(received 04.03.2023, Section received 23.03.2023 In the reference cited, Adverse news published in Prabha News District edition on 20.02.2023, with a caption of * 09 & Sod 85 rm S25 dug” due to this the Collector Bhadradri Kothagudem has issued instructions to verify the FP Shops in ‘Tekulapally Mandal the DCSO & Naib Tahsildar (CS) Kothagudem (I/c) have proceeded to the FP Shop No.3019005, Pragallapadu village Tekulapally Mandal on 20.02.2023 @ 1.00 PM_ has filed complaint under section 6(A) of EC Act, 1955 against Sri. Gaddam Eramma Dio Gangaiah ,FPShop Dealer of Shop No3019005 - Pragallapadu village of Tekulapally Mandal, the following variations with reference to the Distribution Register, Stock Register and EPOS Screens. As such, the DCSO & Naib Tahsildar (CS), Kothagudem has submitted that, due to the above variation of stocks, it was established that, the FPS dealer is indulging in clandestine business of PDS rice for diversion in to the black market and also interrupting the smooth functioning of Public Distributing System by Contravening Violation of Clause17A17B17C of the authorization issued under Telangana State Public Distribution System Control Order 2016r/w sec 3 of the EC Act.1955, IAs per the Clause 17(A), 17(c) of TS PDS (Control) order, 2016, it is provided that : (A) Interruption in the process of Distribution “No Fair Price Shop dealer or card holder or any person shall be allowed to cause interruption or interfere with the process of smooth distribution of Scheduled commodities under Public Distribution System or other Government schemes at any level right from~ Food Corporation of India Civil Supplies Corporation godown point to Fair Price Shop point, till the scheduled ‘commodity reaches the intended beneficiary. Any such attempt of interruption or interfering with such process shall be treated as an abetment ‘and be deemed to have contravened this order, thereby committing an ‘offence under Section 8 of the Essential Commodities Act 1955. (B) If at the time of inspection, the variation in stock Is tound to be more than ‘the stock physically available, the dealer shall be liable to deposit the cost of the commodity for such difference at the market rate prevailing as on date of inspection. Whereas, as per the Condition 4(c) &g of Clause 19 of TS PDS (Control) Order, 2016 it is provided that, he authorization issued under this order shall be lable for suspension or cancellation, as the case may be, for any contravention of the provisions of this order or any instructions, directions, or orders issued by the Government or Commissioner of Civil Supplies or the Collector or Chief Rationing Officer or the appointing authority concerned. In view of the above report, Sri. Gaddam Eframma D/o Gangaiah FPS Dealer of Shop 1No.3019005- Pregallapadu village of Tekulapally Mandal, is hereby directed to show cause as to why her authorization shall not be put under suspension temporarily under clause 4 (6 of TS PDS (Control) Order 2016, pending enquiry.
