Regarding
The Organization and Functioning of the General Secretariat of the
National Council for Building Technical Regulations
Royal Government

- Having seen the Constitution of the Kingdom of Cambodia;


- Having seen the Royal Decree No. NS/RKT/0918/925 dated 6 September 2018 on the
Appointment of the Royal Government of the Kingdom of Cambodia;
- Having seen the Royal Decree No. NS/RKT/0320/421 dated 30 March 2020 on the
Appointment and Compositional Amendment of the Royal Government of the
Kingdom of Cambodia;
- Having seen the Royal Kram No. NS/RKM/0618/012 dated 28 June 2018 which
promulgates the Law on the Organization and Functioning of the Council of Ministers;
- Having seen the Royal Kram No. NS/RKM/0699/09 dated 23 June 1999 which
promulgates the Law on the Establishment of the Ministry of Land Management, Urban
Planning and Construction;
- Having seen the Royal Kram No. NS/RKM/1119/019 dated 2 November 2019 which
promulgates the Law on Construction;
- Having seen the Sub-Decree No. 20 ANKr.BK dated 30 April 1996 on the Organization
and Functioning of the Ministry and State Secretariat;
- Having seen the Sub-Decree No. 62 ANKr.BK dated 20 July 1999 on the Organization
and Functioning of the Ministry of Land Management, Urban Planning and
Construction;
- Having seen the Sub-Decree No. 114 ANKr.BK dated 7 September 2015 on the
Determination and Positioning of the Management Structure of Ministries, National
and Sub-National Institutions;
- Having seen the Sub-Decree No. 103 ANKr.BK dated 31 May 2022 on the
Organization and Functioning of the National Council for Building Technical
Regulations;
- As per the request of the Minister of Land Management, Urban Planning and
Construction;

IT IS HEREBY DECIDED
CHAPTER ONE
GENERAL PROVISIONS
Article 1:
This sub-decree determines the organization and functioning of the General Secretariat of the
National Council for Building Technical Regulations, called the General Secretariat of the
N.C.B.T.R..
CHAPTER TWO
ROLES, TASKS, AND STRUCTURE
Article 2:
The General Secretariat of the N.C.B.T.R. is an operating body of the N.C.B.T.R. and has the
following tasks:
- Initiate studies and research for the development of building technical regulations;
- Submit proposals to the N.C.B.T.R. in order to review, decide or amend the building
technical regulations;
- Prepare plans, project proposals, and training programs on building technical standards,
requirements, rules, and regulations for officials, professionals, higher education
institutions, research institutions, and relevant private sectors;
- Organize meetings, conferences, and workshops in order to consult, develop, integrate,
and publicize building technical standards, requirements, rules, and regulations;
- Monitor, evaluate, and make reports on the economic, social, and environmental
impacts and the effectiveness of the implementation of building technical standards,
requirements, rules, and regulations;
- Collaborate with national and international development partners for the development
of building technical standards, requirements, rules, and regulations;
- Manage the administration, planning, finance, and techniques in order to ensure the
effectiveness of the general administrative processes of the N.C.B.T.R.;
- Prepare the annual budget, and manage the resources and finances of the N.C.B.T.R.
- Prepare the minutes of meetings and create reports for the N.C.B.T.R.;
- Prepare monthly reports as well as summary reports of the performance results to the
Chairperson of the N.C.B.T.R. every third month, sixth month, ninth month, and
twelfth month of the year;
- Perform all other duties as assigned by the Chairperson of the N.C.B.T.R..
Article 3:
The General Secretariat of the N.C.B.T.R. consists of one Secretary General, who is assisted
by a number of Deputy Secretary Generals in accordance with other existing laws and
regulations.
The Secretary General shall be appointed by a Royal Decree.
Deputy Secretary Generals shall be appointed by either a Royal Decree or Sub-Decree.
Deputy Secretary Generals shall perform the duties as determined by the Secretary General.

