.Dear Sir,
Having examined the terms and conditions of tender, scope of work, and all addenda etc, we
the undersigned, offer to execute the work of Sweeping & Cleaning work at East area under
PGMTD, Jaipur, at the rates quoted by us.
[1] We undertake, if our bid (Tender Quotation) is accepted, we will submit all sureties as
mentioned in the tender and also that, we will execute the work only at the approved rates.
We will execute work in accordance with the scope of work, terms and conditions stipulated
in the tender document, and also as per the instructions/orders issued by the competent
authorities of PGMTD, Jaipur from time to time.
[2] We agree to abide by this Bid (Tender Quotation) for a period of 150 days from the date
of opening of qualifying bid, and also agree that the bid (Tender Quotation) may be accepted
at any time before expiry of bid validity period.
[3] Until a formal Agreement is prepared and executed, this bid together with the
writtenacceptance thereof in your notification and award shall constitute a binding contract
between us.

SECTION- III

Bidder has to submit online, scanned copies of following documents alongwith the tender
form:

1. Document showing the legal status of the bidder:

(A) In case of proprietor Firm:-

(i) Affidavit regarding sole propritership on non judicial stamp paper of Rs 100/- by
the proprietor.

(ii) Copy of vaild firm Registration.

(B) In case of Partnership Firm:

(i) Copy of Partnership Deed (all pages) clearly showing the names and addresses
of all partners.
(ii) Consent of all partners to enter into the tendered contract.
(iii) Copy of Valid firm Registration

(C) In case of a Limited Company (Private/Public) & Co-operative Societies [As the
case may be]
(i) Copy of Memorandum and Articles of the Association.

a) The power of attorney in original, in case, person other than the sole proprietor/
authorized signatory has signed the tender document, shall be on a non-judicial stamp
paper of Rs. 100/- in case same has been executed in between blood relations and in
other cases, it should be on a non–judicial stamp paper of Rs.100/- and should be
attested by the Notary Public or same should be registered before the sub registrar.

b) The power of Attorney is executed by a person who has been authorized by the Board
of Directors of the bidder in this regard, on behalf of the company/ institution/ Body
corporate.
c) In case of the bidder being a partnership firm, the said Power of Attorney should be
executed by all the partner(s) in favour of the said Attorney.

d) Attestation of the specimen signature of such authorized signatory of the bid by the
Companys/Firms bankers shall be furnished. Name, designation, phone number, mobile
number, email address and postal address of the authorized signatory shall be provided.

tender. Experience certificate duly issued by the competent issuing authority may be
submitted with technical bid online. (it is essential). Work order will not be
accepeted/entertained as Experience certificate.

SECTION – V
GENERAL INSTRUCTIONS TO THE BIDDERS
AND GENERAL TERMS AND CONDITIONS OF THE TENDER

1. ELIGIBILITY OF BIDDERS/TENDERERS:

1.1 No party who has any relatives working in Jaipur Telecom District shall submit the
tender. (Tenderer should give the certificate as per the format mentioned. The near
relatives for this purpose are defined as:
 Members of Hindu Undivided Family
 They are Husband & Wife
 The one is related to the other in the manner as father, mother, son(s), and son's
wife(daughter-in-law), daughter(s) and daughter's husband (son-in-law), brother(s)
and brother's wife (sister-in-law), sister(s) and sister's husband (brother-in-law).
1.2 Only sincere, capable, experienced and reputed agencies/parties in the field of
Housekeeping, Sweeping & Cleaning Work shall submit the tender.

1.3 Eligibility/ Experience:- Bidder/Tenderer who are having experience of 33% cost of

3.0 SEALING AND MARKING OF BIDS :
3.1 The bid may be called under :-
Single Stage Bidding & two Electronic Envelope System.
The details of sealing & marking of bids in each case is given below:
The bidder shall submit his bid in two envelopes.
**The First electronic envelope will be named as Techno-commercial bid. This
envelope will contain documents of bidders satisfying the eligibility / Technical &
commercial conditions.

