DEED OF EXTRA-JUDICIAL PARTITION

OF THE ESTATE OF THE LATE NORMAN JUMDAIYA LIM

KNOW ALL MEN BY THESE PRESENTS:

We, ESTHER L. LIM, widow of the late NORMAN JUMDAIYA LIM.


Filipino, with residence at Bagay St. Bongao, Tawi-Tawi; WINGARD
LIM, of legal age, Married, Filipino, with residence at I-1 RSG Guevent
Homes, Barangay San Andres, Cainta, Rizal; WAYNARD LIM, of legal
age, Married, Filipino, with residence at Don J. Lucero St. Talaytay,
Argao, Cebu; WENETTE LIM, of legal age, Married, Filipino, with
residence at District 7, Punawan, Mabuhay, Zamboanga Sibugay;
(collectively “the heirs”), hereby execute this Deed of Extra Judicial
Partition, stating thus:

1. We are the sole heirs of the late NORMAN JUMDAIYA


LIM (“NORMAN”), a citizen of the Philippines.

1.01 I ESTHER L. LIM (“ESTHER”) am the surviving spouse


of NORMAN. A certified true copy of our Marriage Contract is
hereto attached as Annex “A”, and made an integral part of this
deed;

1.02 We, WINGARD LIM, WAYNARD LIM and WENETE


LIM, are the legitimate children of NORMAN and ESTHER.
Certified true copies of the Certificates of Live Birth of Wingard,
Waynard and Wenette, indicating that they are the legitimate
children of Norman and Esther are attached as Annexes “B”,
and “C” and made integral parts of this deed;

2. Norman died intestate on 27 October 2021 at Bongao, Tawi


Tawi, without leaving any Last Will or Testament and without leaving
any debts or accounts whatsoever. A certified true copy of the Death
Certificate of Norman is attached as Annex “D”;

3. At the time of his death, Norman owned the following real


properties enumerated herein, either in his own right or as co-owner of
conjugal property:

a. A parcel of land with improvements located at Lot 1513-B-1,


Municipality of Bongao, Tawi Tawi, covered by Transfer Certificate of
Title (TCT) No. T-419, and more particularly described as follows:

“A parcel of land (Lot 1513-B-1) of the subdivision plan, PSD-(ARMM)-


000258 being a portion of Lot No. 1513-B-PSD-09-009675 LRC. Cad.
Rec. No. situated in the Barangay of Poblacion, Bongao, Municipality of
Bongao, Province of Tawi-Tawi, Island of Bongao. Bounded on the
North West. 2-3 by Lot No. 1513-B-3 of the subdivision plan, PSD-
(ARMM)-000258, bounded on the North Line 3-4 by Lot 1513-B-3 of
the subdivision plan, PSD-09-009675, on the South East line 4-1 by Lot
No. 1514-B-4 and bounded on the South West line 1-2 by Lot No.
1513-B-2 both of the Subdivision Plan PSD-(ARMM)-000258. Beginning
at a point marked “1”on plan being S. 73 deg. 18’E., 2506.56m. from
BLIM No.1, Pls-655-D, Thence N. 54. Deg. 51’W., 28.63 m. to point 2;
N. 23. deg. 59’E., 20.02m. to point 3; S. 54 deg. 50’E., 28.65 m. to
point 4; S. 24 deg. 02’W., 20.01m. to point of beginning containing an
area of FIVE HUNDRED SIXTY TWO (562) SQUARE METERS. ”

A certified true copy of TCT No. T-419 is hereto attached marked


as Annex “E” and respectively, and made an integral part hereof.

A Certification from the Municipal Treasurer of Bongao, Tawi Tawi


dated 25 October 2022, Certifying that taxes on the property have been
fully paid as of 31 December 2022 is herein attached as Annex “E-1”

b. An inchoate conjugal co-ownership share in a parcel of land


located in Barrio of Poblacion, Municipality of Bongao, Province of Tawi-
Tawi, covered by Original Certificate of Title (TCT) No. P-632, and more
particularly described as follows:

“Beginning at a point marked “1” on Plan Msi-09-06-000393,


being S. 25-05 W., 484.79m. from triangulation station Bongao
Light House”;
N. 72-51 W., 13.31m. to point 2; N 10-35 E., 3.87 m. to point 3:
S. 72-09 E., 13.93 m. to point 4; S. 19-43 W., 3.68 m. to point 1;

Containing an area of FIFTY ONE (51) SQUARE METERS.”

