Due Diligence
In this term paper, we would like to understand how a land discourse in the
Philippines is being protected of our laws and Register of Deeds to resolve an issue
through conducting due diligence. In our society today, it is genuine that we have
deal with people everyday.
One factor that must met solely in trust, is good faith. These are buying
a land and engaging for a contract. It is very important that we should conduct our
due diligence or monitor of the person, we are engaging.
Due diligence is a vital because it deals with parties when there is a suspicion
concerning in business deal. It is to ensure that the business deal will go without
any difficulties to a third party of the transaction.
Upon buying a land, we learned that due diligence on the seller and the land
should be mandatory complied. One person must see to it that, he or she should go
to Land Registration Authority and verify the title if it is genuine or not. If Land
Registration cannot provide the title, an innocent purchaser , buyer or seller must
visit to the Register of Deeds to check the document.
To identify if the land had tax before buying a parcel of land, the seller must
secure an original copy of tax declaration to present to the Register of Deeds as a
proof and settled it to the BIR before buying that land to avoid any penalties.
Secondly, to know if that land has a pending litigation buyer must to execute an
effort to visit to the Office of the City Prosecutor if that seller has a pending case to
be cautious.
