AGREEMENT FOR SALE

THIS AGREEMENT FOR SALE is made and executed on this


the 30th January of 2019

Sellers 1 to 9 are residing at Kachanayakanahalli, Kasaba Hobli, Anekal


Taluk
hereinafter called the "SELLERS" (which expression shall mean and include
their legal heirs, successors, successors-in-interest, executors,
administrators, legal representatives, attorneys and assigns) of ONE PART.

Residing at No 40,Santhosh Nilaya,
Hosur Main Road, Madiwala,
Bangalore 560068

hereinafter called the "PURCHASER" (represented by his power of attorney )


which expression shall mean and include his heirs, successors, executors,
administrators, legal representatives, attorneys and assigns of the OTHER
PART.

WHEREAS THE SELLERS are the absolute owners and are in


peaceful possession and enjoyment of the property bearing Sy
No:10 Measuring to an extent of 15 guntas, Situated at
Kachanayakanahali Village,Kasaba Hobli, Anekal Taluk,
Bangalore Urban District, which is morefully described in the
schedule hereunder and herein after referred to as the schedule
property.

WHEREAS the property more fully described in the schedule


hereunder was granted under Thoti Inam to Erappa S/o
Lingappa, Bushappa S/o Lingappa, Hulli Muniyappa S/o
Lingappa, Muniyappa S/o Lingappa, Thoti Muniyappa S/o
Lingappa to an extent of 4 acre 21 guntas.

WHEREAS after the death of Erappa S/o Lingappa, Bushappa


S/o Lingappa, Hulli Muniyappa S/o Lingappa, Muniyappa S/o
Lingappa, Thoti Muniyappa S/o Lingappa, the legal heirs, of
Erappa S/o Lingappa, Bushappa S/o Lingappa, Hulla
Muniyappa S/o Lingappa, Muniyappa S/o Lingappa, Thoti
Muniyappa S/o Lingappa, approached Thasildhar Anekal Taluk
and got regrant the schedule land under Village Office Abolition
Act Vide VOA CR 6/2002-03 dated:19/7/2013

Whereas the sellers are absolute owner of the schedule property


and have been enjoying the same with absolute right and have
clear and marketable title to the Schedule Property

WHEREAS the SELLERS being in need of funds for the purpose


of buying property, has decided to sell the property more fully
described in the Schedule hereunder and the PURCHASER has
offered to purchase the same.

WHEREAS the SELLERS offered to sell and transfer the schedule


property to the PURCHASER for a sale consideration of Rs
37,50,000( Rupees Thirty Seven Lakhs Fifty Thousand Only)
and the PURCHASER herein has agreed to purchase the same
for the aforesaid consideration on the following terms and
conditions:

NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:


1. The Sale consideration of the Schedule Property is fixed at Rs.
37,50,000( Rupees Thirty Seven Lakhs Fifty Thousand Only) .

2. The PURCHASER has paid a sum of 7,50,000( Rupees Seven


Lakh Fifty Thousand Only) in the following manner.
a) A sum of Rs1,00,000/-Rupees (One Lakh Only) paid by way of
Cheque/DD bearing No560088008,dated drawn on Sarswat
Bank, Gandhi Nagar.Bangalore in favour of Seller No 1 .

Thus the vendors have acknowledged the receipt of the same in the
presence of the witnesses.

3. The balance payment of Rs .30,00,000/- (Rupees


Thirty Lakhs) will be paid by the PURCHASER to the SELLER at
the time of execution of the absolute Sale Deed and thus
completing the Sale transaction.

4. The SELLERS confirms with the PURCHASER, that they have


not entered into any agreement for sale, mortgage or exchange
whatsoever with any other person relating to the Schedule
Property of this Agreement.

5. The SELLERS hereby assures the PURCHASER, that they


have absolute power to convey the same and there are no
encumbrances, liens, charges, Government dues, attachments,
acquisition, or requisition, proceedings etc.

6. The SELLERS agrees to put the purchaser in absolute and


vacant possession of the schedule property after executing the
sale deed and registering the same in the jurisdictional Sub-
Registrar's office.

7. The SELLERS covenants with the purchaser that they shall


not do any act, deed or thing creating any charge, lien or
encumbrance in respect of the schedule property during the
subsistence of this Agreement.

8. The SELLERS has specifically agreed and covenants with the


PURCHASER that they shall do all acts, deeds and incur all
expenses which are necessary, to convey absolute and
marketable title in respect of the schedule property in favour of
the PURCHASER or his nominee.

9. IT IS AGREED between the parties that all expenses towards


Stamp Duty and Registration charges shall be borne by the
PURCHASER only.

10. The PURCHASER shall have the right to nominate or assign


his right under this agreement to any person / persons of his
choice and the SELLERS shall execute The Sale Deed as per
terms and conditions of this Agreement in favour of the
PURCHASER or his nominee or assignee.

11. The SELLERS has agreed that all her family members will
join to execute sale deed in favour of the purchaser.

12. It is hereby expressly provided and agreed by the parties


here to that both parties are entitled to enforce specific
performance of the agreement against each other in case of
breach of any conditions mentioned in this Agreement.

13. The original of the "AGREEMENT" signed by both the parties


shall be with the PURCHASER and copy of the same similarly
signed shall be with the SELLERS.

SCHEDULE
All the piece and parcel of the agriculture property bearing Sy
No:10, measuring 15 guntas out of 4 acre 20 guntas of land
situated at KachanayakanaHalli Village,Jigani Hobli,Anekal
Taluk and bounded on;

IN WITNESS WHEREOF the SELLER and the PURCHASER have


signed this Agreement of Sale on the day month and year herein
above mentioned in the presence of the witnesses:
