M vuuos UF a@LUUT Q.5: (a) Distinguish Tort & Crime : Black Stone defines crime as ‘an act committed or omitted in violation of a public law either for bidding or commanding it’. It is an offence against the public. Eg. Murder, rape, theft etc. Following are the main difference between Tort and Crime.1. Tort is a private wrong, which infringes the legal right of an individual or specific group of individuals but crime is a public wrong, which violates the rights and duties of public as a whole. (2) The person, who commits tort is called ‘tort-feasor’ or ‘Wrong Doer’ but the person who commits crime called ‘Offender or ‘Criminal’. (3) The place of trial in Tort is Civil Court but the place of trial in Crime is Criminal Court (or Juvenile Court) (4) The renedy in tort is unliquidated damages or other equitable relief to the injured but a © scanned with OKEN Scanner s the remedy in crime is to Punish the offender by the state. (5) Tort litigation ‘s compoundable, i.e. the plaintiff can withdraw the suit filed by him but Criminal cases are not compoundable.