**The second electronic envelope will be named as Financial bid (BOQ) containing
Price Schedules.

3.2 The AGM (Plg),Jaipur may, at its discretion, extend this deadline for the submission
of bids by amending the Bid Documents in which case all rights and obligations of the
PGMTD,Jaipur and bidders previously subject to the deadline will thereafter be
subjected to the extended deadline.

4.0 LATE BIDS:


No bid shall be accepted online either by GeM-Tender Portal or offline document by
the PGMTD, Jaipur after the specified deadline for submission of bids prescribed by
the PGMTD,Jaipur
5 MODIFICATION AND WITHDRAWAL OF BIDS:

5.1 The bidder may modify, revise or withdraw his bid after submission prior to deadline
prescribed for submission of bid.
5.2 The bidder’s modification, revision or withdrawal shall have to be online and digitally
authenticated.
5.3 No bid shall be modified subsequent to the deadline for submission of bids.

6.0 OPENING OF BIDS

6.1 The date fixed for opening of bids, if subsequently declared holiday by the BSNL/
submission of Bids not possible due to unavoidable circumstances, the bid will be
opened on the following working day,time and venue remaining unaltered unless the
revised date of opening of bids is notified before opening of tender
6.2 During the entire evaluation process, if it is observed that the downloaded is exactly
not as per the original tender document, and /or it is tampered / changed /altered
/modified in any way, the bid will be rejected.

7.0 BID SECURITY (Payment/Refund/Forfeiture): (EMD is 2.5% of Tender Cost /


Estimated Cost of Tender as per NIT)

7.1 EMD can be paid in the form of Demand Draft/ Bankers Cheque issued by a
Schedules bank drawn in favor of ‘Account Officer Cash Collection HQ BSNL Jaipur.’
payable at Jaipur. The tender, which is not accompanied by the requisite EMD, shall
be summarily rejected.
7.2 Concessions to MSE Units/NSIC: As per guidelines, issued by Ministry of Micro,
Small & Medium Enterprise (MSME), Government of India regarding concessions for
Micro & Small Enterprise Units registered with District Industries Centers or Khadi &
Village Industries Commission or Khadi & Village Industries Board or Coir Board or
National Small Industries Corporation(NSIC) or Directorate of Handicrafts &
Handloom or MSME units who have Udyog Aadhaar Memorandum(UAM) or any other
body specified by Ministry of Micro, Small & Medium Enterprise, shall be allowed the
following concessions:
7.2.1 The units registered under single point registration scheme of NSIC /MSE units for
OF Cable laying works are exempted from depositing the price of tender document
and from payment of earnest money deposit (EMD). Such bidder shall have to
upload the document in proof of registration of valid NSIC/MSE for carrying out of
the similar nature (tendered item) of work along with bid document.

7.2.2 A proof regarding current registration with bodies as detailed in para 7.1 above for
the tendered items will have to be attached along with the bid.

7.2.3 The enlistment certificate issued by bodies as detailed in para 7.2 should be current
& valid on the date of opening of bid.

8.0 PREPARATION OF BIDS/FILLING UP OF TENDER FORMS:

8.1 Cost of bidding: The bidder shall bear all costs associated with preparation and
submission of the bid. The BSNL will in no case be responsible or liable for these
costs, regardless the conduct or outcome of the bidding process.

8.2 The prospective tenderer should carefully readout the tender document and go
through all general terms and conditions; special terms and conditions, scope,
specification of work; approximate quantum of work; schedule of rates; check-list etc
and then only should fill up the tender quotation form.

9.0 TAXES and Duties:

9.1 Firm shall have valid GST registration, if applicable. The firm shall quote rates for all
items inclusive of all but exclusive of GST. No Concessional form in any shape shall
be issued by the BSNL. The firm shall claim GST with the bill clearly furnishing the
complete details of GST (number, amount, rate etc.) to be paid along with
documentary proof of applicable rate of GST. The documentary proof of GST
payment to be submitted with in stipulated period as per GST rules. BSNL, under no
circumstances, will consider any claim of GST not included in the bill. It will be the
firm’s responsibility to settle GST with GST authorities. All the GST rules updated
from time to time by Government of India & Rajasthan state shall be final in any
dispute regarding GST.

