3.The second party shall be appointed under a 30 Days
probation period, from the date of assuming work. If one of
the two parties’ desires to terminate the contract, he shall
notify the other party in writing, at least 7 days before the
contract expiry date (The probation period must not exceed
3 Months).

5. The second party is entitled for an emergency leave with

a comprehensive wage for (6) days throughout the year, for ‫( ﺳﺘﺔ ﺃﻳﺎﻡ ﻃﻮﺍﻝ ﺍﻟﺴﻨﺔ‬6) ‫ﻳﺴﺘﺤﻖ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺇﺟﺎﺯﺓ ﻃﺎﺭﺋﺔ ﺑﺄﺟﺮ ﺷﺎﻣﻞ ﻟﻤﺪﺓ‬.5

6.Upon application of this contract, employment of women

‫ ﻗﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﻮﺯﺍﺭﻳﺔ‬، ‫ﻋﻨﺪ ﺗﻄﺒﻴﻖ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻳﺮﺍﻋﻰ ﻓﻲ ﺗﺸﻐﻴﻞ ﺍﻟﻨﺴﺎﺀ‬.6

7.The first party shall transfer the employee (Second

8.The first party shall grant the second party a weekly rest
of not less than two consecutive days, after continued five
days of work.
‫ﻋﻠﻰ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺃﻥ ﻳﻤﻨﺢ ﺍﻟﻌﺎﻣﻞ ﺭﺍﺣﺔ ﺃﺳﺒﻮﻋﻴﺔ ﻻ ﺗﻘﻞ ﻋﻦ ﻳﻮﻣﻴﻦ ﻣﺘﺘﺎﻟﻴﻦ ﺑﻌﺪ‬.8
‫ ﻭﻳﺠﻮﺯ ﻓﻲ ﺍﻷﻣﺎﻛﻦ ﺃﻭ ﺍﻷﻋﻤﺎﻝ ﺍﻟﺘﻲ ﺗﺤﺪﺩ ﺑﻘﺮﺍﺭ ﻣﻦ ﺍﻟﻮﺯﻳﺮ‬،‫ﺧﻤﺴﺔ ﺃﻳﺎﻡ ﻋﻤﻞ ﻣﺘﺼﻠﺔ‬
‫ﺗﺠﻤﻴﻊ ﺍﻟﺮﺍﺣﺎﺕ ﺍﻷﺳﺒﻮﻋﻴﺔ ﺍﻟﻤﺴﺘﺤﻘﺔ ﻟﻠﻌﺎﻣﻞ ﻋﻦ ﻣﺪﺓ ﻻ ﺗﺠﺎﻭﺯ ﺛﻤﺎﻧﻴﺔ ﺃﺳﺎﺑﻴﻊ ﺇﺫﺍ ﺍﺗﻔﻖ‬
‫ ﻭﺗﻜﻮﻥ ﺍﻟﺮﺍﺣﺔ ﺍﻷﺳﺒﻮﻋﻴﺔ ﻓﻲ ﺟﻤﻴﻊ ﺍﻷﺣﻮﺍﻝ‬،‫ﺍﻟﻌﺎﻣﻞ ﻭﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﻋﻠﻰ ﺫﻟﻚ ﻛﺘﺎﺑﺔ‬

9.The first party shall be banned from the following:
a.Employing the second party in construction sites and
open areas with high temperatures at noon (from 12:30
to 03:30), during the months of June, July and August in
accordance with the provisions of the regulations for
occupational safety and health measures issued by
Ministerial Decree No. (286/2008).
b.Violating the provisions of this contract, or tasking the
second party with a work which is not agreed upon in the
contract, unless necessity arises and for a transitional
period. However, he/she may assign the worker or the
second party only if there is no fundamental difference
between the new tasks and the original work he is
contracted for.
:‫ ﻳﺤﻈﺮ ﻋﻠﻰ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﺍﻟﻘﻴﺎﻡ ﺑﻤﺎ ﻳﻠﻲ‬.9

