REPUBLIC ACT NO. 7279 - “URBAN DEVELOPMENT AND HOUSING ACT OF
1992” - UNDER THIS RA ARE POLICIES TO BE UNDERTAKEN BY THE STATE IN
ORDER TO CREATE A COMPREHENSIVE AND CONTINUING URBAN
DEVELOPMENT AND HOUSING PROGRAM IN THE PHILIPPINES - IT AIMS TO:
IMPROVE THE LIVING CONDITIONS OF UNDERPRIVILEGED AND HOMELESS
URBAN RESIDENTS BY PROVIDING AFFORDABLE HOUSING, ESSENTIAL
SERVICES, AND JOB OPPORTUNITIES IN BOTH URBAN AND RESETTLEMENT
AREAS, PROMOTE THE RESPONSIBLE USE AND DEVELOPMENT OF URBAN
LAND TO ACHIEVE: (1) FAIR ALLOCATION OF RESIDENTIAL LANDS WITH A
FOCUS ON THE NEEDS OF UNDERPRIVILEGED AND HOMELESS CITIZENS
RATHER THAN MARKET FORCES; (2) EFFICIENT USE AND PRODUCTIVITY OF
URBAN RESOURCES; (3) CREATION OF URBAN AREAS CONDUCIVE TO
ECONOMIC ACTIVITIES; (4) MITIGATION OF URBAN DYSFUNCTIONS
IMPACTING PUBLIC HEALTH, SAFETY, AND ECOLOGY; AND (5) ENSURING
ACCESS TO LAND AND HOUSING FOR THE UNDERPRIVILEGED AND
HOMELESS, IMPLEMENT EFFECTIVE POLICIES TO GUIDE AND CONTROL
URBAN GROWTH, STEERING IT TOWARDS A DISTRIBUTED URBAN NETWORK
AND FOSTERING A MORE BALANCED URBAN-RURAL INTERDEPENDENCE,
ESTABLISH A FAIR LAND TENURE SYSTEM ENSURING SECURE TENURE FOR
PROGRAM BENEFICIARIES WHILE RESPECTING THE RIGHTS OF SMALL
PROPERTY OWNERS AND ENSURING JUST COMPENSATION, PROMOTE ACTIVE
PUBLIC INVOLVEMENT IN URBAN DEVELOPMENT AND ENHANCE THE
CAPACITY OF LOCAL GOVERNMENT UNITS IN IMPLEMENTING HOUSING AND
URBAN DEVELOPMENT PROGRAMS.

REPUBLIC ACT NO. 9653 – “RENT CONTROL ACT OF 2009” - UNDER THIS RA,
ANY RESIDENTIAL UNIT COVERED BY THIS ACT SHALL NOT EXCEED 7%
ANNUAL INCREASE, GIVEN THAT THE SPACE IS OCCUPIED BY THE SAME
LESSEE, AND INCREASES SHALL ONLY BE APPLIED ONCE A YEAR - AIMS TO
REGULATE THE RENT PRICES OF ANY RESIDENTIAL UNIT.

REPUBLIC ACT NO. 9507 – “SOCIALIZED AND LOW-COST HOUSING LOAN


RESTRUCTURING ACT OF 2008” - UNDER THIS RA ARE GSIS, SSS, HDMF,
NHFMC, SHFC, HGC, AND NHA

REPUBLIC ACT NO. 9397 – “URBAN DEVELOPMENT AND HOUSING ACT OF


1992” - THIS RA WAS IMPLEMENTED TO REGULATE URBAN LANDS OWNED BY
THE NATIONAL AND LOCAL GOVERNMENT UNITS.

REPUBLIC ACT NO. 11201 – “DEPARTMENT OF HUMAN SETTLEMENTS AND


URBAN DEVELOPMENT ACT” - THIS IS AN RA INTENDED TO CREATE AND
IMPLEMENT THE DEPARTMENT OF HUMAN SETTLEMENTS AND URBAN
DEVELOPMENT, ITS MANDATE, POWERS, AND FUNCTIONS, AND TO ALLOCATE
ITS FUNDS.

