consumer has vacated the Premises.

2. *We/I hereby agree and undertake as follows—

a) if the declaration stated in Clause 1 above is found to be incorrect by TNB and/or it is disputed by any party(ies) or *We/I no longer
own such Premises, then TNB will terminate the electricity supply contract by giving not less than 24 hours written notice to the
Premises and electricity supply to the Premises will be disconnected without any further notice;

b) will not demand from TNB any loss incurred as a result of the disconnection of electricity supply by TNB in Clause2 (a) above;

c) to indemnify and/or hold harmless TNB of all cost, damages and losses which TNB may suffer or incur against any claim from any third
party arising out of the disconnection and termination of electricity supply by TNB;

d) will bear any loss and/or expense including the costs and legal fees of TNB in enforcing this declaration in court; and

e) this declaration has been voluntarily signed without any element of coercion, intimidation or encouragement from any party and I fully
aware and understand the implications of this declaration.
3. The clauses in this declaration are separate and distinct from one another and at any time if any or more of these clauses become invalid in
law, then such invalidity will not have any effect to the other clauses.

4. This declaration binds the respective heirs, executors, administrator, successor-in-the-title and representatives appointed by *us/me.

5. *We/I do acknowledge that the information provided is true and up to date whereby any false statement will amounting to an offence and may
cause *us/me to be prosecuted and liable to civil claim in court.

20. MAXIMUM DEMAND
Means for any month, the electrical power taken by the Consumer measured to be

An upfront contribution amount payable by a Consumer requiring infrastructure for new
supply and/or upgrading of existing infrastructure for additional supply requirement as
approved by Energy Commission as provided under the Act.

25. SUPPLY AUTHORITY
Any statutory authority established by an Act of Parliament or any other law to generate
and/or supply electricity.
26. TARIFF
The rates to be charged to the Consumer for the consumption of electricity as referred
under the tariff column of the Application Form, as provided by the Act.

6. VACATED PREMISES
If the Consumer vacates the premises without giving any notice to TNB as provided
under Clause 5, the Consumer shall be liable to pay all charges of electricity
consumption and any charges payable relating to the electricity supply until the
installation is disconnected or until another consumer applied for electricity supply and
entered into a new contract of supply.
TNB shall have the right not to provide electricity supply at any other premises to the
Consumer who vacated the premises until the Consumer has made full payment of the
outstanding balance.
7. TENANTED PREMISES
In the event the premises is tenanted, the Consumer/owner of the premises agrees: -
a) to inform tenant to apply for electricity to be registered under the tenant’s name by
way of Change of Tenancy upon occupancy to TNB;
b) to inform TNB of any change of tenancy and the Consumer has the option for the
tenant to apply for Change of Tenancy for the account;
c) the Consumer to take full responsibility to pay all the bills registered under the
Consumer’s name;
8. RESPONSIBILITY TO MAKE GOOD ALL DAMAGE
The Consumer shall pay for all damages which are intentionally caused on TNB’s
installation within the Consumer’s premises or due to negligence on the Consumer’s
part or any persons under his control.
9. NO INTERFERENCE OF ELECTRICITY SUPPLY TO OTHER CONSUMERS
To use electricity supply so as not to interfere with the supply of electricity to any other
consumers.
10. NO OBSTRUCTION TO TNB’S INSTALLATION
a) The Consumer shall not create any obstruction and/or undertake any activity in the
vicinity of any TNB’s electrical installation and/or place any equipment which may
endanger life or properties and/or to make any electrical wiring and/or installation
to any existing wiring and installation at any premises without any written permission
from the Energy Commission and/or TNB.
b) (i) TNB has the right to take any reasonable action to remove any obstruction
created by the Consumer or representative under Consumer’s
supervision/control.
(ii) TNB shall not be liable to pay any compensation for any losses and/or damages
to the Consumer due to the said removal.
11. RENEWABLE ENERGY INSTALLATIONS
All renewable energy installations shall be subjected to the guideline as approved by
Energy Commission.
12. ACCESS
The Consumer consents with TNB that the authorised employees, servants, agents
and/or representatives of TNB shall be permitted to have access to the premises of the
Consumer at reasonable time, manner and circumstances: -
(a) To carry out their duties/ inspection and/or test and/or construction and/or other
things relevant to the supply and disconnection to the Consumer’s premises.
(b) For entry pursuant to Clause 12(a) TNB shall make good any damage, if any, as
a result of such entry.
13. APPLICANT DECLARATION
The Consumer shall abide at all times to the Applicant Declaration as stipulated in the
Application Form.
B. TNB’S COVENANTS
14. LOCATION OF TNB’S INSTALLATION
TNB shall determine the position and end-connection of entry route of the service lines
or cable(s) including cut-out fuses, meter(s), and others to the Consumer's premises.
In the event that the Consumer wishes to remove the said installation, authorization of
TNB must be obtained and the costs of the removal shall be fully borne by the
Consumer. Any removal made without written authorization shall entitle TNB to
disconnect the supply without any notice.
15. USAGE OF INSTALLATION FOR OTHER CONSUMER
TNB may use its part of the installation to supply electricity to other consumers in the
area.
16. INSPECTION BY TNB
(a) TNB may need to inspect and test all installations before connection of supply.
However, it is the responsibility of the Registered Electrical Contractor to ensure
that the installations are safe.
(b) The Consumer shall inform TNB of any proposed extensions or alterations to the
installations so that TNB may conduct inspection and test of the extension or
alteration if TNB so desires.
(c) TNB does not accept any responsibility for any loss or damage caused by or
occurs during or after test due to any defect in the installation and any test carried
out by TNB is for TNB's purposes only and does not imply any warranty that the
installation is suitable for the Consumer's purposes or that it fully complies with the
Act or any subsequent amendments made there under.

