Case 1:
Mona, Nour and Lara are friends. Mona is 21, Nour is 18, and Lara is 23. Lara wanted to start
a business, so based on Mona’s recommendation, Lara bought a fast-food franchise worth
51000 CAD. Nour agreed with Mona’s restaurant to provide food for her birthday party;
however, before the due date Lara decided to repudiate the contract. Now, Mona demands full
payment. Furthermore, the fast-food franchise started to lose money so Mona wants to
rescind the contract because the business failed.

Answer the following questions:


1. In Egypt: Is Mona entitled to the full payment from Nour? (1 Mark)
In Egypt, a number of variables, including the wording of the agreement, any applicable laws,
and the justification for Lara's repudiation of the agreement, would determine the legitimacy
of the contract and whether Mona is entitled to receive full payment from Nour. As for, Nour
she may have a legal claim for damages, which may include the whole money for the services
she was expected to give, provided she and Lara had a legitimate contract for catering
services and Lara unjustly rejected the agreement. Lastly, Egyptian contract law would have
been taken into account.

2. In Canada: What is the competent court to issue the dispute? (0.5 Mark)
The competent court to issue the dispute in Canada will depend on the jurisdiction in which
the franchise agreement was signed. Provinces in Canada have their own court system. It will
determine on which court depending on where the contract was made.

3. In Canada and Egypt: Does Mona have the right to rescind the contract? (1
Mark)
In both Canada and Egypt, it will depend on certain conditions and terms of contract whether
Mona will have the right to rescind the contract. If the fast-food franchise starts to lose
money, Mona will have to speak with her lawyer and read the franchise agreement very
carefully to see if she has the right to cancel the contract. If the contract meets the given
conditions, Mona will have the right to rescind the contract. It's important to keep in mind
that the laws are different in both countries whether it's in Egypt or Canada. This is why it's
also important to consult a lawyer who is familiar with law to be able to determine Mona’s
right.

Case 2:
Hossam is 23 years old. He went to a self-service store to buy himself some snacks. Then, he
silently went to the cashier and paid the amount shown on the display. Moreover, he decided
to buy himself a coffee from a drive through cafe.
Hossan has the Nazi’s symbol on his car; so, the waiter decided not to serve him coffee.
Hossam got angry and drove carelessly which caused a car accident that broke his car. So. he
decided to take a taxi. As a result, he hailed a cab by the gesture of raising a hand and calling,
“Taxi!”.

Answer the following questions:


1. Clarify the offer and acceptance, mentioning their types in the self-service store.
(1 Mark)
Offer: While Hossam was entering the self-service store he bought himself some snacks. He
bought the snacks he wanted and went to the cashier to pay for them. Hossam made an offer
to himself by buying the items he had picked.
Acceptance: As the cashier was scanning his items this showed an act of acceptance. Also,
when Hossam saw the amount shown on display he accepted the offer that was given to him
by the store. However, this was a legally binding agreement that has been created.

2. Is Hossam entitled to compensation from the cafe? (1 Mark)


Hossam is entitled to compensation for the cafe’s refusal to give him coffee because the sign
on his car would depend on the particulars of the case as well as local anti-discrimination
regulations. Some states may deem it illegal to discriminate against someone based only on
their icons or connections, such as having a Nazi symbol on a vehicle.
Hossam might be entitled to damages for discrimination or other legal remedies if the
establishment refused to serve him because of the symbol alone, in violation of applicable
laws. But, the precise result would rely on regional rules and ordinances, therefore Hossam
should speak with a legal professional to evaluate the circumstances.

3. When Hossam stopped the taxi, was it an offer or an acceptance? (0.5 Mark)
By the gesture of raising a hand and calling, “Taxi”, Hossam’s action shows an action of
offer. When the taxi driver stopped, it was a response of acceptance to Hossam’s signal. A
contract for a taxi ride has been made.
