IN THE MATTER OF:

State of U. T, Chandigarh Versus Pinky & Halima.

Application praying for conducting Ossification test of the

applicant Pinky to substantiate the claim of juvenility by the

applicant under section 9(2) of the Juvenile Justice (Care &

Protection of Children) Act, 2015. The applicant is arraigned as

an accused in case FIR No. 98/2021 under sections 177, 420,

467, 468, 471, 195, 120-B IPC registered at PS- Mauli Jagran.

Respectfully Showeth:

1. That the applicant has been arraigned as an accused in the present case by

the Police officials.

2. That the age of the applicant is projected as 20 years as per the IO of the

case and the same claim regarding the age of the applicant is put forth by the

IO before this Hon’ble Court.

3. That the applicant has already moved an application dated 21.10.2021 before

this Hon’ble Court as in accordance with the relevant provision of the

Juvenile Justice Act (Care & Protection of Children) Act, 2015, claiming

juvenility and sending of the applicant to the Child protection home instead

of Model Jail, Burail.

4. That the applicant has given her date of birth certificate to support her claim.

5. That no conclusion has been reached upon by this Hon’ble Court based on

the said document as the same was got verified through the IO and this

Hon’ble Court has not been able to record a satisfactory finding.

 6. That the Ossification test of the applicant be conducted to medically support

the document produced by the applicant and to assist this Hon’ble Court to

reach a conclusive finding regarding the age of the applicant.

7. That the investigation be handed over to some impartial officer to protect the

constitutional guarantee of Right to fair trial of the applicant.

PRAYER:

It is, therefore, most respectfully prayed that the present application is allowed and

Ossification test of the applicant may kindly be directed to be done in order to

reach a conclusive finding regarding the age of the applicant, in the interest of

justice.
