COMPLAINT-AFFIDAVIT

I, GINIPER ANISTONE, of legal age, single, Filipino, and a resident of Barangay


San Roque, Cebu City, after having been duly sworn to in accordance with law,
do hereby depose and state that:

1. I am and the same person who is the complainant in the instant case;
2. I know the person of DEKDEK, being my college sweetheart for more
than two years.
3. On March 16, 2011 right after our graduation, we both decided to live in
together.
4. After being a former live in partners for more than eight years, we were
blessed with one wonderful child, Washington aged 7.
5. The first five years of our relationship have been harmonious. He was a great
and responsible man to our family and become a seafarer that can fully acquire
our needs.
6. However, things changed starting September 03, 2017, when he was find a
certain girl name MARRY ANN and left me and his son. He and his new
girlfriend live happily.
7. On January 15 2019 he and MARY ANN have been married. Even though
DEKDEK is married to another woman but he constantly provides financial
support to our child in the amount of 20,000 pesos per month and he visit our
child and sometimes bring him to malls and other places that our child want to
visit.
8. On March 18 2021, when he was figured into an accident in the course of his
employment which resulted to the incapacity of DEKDEK to return to work.
While he received compensation form the work- related accident, most of it was
spent to his medication and actually a bigger portion was given to me for the
support to our child.
9. However, things changed after his medication, DEKDEK had troubles with
managing his finances, as he no longer is working, and so, he after year 2021, He
was not able to provide financial support to our child.
10. But on May 06 2022, I know his status that he gained employment as a
medical representative in a known supplier for medical goods and supplies. As a
mother to our child I started to demand financial support to our child but he
cannot continue and provide the same amount as he has been providing when
he was a seafarer. According to him, he can only share a portion of his meager
salary, since he is also providing for his legitimate family and he demanded that
he started providing 2,000 pesos per month financial support for our child.
11. But as a mother to our child I did not convinced of what he demanded and
said because the salary of medical representative in the Philippines was 18,409
pesos per month and that 2,000 pesos he said was not enough to support the
need of our child. Our child was weak and sick and not goes to school.
12. That his act of failure to give enough financial support to our child
tantamount to economic abuse which is defined under R.A 9262 or Violence
Against Women and their Children as:

Economic abuse” refers to acts that make or attempt to make a woman financially
dependent which includes, but is not limited to the following:

1. withdrawal of financial support or preventing the victim from engaging in


any legitimate profession, occupation, business or activity, except in cases
wherein the other spouse/partner objects on valid, serious and moral grounds as
defined in Article 73 of the Family Code;

13. That I cause the preparation of this affidavit to support my


complaint.
IN WITNESS WHEREOF, I have here unto set my hand this November, 2023 at
