ASSESSMENT INSTRUCTIONS
OVERVIEW
In this assessment, you will have the opportunity to explore the practical application of the
Australian Consumer Law (‘ACL’) in the context of advertising: a common business activity.
This assessment consists of two main components: generating a Spotify advertisement using
the generative AI system, ChatGPT, and analysing it for potential legal issues that might arise
under the ACL. This assessment is worth 20% of your final grade, and is marked out of 20.
ASSESSMENT SPECIFICATIONS
Your assessment specifications are set out in a separate document that is also available in the
Assessments area on Moodle. Please read that document together with these instructions.
INSTRUCTIONS
This assessment has two parts, as outlined below. You are required to complete both parts.
In Part 1 you will use the generative AI system, ChatGPT, to create the wording (in text
form) for a Spotify advertisement that will promote one of two products. To do this, follow
the below steps.
1. Select a Product: Choose one of the below fictional products for which you will
create the wording for a Spotify advertisement. You do not need to create an
advertisement for both products – chose only one.

Important! You must take note of how you use ChatGPT to produce your
advertisement, including what prompt/s you provide to ChatGPT, as this information
must be included in your Generative AI declaration. See the ‘Generative AI
Declaration’ section below on page 4 for further information.

below on page 4 for further information.
3. Finalise your Spotify Advertisement: Using ChatGPT, reach a final version of the
wording for your Spotify advertisement. Take note of, by copying and saving, the
final wording as this will need to be included in your report in Part 2.
In this part, you will analyse the advertisement that you have generated in Part 1 above for
potential legal issues arising under the ACL. In doing so, you are required to write a 1,500

word report. The report should follow the structure outlined below and address the points
raised below.
Note that this assessment is not a research task: you do not need to (and should not) refer to
materials other than those covered in our syllabus. This includes your prescribed readings,
lectures, tutorial exercises, and other materials provided on Moodle.
1. Introduction:
- Define what misleading or deceptive conduct is, and what false or misleading
representations are, according to the ACL.
- Discuss whether your advertisement complies with the ACL prohibitions. You may
want to include quotes from your advertisement to support your arguments (these
quotes count towards your word limit).
- In your discussion, specifically address sections 18 and 29 of the ACL and explain how
they relate to your advertisement.
3. Consumer Guarantees:
- Define consumer guarantees according to the ACL: addressing when they apply, and
what they require.
- Outline and discuss different types of consumer guarantees (at least the two in sections
54 and 55 of the ACL: you do not need to address all consumer guarantees considered
in our course materials but must address these two).
- Identify sections of your advertisement related to product descriptions, warranties, or
guarantees, and quote those sections (this counts towards your word limit).
- Assess whether your advertisement would result in your chosen product complying with
the consumer guarantees outlined in the ACL sections 54 and 55 (acceptable quality,
and fitness for disclosed purpose).
- Consider any potential improvements that could be made to your advertisement to make
it more compliant with the ACL.
- Suggest strategies or recommendations to enhance consumer protection compliance in
the context of your advertisement. If you conclude that your advertisement breaches the
ACL, propose corrective actions that the advertiser should take to ensure compliance
with the ACL.

- Discuss potential legal remedies available to consumers who may be affected by
breaches of the ACL. Consider both the remedies for misleading or deceptive conduct
and false and misleading representation, and also breaches of the consumer guarantees.
If your advertisement breaches one of these provisions, tailor your discussion to what
the advertiser should do in relation to your specific advertisement. If you conclude that
your advertisement does not breach these aspects of the consumer law, consider what
steps the advertiser would need to take in the event that it was in breach of the ACL
including the potential legal remedies for which the advertiser would be liable.

For the purposes of this assessment, you must use ChatGPT specifically: no other generative
AI systems are permitted. You can use any version of ChatGPT, including version 3.5,
which is available for use for free. You will not be penalised in any way for using the free
version of ChatGPT as opposed to a paid version.
GENERATIVE AI DECLARATION
As part of the document you upload, you must submit a Generative AI Declaration. As all
students are required to use generative AI in their assessment, declaring that you did not use
generative AI in this assessment will be deemed an invalid declaration.

NOTE:
Please take note that your generative AI declaration does not contribute to the word limit.
You have the option to upload your declaration in the same document as your assignment or
as a separate file but it is mandatory to include a generative AI declaration as part of the
submission process.
MARKING CRITERIA
This assessment is marked against the marking rubric set out in Appendix 1, contained at the
end of this document.

Please note, all applications must be processed in accordance with the process set out in the
above link – the Chief Examiner cannot directly grant you an extension.
SUBMISSION GUIDELINES
- Include references and citations for any legal references or sources used in your
analysis. You should reference legislation and cases in the same way that you would
when responding to a hypothetical legal problem question. You do not need to include
full formal legal citations that would be required (for example) in a research paper.

- Remember to check that you have completed all steps of the submission process. For
Assessment 3, assignments in 'draft' form will not be accepted as a valid form of
submission and will be subject to late penalties until they are formally submitted. (For