17. TEMPORARY DISCONNECTION OF SUPPLY
TNB may temporarily disconnect the supply to the Consumer’s premises for any
purposes in connection with TNB’s efficient electricity supply system by giving an early
notice. TNB shall not be liable to provide any alternative supply after the disconnection.
18. CHANGE OF TENANCY
In the event the Consumer’s premises which supply is being given under this Contract
is tenanted, TNB shall inform the Consumer that they have the option for the tenant to
apply for Change of Tenancy for the account.
19. THE CONSUMER STATUS
TNB has the obligation to provide electricity supply to the legal owner or occupier of
any premises as provided by the Law.
C. IT IS HEREBY AGREED BY BOTH PARTIES
20. RISER AND LATERAL MAINS
(a) For single individual premises, any installation comprising mains and service
lines and other ancillary equipment up to and including the meter will be the
property of TNB;
(b) For multi tenanted premises where part of the supply is intended for including
but not limited to the owner, developer, management or landlord, and the rest for
the tenants in the building, the landlord’s supply and each of the tenant’s supplies
will be separately metered and billed by TNB. The owner, developer,
management, landlord or their respective agents shall provide, own, maintain
and repair at his own expense the electrical systems in the buildings including
adequate and necessary rising and lateral mains. The design, installation and
operating of such electrical systems shall comply with requirements set by the
relevant authorities including the Statutory Authority and TNB as provided by the
Act.
21. BILLING AND PAYMENT
(a) All bills including but not limited to any other applicable charges in respect of any
amounts payable to TNB shall be rendered to the Consumer monthly and shall be
paid by the Consumer within thirty days of its presentation.
(b) Notwithstanding anything hereinbefore mentioned, TNB shall have the right to
impose Minimum Monthly Charge in the event the monthly total electricity bill is
less than the stipulated amount in the Tariff Book.
(c) TNB shall have the right to impose surcharge of one percent (1%) on the
outstanding amount calculated until the date of full payment.
(d) The Consumer shall be liable for electricity bills issued by TNB including any
unpaid amount insofar as the account is registered under the Consumer’s name
regardless of any consumption of electricity by any third party.
(e) The Consumer shall be responsible to repay the amount in the bills rendered by
TNB including any other relevant charges for any invalid payment made by the
Consumer such as false credit card, bounced cheque and any other invalid
payment.
(f) In the event the Consumer fails to make payments of any amount pursuant to
Clause 21(a), (b) and (c), TNB shall have the right to disconnect electricity supply
at the Consumer’s premises.
(g) The Consumer shall be liable to pay for any unpaid amount of electricity bill and/or
loss of revenue and/or expenses incurred by TNB by reason of dishonest
consumption of electricity supply in accordance with the provisions of the Act.
(h) TNB shall have the right to make adjustment and to update the Consumer’s
account in accordance with the Law.
22. REMOVAL OF TNB INSTALLATION
If the Consumer or the proprietor of the premises requests TNB to remove or relocate
the supply line, pole, sub-station, pylon or any other TNB’s installation or equipment
within or outside the Consumer’s premises, subject to consent by TNB if the
transmission/distribution system is not disrupted, all costs of executing the removal or
relocation shall be fully borne by the Consumer or the proprietor as the case may be.
23. EVENT OF DEFAULT
The occurrence of any of the following shall constitute an event of default under this
Contract and it is not limited to:
(a) Act or default of the Consumer affecting the efficiency and/or safety of TNB’s
installation.
(b) The Consumer has failed to comply and/or breach with any provision of this
Contract and/or the Act and/or commit any offence under the Act.
(c) The Consumer has obtained consent for the appointment of or the taking of
possession by a receiver or liquidator of itself or of all or a substantial part of its
property.
(d) The Consumer acknowledges in writing its inability to pay its debt as such debts
become due.
(e) The Consumer makes a general assignment or an arrangement or composition
with or for the benefit of its creditor.
(f) Instituting a case voluntarily or filing a petition against any party seeking to take
advantage of any law relating to bankruptcy, insolvency, restructuring of its debts,
winding up or composition.
(g) The Consumer is under receivership or under special administration or liquidation.
(h) The Consumer is declared a bankrupt by the Court.
(i) Upon the Consumer dissolution or death.
(j) Failure to pay the amount as stipulated under Clause 21 above.
(k) Consumption of electricity in any dishonest manner.
 (l) The Consumer fails to comply with any of the provisions stipulated under Clause
13 of this Contract.
On such effective date of termination hereof, TNB shall be discharged from any
obligations and liabilities under this Contract.
24. DISCONNECTION OF SUPPLY
TNB may disconnect the supply to the Consumer by giving no less than seven (7)
working days prior notice in any situation mentioned below: -
(a) Any default by the Consumer under Clause 23 and such default are not remedied
within the stipulated period if any;
(b) Any right to disconnect the supply as provided under the Act.
25. TERMINATION OF CONTRACT BY TNB
(a) TNB may terminate this Contract on reasonable grounds taking into account of the
circumstances accordingly, or for reasons permitted by the Law and this Contract
upon giving not less than fourteen (14) working days’ notice in writing of its
intention to do so.
(b) TNB may terminate this Contract under Clause 23 by giving fourteen (14) working
days’ notice from the date of expiry of the remedy period (if applicable)
(c) If the Consumer renders to TNB a notice of disconnection of supply thereby it shall
be deemed as a notice of termination of the Contract subject to the issuance of
notice under Clause 25(a).
(d) If TNB discovers that the information given is false and/or is disputed with the
existence of prima facie proof relating to the supply and proven by any applicable
laws, TNB shall have the right to terminate this Contract upon giving a written
notice of not less than 48 hours.
26. NOTICES
Unless and otherwise provided under the Act and any clause stated under this
Contract, any notice, demand or other communication which is required or allowed to
be given or made under this Contract shall be in writing and shall be served by hand
delivery or by way of prepaid registered post or ordinary post or electronically, as opted
by the Consumer, to the address stated in this Contract. Proof of posting or service of
any notice, demand or communication shall be deemed to be duly served:
i) if service is delivered by hand, at the time of such delivery and duly
acknowledged;
ii) if service is by way of post, on the third (3rd) Working Day after posting thereof.
iii) if service is by way of electronic means, at the time of delivery to the recipient;
or
iv) if service is by way of post and electronic means, on the third (3rd) Working Day
after posting thereof.
27. SERVICES OF LEGAL PROCESS
The service of any legal process shall be by way of prepaid registered post sent to the
address as stated in this Contract. Proof of posting will be regarded as proof of
acceptance and the said service shall be deemed to have been duly served and duly
received upon the expiry of five (5) days from the date of posting.
28. FORCE MAJEURE
TNB shall not be liable to the Consumer for any breach of terms and conditions of this
Contract due to any of this event which shall include but not limited to national
emergency, war, hostilities, riot, civil commotion, earthquake, flood, disposition or by
compliance with any order of government, local government or any other authorities.
29. INDEMNITY AND NO LIABILITY CLAIM
a) The Consumer agrees to indemnify and keep indemnified (indemnifying) TNB from
and against all and/or any claims, actions, compensations, suits, proceedings,
demands and all legal costs incurred thereby, brought against TNB, its servants
or agents by a third party to which TNB may be or become liable in respect of or
arising from the performance of this Contract provided always it is not due to the
negligence or willful acts of TNB, its employees or agents.
b) The Consumer hereby agrees that neither TNB nor its employees, servants,
agents, representatives shall be liable and/or make good the Consumer in respect
of any damage, injury or loss to any of the Consumer’s property and/or life unless
such damage, injury or loss have been proven as a result of any willful act,
negligence, omission and/or failure to comply with any safety measures as
provided under any written law.
c) The Consumer hereby agrees further that TNB shall not be liable for any cost
incurred, loss and/or damage of industrial goods, product, property or life of the
Consumer as a result of any unavoidable accident, voltage fluctuation,
interruption, reduction and/or cessation of the electricity supply, fire or accident
that may occur in consequence of the supply or the use or misuse which is not
due to the negligence or willful act of TNB and/or its employees.
30. PERMISSION FROM LANDLORD
If required, the Consumer may assist TNB in getting the permission from the landlord
for the connection of electricity supply to the Consumer’s premises.
D. MISCELLANEOUS
31. TAXES
(a) Service Tax
The Consumer shall bear and pay its own Service Tax on the services as may be levied
by the government from time to time.