9.2 The contractor should keep a proper and clear record of all taxes & levies paid by
him. Especially the records of payment of GST should always be kept ready and
updated timely.

10.0 PERIOD OF VALIDITY OF BIDS:

10.1 Bid shall remain valid for 150 days from the date of opening the Technical [Qualifying
bid].A Bid valid for a shorter period shall be rejected by the BSNL as Non –
Responsive.

10.2 The BSNL reserves the right to request the bidder to extend the bid validity for period
of further 90 days and the bidder has to necessarily extend the bid validity.Refusal to
extend the bid validity will result in forfeiture of the bid security/The bidders will be
debarred from any further work/contract by BSNL(PGMTD, Jaipur BA) for one year
from the date of issue of such order.A bidder accepting the request and extending
the bid validity will not be permitted to modify his bid.

11.0 EVALUATION OF TENDER:

11.1 Preliminary, BSNL shall evaluate the tenders / bids to determine whether they are
complete, whether all required sureties have been furnished, whether the essential
documents are enclosed.

11.2 BSNL may waive any minor irregularity or non-conformity in a bid, which does not
constitute a material deviation, provided such waiver, does not prejudice or affect the
relative ranking of the bidders.

11.3 After the preliminary [Technical] evaluation, further evaluation and comparison of
responsive/ technically & commercially eligible bids/tender quotations will be done on
the basis of lowest quotes in the financial bids. The financial bids will be evaluated
on composite basis only (i.e. amount involved for complete work of Two year).

For composite basis evaluation purpose, approx. quantity as mentioned in the tender
will be taken into consideration.

11.4 BSNL is not bound to accept the lowest quotes. Reasonableness of the lowest
quoted rates will also be examined and verified.

12.0 Contacting the BSNL:-


12.1 No bidder shall try to influence BSNL on any matter relating to its bid, from the time
of bid opening till the time the contract is awarded.

12.2 Any effort by the tenderer/bidder to modify his bid or influence BSNL in the bid/tender
evaluation/ comparison or the contract award decision, shall be liable for rejection of
bid and forfeiture of EMD/Bid Security/Security deposit or The bidders will be
debarred from any further work/contract by BSNL(PGMTD, Jaipur BA) for one year
from the date of issue of such order.

13.0 SECURITY DEPOSIT:-


Amount of security deposit will be 10% of total approved cost of tender is to be
deposited by tenderer in cash or DD to Account Officer Cash Collection HQ BSNL
Jaipur before agreement.

13.2 REFUND OF SECURITY DEPOSIT:-

13.2.1 Security Deposit of the contractor(s) who has/have successfully executed the work
as per the issued Work Orders will be refunded after deducting all costs, damages
and other expenses that the BSNL may have incurred for making good any loss due
to any action of the contractor and which BSNL is entitled to recover from the
contractor. Normally Security Deposit will be released/ refunded on expiry of the
tender period and also on receipt of ‘No Dues Certificates’ and Satisfactory
Performance Reports from the concerned officer(s).

13.2.2 The Security Deposit, if the amount of which is paid by the successful bidder(s) in
cash or DD, will not bear any interest, i.e., refund of the Security Deposit will be
without any interest amount on it.

13.3 FORFEITURE OF SECURITY DEPOSIT:-

Security Deposit is liable for forfeiture in the event of or for the reasons detailed
hereunder:-
Breach of any items of terms and conditions (General) of the tender /contract by the
contractor.….The contractor fails to execute and complete the work within the
stipulated period of time, as specified in the detailed work order(s).….Quality of the
work is not satisfactory, and the work is not re-executed even after bringing the fact
to the notice of the contractor.…..Decision of PGMTD, Jaipur in this regard will be
final and binding on the contractor(s).

13.4 SIGNING OF AGREEMENT:-

Successful tenderer(s)/bidder(s) shall execute an agreement with PGMTD,Jaipur in


the given format, on a non-judicial stamp paper of Rs.500/- (Rs. five hundred
only ).Cost of stamp paper shall be borne by the tenderer/bidder. Signing of
agreement shall constitute the award of contract on the bidder.