‫ ﺍﻟﺨﺮﻭﺝ ﻋﻠﻰ ﻧﺼﻮﺹ ﺍﻟﻌﻘﺪ ﺃﻭ ﺗﻜﻠﻴﻒ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺑﻐﻴﺮ ﺍﻟﻌﻤﻞ ﺍﻟﻤﺘﻔﻖ ﻋﻠﻴﻪ‬-‫ﺏ‬
‫ ﻭﻣﻊ ﺫﻟﻚ ﻳﺠﻮﺯ ﻟﻪ ﺃﻥ‬، ‫ﻓﻲ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺍﻻ ﺍﺫﺍ ﺩﻋﺖ ﺍﻟﻀﺮﻭﺭﺓ ﻟﺬﻟﻚ ﻭﺑﺼﻔﺔ ﻣﺆﻗﺘﻪ‬
‫ﻳﻜﻠﻒ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺑﻌﻤﻞ ﻏﻴﺮﺍﻟﻤﺘﻔﻖ ﻋﻠﻴﻪ ﺇﺫﺍ ﻛﺎﻥ ﺍﻟﻌﻤﻞ ﻻ ﻳﺨﺘﻠﻒ ﻋﻦ ﺍﻟﻌﻤﻞ‬
ً‫ﺍﻷﺻﻠﻲ ﺇﺧﺘﻼﻓﺎً ﺟﻮﻫﺮﻳﺎ‬.

‫ﻳﻠﺘﺰﻡ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﺑﺈﻋﺎﺩﺓ ﺍﻟﻌﺎﻣﻞ ﻏﻴﺮ ﺍﻟﻌﻤﺎﻧﻲ ﺍﻟﻰ ﺑﻠﺪﻩ ﺑﻌﺪ ﺍﻧﺘﻬﺎﺀ ﻋﻼﻗﺔ ﺍﻟﻌﻤﻞ‬.10
10.The first party shall repatriate the non-Omani employee
‫ ﻭﺍﺫﺍ ﺗﺮﻙ ﺍﻟﻌﺎﻣﻞ ﺍﻟﻌﻤﻞ ﺑﻄﺮﻳﻘﺔ‬، ‫ ﻣﺎﻟﻢ ﻳﺘﻢ ﻧﻘﻞ ﺧﺪﻣﺎﺗﻪ ﺍﻟﻰ ﺻﺎﺣﺐ ﻋﻤﻞ ﺍﺧﺮ‬، ‫ﻣﻌﻪ‬
to his country, after completing the work relation with him,
.‫ﻣﺨﺎﻟﻔﺔ ﻷﺣﻜﺎﻡ ﻗﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ ﻳﺘﻢ ﺗﺮﺣﻴﻠﻪ ﻭﻓﻖ ﺍﻹﺟﺮﺍﺀﺍﺕ ﺍﻟﻤﺘﺒﻌﺔ ﺑﺎﻟﻮﺯﺍﺭﺓ‬
unless the employee`s services have been transferred to
another employer, and if the employee has left the work in
violation of the labor law he shall be deported, in
accordance with the procedures adopted by the Ministry.

11.First party should Provide death and work injuries .‫ﻳﻠﺘﺰﻡ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﺑﺘﻮﻓﻴﺮ ﺍﻟﺘﺄﻣﻴﻦ ﺿﺪ ﺇﺻﺎﺑﺎﺕ ﺍﻟﻌﻤﻞ ﻭﺍﻟﻮﻓﺎﺓ ﻟﻠﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ‬.11
insurance for the second party.

12.The second party shall undertake the following:
a.Comply with the work terms stipulated in this contract.
b.Respect the Islamic religion, the sultanate’s laws and
social traditions and customs.
c.Not to get involved in any activities that harm the
State`s security.