For the purpose of this clause:
“Service Tax” means the Service Tax applicable to the Contract pursuant to the Service
Tax Act;
“Service Tax Act” means the Service Tax Act 2018 of Malaysia and includes its rules,
regulations or guideline issued by the relevant authorities in charge of such tax.
(b) Other Taxes & Levies
Except as provided for otherwise, the Consumer shall be responsible for all present
and future taxes, duties, levies, and other similar charges including any related interest
and penalties, howsoever designated (hereinafter referred to as ‘Other Taxes’), arising
out or in connection with the supply of any kind imposed by law.
32. GOVERNING LAW
This Contract will be governed by and construed in accordance with the Act and any
regulations made there under including any amendment thereto as well as any other
relevant written laws.
33. AMENDMENT, MODIFICATION OR REPLACEMENT
No amendment or other variation to this Contract is binding unless the same is duly
affected by an instrument in writing signed by the parties and expressed to be for the
purpose of such amendments.
34. ASSIGNMENT
The Consumer shall not assign any of the rights or obligations arising under this
Contract to any third party without the prior consent in writing of TNB.
35. WAIVER
Knowledge or acquiescence by TNB of or in breach of any of the conditions or
covenants herein contained shall not operate as or be deemed to be waiver of such
conditions or covenants or any of them and notwithstanding such acknowledge or
acquiescence, TNB shall be entitled to exercise its rights under this Contract.
36. TIME PERIOD
Time wherever mentioned shall be the essence of this Contract.
37. SUCCESSORS-IN-TITLE
This Contract shall be binding upon the successors-in-title and permitted assigns of
the respective Parties hereto.
38. STAMP DUTY
The stamp duty in respect of this Contract shall be borne and fully paid by the
Consumer.
39. SEVERABILITY
If any one or more of the provisions or part thereof contained in this Contract should
be or become invalid or unenforceable due to whatsoever reasons this shall not in any
way affect or impair the validity or enforceability of the remaining provision hereof.
40. INSTALLATION OF EQUIPMENT TO GENERATE ELECTRICITY
The Consumer shall inform TNB on any equipment installed at his premise for the
purpose of generating electricity.
41. POWER QUALITY
The Consumer shall ensure all its electrical installations have sufficient immunity
against short duration voltage events (sags & swells) and transient events, and shall
not generate other significant power quality voltage signatures that might have
detrimental effects to the electrical supply systems. The related power quality technical
standards are defined in TNB Electricity Supply Application Handbook (ESAH).
42. POWER FACTOR
The Consumer shall at any time use its best endeavor to obtain the highest power
factor possible close to the value of 1.0 in all the operation of the Consumer’s electrical
installations. A power factor charge shall be imposed on the Consumer based on the
current rates approved as provided by the Act if the power factor in any month falls
short of the minimum power factor set under the existing TNB policy. Consumers
under domestic tariff and streetlight tariff are exempted from the power factor charge.
43. WELDING SET
In addition to the applicable tariff rate, Low Voltage, Medium Voltage, High Voltage and
Extra High Voltage Consumers who install transformer-operated electric welding set
equipment will be imposed a charge. Motor-operated welding sets are exempted from
the said charge.
44. CONFIDENTIALITY
Except as it is or becomes a part of the public domain, all information provided by either
Party under this Contract shall be confidential at all times unless specified otherwise
in writing.
45. PERSONAL DATA
(a) TNB will comply with the provisions of the Personal Data Protection Act 2010
("APDP 2010") while processing the Consumer’s personal data under this
contract;
(b) TNB may disclose Consumer's personal data to lawyers, debt collection agencies
and any third parties appointed by TNB as agents, contractors, service providers
 and/or professional advisors for any purpose related to the supply of electricity to
the Consumer;
(c) Consumer may make any inquiries, complaints or applications for access or
correction to his/her personal data relating to the electricity supply to TNB;
(d) Consumer hereby agrees that his/her personal data may be transferred outside
Malaysia for a lawful purpose or necessary for and directly related to the activities
of supplying electricity by TNB. In the event of no consent is given by the
Consumer, the personal data may be transferred to a country that have personal
data protection law at least equivalent to the level of protection afforded by PDPA
2010 or for the exercise of any functions conferred on any person by any law; and
(e) TNB Personal Data Protection Policy can be accessed by the Consumer at
https://www.tnb.com.my/pdpa.

E. THE FOLLOWING ADDITIONAL CLAUSES ARE APPLICABLE FOR

BUSINESS/NON-DOMESTIC CONSUMER/LARGE POWER CONSUMER (LPC)

46. MAXIMUM DEMAND

Consumers who are taking supply at Medium Voltage, High Voltage or Extra High
Voltage shall have an obligation to ensure that the Actual Maximum Demand shall not
exceed Declared Maximum Demand;
(i) In the event the Actual Maximum Demand at any time during the prescribed period
exceeds the Declared Maximum Demand, the Actual Maximum Demand shall be
the new Declared Maximum Demand for the billing purpose shall become
effective from the next billing period.
(ii) Notwithstanding the foregoing, in the event the Actual Maximum Demand
exceeds the Declared Maximum Demand and such excess impacts or affects the
safety, security and efficiency of the TNB System, TNB shall in its absolute
discretion reduce the Maximum Demand to the Declared Maximum Demand.

47. CONNECTED LOAD CHARGE (CLC)

The Consumer shall be required to pay a Connected Load Charge (if any) when taking
supply at Medium Voltage, High Voltage or Extra High Voltage based on the prevailing
Tariff and Connection Charges policy.

48. LIQUIDATED DAMAGES

In the event the Consumer fails or ceases to take supply for the period of five (5) years
after supply been given, the Consumer shall pay to TNB Liquidated Damages.
Provided always that the amount and payment of Liquidated Damages shall be
subjected to the prevailing Tariff and Connection Charges policy.

