Trial ensued in the presence of the Public Prosecutor:

Petitioner confirmed all the material allegations in the petition

Respondent after few years of marriage manifested and showed his
Psychological incapacity to perform his duties as a husband. He provide to
be hard headed and domineering husband who always insisted to be
followed by the petitioner in making major and important decision affecting
their relationship and not giving the petitioner any participation in the
process.

Petitioner always respected the Respondent; however, it was the

respondent going home very late that the Petitioner did not approve of.
Moreover, respondent was very fond of being away from home and friends,
Drinking wine, gallivanting and having good time in disco bars. He is also
engaged in regular gambling sessions at nearby casino. As such,
consuming all this time and going home in the unholy and wee hours of the
morning. He has little or of no concern at all of the Petitioner.

Petitioner tried her best to cope with respondent’s attitude and

Carefree personality by giving the respondent love and understanding but
this went on unreciprocated . Worse, he would frequently stay out of the
house partying with his friends. Thereby squandering much of their earnings
which should have been intended for his family finally. sometime on
September, 2009 , he frankly told Petitioner that he justly plainly wanted out
of his life and without hesitation, he abandoned Petitioner.

After their marriage, The Respondent failed to assume and discharge

duties as husband, he refused to render mutual help and support with the
Petitioner.

The Respondent refused to live with Petitioner, neither did the

Petitioner show love with the Respondent. He failed to show respect and
fidelity to their covenant of live which they promised at the time of marriage.