Contract of Work - Non Omani

a.Be available at the workplace at the set timings and
perform his duties loyally and honestly as per the
stipulations of this contract and according to the
provisions of the labor law and the systems in place.
b.Take care of the production means and work tools at
his disposal and preserve them.
c.Implement the occupational safety and health
regulations set at the establishment, as per the labor law,
its implementing decisions and the work systems and
regulations and instructions.
‫ ﻭﺍﻥ ﻳﺆﺩﻱ ﻋﻤﻠﻪ ﺑﺈﺧﻼﺹ‬، ‫ ﺍﻟﺘﻮﺍﺟﺪ ﻓﻲ ﻣﻜﺎﻥ ﺍﻟﻌﻤﻞ ﻓﻲ ﺍﻟﻤﻮﺍﻋﻴﺪ ﺍﻟﻤﻘﺮﺭﺓ‬-‫ﺃ‬
‫ﻭﺃﻣﺎﻧﺔ ﺃﻥ ﻳﺒﺬﻝ ﻓﻲ ﺗﺄﺩﻳﺘﻪ ﺍﻟﻌﻨﺎﻳﺔ ﺍﻟﻼﺯﻣﺔ ﻃﺒﻘﺎ ﻟﻤﺎ ﻫﻮ ﻣﺤﺪﺩ ﺑﻬﺬﺍ ﺍﻟﻌﻘﺪ ﻭﻃﺒﻘﺎ‬
‫ﻷﺣﻜﺎﻡ ﻗﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ ﻭﺃﻧﻈﻤﺔ ﺍﻟﻌﻤﻞ ﺍﻟﻤﻌﻤﻮﻝ ﺑﻬﺎ‬

‫ﻋﻠﻴﻬﺎ ﺑﻌﻨﺎﻳﺔ‬
‫ ﺍﻟﻘﻴﺎﻡ ﺑﺘﻨﻔﻴﺬ ﺗﻌﻠﻴﻤﺎﺕ ﺍﻟﺴﻼﻣﺔ ﻭﺍﻟﺼﺤﺔ ﺍﻟﻤﻬﻨﻴﺔ ﺍﻟﻤﻘﺮﺭﺓ ﺑﺎﻟﻤﻨﺸﺄﻩ ﺑﻤﻮﺟﺐ ﺍﻟﻘﺎﻧﻮﻥ‬-‫ﺝ‬
‫ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﺍﻟﻤﻨﻔﺬﺓ ﻟﻪ ﻭﻧﻈﻢ ﻭﻟﻮﺍﺋﺢ ﺍﻟﻌﻤﻞ ﻭﺗﻌﻠﻴﻤﺎﺗﻪ‬

14.It is not permitted for the second party to compete with ‫ﻻ ﻳﺠﻮﺯ ﻟﻠﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺃﻥ ﻳﻨﺎﻓﺲ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﺃﻭ ﻳﺸﺘﺮﻙ ﻓﻲ ﻋﻤﻞ ﻳﻨﺎﻓﺴﻪ ﺑﻌﺪ‬.14
the first party or to participate in work that competes against ‫ ﻋﻠﻰ ﺃﻥ ﻳﻜﻮﻥ ﻫﺬﺍ ﺍﻟﺸﺮﻁ ﻣﻘﻴﺪﺍ ﺑﺎﻟﺰﻣﺎﻥ ﻭﺍﻟﻤﻜﺎﻥ ﻭﻧﻮﻉ ﺍﻟﻌﻤﻞ ﺑﺎﻟﻘﺪﺭ‬،‫ﺍﻧﺘﻬﺎﺀ ﺍﻟﻌﻘﺪ‬
him after the end of the contract, provided that this condition .‫ﺍﻟﻀﺮﻭﺭﻱ ﻟﺤﻤﺎﻳﺔ ﺍﻟﻤﺼﺎﻟﺢ ﺍﻟﻤﺸﺮﻭﻋﺔ ﻟﻠﻄﺮﻑ ﺍﻻﻭﻝ‬
is tied by the time, place, and kind of work to the extent
necessary to protect the legitimate interests of the first
party.

