This letter is in response to your complaint lodged at 8888 Citizen’s

Complaint Hotline with reference No. EML-100123-844-003 dated October 1,
2023, re: Follow-up on requested Executory Letter relative to land title filed in the
Department of Environment and Natural Resources (DENR) CARAGA Region.

To recall, DENR-CARAGA Regional Office issued a decision dated August

19, 2022 relative to the protest filed by Rogelio J. Ocura (protestant) against the
Free Patent Application of Roldan G. Elsisura, Vernie S. Reyes, Solidad J.
Elsisura, Elisa J. Elsisura (Protestee), all portion of Lot No. 34, CAD 917-D,
situated at Brgy. Bad-as, Placer, Surigao del Norte.
The dispositive portion of the decision partly states that:

“Wherefore, considering the foregoing premises, this Office hereby

RESOLVES:

1. To DISMISS the herein protest and to advise the Protestant herein to go

to the court of law and file the appropriate legal action for his cause of
action for the cancellation of the issued certificates of title; and
2. The pending public land applications of the Protestees be given due
course leading to the issuance and assignment of patent numbers and its
regulation.

SO ORDERED.

Further, a Motion for Reconsideration was timely filed by the Protestant in

this Office dated October 5, 2022. Unfortunately, a Resolution dated May 15, 2023
was issued by this Office, denying the Motion for Reconsideration, its dispositive
portion partly states that:

“Wherefore, premises considered, the instant Motion for

Reconsideration is hereby DENIED for lack of merit. Accordingly,
the Decision dated August 19, 2022 is hereby affirmed in toto.

Finally, a copy of the Resolution was personally delivered and received by

the counsel of the Protestant Atty. Vals P. Lisondra on June 2, 2023, which made
the Notice of Appeal filed by the Protestant in this Office on June 13, 2023, in due
time.

With the foregoing concerns, we would like to inform you that this Office
cannot issue a Certificate of Finality for the reason that the Protestant filed a
Notice of Appeal in due form and within the reglementary period. This Office is
on the process of drafting an Order for the transfer of the case folder to the Office
of the Secretary for his perusal. This is in pursuance to DENR Administrative
Order No. 2016-31 titled Procedure in the Investigation of Land Claims and
Conflicts Cases effective on February 24, 2017, Sections 22 and 23. Rest assured,
that this Office will immediately notify you of whatever decision the Office of the
Secretary will render.