 TERMA DAN SYARAT-SYARAT BEKALAN BAGI PENGGUNA
DEFINISI
1. AKTA
Akta Bekalan Elektrik 1990 (Akta 447) dan/atau mana-mana peraturan yang dibuat di
bawah ini dan/atau mana-mana pindaan, penyemakan, pengubahsuaian atau enakmen
yang dibuat kepadanya atau apa-apa dari semasa ke semasa.
2. BORANG PERMOHONAN
Borang permohonan bermaksud borang bagi tujuan permohonan bekalan elektrik sama
ada dalam bentuk fizikal bercetak atau dalam bentuk digital bagi permohonan secara
atas talian, yang mana berkenaan.
3. CAJ MINIMUM BULANAN (CMB)
Caj minimum bulanan yang dikenakan ke atas Pengguna di mana bil bulanan elektrik
(kW dan/atau kWj) adalah kurang daripada jumlah yang ditetapkan berdasarkan Tarif
yang terpakai seperti diluluskan oleh kerajaan.
4. CAJ MINIMUM BULANAN PROJEK (CMBP)
Caj bulanan bersamaan 2% dari kos modal bersih projek bekalan. CMBP dikenakan
dalam tempoh lima (5) tahun pertama dari tarikh pembekalan, selepas itu Caj Minimum
Bulanan (CMB) akan digunakan. Tertakluk kepada jumlah elektrik yang digunakan,
Pengguna akan dikenakan jumlah yang lebih tinggi antara CMBP atau penggunaan,
berdasarkan tarif yang digunapakai seperti diluluskan oleh Suruhanjaya Tenaga atau
pihak berkuasa yang berkenaan.
5. CAJ SAMBUNGAN
Bayaran awal yang perlu dibayar oleh Pengguna yang memerlukan infrastruktur untuk
bekalan elektrik baru dan/atau untuk menaiktaraf infrastruktur sedia ada bagi
mendapatkan bekalan elektrik tambahan seperti yang diluluskan oleh Suruhanjaya
Tenaga selaras dengan peruntukan Akta.
6. CAJ SAMBUNGAN BEBAN (CSB)
Caj tambahan bagi setiap kilowat yang perlu dibayar oleh Pengguna secara bulanan
apabila Kehendak Maksimum sebenar yang direkodkan adalah kurang daripada 75%
dari Kehendak Maksimum yang diisytiharkan.
7. GANTI RUGI BERES
Sejumlah wang yang dikenakan kepada Pengguna yang gagal atau berhenti untuk
mengambil bekalan bagi tempoh lima (5) tahun.
8. KEHENDAK MAKSIMUM
Bermaksud untuk mana-mana bulan, kuasa elektrik yang diambil oleh Pengguna diukur
dua kali ganda jumlah terbesar kilowatt-jam (kWj) yang dibekalkan dalam mana-mana
tiga puluh (30) minit berturut-turut dalam bulan tersebut.
9. KEHENDAK MAKSIMUM DIISYTIHARKAN
Bermaksud keperluan kuasa elektrik yang disytiharkan oleh Pengguna dalam kilo-watt
(kW) atau mega-watt (MW) seperti yang dikontrakkan dengan TNB.
10. KEHENDAK MAKSIMUM SEBENAR
Bermaksud Kehendak Maksimum seperti yang direkodkan oleh meter kilowatt yang
dipasang di premis Pengguna di mana Pengguna akan dibilkan secara bulanan untuk
kapasiti kuasa elektrik digunakan.
11. KONTRAK
Kontrak Bekalan Elektrik yang merangkumi terma dan syarat-syarat serta borang
permohonan bekalan.
12. KONTRAKTOR ELEKTRIK BERDAFTAR
Orang yang memegang Perakuan Pendaftaran sebagai Kontraktor Elektrik yang
dikeluarkan di bawah Peraturan-Peraturan Elektrik 1994.
13. PEMEGANG LESEN
Orang yang dilesenkan di bawah seksyen 9 Akta.
14. PENGGUNA
Orang yang dibekalkan dengan elektrik atau yang premisnya pada masa ini
disambungkan bagi maksud pembekalan elektrik oleh Pihak Berkuasa Bekalan atau
Pemegang Lesen.
15. PENGGUNA BUKAN KEDIAMAN
Mana-mana Pengguna yang memohon bekalan elektrik bagi tujuan selain dari rumah
persendirian (Rumah persendirian adalah premis domestik yang mana tidak digunakan
sebagai hotel, rumah asrama atau digunakan bagi tujuan menjalani sebarang bisnes,
perniagaan, pekerjaan khas atau perkhidmatan).
16. PENGGUNA KEDIAMAN
Pengguna yang menduduki premis kediaman persendirian yang tidak digunakan
sebagai hotel, rumah penginapan atau untuk sebarang bentuk aktiviti atau
perkhidmatan perniagaan, perdagangan dan professional.
17. PERTUKARAN PENGHUNI
Proses pertukaran nama pengguna berdaftar asal kepada pengguna berdaftar baru
yang akan bertanggungan terhadap akaun elektrik sedia ada bagi suatu premis.
18. PIHAK BERKUASA BEKALAN
Mana-mana pihak berkuasa berkanun yang ditubuhkan oleh Akta Parlimen atau mana-
mana undang-undang lain untuk menjanakuasakan dan/atau rnembekalkan elektrik
19. SURUHANJAYA TENAGA
Suruhanjaya Tenaga yang ditubuhkan di bawah Akta Suruhanjaya Tenaga 2001.
20. TARIF
Kadar yang akan dikenakan kepada Pengguna bagi penggunaan elektrik seperti yang
dirujuk pada ruangan tarif Borang Permohonan sebagaimana diluluskan di bawah Akta.
21. TNB
Tenaga Nasional Berhad (200866-W) adalah sebuah syarikat yang ditubuhkan di
Malaysia di bawah Akta Syarikat 1965 dengan alamat berdaftar di Pejabat Setiausaha
Syarikat, Tingkat 2, Ibu Pejabat Tenaga Nasional Berhad, No. 129 Jalan Bangsar,
59200 Kuala Lumpur dan mempunyai cawangan-cawangan di Semenanjung Malaysia.
22. UNDANG-UNDANG
Mana-mana peruntukan undang-undang di bawah Akta, prinsip undang-undang yang
diputuskan oleh mahkamah atau perintah mahkamah yang memberi kesan kepada
sebarang isu berkaitan pemberian bekalan elektrik kepada Pengguna.
23. VOLTAN AMAT RENDAH
Voltan yang biasanya tidak melebihi 50 volt arus ulang alik atau 120 volt arus terus,
sama ada antara konduktor ataupun antara konduktor dengan bumi.
24. VOLTAN AMAT TINGGI
Voltan yang biasanya melebihi 230,000 volt.
25. VOLTAN RENDAH
Voltan yang biasanya melebihi Voltan Amat Rendah tetapi tidak melebihi 1,000 volt arus
ulang alik atau 1,500 volt arus terus di antara konduktor, atau 600 volt arus ulang alik
atau 900 volt arus terus antara konduktor dengan bumi.
26. VOLTAN SEDERHANA
Voltan yang biasanya melebihi Voltan Rendah tetapi bersamaan dengan atau tidak
melebihi 50,000 volt.
27. VOLTAN TINGGI
Voltan yang biasanya melebihi 50,000 volt tetapi bersamaan dengan atau tidak melebihi
230,000 volt.
A. TANGGUNGJAWAB PENGGUNA
1. MENGAMBIL BEKALAN
Mengambil bekalan elektrik dipremis tersebut mengikut kadar Tarif menurut peruntukan
Akta.
2. CAJ SAMBUNGAN