Article 4:
The General Secretariat of the N.C.B.T.R. is entitled to use a dedicated stamp for the purposes
of fulfilling work obligations.
The stamp design of the General Secretariat of the N.C.B.T.R. is provided in Annex 1 of this
sub-decree.
Article 5:
Officials within the General Secretariat of the N.C.B.T.R. are civil servants of the Ministry of
Land Management, Urban Planning and Construction.
Representatives of other ministries and institutions who are vice chairs or members of the
General Secretariat of the N.C.B.T.R. are able to assign officials to work at the General
Secretariat as requested by the chairperson of the N.C.B.T.R..
The General Secretariat of the N.C.B.T.R. is able to request for the employment of interim
officials.
Officials who have received approval to work for the General Secretariat of the N.C.B.T.R.
must be suspended from their previous work obligations while their position, salary, and
seniority shall be maintained for the purposes of promotions, ranking, and retirement.
Moreover, a civil servant holding multiple positions must decide upon the salary of a single
position.
Article 6:
The General Secretariat of the N.C.B.T.R. consists of the following departments:
- Department of Administration and Finance;
- Department of Structural Buildings;
- Department of Geotechnics;
- Department of Building Services;
- Department of Architecture and Green Development.
Article 7:
Each department consists of one Director and a number of Deputy Directors in accordance with
other existing laws and regulations.
Department Directors shall be appointed by a Sub-Decree.
Deputy Directors shall be appointed by a Prakas from the Minister of Land Management, Urban
Planning and Construction.
The organizational chart of the General Secretariat of the N.C.B.T.R. is provided in Annex 2
of this sub-decree.
Article 8:
The organization and functioning of the offices within each department of the General
Secretariat of the N.C.B.T.R. shall be determined by a Prakas from the Minister of Land
Management, Urban Planning and Construction.

CHAPTER THREE
DUTIES OF EACH DEPARTMENT

Article 9:
The Department of Administration and Finance has the following tasks:
- Manage the administration, personnel, finance, procurement, supply, and management
of assets of the N.C.B.T.R.;
- Prepare annual action plans and budgets for the General Secretariat;
- Organize meetings, workshops, and protocols;
- Study, research, collect, compile, publish, organize training, and publicize legislation
related to building technical regulations;
- Monitor and evaluate the implementation of memoranda, protocols, and cooperation
agreements with national and international development partners;
- Organize and control the information technology system and update the website of the
N.C.B.T.R.;
- Prepare monthly reports as well as summary reports of the performance results of the
Department, the General Secretariat, and the N.C.B.T.R. every third month, sixth
month, ninth month, and twelfth month of the year;
- Perform all other duties as assigned by the Secretary General.
Article 10:
The Department of Structural Buildings has the following tasks:
- Study, research, establish, collect, and compile building technical standards for
structural buildings, design loads, building equipment, and building products;
- Initiate and propose decisions on building technical regulations for structural buildings;
- Monitor and evaluate the implementation of building technical standards and building
technical regulations for structural buildings, design loads, and building products; as
well as request for the amendment of building technical regulations where necessary;
- Study, research, and prepare guidelines for the implementation of building technical
regulations for structural buildings, design loads, building equipment, and building
products;
- Cooperate with ministries, institutions, national and international development
partners, higher education institutions, research institutions, and the private sector in
order to study, research, and develop building technical standards and building
technical regulations for structural buildings, design loads, building equipment, and
building products;
- Prepare plans and training programs on building technical standards and building
technical regulations on structural buildings, design loads, building equipment, and
building products for professionals, officials, higher education institutions, research
institutions, and relevant private sectors;
- Manage the administration, finance, and personnel of the department;
- Prepare annual action plans and a budget for the department;
- Prepare monthly reports as well as summary reports of the performance results of the
Department every third month, sixth month, ninth month, and twelfth month of the year;
- Perform all other duties as assigned by the Secretary General.

