CEARE ANALYSIS ON CHILDREN IN CONFLICT WITH THE LAW (CICL)

CONTEXT

CICL or Children in Conflict with the Law refers to a children or child who is
alleged as accused of, or adjudged as, having committed an offense under the
Philippine Laws. In the Philippines, a child or minor is legally defined as a person who
below 18 years of age. Under the juvenile justice and welfare act of 2006, age 15 is the
minimum age of criminal responsibility (MACR). Law makers, however, have been
pushing for the lowering of MACR from 15 to 12 – a move that has been strongly
opposed by many child rights advocates and experts.
The PNP Women and Children Protection Center has reported that from January to
December 2020, authorities arrested 15,892 CICL. Of these, 1,806 were undergoing
diversion at the police level and 9,502 were turn over to Local Social Welfare and
Development Officers (LSWDO) or DSWD representatives. A total of 2,447 CICL were
at large. Thirty-seven juveniles were incarcerated in facilities under BJMP.
Crimes allegedly committed by CICLs in 2020 were rape (1,506 offenders), violation of
R.A. 9165 (Prohibited Drugs -1,207), theft -765, and crimes (10,079). In the context of
the COVID19 Pandemic, 1452 were arrested violation of R.A. 11332 (Mandatory
Reports Notifiable Diseases and Health events of Public Health Concerns).

EXPERIENCE

According to the video there’s a process on handling a case regarding CICL or


Children in Conflict with the Law and it is depending on their age as well as it will
depend on what ordinance they have violated. According to Atty.Tricia Claire Oco,
Executive Director-Juvenile and welfare Council (JWC), they have to undergo
Community Based or Center Based Interventions to help them for the rehabilitation that
will going to undergo.
The policy is a like a mother that could guide us and the children to behave and
discipline. It is also stated on the video that there’s a need of appropriate interaction,
management, intervention and diversion program that will needed to undergo by the
child.
There’s a minimum age of criminal responsibility. CICL has two types, the above
age of criminal responsibility means 15-year-old on the date of their birth day plus 1 day
and they have their discernment or they can differ what’s right and wrong doings. And in
this state, if they do something deviant or unacceptable like use of substance abuse and
killing, murder and rape, the police are allowed to arrest those. 15-years-old on the date
of their birthday below, they are the children that is not allowed to be arrested when they
do something bad in considering that they do not have discernment. A police need to
used rescue instead of arrest.
REFLECTION

Based on my observations, all I can say, the reason children have deviant
behavior or act negatively, such as disobeying their parents, is because their parents
raise their children by being careless and don’t enlighten their children about what’s
right and wrong. Because of this, the child’s discernment becomes weak.
One of its reason why children behave negative behaviors is that the bad
behaviors that the parent shows their children will be learned and adapted by the child.
Another thing, is being too much strict will result of which the child becomes
hardheaded and he comes up with the idea of rebelling because he feels that he is not
loved nor belong to the family.
Poverty also part of becoming deviant why children have unacceptable behaviors
because they have an unstable financial status that makes them rob objects or do
something else that is bad to survive, knowing that they don’t like to behave negatively,
but have of no choice but to do such things that is unacceptable.
As a person, let’s do our responsibilities as a son or daughter. Don’t be angry
even if our parents neglected us, and most importantly, never engage in bad habits.
Always come up with the idea that we live in this world temporarily and made this quote
as a reminder to do good deeds and will help you avoid doing bad deeds.

ACTION

The social worker has this scientific tool that will help them to identify whether the
children has discernment or that will help them or assist them if that child has the ability
to think in a matured way in a way of giving them objects or showing them some
behaviors and they will try to ask the children about their opinion or ideas about the
object they have shown on the child.
Parents patriate is the process of the government which the government will step
into the life of the children and help them by adopting them if they were neglecting by
their parent or the parents are not capable of doing their responsible as a mother of the
child.
The government has established a Bahay Pag-asa for those children who
commit serious crime. It is a place for rehabilitation for those children who made serious
crimes. There’s a need to subject intensive juvenile intervention program for them to not
do it again and for their accountability as well. The child who made serious crime will
undergo rehabilitation in bahay pag-asa at least 1 year.
Online counseling, Virtual skills training at online class, Arts and craft session,
Religious activities and Helping provision of relief operation are other programs of the
government to the children who committed serious crime and CICL.

EVALUATION

The government shall implement a seminar regarding parenting skills considering


lack of parenting skills leads to social problem such as the children became deviant or
will do something that will violate the government rules such as crime, robbery, stealing,
murder and use of substance and alcoholic drinks.
In this generation it is really important to teach children good moral conduct
because as I have observed children today have no manners and they do no care what
words they throw to others even it can hurt someone’s feelings.
