Loan Agreement and Disclosure Statement 12640 1699006012
1. CASHA shall extend to June Dela Cruz San Pedro (the BORROWER) a salary loan facility which may be availed of by one time availment or
several availments. The total amount of the loan principal that the BORROWER may avail of will be determined by the BORROWER'S
monthly salary and the credit score on CASHA's system. BORROWER shall execute a promissory note (PN), and disclosure statement for
every availment, which shall be considered integral parts of this T&C. This salary loan facility shall be available to the BORROWER for as
long as the BORROWER remains an employee of Diamond Q Security Agency Inc (EMPLOYER COMPANY), subject to the approval of
CASHA.
2. The monthly amortization on the availment/s shall bear an interest of 3.50% on the loan's principal amount per month, automatically
deductible from the BORROWER'S monthly salary by the EMPLOYER COMPANY. The BORROWER con rms the Authority To Deduct (ATD)
and that the deduction shall continue until the loan is fully paid.
3. The BORROWER shall pay directly to CASHA the amount due under any of the following circumstances: (a) His name is excluded from the
monthly collection list; (b) He is on extended leave without pay; (c) The monthly amortization is not deducted and/or remitted by the
EMPLOYER COMPANY; (d) The loan amortization deducted from the payroll is not su cient to cover the full amortization due; (d) other
reasonable circumstances that CASHA may deem necessary.

4. BORROWER agrees that any outstanding amount will be deducted from his nal pay upon resignation or termination of employment
from the EMPLOYER COMPANY.

5. The BORROWER represents and warrants that: (a) He is an employee of the EMPLOYER COMPANY with a regular and permanent status;
(b) There is/are no pending or threatened actions before any court or governmental agency of any jurisdiction, which will materially
a ect his nancial condition or capacity;

6. The BORROWER shall be considered in default if: (a) He fails to fully pay any monthly amortization or any accrued interest and other
charges thereon; (b) His monthly salary is insu cient to satisfy the full amount of the monthly amortization; (c) Any of his

representation or warranty proves to be untrue in any material aspect; (d) He breaches or fails to comply with any term or condition in
this agreement. If any event of default occurs, the whole unpaid principal, accrued interest and other charges shall immediately

become due and demandable without the necessity of demand, protest or any further act or deed.
7. If the BORROWER defaults, his loan may be re nanced at the sole discretion and approval of CASHA. The outstanding principal and the

accrued interests shall be the re ected principal amount of the new loan.
8. Should the BORROWER be separated, terminated or severed from employment, he shall pay a late charge of 3.5% for each installment

that remains unpaid for more than 1 day after its due date. Such late charge shall be paid as liquidated damages.
9. No delay in enforcing any right of CASHA under this T&C, or assignment of CASHA of its right, or failure to accelerate the debt subject of

the Agreement by reason of default in the payment of any installment or the acceptance of a past-due installment shall be construed as
waiver of the right of CASHA to thereafter insist upon strict compliance with these T&C without notice being given to BORROWER.

10. This Agreement shall be binding upon the successors and assigns of both parties.

11. If any one or more of the provisions of this T&C is determined to be unenforceable, in whole or in part, for any reason, the remaining
provisions shall remain fully operative.
12. All notices and other communications required or permitted hereunder shall be via electronic mail and/or registered mail. Each may
change his address by giving notice of the same to the other party.
13. BORROWER cannot assign any of his rights and/or duties under this T&C without the prior written consent of CASHA. All of the rights
and/or duties of CASHA under the loan documents, or any of them, shall be freely assignable.
14. The parties con rm that this T&C contains the full terms of their agreement and that no addition or variation of the provisions shall be of
any force and e ect, unless done in writing and signed by both parties.
15. The BORROWER shall indemnify CASHA against all fees and expenses, including but not limited to collection agency fees, attorney's
fees, costs of suit and litigation, incurred by CASHA in connection with the enforcement of its rights under this Agreement. Any legal
action, suit or proceeding shall be instituted at the competent court in Makati City, to the exclusion of all other venues, the BORROWER
hereby waiving all such other venues.
I acknowledge that I have read, understood and agree to be bound by the aforementioned Terms & Conditions of Agreement in its entirety.