Membayar penuh kepada TNB bayaran Caj Sambungan (jika ada) sebelum sebarang
kerja dimulakan oleh TNB, menurut peruntukan di bawah Akta.
3. WANG CAGARAN
Membayar wang cagaran yang diperlukan bagi menampung caj yang dianggarkan
untuk dua (2) bulan bekalan elektrik sebelum bekalan disambungkan, dengan syarat
bahawa TNB dari masa ke semasa mempunyai hak untuk mengkaji semula jumlah
wang cagaran yang diperlukan berdasarkan kepada jumlah penggunaan elektrik.
Pembayaran wang cagaran boleh dibuat dalam bentuk tunai, cek, draf bank, perintah
juruwang atau jaminan bank.
Dengan syarat bahawa, kecuali wang cagaran dalam bentuk jaminan bank, TNB
hendaklah membayar kepada Pengguna tertakluk kepada apa-apa syarat dan kadar
sebagaimana yang ditetapkan sejumlah wang yang bersamaan dengan faedah tahunan
ke atas wang cagaran menurut Akta.
4. PENJAGAAN DAN PENYELENGGARAAN PEPASANGAN TNB
Pengguna bersetuju: -
a) untuk menjaga pepasangan TNB dan mengambil langkah bagi memastikan
bahawa tiada kerosakan atau menyebabkan berlaku usikan ke atas pepasangan
tersebut;
b) untuk membenarkan TNB menyelenggara mana-mana pepasangan dan
peralatan elektrik di premis Pengguna pada bila-bila masa untuk tujuan
keselamatan.
Sekiranya terdapat sebarang kecacatan atau kejanggalan pada pepasangan, TNB
berhak untuk membaik pulih dan menghapuskan kecacatan kecacatan tanpa
bertanggungan terhadap sebarang kerosakan selagi ianya bukan disebabkan oleh
kecuaian atau tindakan yang disengajakan oleh TNB, pekerja-pekerjanya atau agen-
agennya.
5. PENAMATAN OLEH PENGGUNA
Tertakluk kepada klausa 26, memberi notis kepada TNB secara bertulis dan hendaklah
disampaikan melalui: -
a) serahan tangan; atau
b) pos berdaftar;atau
c) pos biasa; atau
d) elektronik seperti yang ditentukan oleh TNB.
Penamatan Kontrak akan berkuatkuasa tiga (3) hari bekerja selepas TNB menerima
notis penamatan. Pengguna hendaklah memberikan akses kepada TNB untuk
pemotongan bekalan di premis dan sekiranya Pengguna gagal berbuat demikian,
penamatan tidak akan berkuatkuasa dan Pengguna hendaklah membayar semua caj
yang berkaitan dengan penggunaan tenaga elektrik di premis tersebut sehingga
pemotongan bekalan dan penamatan kontrak yang sebenar dapat dilaksanakan.
6. PENGOSONGAN PREMIS
Sekiranya Pengguna mengosongkan premis tanpa memberi notis seperti di Klausa 5,
Pengguna bertanggungjawab membayar semua caj penggunaan elektrik dan apa-apa
caj yang perlu dibayar berkenaan dengan pembekalan elektrik sehingga pepasangan
itu dipotong atau sehingga seorang pengguna lain memohon bekalan elektrik dan
menandatangani suatu kontrak bekalan yang baru.
TNB berhak untuk tidak memberi bekalan elektrik kepada Pengguna yang
mengosongkan premis tersebut di mana-mana premis lain sehingga Pengguna tersebut
membayar penuh amaun yang tertunggak.
7. PREMIS DISEWA
Sekiranya premis disewakan, Pengguna/pemilik premis bersetuju: -
a) untuk memaklumkan penyewa supaya memohon kepada TNB bekalan elektrik
untuk didaftarkan di bawah nama penyewa melalui proses Pertukaran Penghuni;
b) untuk memaklumkan TNB apa-apa pertukaran penyewa dan Pengguna
mempunyai pilihan untuk penyewa memohon Pertukaran Penghuni bagi akaun
tersebut;
c) Pengguna bertanggungjawab sepenuhnya bagi pembayaran bil yang berdaftar di
bawah nama Pengguna;
8. TANGGUNGJAWAB UNTUK MEMBAIKI KEROSAKAN
Pengguna perlu membayar sebarang kerugian terhadap apa-apa kerosakan yang
disengajakan ke atas pepasangan TNB yang berada di premis Pengguna atau yang
diakibatkan oleh kecuaian Pengguna atau mana-mana orang di bawah seliaannya.
9. TIADA GANGGUAN BEKALAN ELEKTRIK KEPADA PENGGUNA LAIN
Menggunakan bekalan elektrik tanpa mengganggu pembekalan elektrik kepada
pengguna-pengguna lain.
10. TIADA HALANGAN KEPADA PEPASANGAN TNB
(a) Pengguna tidak akan mewujudkan apa-apa halangan dan/atau menjalankan apa-
apa aktiviti berhampiran dengan mana-mana pepasangan elektrik TNB dan/atau
menempatkan apa-apa kelengkapan yang mungkin menyebabkan bahaya kepada
nyawa atau harta benda dan/atau membuat pendawaian dan/atau pemasangan
elektrik kepada mana-mana pendawaian dan pepasangan sedia ada pada mana-
mana premis tanpa terlebih dahulu mendapat kelulusan bertulis daripada
Suruhanjaya Tenaga dan/atau TNB.
(b) (i) TNB berhak untuk mengambil tindakan yang munasabah untuk menghapuskan
halangan yang diwujudkan oleh Pengguna atau wakil yang berada di bawah
seliaan/kawalan pihak Pengguna.
(ii) TNB tidak akan bertanggungan untuk membayar kos kerugian dan/atau
kerosakan kepada Pengguna yang berkaitan dengan tindakan penghapusan
tersebut.
11. PEPASANGAN TENAGA BOLEH BAHARU
Semua pepasangan tenaga boleh baharu akan tertakluk kepada garis panduan yang
diluluskan oleh Suruhanjaya Tenaga.
12. KEBENARAN LALUAN
Pengguna bersetuju dengan TNB bahawa pekerja, agen, dan/atau wakil TNB
dibenarkan untuk memasuki kawasan premis Pengguna pada masa , cara dan keadaan
yang munasabah:-
(a) untuk menjalankan kerja-kerja/pemeriksaan dan/atau ujian dan/atau pembinaan
dan/atau perkara-perkara lain yang berkaitan dengan pembekalan dan
pemotongan ke premis Pengguna.
(b) bagi kemasukan di bawah Klausa 12(a) TNB akan membaikpulih apa-apa
kerosakan, sekiranya ada, disebabkan oleh tindakan tersebut.
13. PERAKUAN PEMOHON
Pengguna hendaklah mematuhi pada bila-bila masa Perakuan Pemohon sepertimana
yang dinyatakan di dalam Borang Permohonan.
B. TANGGUNGJAWAB TNB
14. KEDUDUKAN PEPASANGAN TNB
TNB akan menentukan kedudukan dan penamatan-akhir masuk talian-talian sesalur
atau kabel termasuk fius-fius “cut-out”, meter dan lain-lain ke premis Pengguna.
Sekiranya Pengguna hendak mengalihkan pepasangan tersebut, kebenaran TNB mesti
diperolehi dan kos pengalihan akan ditanggung sepenuhnya oleh Pengguna. Apa-apa

