whatever designation such officers may be called (hereinafter referred to as the
said officer) and if the PGMTD,Jaipur or the said officer is unable or unwilling to act
as such to the sole arbitration or some other person appointed by the PGMTD, or the
said officer. The agreement to appoint an arbitrator will be in accordance with the
Arbitration and Conciliation Act, 1996. There will be no objection to any such
appointment that the arbitrator is Government Servant or that he has to deal with the
matter to which the agreement relates or that in the course of his duties as
Government Servant he has expressed views on all or any of the matter under
dispute. The award of the arbitrator shall be final and binding on the parties. In the
event of such arbitrator to whom the matter is originally referred, being transferred or
vacating his office or being unable to act for any reasons whatsoever such Chief
General Manager or the said officer shall appoint another person to act as arbitrator
in accordance with terms of the agreement and the person so appointed shall be
entitled to proceed from the stage at which it was left out by his predecessors.
The arbitrator may fromtime to time with the consent of parties enlarge the time for
making and publishing the award, Subject to aforesaid Indian Arbitration and
Conciliation Act 1996 and the Rules made there under, any modification thereof for
the time being in force shall be deemed to apply to the arbitration proceeding under
this clause. The award of the sole Arbitrator shall be final and binding on all the
parties to the dispute.
29. CONTINGENCIES:
If any item of work/operation provided in the work order does not read with the
specification and scope of work given in the tender document & the schedule of
rates, the contractor is required to perform such work under the orders issued by field
officer in-charge of work, then the rate for such works will be fixed by the
PGMTD,Jaipur, whose decision in the matter shall be final & binding on the
contractor.
The BSNL reserves the right to increase or decrease the quantum of work by 25% of
the tendered quantum of work without any changes in rates or terms and conditions of
the tender at the time of actual award of the work. The successful bidder is bound to

Tenderer(s)/bidder(s) cannot claim any compensation or hike in rates due to increase or
decrease in quantum of work to the extent of increase or decrease upto 25%.
The quantum of work will be spread over the entire validity period of the tender, i.e. Two
year and the extension period of the tender, if granted by the competent authority for further