15.The second party shall maintain the confidentiality of any ‫ﻳﻠﺘﺰﻡ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺑﺎﻟﻤﺤﺎﻓﻈﺔ ﻋﻠﻰ ﺳﺮﻳﺔ ﺃﻳﺔ ﺑﻴﺎﻧﺎﺕ ﺍﻭ ﻣﻌﻠﻮﻣﺎﺕ ﺗﺼﻞ ﺍﻟﻰ ﻋﻠﻤﻪ‬.15
data or information pertaining to his knowledge by virtue of ‫ ﻭﻋﺪﻡ ﺍﻓﺸﺎﺀ ﺍﻭ ﻛﺸﻒ ﺍﻭ ﻧﻘﻞ‬، ‫ﺑﻤﻮﺟﺐ ﺍﺣﻜﺎﻡ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺧﻼﻝ ﻓﺘﺮﺓ ﺗﻨﻔﻴﺬﻩ ﻭﺑﻌﺪ ﺍﻧﺘﻬﺎﺀﻩ‬
the provisions of this contract during its implementation and ‫ ﻭﻓﻲ ﺣﺎﻟﺔ ﺍﺧﻼﻟﻪ ﺑﺬﻟﻚ‬، ‫ﺍﻳﺔ ﻣﻌﻠﻮﻣﺎﺕ ﺗﺘﻌﻠﻖ ﺑﻬﺬﺍ ﺍﻟﻌﻘﺪ ﺍﻟﻰ ﺍﻱ ﺷﺨﺺ ﺍﻭ ﺟﻬﺔ ﺍﺧﺮﻯ‬
after its termination, and shall not disclose, reveal, or . ‫ﺗﻄﺒﻖ ﺍﻟﻘﻮﺍﻧﻴﻦ ﻭﺍﻻﻧﻈﻤﺔ ﺍﻟﻤﻌﻤﻮﻝ ﺑﻬﺎ ﻓﻲ ﺍﻟﺴﻠﻄﻨﺔ‬
communicate any information relating to this contract to any
other person or entity, and in case of violation the laws and
regulations in force in the Sultanate shall apply.

16.The parties acknowledge being aware of the Law on the

Classification of State Documents and Governing Protected ‫ﻳﻘﺮ ﺍﻟﻄﺮﻓﺎﻥ ﺑﺈﻃﺎﻟﻌﻬﻤﺎ ﻋﻠﻰ ﻗﺎﻧﻮﻥ ﺗﺼﻨﻴﻒ ﻭﺛﺎﺋﻖ ﺍﻟﺪﻭﻟﺔ ﻭﺗﻨﻈﻴﻢ ﺍﻷﻣﺎﻛﻦ ﺍﻟﻤﺤﻤﻴﺔ‬.16
Places, and the Labor Law and its implementing decisions .‫ﻭﻛﺬﻟﻚ ﻗﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﻭﺍﻟﻠﻮﺍﺋﺢ ﺍﻟﻮﺯﺍﺭﻳﺔ ﺍﻟﻤﻨﻔﺬﻩ ﻟﻪ‬
and ministerial decisions.

17.The labor law and the decisions and ministerial

‫ﻳﺴﺮﻱ ﻗﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ ﻭﺍﻟﻘﺮﺍﺭﺍﺕ ﻭﺍﻟﻠﻮﺍﺋﺢ ﺍﻟﻮﺯﺍﺭﻳﺔ ﺍﻟﻤﻨﻔﺪﺓ ﻟﻪ ﻋﻠﻰ ﻣﺎ ﻟﻢ ﻳﺮﺩ ﺫﻛﺮﻩ‬.17
regulations implementing it shall be effective on whatever
‫ﺑﻬﺬﺍ ﺍﻟﻌﻘﺪ‬
has not been mentioned in this contract.