14.0 VALIDITY OF TENDER/CONTRACT:-

14.1 Tender will be valid for a period of Two years in total from the date of award of work,
extendable by a further period of One year in spells of six month at a time without
any consent of the contractor.

14.2 However, the tender may be awarded initially for a period of Two year or even a
shorter period, if felt necessary, for monitoring of performance of the work by
contractor(s). If the performance is found to be satisfactory, the tender will be
awarded for a further period. The works will be executed during the entire validity
period or any extension thereof, as mentioned above, at the same rates and terms,
conditions.

15.0 Annulment of Award:-Failure of the successful tenderer(s)/bidder(s) to comply with


the requirement as regards to payment of Security Deposit and signing of the
agreement shall constitute sufficient ground for annulment of the award and forfeiture
of the Bid Security/EMDor The bidders will be debarred from any further
work/contract by BSNL(PGMTD, Jaipur BA) for one year from the date of issue of
such order. In such case, BSNL reserves the right to award the work to other eligible
tenderer(s)/bidder(s) or call for the new tender.

16.0 ACCEPTANCE / REJECTION OF TENDER:


PGMTD, Jaipur or any other competent authority reserves the right to reject any or all
tenders in full or in a part. Further, PGMTD,Jaipur or any other competent authority
reserves the right to hold in abeyance this tender in full or in part and also to
subsequently cancel this tender in full or in part. No liability will be incurred to the
affected bidder(s) on the grounds of BSNL's action of rejection/cancellation/holding
the tender in abeyance, before award of work or before the contract actually coming
into effect/force.

17.0 In general, the tenders will be received, opened, evaluated, finalized and awarded as
per the procedure given in the above clauses/paragraphs of Section-V: General
Terms & Conditions specified in the tender. In case of any ambiguity, PGMTD,Jaipur
reserves the right to fix any criteria/procedure or to make a slight change if required
any. Decision taken by PGMTD,Jaipur will be final in the matter.

18.0 ESCALATION / PRICES:

18.1 Rates once approved shall remain valid during the entire period of tender contract
and also during the extension period, if granted so after expiry of tender period.
PGMTD,Jaipur will not be responsible for any escalation in cost of materials/labour
rates or any increase in duties, taxes, levies etc.

18.2 Prices charged by the contractor(s) for the works performed under the contract shall
not be higher than the rates quoted by the tenderer(s)/bidder(s) and approved by the
competent authority of BSNL

19.0 SUB CONTRACT:

The contractor(s) shall not assign, sub contract or sublet the whole or any part of the
works covered by the contract, under any circumstances.

20.0 EXECUTION OF WORK:

The contractor will have to execute the work as per the instructions of Incharge of
Building/ Premises. The work will be commenced only after receipt of tender award
copy / work order issued by the competent authority. Three work orders will be
issued for three areas and Tenderer have to submit three bills for payment.

21.0 CERTIFICATION OF WORK;

21.1 In-charge of Building/Premises or any officer authorized cancerned DGM shall


inspect the works done at any time. The contractor shall prepare a log book to
include all items of works under this contract and get signed by the Officer in-charge
of location/building/premises maintenance. Logbook shall be maintained for works to
be carried out daily/weekly basis.

22.0 LABOUR LAWS:

22.1 The contractor shall obtain a valid labour license under the Contract Labour (R&A)
Act 1970 and the Contract Labour (Regulation & Abolition) Central Rules 1971,
before commencement of work and continue to have a valid license during the
validity of contract and renewal if any can be made.

22.2 During the performance of the works the contractor shall at his own cost and initiative
fully comply with the provisions of all acts and laws as regards to the engagement of
labour, payment of minimum wages and EPF, insurance etc.

22.3 No minor labour, i.e. below the age of eighteen (18) years or a labour with a criminal
record shall be employed on the work.

22.4 The contractor shall maintain all records relating to engagement of labours, payment
of wages to them, EPF & insurance etc. and make available the records to the BSNL
field Officers / Labour Enforcement Officer, whenever asked for.

23.0 PAYMENT TERMS:

23.1 Payment will be made for the areas where the work has actually been done to the
satisfaction of the In-charge of building/premises. Area of the work will be measured
by authorized field Officer, appointed by cancerned DGM and the payment shall be
made based on the actual measurement taken at the time of commencement of
work.

