16) ISSUE NO 4 :- In view of my answer to
Issues No.1 to 8, the plaintiff is entitled for the relief of
Declaration and Permanent Injunction against the defendants.
Hence, I answered Issue No.4 in the 'Affirmative'.

17) ISSUE NO.5 :- For the reasons discussed above,


I proceed to pass the following :-

The suit filed by the plaintiff is hereby decreed with cost.


It is hereby declared that the plaintiff is the owner of the
suit schedule property and the defendants, their men or, agents,
or anybody claiming under them are hereby restrained by an order
of Permanent Injunction from interfering with the peaceful
possession and enjoyment of the suit schedule property.