pengalihan yang dibuat tanpa kebenaran bertulis, TNB berhak untuk memotong
bekalan tanpa sebarang notis.
15. PENGGUNAAN PEPASANGAN UNTUK PENGGUNA LAIN
TNB boleh menggunakan mana-mana bahagian pepasangan yang disediakan oleh
pihak TNB untuk memberi bekalan kepada pengguna-pengguna yang lain di kawasan
berkenaan.
16. PEMERIKSAAN OLEH TNB
(a) TNB boleh menjalankan pemeriksaan dan ujian ke atas semua pepasangan
sebelum bekalan disambungkan. Walau bagaimanapun, ia adalah menjadi
tanggungjawab Kontraktor Elektrik Berdaftar untuk memastikan bahawa
pepasangan adalah selamat.
(b) Pengguna hendaklah memaklumkan TNB sebarang cadangan penyambungan
atau pindaan kepada pepasangan supaya TNB boleh menjalankan kerja-kerja
pemeriksaan dan ujian terhadap penyambungan atau pindaan sekiranya TNB ingin
berbuat demikian.
(c) TNB tidak bertanggungjawab terhadap sebarang kerugian atau kerosakan yang
disebabkan atau yang berlaku semasa atau selepas ujian akibat sebarang
kecacatan pada pepasangan itu dan sebarang ujian yang dijalankan oleh TNB
adalah bagi maksudnya sendiri dan tidak boleh disiratkan ada sebarang waranti
bahawa pepasangan itu sesuai bagi kepentingan Pengguna atau ianya telah
mematuhi sepenuhnya Akta atau sebarang pindaan selanjutnya yang dibuat di
bawahnya.
17. PEMBERHENTIAN BEKALAN SEMENTARA
TNB boleh memberhentikan bekalan ke premis Pengguna untuk sementara waktu bagi
apa-apa tujuan yang berkaitan dengan keberkesanan sistem pembekalan elektrik TNB
dengan memberikan notis lebih awal. TNB tidak bertanggungjawab untuk memberi
bekalan alternatif setelah pemotongan berlaku.
18. PERTUKARAN PENGHUNI
Sekiranya premis Pengguna yang diberikan bekalan elektrik di bawah Kontrak ini
disewakan, TNB perlu memaklumkan kepada Pengguna bahawa Pengguna
mempunyai pilihan untuk penyewa memohon Pertukaran Penghuni bagi akaun
tersebut..
19. STATUS PENGGUNA
TNB berkewajipan untuk memberikan bekalan elektrik kepada pemilik atau penduduk
yang sah bagi premis tersebut seperti yang yang diperuntukkan oleh Undang-Undang.
C. ADALAH DENGAN INI DIPERSETUJUI OLEH KEDUA PIHAK
20. SESALUR MENINGKAT DAN SESALUR SISI
(a) Bagi premis individu, mana-mana pepasangan sesalur dan talian servis dan alat-
alat tambahan sehingga dan termasuk meter adalah harta TNB.
(b) Bagi premis yang berbagai penghuninya di mana sebahagian dari bekalan adalah
bagi tujuan termasuk tetapi tidak dihadkan kepada pemilik, pemaju, pemunya
pengurusan atau tuan tanah dan lain-lain penghuni bangunan, bekalan tuan tanah
dan bekalan setiap penghuni akan mempunyai meter yang berasingan dan dibilkan
oleh TNB. Pemilik, pemaju, pemunya pengurusan, tuan tanah atau agen masing-
masing wajib atas perbelanjaan sendiri memperuntukkan, memiliki,
menyelenggara dan membaikpulih sistem elektrik di dalam bangunan termasuk
sesalur meningkat dan sesalur sisi jika difikirkan patut atau perlu. Rekabentuk,
pepasangan dan pengendalian sistem elektrik tersebut harus mematuhi segala
peruntukan yang telah ditetapkan oleh badan yang bertanggungjawab termasuk
Pihak Berkuasa dan TNB selaras dengan Akta.
21. PEMBILAN DAN PEMBAYARAN
(a) Segala bil termasuk tetapi tidak terhad kepada apa-apa caj lain berkenaan dengan
amaun yang kena dibayar kepada TNB akan diberikan kepada pengguna secara
bulanan dan hendaklah dibayar dalam masa tiga puluh hari selepas
penyerahannya.
(b) Walau apa pun yang dinyatakan sebelum ini, TNB mempunyai hak untuk untuk
mengenakan Caj Minimum Bulanan sekiranya jumlah bil elektrik bulanan kurang
dari amaun yang ditetapkan dalam Buku Tarif.
(c) TNB mempunyai hak untuk mengenakan surcaj sebanyak satu peratus (1%)
sebulan ke atas apa-apa amaun tertunggak yang dikira sehingga pembayaran
sepenuhnya dibuat.
(d) Pengguna hendaklah bertanggungjawab ke atas bil-bil elektrik yang dikeluarkan
oleh TNB termasuk jumlah yang belum dibayar kepada TNB, jika ada, selagi akaun
ini didaftarkan di bawah nama Pengguna tanpa mengira apa-apa penggunaan
tenaga elektrik oleh mana-mana pihak ketiga.
(e) Pengguna hendaklah bertanggungjawab untuk membayar semula amaun dalam bil
yang dihantar oleh TNB termasuk apa-apa caj lain yang berkaitan bagi apa-apa
bayaran yang tidak sah yang dibuat oleh Pengguna seperti kad kredit palsu, cek
tendang dan lain-lain.
(f) Sekiranya Pengguna gagal membayar apa- apa amaun di bawah Klausa 21(a), (b)
dan (c) maka TNB berhak memotong bekalan elektrik di premis berkenaan.
(g) Pengguna hendaklah bertanggungjawab untuk membuat bayaran terhadap
sebarang amaun bil elektrik yang belum dijelaskan dan/atau kehilangan
pendapatan dan/atau kos yang ditanggung TNB akibat dari penggunaan elektrik
yang tidak jujur sebagaimana diperuntukkan di bawah Akta.
(h) TNB berhak untuk membuat pelarasan dan mengemaskini akaun Pengguna
mengikut Undang-Undang.
22. PENGALIHAN PEPASANGAN TNB
Jika Pengguna atau pemilik sesebuah premis meminta TNB supaya mengalihkan atau
memindahkan litar bekalan, tiang, bilik pencawang, pilon atau apa-apa pepasangan
TNB atau peralatan di dalam atau di luar premis Pengguna, tertakluk kepada
persetujuan oleh TNB sekiranya tidak menjejaskan sistem penghantaran/pengagihan
elektrik, segala kos melaksanakan pengalihan atau penempatan semula akan
ditanggung sepenuhnya oleh Pengguna atau pemilik yang mana berkenaan.
. 29. INDEMNITI DAN LIABILITI TIDAK BOLEH TUNTUT
23. KEJADIAN KEINGKARAN
Kejadian mana-mana perkara di bawah adalah merupakan kejadian keingkaran di
bawah Kontrak ini dan ia tidak terhad kepada:
(a) Tindakan atau keingkaran Pengguna yang telah menjejaskan kecekapan dan/atau
keselamatan pepasangan TNB.
(b) Pengguna telah gagal mematuhi dan/atau pelanggaran mana-mana peruntukan
Kontrak ini dan/atau Akta dan/atau melakukan apa-apa kesalahan di bawah Akta.
(c) Pengguna ini telah mendapat kebenaran bagi pelantikan atau mengambilalih oleh
penerima atau pelikuidasi itu sendiri atau keseluruhan atau sebahagian besar
daripada harta Pengguna.
(d) Pengguna mengakui secara bertulis ketidakupayaan Pengguna untuk membayar
hutang apabila hutang tersebut dituntut.
(e) Pengguna membuat serahanhak umum atau penyusunan atau komposisi dengan
atau bagi faedah kepada pemiutangnya.
(f) Memulakan kes secara sukarela atau memfailkan petisyen terhadap mana-mana
pihak yang ingin mendapatkan kelebihan daripada mana-mana undang-undang
yang berkaitan dengan kebankrapan, insolvensi, penstrukturan hutang,
penggulungan atau komposisi.
(g) Pengguna diletakkan di bawah penerimaan atau pentadbiran khas atau likuidasi.
(h) Pengguna ini diisytiharkan muflis/bankrap oleh Mahkamah.
(i) Telah berlakunya pembubaran atau kematian di pihak Pengguna.
(j) Kegagalan untuk membayar jumlah yang ditetapkan di bawah Klausa 21 di atas.
(k) Penggunaan bekalan elektrik secara tidak jujur.
(l) Kegagalan Pengguna mematuhi mana-mana peruntukan di bawah Klausa 13
kontrak ini.
Pada tarikh kuatkuasa penamatan Kontrak, TNB akan dilepaskan daripada sebarang
obligasi dan liabiliti di bawah Kontrak ini.
24. PEMOTONGAN BEKALAN ELEKTRIK
TNB boleh memotong bekalan kepada Pengguna dengan memberikan notis bertulis
tidak kurang daripada tujuh (7) hari bekerja terlebih dahulu dalam mana-mana keadaan
yang dinyatakan di bawah:
(a) Apa-apa keingkaran oleh Pengguna di bawah Klausa 23 dan keingkaran tersebut
tidak diremedi dalam tempoh yang ditetapkan jika ada;
(b) Sebarang hak untuk memotong bekalan seperti yang diperuntukkan di bawah
Akta.
25. PENAMATAN KONTRAK OLEH TNB
(a) TNB boleh menamatkan Kontrak ini di atas sebab-sebab yang munasabah dengan
mengambilkira hal keadaan yang sewajarnya, atau di atas sebab-sebab yang
dibenarkan oleh Undang-Undang dan Kontrak ini dengan memberikan notis secara
bertulis tidak kurang dari empat belas (14) hari bekerja mengenai niatnya untuk
berbuat demikian.
(b) TNB boleh juga menamatkan Kontrak ini di bawah Klausa 23 dengan memberi
notis bertulis empat belas (14) hari bekerja yang bermula dari tarikh tamat tempoh
remedi (sekiranya ada).
(c) Sekiranya TNB menerima sebarang notis pemotongan daripada Pengguna maka
penerimaan tersebut adalah dianggap sebagai notis penamatan kontrak oleh
Pengguna tertakluk kepada penyerahan notis oleh TNB di bawah Klausa 25(a).
(d) Jika TNB mendapati bahawa maklumat yang diberikan adalah palsu dan/atau
dipertikaikan dengan kewujudan bukti prima facie yang berhubungan dengan
pembekalan elektrik dan dibuktikan dengan mana-mana undang-undang yang
terpakai, TNB berhak untuk menamatkan Kontrak ini selepas memberi notis
bertulis tidak kurang daripada 48 jam.
26. NOTIS
Melainkan dan kecuali diperuntukkan di bawah Akta dan mana-mana klausa dalam
Kontrak ini, apa-apa notis, tuntutan atau komunikasi-komunikasi lain yang diperlukan
atau dibenarkan untuk diberi atau dibuat di bawah Kontrak ini hendaklah dibuat secara
bertulis dan hendaklah disampaikan secara serahan tangan atau melalui pos berdaftar
prabayar atau pos biasa atau secara elektronik berdasarkan pilihan pengguna kepada
alamat yang diberikan dalam Kontrak ini. Bukti pengeposan atau penghantaran apa-
apa notis, tuntutan atau komunikasi akan dianggap sebagai bukti penerimaan:
(i) sekiranya disampaikan secara serahan tangan, pada masa ia diserahkan dan telah
diakui penerimaannya;
(ii) sekiranya surat dihantar melalui pos, pada hari ketiga (3) Hari Bekerja selepas
pengeposan.
(iii) sekiranya dihantar secara elektronik, pada masa ia dihantar kepada penerima.
(iv) sekiranya dihantar secara pos dan elektronik, pada hari ketiga (3) hari bekerja
selepas pengeposan.
27. PENYAMPAIAN PROSES UNDANG-UNDANG
Penyampaian sebarang proses undang-undang hendaklah melalui pos berdaftar
prabayar yang dihantar kepada alamat yang diberikan dalam Kontrak ini. Bukti
pengeposan akan dianggap sebagai bukti penerimaan dan penyampaian berkenaan
hendaklah dianggap lengkap selepas lima (5) hari dari tarikh pengeposan.