18.In case of any dispute arising between the parties on

implementing the commitments resulting from this contract,
‫ﻓﻲ ﺣﺎﻝ ﻭﺟﻮﺩ ﺃﻱ ﻧﺰﺍﻉ ﺑﻴﻦ ﺍﻷﻃﺮﺍﻑ ﺑﺸﺄﻥ ﺗﻨﻔﻴﺬ ﺍﻹﻟﺘﺰﺍﻣﺎﺕ ﺍﻟﻨﺎﺷﺌﺔ ﻋﻦ ﻫﺬﺍ‬.18
such dispute shall be settled cordially at the concerned
‫ ﻓﺎﻧﻪ‬، ‫ ﻭﻓﻲ ﺣﺎﻝ ﺗﻌﺬﺭ ﺫﻟﻚ‬، ‫ﺍﻟﻌﻘﺪ ﻳﺘﻢ ﺗﺴﻮﻳﺘﻪ ﻭﺩﻳﺎ ﻟﺪﻯ ﺍﻟﺪﺍﺋﺮﺓ ﺍﻟﻤﺨﺘﺼﺔ ﺑﺎﻟﻮﺯﺍﺭﺓ‬
department of the Ministry. And if this is not possible, it
.‫ﻳﺘﻌﻴﻦ ﺍﻟﻠﺠﻮﺀ ﺍﻟﻰ ﺍﻟﻤﺤﻜﻤﺔ ﺍﻟﻤﺨﺘﺼﺔ ﺑﺴﻠﻄﻨﺔ ﻋﻤﺎﻥ‬
shall be referred to the competent court in the Sultanate of
Oman.
19.In case the two parties desire to abide be other terms,
‫ ﺗﺤﺮﺭ ﻓﻲ ﻣﻠﺤﻖ ﺃﺧﺮ‬، ‫ﻓﻲ ﺣﺎﻟﺔ ﻭﺟﻮﺩ ﺷﺮﻭﻁ ﺃﺧﺮﻯ ﻳﺮﻏﺐ ﺍﻟﻄﺮﻓﻴﻦ ﺍﻹﻟﺘﺰﺍﻡ ﺑﻬﺎ‬.19
such terms shall be included in an annex to this contract,
‫ ﻣﻊ ﻣﺮﺍﻋﺎﺓ ﺍﻥ ﺗﻜﻮﻥ ﻣﻄﺎﺑﻘﺔ‬، ‫ﺧﺎﺭﺝ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺩﻭﻥ ﺍﻟﺘﺼﺪﻳﻖ ﻋﻠﻴﻬﺎ ﻣﻦ ﻗﺒﻞ ﺍﻟﻮﺯﺍﺭﺓ‬
without being endorsed by the ministry, provided that they
.‫ﻷﺣﻜﺎﻡ ﻗﺎﻧﻮﻥ ﺍﻟﻌﻤﻞ‬
comply with the provisions of the labor law.
20.The contract is drafted in two copies in both Arabic and
‫ﺣﺮﺭ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻣﻦ ﻧﺴﺨﺘﻴﻦ ﺑﺎﻟﻠﻐﺔ ﺍﻟﻌﺮﺑﻴﺔ ﻭﺍﻟﻠﻐﺔ ﺍﻻﻧﺠﻠﻴﺰﻳﺔ ﻟﻜﻞ ﻃﺮﻑ ﻧﺴﺨﺔ‬.20
English languages, one copy for each party, both texts
‫ ﻭﻓﻲ ﺣﺎﻟﺔ ﺍﻻﺧﺘﻼﻑ ﻓﻲ ﺍﻟﺘﻔﺴﻴﺮ‬.‫ﻟﻠﻌﻤﻞ ﺑﻤﻮﺟﺒﻬﺎ ﻭﻟﻜﻞ ﻣﻨﻬﻤﺎ ﺫﺍﺕ ﺍﻟﺤﺠﻴﺔ ﺍﻟﻘﺎﻧﻮﻧﻴﺔ‬
being equally authentic and in case of a divergence in
.‫ﻳﻌﺘﺪ ﺑﺎﻟﻨﺴﺨﺔ ﺍﻟﻌﺮﺑﻴﺔ‬
interpretation, the Arabic text shall prevail.