REPUBLIC ACT NO. 10884 – “BALANCED HOUSING DEVELOPMENT PROGRAM


AMENDMENTS” - THIS IS AN ACT ENHANCING THE BALANCED HOUSING
DEVELOPMENT PROGRAM BY AMENDING REPUBLIC ACT NO. 7279, ALSO
KNOWN AS THE URBAN DEVELOPMENT AND HOUSING ACT OF 1992.

REPUBLIC ACT NO. 9904 – “MAGNA CARTA FOR HOMEOWNERS AND


HOMEOWNERS ASSOCIATION (2010)” - THIS ACT IS IMPLEMENTED TO PROVIDE
A MAGNA CARTA FOR HOMEOWNERS AND HOMEOWNERS’ ASSOCIATION,
AND FOR OTHER PURPOSES.

REPUBLIC ACT NO. 8501 – “HOUSING LOAN CONDONATION ACT OF 1998” -


THIS ACT AIMS AT REVITALIZING THE NATIONAL SHELTER PROGRAM BY
PARDONING PENALTIES ON ALL OVERDUE HOUSING LOAN ACCOUNTS WITH
GOVERNMENT INSTITUTIONS INVOLVED IN THE PROGRAM AND MAKING
AMENDMENTS TO PRESIDENTIAL DECREE NO. 1752, AS AMENDED.

REPUBLIC ACT NO. 8368 – “ANTI SQUATTING LAW REPEAL ACT OF 1997” -
THIS ACT AIMS TO ABOLISH PRESIDENTIAL DECREE NO. 772, TITLED
'PENALIZING SQUATTING AND OTHER SIMILAR ACTS.'

REPUBLIC ACT NO. 7835 – “COMPREHENSIVE AND INTEGRATED SHELTER


FINANCING ACT OF 1994” - THIS ACT AIMS TO ESTABLISH A COMPREHENSIVE
AND INTEGRATED SHELTER AND URBAN DEVELOPMENT FINANCING
PROGRAM BY INCREASING AND REGULARIZING THE ANNUAL ALLOCATION
FOR KEY COMPONENTS OF THE NATIONAL SHELTER PROGRAM, INCLUDING
THE ABOT-KAYA PABAHAY FUND UNDER REPUBLIC ACT NO. 6846. THE LAW
ALSO INVOLVES AUGMENTING THE AUTHORIZED CAPITAL STOCK AND PAID-
UP CAPITAL OF THE NATIONAL HOME MORTGAGE FINANCE CORPORATION

BATAS PAMBANSA BLG. 220 – “ECONOMIC AND SOCIALIZED HOUSING (1982)”


- THIS LAW GRANTS THE MINISTRY OF HUMAN SETTLEMENTS THE
AUTHORITY TO CREATE AND ENFORCE VARYING LEVELS OF STANDARDS
AND TECHNICAL REQUIREMENTS FOR ECONOMIC AND SOCIALIZED HOUSING
PROJECTS IN BOTH URBAN AND RURAL AREAS, DISTINCT FROM THOSE
STIPULATED IN PRESIDENTIAL DECREES NUMBERED 957, 1216, 1096, AND 1185.

PRESIDENTIAL DECREE NO. 1216 – “AMENDMENTS TO SECTION 31 OF PD 957


(1977)” - THIS LAW IS IMPLEMENTED TO REQUIRE SUBDIVISION OWNERS TO
PROVIDE ROADS, ALLEYS, SIDEWALKS, AND RESERVE OPEN FOR PARKS OR
RECREATIONAL USE.

PRESIDENTIAL DECREE NO. 957 – “SUBDIVISION AND CONDOMINIUM


BUYER’S PROTECTIVE DECREE (1976)” - THIS LAW REGULATES THE SALE OF
SUBDIVISION LOTS AND CONDOMINIUMS, ESTABLISHING PENALTIES FOR
ANY INFRINGEMENTS.

