TERMS AND CONDITIONS

WARRANTY:
TRISTAR Responsibilities:
 Brand new unit – one (1) year or 1000 running hours, whichever comes first upon delivery.
  Preventive maintenance services should be performed by Tristar company for prime power 50 running hours
1st PMS. 2nd PMS every 200 running hours. Standby power every 6mos. Failure to do so, in the warranty will be
void
 Cost to investigate complaints, unless the problem is caused by a defect in materials or workmanship of the
manufacturer.

LIMITATIONS:
 Failure resulting from abuse, neglect, or improper repair.
 Failure resulting from any use or installation which TRISTAR judges improper.
 Failure resulting from the user’s delay in making the product available after being notified of a potential
product problem.
 Factory’s warranty shall only cover against manufacturer’s defect, materials, and workmanship.
 Warranty is not applicable to damages sustained through mishandling, negligence, ignorance, wrong
maintenance, and operation. All the misconduct against the factory’s strict maintenance procedure and or any
consequential loss or damages howsoever it may occur.
 Failure resulting from the user’s delay in making the product available after being notified of a potential
product problem.
 Factory’s warranty shall only cover against manufacturer’s defects, materials, and workmanship.

NORMAL WEAR:
This warranty will not cover repair where normal use has exhausted the life of a part of the product. All
mechanical devices need periodic parts replacement and service to perform well. It should be remembered that
the service life of any product is dependent on the care it receives and the conditions under which it has to
operate. This warranty shall not apply to starting batteries, filters, and other consumables.

INSTALLATION WORK:
Mounting, positioning of the generator, wiring, and other installation work are NOT included in this proposal but
are available upon customer request, and will be quoted and charged separately.

DELIVERY DATE:
Counting of days to delivery dates begins only upon receipt of the down payment, which confirms the contract. For
check payments, counting begins only upon clearance of the check at our bank. Completion dates are best estimates
during the time of order placement. We are not liable for damages, direct or indirect, caused by delays in delivery or
non-performance of the order that are a result of circumstances beyond our control, including acts of God or nature,
civil war, strikes, riots, etc., as well as disruption in the delivery and performance schedules of 3 rd party suppliers.

PAYMENT AND TERMS:

50% Down payment and 50% before delivery. The customer agrees that the unit/s herein quoted remain to be the
property of TRISTAR POWER CORP until full payment is made. Partial payments made will be applied as unit rental fees
and/or payments for transportation charges, costs of money, etc. in favor of TRISTAR POWER CORP, should the
customer fail to remit full payments or fund check payments made for the generator set, 30 days from the time of
delivery.

DELAYED/RE-SCHEDULED DELIVERIES:
For delays and reschedules in deliveries for reasons other than ours, we reserve the right to demand and collect for
applicable costs, including but not limited to storage fees, transportation fees, labor costs, opportunity costs, etc.

CANCELLATION:
In case of cancellation of an order for reasons other than ours, payments will be refunded less all applicable charges,
including but not limited to the cancellation charge, which is equivalent to 25% of the total contract price. We reserve
the right to deem the order canceled if full payment is not received within 30 days from the presentation of shipping
documents or notice of availability, whichever is applicable.

COMMISSIONING AND TESTING

Only labor shall be supplied free of charge. One-time free service only at the site. Please make sure wiring, breakers,
and connections have been properly installed already by the client’s accredited electrician (applicable to contract with
supplied generator set unit only without installation) prior to the scheduling of the company’s accredited technician.
Materials such as fuel, lube oil, water DCA coolant, transportable resistive load bank for load testing if required, as well
as other testing consumables necessary are NOT included and shall be supplied by the customer. For outside Metro
Manila, all transportation (air, sea, and/or land) and board/lodging expenses of the technician for actual load testing
services will be for the customer’s account.