23.2 Contractor shall submit printed bills per month for the actual work done during the
month.

23.3 Bill should be submitted in terms of charges for actual work done & not in terms of
labour supplied/engaged

23.4 Bills for the work carried out will be settled on monthly basis i.e. bills for the works
carried out during the month will be submitted to the controlling officer. Contractor will
be responsible to submit the bills prepared, accurately & intime by observing all the
formalities.

23.5 Printed bills for the work carried out shall be submitted within 30 days from the date
of completion. In other words bill should be submitted not later than the last date of
the next month. Detailed justification shall invariably be given to each delayed bill and
the same shall be got approved by the concerned AGM/DE.

23.6 If bill not submitted within three months penalty will be imposed @ 2% of the amount
ofthe total monthly bill.

23.7 Bills submitted for payment shall be supported with proper tender award copy, due
certificate given by the in-charge of work regarding area of the Indoor/Out-door area
etc.
23.8 Firm shall submit the GST number printed bill/invoice with mentioning applicable
GST rate and amount of GST separately. BSNL GST number must be mentioned on
the bill/invoice as input TAX Credit of GST will be claimed by BSNL.If GST
number/GST rate and GST amount is not mentioned in bill/invoice, BSNL is not liable
to pay separate amount of TAX/GST.

23.9 On expiry/termination of the contract, all pending bills against this contract should be
submitted within a period of not more than 45 days after expiry/termination of the
contract.

23.10 100% payment will be made after scrutiny and thorough checking of the bill[s], after
deduction of taxes and other dues recoverable from the contractor.
23.11 The bills shall be submitted along with Attendance register, pay slip showing EPF/ESI
contribution, payment of EPF/ESI challans.
23.12 Income tax, surcharge on I/T at the prevailing rates and any other taxes levied by
Central/State Govts. will be deducted at source from the contractors bills. This will be
done as per the prevailing tax deduction procedure and guidelines issued by the
competent authorities of Central/State Governments in this regard.

23.13 PGMTD,Jaipur reserves the right to recovery compensation for damages caused by
the contractor to the BSNL properties or third party properties, while executing the
work. Such recoveries will be made from the bills submitted by the contractors and as
per the prevailing procedure, norms laid down by the BSNL.Decision of cancerned
DGM in this regard will be final and binding on the contractors.

24.0 RESCISSION / TERMINATION OF CONTRACT:


Under the following circumstances the competent authority may rescind/terminate the
contract:
[a] If the contractor commits breach of any item of terms and conditions of the contract.
[b] If the contractor suspends or abandons the execution of work and the field officer in-
charge of the work comes to the conclusion that work could not be completed by the
due date.
[c] If the contractor does not carry out the work as per the standards or the work already
carried out is of sub-standard quality.
[d] If the contractor fails to rectify/replace the defective work, even after giving the notice
to the contractor.
[e] If the contractor becomes bankrupt or otherwise insolvent as declared by the
competent court.In the event of rescission/termination of the contract as detailed
above, the security deposit paid by the contractor is liable for forfeiture. Decision of
cancerned DGM in this regard, will be final and binding on the contractor.

25. OPTIONAL TERMINATION BY BSNL :


The BSNL may, at any time, at its option cancel and terminate this contract by giving
notice in writing to the contractor. In the event of such optional termination, the
contractor shall be entitled to payment for the work done upto the time of such
cancellation/termination and also for the compensation in accordance with the
contract prices for any additional expenses already incurred for balance work. The

contractor shall be entitled for refund of S/D in the event of optional
cancellation/termination of the contract.