28. FORCE MAJEURE
TNB tidak bertanggungan kepada Pengguna untuk apa-apa pelanggaran terma dan
syarat-syarat Kontrak ini yang disebabkan oleh apa-apa kejadian yang merangkumi
tetapi tidak terhad kepada kecemasan nasional, peperangan, permusuhan, rusuhan,
kekecohan awam/gangguan sivil, gempa bumi, banjir, disposisi, atau pematuhan apa-
apa perintah kerajaan, kerajaan tempatan atau mana-mana pihak berkuasa lain.
(a) Pengguna bersetuju untuk menanggung rugi dan akan terus menanggung rugi
TNB daripada dan terhadap segala tuntutan, perbuatan, gantirugi, tuntutan
mahkamah, prosiding, dan segala kos guaman yang dibawa oleh pihak ketiga ke
atas TNB, pekerja atau agennya, yang mana TNB mungkin boleh
dipertanggungjawabkan akibat daripada perlaksanaan kontrak kecuali disebabkan
oleh kecuaian atau perbuatan sengaja TNB, pekerja atau agennya.
(b) Pengguna bersetuju bahawa TNB, pekerja, pengkhidmat, agen, wakil tidak akan
bertanggungjawab dan/atau menanggung rugi kepada Pengguna apa-apa
kerosakan, kecederaan atau kehilangan terhadap harta Pengguna dan/atau nyawa
melainkan kerosakan, kecederaan atau kehilangan telah dibuktikan adalah
disebabkan oleh perbuatan sukarela, cuai atau tidak melakukan dan/atau
kegagalan untuk mematuhi mana-mana standard keselamatan yang terdapat di
bawah mana-mana akta.
(c) Pengguna juga bersetuju selanjutnya bahawa TNB tidak bertanggungan bagi
sebarang kos yang ditanggung, kehilangan dan/atau kerosakan barang-barang
industri, produk, harta atau nyawa Pengguna akibat daripada kemalangan yang
tidak dapat dielakkan, ketidaktetapan voltan, gangguan, pengurangan dan/atau
gangguan bekalan elektrik, kebakaran atau kemalangan yang mungkin
disebabkan oleh bekalan elektrik atau penggunaan atau penyalahgunaan yang
tidak disebabkan oleh kecuaian atau perbuatan sengaja TNB dan/atau
kakitangannya.
30. KEBENARAN TUAN TANAH
Sekiranya perlu, Pengguna boleh membantu TNB mendapatkan kebenaran tuan tanah
bagi penyambungan bekalan elektrik ke premis Pengguna.
D. LAIN-LAIN PERKARA
31. CUKAI-CUKAI
(a) Cukai Perkhidmatan
Pengguna hendaklah menanggung dan membayar Cukai Perkhidmatan yang mungkin
dikenakan oleh kerajaan ke atas perkhidmatan-perkhidmatan dari semasa ke semasa.
Bagi maksud klausa ini:
"Cukai Perkhidmatan" bermaksud Cukai Perkhidmatan yang terpakai bagi Kontrak
menurut Akta Cukai Perkhidmatan;
“Akta Cukai Perkhidmatan” bermaksud sebagai Akta Cukai Perkhidmatan 2018
Malaysia termasuk kaedah-kaedah, peraturan atau garis panduan yang dikeluarkan
oleh pihak berkuasa yang berkaitan yang bertanggungjawab ke atas cukai tersebut.
(b) Cukai-Cukai dan Levi-Levi yang Lain
Kecuali dinyatakan sebaliknya, Pengguna hendaklah bertanggungjawab ke atas semua
cukai semasa dan akan datang, duti-duti, levi-levi, dan caj-caj yang serupa termasuklah
mana-mana faedah dan penalti yang berkaitan, walau bagaimana cara sekalipun ianya
diperuntukkan (selepas ini dirujuk sebagai ‘Cukai-Cukai Lain’), yang timbul daripada
satu atau yang berkaitan dengan apa-apa jenis pembekalan yang dikenakan oleh
undang-undang.
32. PERUNTUKAN UNDANG UNDANG
Kontrak ini adalah tertakluk dan ditafsirkan mengikut Akta dan sebarang Peraturan yang
dibuat di bawahnya termasuk sebarang pindaan kepadanya serta mana-mana undang-
undang bertulis lain yang berkaitan.
33. PINDAAN, MODIFIKASI ATAU GANTIAN
Tiada apa-apa pindaan atau perubahan terhadap Kontrak ini mengikat melainkan ia
dipersetujui melalui instrumen bertulis yang ditandatangani oleh pihak-pihak yang
berkontrak bagi maksud pindaan tersebut.
34. SERAHAN HAK
Pengguna tidak dibenarkan menyerahkan apa-apa hak atau obligasi yang timbul di
bawah Kontrak ini kepada mana-mana pihak ketiga tanpa kebenaran bertulis terlebih
dahulu daripada TNB.
35. PENGENEPIAN
Pengetahuan atau keakuran oleh TNB atas pelanggaran mana-mana syarat atau
tanggungjawab yang terkandung di atas tidak dianggap sebagai atau disifatkan sebagai
pengenepian mana-mana syarat atau terma atau mana-mana daripadanya dan walau
apa pun pengetahuan atau keakuran sedemikian, TNB berhak untuk menguatkuasakan
haknya di bawah Kontrak ini.
36. TEMPOH MASA
Tempoh masa adalah intipati di bawah Kontrak ini.
37. PENGGANTI HAKMILIK mengurangkan Kehendak Maksimum kepada Kehendak Maksimum
Kontrak ini hendaklah mengikat terhadap pengganti hakmilik dan pemegang-pemegang Diisytiharkan.
serah hak yang dibenarkan oleh mana-mana pihak di bawah Kontrak ini.
47. CAJ SAMBUNGAN BEBAN (CSB)
38. DUTI SETEM Pengguna dikehendaki untuk membayar Caj Sambungan Beban (jika ada) apabila
Duti setem di bawah Kontrak ini akan ditanggung dan dibayar sepenuhnya oleh mengambil bekalan pada Voltan Sederhana, Voltan Tinggi atau Voltan Amat Tinggi
Pengguna. berdasarkan dasar semasa Tarif dan polisi Caj Sambungan.

