Pada hari ini, Sabtu tanggal Tiga Belas bulan Januari tahun Dua Ribu Delapan Belas pukul 13.28 LT, telah dilakukan
pemeriksaan SPOB. SEAGULL 202 di dermaga 1 (Satu) Terminal BBM Pontianak sehubungan dengan terjadinya

Art. 1, the vessel has liberty to call at any port or ports in any order in or out of or beyond the customary route for bunkering, louding of 29
discharging cargo or any other purpose whatsoever, to sail without pilots, to make trial trips, to adjust compasses, to dry dock, to move to repair yards, 30
to shift berths, to tow and be towed and to assist vessels or aircraft in distress or to deviate for the purpose of saving life or property or any other 31
reasonable purpose whotsoever in the master's discretion and any use of the aforesaid liberties shall be deemed to be part oil the contract voyage, this clause 32
shall not be considered as restricted by any provision of this Bill of Lading whether express or implied or by any circumstances attending or preceding 33
the shipment of cargo hereunder or construed by reference to whether any use of the said liberies would of would not trustrate the object of this 34
Bill of Lading or the contract evidenced thereby 35
Art. 2. AVERAGES in the event of average and all other in instances the enactmens of the Commercial Code of Indonesia Shall apply, unless 36
other rules and regulations havw been laid down in this B/L provided that all damages, loss and costs caused by the negligence of the Master and his 37
Crew, as well as by any fault of the engines and boilers shall not wishstanding the enactments of section 700 of the Commercial Code Indonesia be 38
considered as average 39
General average shall be adjusted at Jakarta by any average adjuster appointed by the carrier. 40
NEW JASON CLAUSE in the event of accident, damage, or disaster before of after the commencement of the voyage, from any cause, 41
whatsoever whether due to negligence or not for which or the consuquence of which the carrier is not respondsible, by statute contract or otherwish 42
the cargo shippers consigness or owners of the cargo shall contribute with the carrier in general average to the payment of any sacrificesses 43
of expenses of a General average nature that my be made or incurred and shall pay salvage and special charges incurred in respect of the 44
cargo if a salving vessel is owned or operated by the carrier salvage shall be paid for as fully as if the said salving vessel or vessels belonged to strangers. 45
Such deposit as the carrier or this agents may deem sufficient to cover the estomated contribution of the cargo and any salvage and special charges 46
thereon shall, If required be made by the cargo Shippers consignees of Owner of the cargo to the carrier before delivery. 47
Art. 3. BOTH TO BLAME COLLISION CLAUSE. If the vessel comes into collision with another vessel as a result of the negligence of the other vessel 48
and any act. Neglet of defaults of Master mariner, pilot or at the servants of the carrier in the navigation or in the management of the Vessel the Owner of the cargo 49
carrier hereunder will indemnity the carrier againts all loss or liability to the other or non-carrying Vessel or her owner insofar as such loss or liability represents 50
loss of or damage to or any claim whatsoever of the Owners of the said cargo paid or payble by the other non-carrying Vessel or her owners to the owners 51
of the said cargo and set off recouped or recovered by the other or non-carrying Vessel or her owners as part those claim againts the carrying vessel of carrier. 52
The foregoing provisions shall also apply where the Owners Operator or those in charge of any vessel s or objects other than or in addition to the colliding vessels 53
or objecs are at fault in respect of a collision or contact. 54
Art. 4. STRIKE. In case of srike lock-outs stoppage or restraint of labour or if there are reasonbly grounds for anticipating the same and at all events 55
of force majeure the Carrier has the right to discharge the goods at a port in his option. The contract of carrige shall thereupon be considered and Carrier to have 56
complied with all his obligations. 57
Freight and additional charges have to be paid for the conveyance to the actual port of discharge, if the freight and additional charges to the actual 58
port of discharge are lessthan the freight according to the B/L no refund will take place when the goods are received of this port. 59
In these cases the Carrier shall have the right to keep the goods on board and land them on the returntrip at the port of destination c.q. port of 60
transhipment or to discharge them at another port and send them back by a vessel to the port of destination c.q. part of transhipment. 61
In both cases the persons concerned shall be liable for extra freight and/or charges 62
Art. 5. OTHER RISKS. 63
(1) the master shall not be required or bound to sign Bills of Lading for any blokaded port or for any port whice the master or Owners in his or 64
theirs discretion cinsider dangerous or impossible to anter or reach. 65
(2) (A) if any port discharge named in the charterparty refferred to in Clause 7 here of in this Bill of Lading or to which the vessel ay properly be 66
