AFFIDAVIT IN SUPPORT OF NOTICE OF MOTION

I, PAULSEN KOOLYA of C/O TRANSCEND & Co. Advocates, Kampala Road P.O.BOX
422 Kampala, do hereby solemnly swear and state as follows:

1. That I am a Male adult Ugandan of sound mind, the executor of the estate of the late Isaiah
Koolya and the applicant in this application and I swear this affidavit in that capacity.

2. That I filed an application for temporary injunction and it is pending hearing and determination
vide Misc Application No.021 of 2023.

4.That the 1st Respondent has initiated proceedings to sale the property by public auction and is
likely to permanently dispose off the property before the temporary injunction is determined.

5.The 1st Respondent has gone ahead to advertise the suit property land. Hereto attached is
copy of the newspaper advertisement marked annexure “B”.

6. That the temporary injunction application if the application is not granted by the time the
temporary injunction is determined the suit property would have been disposed off which act will
render the application nugatory.

7.That the 1st Respondent has already advertised the suit property which the applicant has
attachments to and would cause irreparable damage to the applicant.

8. That I depone this affidavit in support of the application for an interim injunction pending the
hearing and disposal of the temporary injunction.

9.That all what is contained herein is correct and true to the best of my knowledge.