39. KEBOLEHASINGAN 48. GANTIRUGI BERES

Jika satu atau lebih peruntukan di dalam Kontrak ini atau sebahagian darinya tak sah Sekiranya Pengguna gagal atau berhenti mengambil bekalan untuk tempoh lima (5)
atau menjadi tidak sah atau tidak terpakai atas apa-apa juga alasan, ianya tidak akan tahun selepas bekalan diberikan, Pengguna hendaklah membayar kepada TNB Ganti
sama sekali mengganggu atau merosakkan keesahan atau penguatkuasaan Rugi Beres. Dengan syarat bahawa jumlah dan bayaran Gantirugi Beres adalah
peruntukan yang lain. tertakluk kepada dasar semasa Tarif dan polisi Caj Sambungan.

40. PEMASANGAN PERALATAN UNTUK MENJANA ELEKTRIK

Pengguna hendaklah memaklumkan kepada TNB sebarang pemasangan peralatan
bagi tujuan penjanaan di dalam premis Pengguna.

41. POWER QUALITY

Pengguna hendaklah memastikan semua pepasangan elektrik mempunyai immuniti
yang mencukupi terhadap kejadian voltan yang mempunyai tempoh singkat (sag &
swell) dan voltan fana (transient), dan tidak akan menjana (emisi) kejadian kualiti kuasa
lain yang boleh memudaratkan sistem bekalan elektrik. Standard kualiti kuasa yang
berkaitan adalah ditakrifkan dalam buku panduan permohonan bekalan elektrik TNB
(ESAH).

42. FAKTOR KUASA

Pengguna hendaklah pada setiap masa melaksanakan usaha yang terbaik untuk
memperolehi nilai faktor kuasa hampir kepada nilai 1.0 dalam semua operasi
pepasangan elektrik. Caj faktor kuasa akan dikenakan kepada Pengguna, berdasarkan
kadar semasa yang diluluskan berdasarkan Akta sekiranya nilai faktor kuasa bulanan
kurang dari nilai faktor kuasa minimum yang ditetapkan di bawah polisi semasa TNB.
Pengguna di bawah tarif domestik dan tarif lampu jalan adalah dikecualikan caj faktor
kuasa.

43. ALAT KIMPALAN

Selain daripada kadar tarif yang berkaitan, Pengguna Voltan Rendah,Voltan
Sederhana, Voltan Tinggi dan Voltan Amat Tinggi yang memasang alat kimpalan
elektrik yang menggunakan alat ubah akan dikenakan caj. Alat kimpalan elektrik
berkendalian motor adalah dikecualikan caj tersebut.

44. KERAHSIAAN
Melainkan ia adalah atau menjadi sebahagian daripada kepentingan awam, semua
maklumat yang diberikan oleh pihak yang berkontrak adalah sulit pada setiap masa
kecuali dinyatakan sebaliknya secara bertulis.

45. DATA PERIBADI

(a) TNB akan mematuhi peruntukan Akta Perlindungan Data Peribadi 2010 (“APDP
2010”) semasa memproses data peribadi Pengguna di bawah Kontrak ini;
(b) TNB boleh menzahirkan data peribadi Pengguna kepada peguam, agensi-agensi
kutipan hutang dan mana-mana pihak ketiga yang dilantik oleh TNB sebagai
agen, kontraktor, pembekal perkhidmatan dan/atau penasihat profesional bagi
apa-apa tujuan berkaitan pembekalan elektrik kepada Pengguna;
(c) Pengguna boleh membuat sebarang pertanyaan, aduan atau permohonan untuk
akses atau pembetulan kepada data peribadinya yang berkaitan dengan
pembekalan elektrik kepada TNB;
(d) Pengguna dengan ini memberi persetujuan bahawa data peribadi mereka boleh
dipindahkan ke luar Malaysia untuk maksud yang sah atau yang perlu dan
berkaitan dengan aktiviti pembekalan elektrik oleh TNB. Namun begitu, sekiranya
tiada persetujuan yang diberikan oleh Pengguna, pihak TNB boleh melakukan
pemindahan data peribadi tersebut ke negara yang mempunyai undang-undang
perlindungan data peribadi yang sekurang-kurangnya setara dengan tahap
perlindungan yang diberikan oleh APDP 2010 atau bagi tujuan menjalankan apa-
apa fungsi yang diberikan kepada mana-mana orang dibawah mana-mana
undang-undang; dan
(e) Polisi Perlindungan Data Peribadi TNB boleh diakses oleh Pengguna di
https://www.tnb.com.my/pdpa

E. KLAUSA TAMBAHAN BERIKUT TERPAKAI BAGI PERNIAGAAN/ PENGGUNA

BUKAN DOMESTIK / PENGGUNA KUASA BESAR (PKB)

46. KEHENDAK MAKSIMUM

Pengguna yang mengambil bekalan pada tahap Voltan Sederhana, Voltan Tinggi atau
Voltan Amat Tinggi, hendaklah bertanggungjawab untuk memastikan bahawa
Kehendak Maksimum Sebenar tidak melebihi Kehendak Maksimum Diisytiharkan;
(i) Sekiranya Kehendak Maksimum Sebenar melebihi dari Kehendak Maksimum
Diisytiharkan pada bila-bila masa dalam tempoh ditetapkan, Kehendak
Maksimum Sebenar tersebut akan menjadi Kehendak Maksimum
Diisytiharkan yang baru bagi tujuan pembilan dan berkuatkuasa mulai dari
tempoh pembilan yang berikutnya.
(ii) Walau apa pun yang dinyatakan di atas, sekiranya Kehendak Maksimum
Sebenar yang direkodkan melebihi Kehendak Maksimum Diisytiharkan dan
kesan lebihan itu menyebabkan atau menjejaskan keselamatan, keselamatan
dan kecekapan sistem TNB, TNB mengikut budi bicara mutlaknya boleh