ordered pursuant ti the terms of this Bill of Ladingbe blockaded or. 67
(B) If owing to any war hostilities warlike operations civil war, civil commotions revolutions of the operations of international law (a) entry to any such 68
port of discharge of cargo intended for any such port be considered by the Master or Owners in his or their discretion dangerous or prohibited or (b) if be 69
considered by the Master or Owners in his or their discretion dangerous or imposible or prohibited for the vessel to reach such discharging port the cargo or 70
such port of if as may be affeceted shall be discharged at any other port in the vicinity of the said port of discharge as may be ordered by the cargo owners 71
(provided such other port is not blokaded or the entry thereto or discharge of chargo thereat or reaching the same is not in the Master or Owners discreation 72
dangerous or probibites). If not such order be received from the Cargo Owners within forty-eight hours after they or their agents have received from the 73
Owners a request for the nomination of a subtitute discharging port. The Owners shall then of liberty to discharge the cargo at any port wich they or the master 74
may in their or his discretion on and such discharge shall be deemed to be due fulfilment of the contract of the contracks of afreightmen or of the contract 75
contained I or evidance by hi Bill of Lading so far as cargo discharged is concerned. In the event of cargo being discharged at any such other port the Owners 76
shall be entitled to freoght as if the discharge had beeb effected at the port or port originally designated or to which the vessel may have been ordered pursuant 77
to the terms of this Bill of lading All expenses involid in reaching and discharging the cargo at any such other port shall be paid by the charters and/or Cargo 78
Owners shall have a lien on the cargo for freight and all such expenses. 79
(3) The vessel shall have liberty to comply with any directions or recommendations as to departure. Arrival routes, ports of call, stoppages, 80
destoination, zones waters delivery or in any otherwise whatsoever given by the government of the nation, under whose flag the vessel sails or any other 81
government of local authority including any de facto government or local authority or by any person or body acting or purporting to act as or with the authorithy 82
of any such government or authority or by any committee or person having under the tearms of the war risks insurance on the vessel the right to give any such 83
directions or recommendations. If by reason of or in compliance with any such direction or recommendations, anything is done or is not done such not be 84
deemen a deviation. 85
If by reason of or in compliance with any such direction or recommendations the vessel does not proceed to the part of ports originally designated 86
or to wich she may have been ordered pursuant to the terms or this Bill of Lading the vessel may proceed to any port which the master or owners in this or 87
their discretion may decide on and there discharge the cargo such discharge shall be deemed to be due fulfilment ot the contract or contracts of afrieghment or of 88
the contract contained on or evidenced by this Bill of Lading and the Owners shall be entitled to freigh as if discharge has been efected the port or ports originaly 89
designated or to which the vessel may properly hanve been ordered pursuant to the terms of Bill of Lading All extra expanses invloved in reaching and 90
discharging the cargo at any such other port shall be paid by the Charterers and/or Cargo Owners and the Owners shall have a lien on the cargo freight and 91
all such expenses. 92
Art. 6 In the event of the cargo herein mentioned being lost of damage the Owners in addition to the rights, immunities and limitation of liability herein 93
contained or to which they may otherwise be entitled and without prejudice there to shall be entitled to such limitation of liability in respect of such loss or damage 94
as may be provided by the law of the country of the vessel's flag in force at the date of the issue here of and for the purposes of any limitation of lability 95
naither this Bill of lading not the contract contained in or evidenced there by shall not with standing anything herein contained, be construed to be or to give rise 96
to a personal contrasct so as to deprive the Owners of such limition 97
Art. 7. LAW APPLICABLE TO THIS B/L. This B/L shall be governed by the Indonesia law observant of the stipilations, laid down herein. The contects 98
of this. B/L must be consideredas cancelles in so far these contents are contrary to the stipulations of sections 470 of the commercial Code of Indonesia. 99
Art. 8. JURISDICTION. All actions under the contract of carriage ahall be brought before the Court at jakarta and no other court shall have 100
jurisdiction with regard to ay other action unless the carrir appeals to another jurisdiction or voluntaruly submits thereto. 101

pada manifold kapal SPOB. SEAGULL 202 setelah selesai discharge di TBBM Pontianak.
Penyegelan dilakukan sehubungan dengan Instruksi dari Ast. Manager Quantity Assurance Pusat.