B. URBAN DESIGN
REQUIREMENTS
THE SPECIFIC REQUIREMENTS FOR URBAN DESIGN CAN VARY BASED ON
LOCAL REGULATIONS, THE SCALE OF THE PROJECT, AND THE GOALS OF THE
COMMUNITY. HOWEVER, HERE ARE SOME COMMON ELEMENTS AND
CONSIDERATIONS OFTEN INVOLVED IN URBAN DESIGN:

1. ZONING REGULATIONS: COMPLYING WITH LOCAL ZONING LAWS AND


REGULATIONS THAT DICTATE LAND USE, DENSITY, BUILDING HEIGHT,
SETBACKS, AND OTHER PARAMETERS.

2. LAND USE PLANNING: IDENTIFYING AND ALLOCATING LAND FOR


DIFFERENT USES SUCH AS RESIDENTIAL, COMMERCIAL, INDUSTRIAL, AND
PUBLIC SPACES.

3. SITE ANALYSIS: CONDUCTING A THOROUGH ANALYSIS OF THE SITE'S


CHARACTERISTICS, INCLUDING TOPOGRAPHY, CLIMATE, EXISTING
INFRASTRUCTURE, AND ENVIRONMENTAL CONSIDERATIONS.

4. TRANSPORTATION PLANNING: INTEGRATING TRANSPORTATION


INFRASTRUCTURE TO ENSURE EFFICIENT CONNECTIVITY, INCLUDING ROAD
NETWORKS, PUBLIC TRANSIT, AND PEDESTRIAN PATHWAYS.

5. PUBLIC SPACES: DESIGNING AND INCORPORATING PUBLIC SPACES, PARKS,


PLAZAS, AND RECREATIONAL AREAS TO ENHANCE THE QUALITY OF LIFE
AND FOSTER COMMUNITY INTERACTION.

6. ARCHITECTURAL DESIGN STANDARDS: ESTABLISHING GUIDELINES FOR


THE DESIGN AND AESTHETICS OF BUILDINGS TO CREATE A COHESIVE AND
VISUALLY APPEALING URBAN ENVIRONMENT.

7. SUSTAINABILITY: INCORPORATING SUSTAINABLE PRACTICES AND


PRINCIPLES, SUCH AS GREEN BUILDING DESIGN, ENERGY EFFICIENCY, AND
ENVIRONMENTAL CONSERVATION.

INFRASTRUCTURE PLANNING: COORDINATING WITH UTILITIES AND PUBLIC
SERVICES TO ENSURE ADEQUATE WATER, SEWAGE, POWER, AND
TELECOMMUNICATION INFRASTRUCTURE.

9. ACCESSIBILITY: ENSURING ACCESSIBILITY FOR PEOPLE WITH


DISABILITIES AND PROMOTING INCLUSIVE DESIGN FOR ALL MEMBERS OF
THE COMMUNITY.

10. COMMUNITY ENGAGEMENT: INVOLVING THE COMMUNITY IN THE


PLANNING PROCESS TO GATHER INPUT, ADDRESS CONCERNS, AND FOSTER A
SENSE OF OWNERSHIP IN THE DEVELOPMENT.

11. HISTORIC PRESERVATION: PROTECTING AND PRESERVING HISTORIC


STRUCTURES OR DISTRICTS, IF APPLICABLE, TO MAINTAIN CULTURAL AND
HISTORICAL IDENTITY.

12. DENSITY AND MIXED-USE DEVELOPMENT: BALANCING DENSITY AND


PROMOTING MIXED-USE DEVELOPMENT TO CREATE VIBRANT, WALKABLE
COMMUNITIES WITH A MIX OF RESIDENTIAL, COMMERCIAL, AND
RECREATIONAL SPACES.

IT'S IMPORTANT TO NOTE THAT URBAN DESIGN IS A COMPLEX AND


INTERDISCIPLINARY FIELD, AND THE SPECIFIC REQUIREMENTS WILL DEPEND
ON THE CONTEXT AND GOALS OF THE PARTICULAR URBAN DESIGN PROJECT.
LOCAL PLANNING DEPARTMENTS, ARCHITECTS, URBAN DESIGNERS, AND
OTHER PROFESSIONALS TYPICALLY COLLABORATE TO ENSURE THAT THE
DESIGN MEETS BOTH REGULATORY REQUIREMENTS AND THE NEEDS OF THE
COMMUNITY
