APPELLATE COURT RECORDS BY APPELLATE COURT CLERK JAMES HIVNER
By Tennessee Statute, T.C.A. § 18-1-202, Records for the Appellate Court are to be Kept for
10 years. (See attached document – (COURTS RECORDS RETENTION SCHEDULE BY
T.C.A. § 18-1-202 V2). This document is a clear violation of T.C.A. § 18-1-202 and clear
subterfuge to gain advance knowledge of the Simpkins intentions as to whether they will file
an Appeal. Which the Simpkins creating their response first to the false and unlawful
dismissal and then will file an Appeal to the Appellate Court, if the Chancery Court does not
set aside the baseless and false judgement.
This means that Hivner and the Opposing Party want to know what the Simpkins intentions
are so that Hivner and Others can either tamper with more of the documents on the Appellate
Court Website, or destroy specific documents before the Simpkins track what is up there on
the Website right now. The Simpkins would not be surprised if several of the documents are
not already deleted. (The Simpkins already told Assistant US Attorney Taylor Phillips, the
Washington, D. C. DOJ and FBI that there are numerous modified documents that show up
as damaged when trying to either view or download which causes a failure). Please Check
Immediately Upon Seeing This Notice And Document The Number Of Files That Will
Not Open Or Download And Stated Damaged Which Are Actually Tampered With At The
Appellate Court Website!

A Tech at Adobe discovered that there was not really a problem, that the ORIGINAL FILE
was modified several times and opened in a DIFFERENT Adobe Editor and when it saved,
was not in an approved ADOBE FORMAT, therefore appears damaged. You have to have
the EDITOR USED BY THE COURT TO SEE THE CHANGES TO THE DOCUMENT!!!

James Hivner.
Please note that Mr. Hivner did not sign the document. Why? Aren’t all documents to and
from the Court required to have a signature of the individual sending the document?