A certified true copy of OCT No. P-632 is hereto attached marked


as Annex “F” and respectively, and made an integral part hereof.

A Certification from the Municipal Treasurer of Bongao, Tawi Tawi


dated 25 October 2022, Certifying that taxes on the property have been
fully paid as of 31 December 2022 is herein attached as Annex “F-1”

c. An inchoate conjugal co-ownership share in shares of stock as


follows (“shares of stock” for brevity):

Copies of the Certificates of Stock indicating the above-mentioned


facts are hereto attached marked as Annex “G” and respectively, and
made an integral part hereof

4. By way of liquidating the conjugal partnership regime of


Norman and Esther, one-half (1/2) share of the property covered by
TCT T-419 under the name of Norman J. Lim is hereby adjudicated to
Esther, as her share in conjugal partnership property; while the
remaining one-half (1/2) share pro-indiviso share shall comprise the Net
Hereditary Estate of Norman which shall be distributed among his heirs.

On the other hand, one-half (1/2) share of the property covered by OCT
P-632 under the name of Esther L. Lim and the afore-mentioned Shares
of Stock also under the name of Esther L. Lim shall pertain to her as her
exclusive share in the conjugal property; while the remaining one-half
(1/2) share in the afore-mentioned properties shall be considered
Norman’s inchoate share in the conjugal partnership property and shall
form part of this Net Hereditary Estate which shall be distributed among
his heirs pursuant to Article 116 of the Family Code, which provides that
all property acquired during the marriage, whether the acquisition
appears to have been made, contracted or registered in the name of
one or both spouses, is presumed to be conjugal unless the contrary is
proved.

5. Thus, after the liquidation of the conjugal partnership regime


of Norman and Esther, the real estate properties covered by TCT T-419
and OCT P-632 and the shares of stock as mentioned above shall be
divided in the following manner: ESTHER as absolute owner of one-half
(½) pro-indiviso share; and, the net hereditary estate of NORMAN.,
which consists of the other one-half (1/2) pro-indiviso share of the
above described properties.

6. Pursuant to Section 1, Rule 74 of the Revised Rules of Court


of the Philippines, the heirs, herein being all of age and full civil
capacity, have agreed to divide and adjudicate, the one-half (1/2) pro-
indiviso share comprising the Net Hereditary Estate Norman among
themselves in the manner provided in the succeeding paragraph.

7. In sum, with regard to the Net Hereditary Estate of Norman


for the property covered by TCT T-419, the heirs have agreed to waive

their respective share in favour of WINGARD and thus, the said
property shall be owned and registered in the names of the following
according to their share in ownership: ESTHER, as the owner of her
exclusive share which comprises one-half of the property and
WINGARD as the sole heir of the Net Hereditary Estate of Norman with
regard to TCT T-419, comprising the other half of the property.

As for the property covered by OCT P-632, the same shall be


divided equally among the heirs. Thus, the said properties shall be
owned and registered in the names of the following according to their
share in ownership: ESTHER L. LIM (6.25/10); WINGARD LIM
(1.25/10); WAYNARD LIM (1.25/10); WENETTE LIM (1.25/10).

As for the Net Hereditary estate of Norman with regard to the


shares of stock, the heirs have likewise agreed to waive their respective
share in favour of WINGARD and thus, the same shall be owned and
registered in the names of the following according to their share in
ownership: ESTHER, as the owner of her exclusive share which
comprises one-half of the property and WINGARD as the sole heir of
the Net Hereditary Estate of Norman with regard to shares of stock,
comprising the other half of the property.

8. We hereby affirm that we have executed this instrument out


of our own free will without force, intimidation or violence upon our
person, and that we have hereby received our just and proper share
and have no more claim or demand against each other in connection
with the adjudication of the above-described property.
