INMETRO Ordinance No. 09 of 2022 - Plug and Socket Adapters

Pre-Market Requirements
Art. 5 Plug and socket adapters, manufactured, imported, distributed and sold in the national territory,
free of charge or for a fee, must be submitted,

§ 2 The certification does not exempt the supplier from the exclusive responsibility for the safety of the product.
§ 3 Obtaining certification is a condition for authorizing the use of the Conformity Identification Seal on products
and for their availability in the national market.
Art. 6 The plug and socket adapters covered by the approved Regulation are subject to the non-automatic
import licensing regime, and the importer must obtain consent from Inmetro, considering Inmetro Ordinance No. 18,
of January 14, 2016, or substitute.
Market Surveillance
Art. 7 Plug and socket adapters, objects of this Regulation, are subject, throughout the national territory, to
market surveillance actions carried out by Inmetro and public law entities linked to it by delegation agreement.
Art. 8 The action or omission contrary to the provisions of this Ordinance constitutes an infraction, which may give rise to
the penalties provided for in Law No. 9,933 of 1999.
Art. 9 The supplier, when subjected to market surveillance actions, must provide the
Inmetro, when requested, the required information within a maximum period of 15 days.
Art. 10. The publication of this Ordinance does not imply the need to start a new process
certification based on the consolidated requirements.
Single paragraph. The certificates already issued must be reviewed, with reference to the Ordinance now
published, in the next evaluation stage.
Art. 11. The certificates issued based on Inmetro Ordinance No. 324, of 2007, must have their validity adjusted,
under the terms of item 6.1.1.6 of the RAC, established in Annex I of this Ordinance, with the
reference to the grant date.
§ 1 Exclusively for the purposes of dismembering certificates issued based on Inmetro Ordinance No. 324, of
2007, aiming at meeting the definition of family provided for in item 4.2 of Annex I of this Ordinance, test reports
issued before the start of the process may be accepted certification, by laboratories accredited by Inmetro or signatory
of the ILAC or IAAC mutual recognition agreements, provided that these reports are part of the certification process
of the family that gave rise to the dismemberment.
§ 2 The dismemberment referred to in the caput must be carried out within a maximum period of 12 (twelve)
months from the effective date of this Ordinance.
Art. 12. From the effective date of this Ordinance, manufacturers and importers must adopt, in new certification
processes for plug and socket adapters, the conditions and layout of the Conformity Identification Seal as per Figure
1 of Annex II of this Ordinance.

Art. 13. The families of plug and socket adapters already certified until the effective date of this Ordinance may maintain
the adoption of the Conformity Identification Seal, affixed to the product, according to the applicable conditions and layout of the

§ 1 Manufacturers and importers of already certified plug and socket adapter families will have 36 (thirty-six) months,
counted from the effective date of this Ordinance, to adapt the certification processes in order to meet, on the packaging, the
conditions and the applicable layout of the Conformity Identification Seal - Figure 1 of Annex II of this Ordinance.
§ 2 The Conformity Identification Seal may be maintained until the deadline established in § 1
according to the conditions and layout of Figure 2 of Annex II of this Ordinance.
Art. 14. Until the first recertification that occurs after the effective date of this Ordinance, the maintenance provided for in
subitem 6.1.2.2.1.3 of Annex I of this Ordinance, must adopt the sequence of half-yearly tests “b”, “a”, “ d”, c”, in that order.
Revocation clause
Art. 15. On the date of publication of this Ordinance, the Inmetro Ordinances are revoked:

4. DEFINITIONS
For the purposes of this RAC, the definitions contained in the documents listed in item 3 are adopted, complemented by
the specific definitions below.

of samples of the product in the trade, to carry out the assessment activities of the compliance, and QMS audit;

The criteria for analysis of the request and the conformity of the documentation must follow the requirements
described in the RGCP.
The initial audit criteria of the management system must follow the requirements established in the RGCP, except
for what is described in subitems 6.1.1.3.1 and 6.1.1.3.2 below.
6.1.1.3.1 The evaluation of the QMS must be carried out by the OCP based on the scope of the certification process
and in accordance with the requirements of ISO 9001:2015 or ABNT NBR ISO 9001:2015, with the minimum
requirements defined in Table 1 Next.

6.1.1.3.1.1 In the evaluation of the quality management system, the performance, by the manufacturer, of routine tests,

6.1.1.3.2 The presentation of a certificate from the manufacturer's QMS, within its validity period, issued by an OCS accredited

6.1.1.4.1.1 The products must be submitted to the tests provided for in ABNT NBR NM 14936: 2012, according to Tables 2
and 3 below. Compliance with the provisions of subitems 6.1.1.4.1.4 to 6.1.1.4.1.7 must also be verified.

6.1.1.4.2 Definition of Sampling

6.1.2.2.2.1 The maintenance sampling must follow the general conditions defined in the RGCP.

6.1.2.2.1, the sampling of at least 1 (one) model must be carried out based on Table 4.
