List of evidence for I-130 and I-485 (this evidence list applies for both, petitioner and beneficiary)

• Two passport-style photographs


• Passport for both
• Naturalization certificate or permanent residence card (if applicable for petitioner)
• A copy of your government-issued identity document with photograph
• A copy of your birth certificate. If it is unavailable or does not exist, submit other
acceptable evidence of birth such as church, school, or medical records, and proof
of unavailability or nonexistence
• Inspection and admission, or inspection and parole documentation (stamp on
passport or I-94 document)
• Documentation of immigrant category, such as a copy of Form I-797, Approval or
Receipt Notice, for the Form I-130 filed on your behalf (unless you are filing your
Form I-485 with the Form I-130 filed on your behalf)
• Form I-864, Affidavit of Support (if required)
• Certified police and court records of all criminal charges, arrests, or convictions
regardless of final disposition (if applicable)
• Documentation regarding J-1 and J-2 exchange visitor status (Form I-612, if
applicable)
• Marriage certificate, and divorce decree (if applicable)
o Proof of marriage: bank statement under both names, utility bills,
lease/mortgage statement, etc.
o Family photos
o Good faith letters: stating that the marriage is in good faith, at least 3 letters
from people that know of the marriage (they must be US citizens or permanent
residents)
• Birth certificate for children (if applicable)
• Residency history for the past 5 years; employment history for the past 5 years
(include complete addresses, dates from and to (mm/dd/yyyy)
• Date when beneficiary entered the U.S.A. for the last time (mm/dd/yyyy)

Affidavit of Support Under Section 213A of the INA | USCIS


For ALL sponsors:

• A copy of your individual federal income tax return, including W-2s for the most recent
tax year, or a statement and/or evidence describing why you were not required to file.
Also include a copy of every Form 1099, schedule, and any other evidence of reported
income. You may submit this information for the most recent three tax years, pay
stubs from the most recent six months, and/or a letter from your employer if you
believe any of these items will help you qualify.
• For U.S. citizens or U.S. nationals, a copy of your birth certificate, passport, or
Certificate of Naturalization or Citizenship.
• For lawful permanent residents, a copy of both sides of your Permanent Resident Card
• Current government issued ID

For SOME sponsors:

• If you are currently self-employed, a copy of your Schedule C, D, E, or F from your most
recent federal income tax return which establishes your income from your business.
• For U.S. citizens or U.S. nationals, a copy of your birth certificate, passport, or
Certificate of Naturalization or Citizenship.
• For lawful permanent residents, a copy of both sides of your Permanent Resident Card
• Current government issued ID