Article 11:
The Department of Geotechnics has the following tasks:
- Study, research, establish, collect, and compile building technical standards for
geotechnics including soils and foundations, soil improvement, slope stability, and
excavation;
- Initiate and propose decisions on building technical regulations for geotechnics;
- Monitor and evaluate the implementation of building technical standards and building
technical regulations for geotechnics, and request for the amendment of building
technical regulations where necessary;
- Study, research, and prepare guidelines for the implementation of building technical
regulations for geotechnics;
- Cooperate with ministries, institutions, national and international development
partners, higher education institutions, research institutions and the private sector in
order to study, research, and develop building technical standards and building
technical regulations for geotechnics;
- Prepare plans and training programs on building technical standards and building
technical regulations on geotechnics for professionals, officials, higher education
institutions, research institutions, and relevant private sectors;
- Manage the administration, finance, and personnel of the department;
- Prepare annual action plans and a budget for the department;
- Prepare monthly reports as well as summary reports of the performance results of the
Department every third month, sixth month, ninth month, and twelfth month of the year;
- Perform all other duties as assigned by the Secretary General.
Article 12:
The Department of Building Services has the following tasks:
- Study, research, establish, collect, and compile building technical standards of
mechanical systems, electrical systems, plumbing systems, information technology,
and telecommunication systems, acoustic and insulation systems, and other building
services aligning with economic, social, environmental, scientific and technological
situations;
- Initiate and propose decisions on building technical regulations for mechanical systems,
electrical systems, plumbing systems, information technology, and telecommunication
systems, acoustic and insulation systems;
- Monitor and evaluate the implementation of building technical standards and building
technical regulations for mechanical systems, electrical systems, plumbing systems,
information technology, and telecommunication systems, acoustic and insulation
systems and other building services as well as request for the amendment of building
technical regulations where necessary;
- Study, research, and prepare guidelines for the implementation of building technical
regulations for mechanical systems, electrical systems, plumbing systems, information
technology, and telecommunication systems, acoustic and insulation systems and other
building services;
- Cooperate with ministries, institutions, national and international development
partners, higher education institutions, research institutions, and the private sector in
order to study, research, and develop building technical standards and building
technical regulations for mechanical systems, electrical systems, plumbing systems,

information technology, and telecommunication systems, acoustic and insulation
systems, and other building services;
- Prepare plans and training programs on building technical standards and building
technical regulations on mechanical systems, electrical systems, plumbing systems,
information technology, and telecommunication systems, acoustic and insulation
systems, and other building services for professionals, officials, higher education
institutions, research institutions, and relevant private sectors;
- Manage the administration, finance, and personnel of the department;
- Prepare annual action plans and a budget for the department;
- Prepare monthly reports as well as summary reports of the performance results of the
Department every third month, sixth month, ninth month, and twelfth month of the year;
- Perform all other duties as assigned by the Secretary General.
Article 13:
The Department of Architecture and Green Development has the follow tasks:
- Study, research, establish, collect, and compile building technical standards of
architecture and green development aligning with economic, social, environmental,
scientific, technological situations, and focusing on individuals with disabilities,
children, the elderly, and gender equality;
- Initiate and propose decisions on building technical regulations for architecture and
green development;
- Monitor and evaluate the implementation of building technical standards and building
technical regulations for architecture and green development as well as request for the
amendment of building technical regulations where necessary;
- Study, research, and prepare guidelines for the implementation of building technical
regulations for architecture and green development;
- Cooperate with ministries, institutions, national and international development
partners, higher education institutions, research institutions, and the private sector in
order to study, research, and develop building technical standards and building
technical regulations related to architecture and green development;
- Prepare plans and training programs on building technical standards and building
technical regulations on architecture and green development, and other building
services for professionals, officials, higher education institutions, research institutions,
and relevant private sectors;
- Manage the administration, finance, and personnel of the department;
- Prepare annual action plans and a budget for the department;
- Prepare monthly reports as well as summary reports of the performance results of the
Department every third month, sixth month, ninth month, and twelfth month of the year;
- Perform all other duties as assigned by the Secretary General.

CHAPTER 4
FINAL PROVISIONS
Article 14:
Any provisions that contradict this sub-decree shall be abrogated.

Article 15:
The Minister in charge of the Office of the Council of Ministers, the Minister of Economy and
Finance, the Minister of Land Management, Urban Planning and Construction, and the
Ministers from all ministries and Heads of all relevant institutions shall be responsible for the
implementation of this sub-decree according to their respective duties from the date of signing
of this sub-decree.