26. ISSUANCE OF NOTICE:


The AGM/Divisional Engineer/in-charge of work will issue show cause notice to the
contractor(s), giving details of lapses, violation of terms and conditions of the
contract, wrongful delays or suspension of work, directing the contractor(s) to take
corrective action. A definite time schedule for corrective action will be mentioned in
the notice. If the contractor fails to take corrective action within the stipulated time
frame, action as deemed feet will be taken against the defaulting contractor by the
competent authority of BSNL.
27. INDEMNITIES:
The contractor shall at all times hold the BSNL harmless and indemnify from against
all actions, suits, proceedings, works, cost, damages, charges claims and demands
of every nature and descriptions, brought or procured against the BSNL any its
officers and employees and forthwith upon demand and without protect or demur to
pay to the BSNL any and all losses and damage sand cost (inclusive between
attorney and client) and all costs incurred in endorsing this or any other indemnity or
security which the BSNL may now or at any time have relative to the work or the
contractor obligation or in protecting or endorsing its right in any suit on other legal
proceeding, charges and expense and liabilities resulting from +or incidental or in
connection with injury, damages of the contractor or damage to property resulting
from or arising out of or in any way connected with or incidental to the operations
caused by the contract documents. In addition the contractor shall reimburse the
BSNL or pay to the BSNL forthwith on demand without protect or demur all cost,
charges and expenses and losses and damages otherwise incurred by it in
consequence of any claim, damages and actions which may be brought against the
BSNL arising out of or incidental to or in connection with the operation covered by the
contractor.
The contractor shall at his own cost at the BSNL’s request defend any suit or other
proceeding asserting a claim covered by this indemnity, but shall not settle,
compound or compromise any suit or other finding without first consulting the BSNL.

28. ARBITRATION:

In the event of any question, dispute or difference arising under this agreement or in
connection there-with except as to matter the decision of which is specifically
provided under this agreement, the same shall be referred to sole arbitration of the
Principal General Manager Telecom District ,Jaipur or in case his designation is

changed or his office is abolished then in such event to the sole arbitration of the
officer for the time being entrusted whether in addition to the functions of the PGMTD
or by whatever designation such officers may be called (hereinafter referred to as the
said officer) and if the PGMTD,Jaipur or the said officer is unable or unwilling to act
as such to the sole arbitration or some other person appointed by the PGMTD, or the
said officer. The agreement to appoint an arbitrator will be in accordance with the
Arbitration and Conciliation Act, 1996. There will be no objection to any such
appointment that the arbitrator is Government Servant or that he has to deal with the
matter to which the agreement relates or that in the course of his duties as
Government Servant he has expressed views on all or any of the matter under
dispute. The award of the arbitrator shall be final and binding on the parties. In the
event of such arbitrator to whom the matter is originally referred, being transferred or
vacating his office or being unable to act for any reasons whatsoever such Chief
General Manager or the said officer shall appoint another person to act as arbitrator
in accordance with terms of the agreement and the person so appointed shall be
entitled to proceed from the stage at which it was left out by his predecessors.

The arbitrator may fromtime to time with the consent of parties enlarge the time for
making and publishing the award, Subject to aforesaid Indian Arbitration and
Conciliation Act 1996 and the Rules made there under, any modification thereof for
the time being in force shall be deemed to apply to the arbitration proceeding under
this clause. The award of the sole Arbitrator shall be final and binding on all the
parties to the dispute.

29. CONTINGENCIES:

If any item of work/operation provided in the work order does not read with the
specification and scope of work given in the tender document & the schedule of
rates, the contractor is required to perform such work under the orders issued by field
officer in-charge of work, then the rate for such works will be fixed by the
PGMTD,Jaipur, whose decision in the matter shall be final & binding on the
contractor.

30. BSNL RIGHT TO VARY QUANTUM OF WORK:

The BSNL reserves the right to increase or decrease the quantum of work by 25% of
the tendered quantum of work without any changes in rates or terms and conditions of
the tender at the time of actual award of the work. The successful bidder is bound to

accept additional quantum of work on the same rates and terms & conditions of the
tender during validity of tender/agreement and extended validity period.

31. PGMTD, Jaipur reserves the right to fix any criteria for opening, evaluation,
finalization of this tenderand award of work/contract after finalization of this tender,
which has not been clearly specified in the General Terms & Conditions of this tender
[Section-V]. PGMTD ,Jaipur also reserves the right to add, delete, change or modify
any clause[s] of general terms and conditions of the tender [Section-V], during
evaluation/finalization of this tender and award of work, provided such addition,
deletion, modification or change does not prejudice or affect the relative ranking of
