II. MATTERS INVESTIGATED:

2. To determine the facts and circumstances surrounding the incident.
3. To determine other relevant matters that would require further police actions.
4. To determine the motive and the relationship of the suspect to the victim.

III. FACTS OF THE CASE:

5. One Jose Balintawak, 33 years old, Filipino, Male, Carpenter, resident in Datu
Ingkal Street Subdivision, Kidapawan City came to this office & requested to put into
record that on or about 4:30pm on Nov. 08,2023 the same date a shooting incident
transpired at Datu Ingkal Street Subdivision, Kidapawan City. The victim was identified
as Mario Sinauglo, driver, 45 years old, Male, Filipino, Married, resident in Datu Ingkal
Street Subdivision, Kidapawan City. The suspect was also identified as Luigi
Gamayulo, male,Filipino, driver, 47 years old, resident in Datu Ingkal Street
Subdivision, Kidapawan City.

6. On or about 10:30 PM of November 07, 2023, Tuesday, Mario Sinagulo, who was
the victim was having a drinking session on his residence with the suspect Luigi
Sinagulo, came as it turn out. They were the best of friends not to mention they were
co workers both driver in a company.

7. Later on they had an argument in which Luigi Sinagulo is drunk and tries to flirt with
the wife of Mario Sinagulo as well as admitting out of the blue that he really likes her for
a long time, resulting this to punched by Mario and forcing him out. Luigi on the other
hand made a word on how he has the guts to punch his friend.

8. November 08, 2023 7:30 am Mario Gamayulo, was going out from work noticing
Luigi’s absence he felt bad for what he did and tries to get back to him. Later, afternoon
4:30pm, Jose Balintawak, just got home from work, saw what was happening as Mario
cleaning his car he saw Luigi from the side of the corner with a motor-vehicle tries to
shot three times in the chest. While the victim is standing.
 9. Jose, Immediately calls for help as he goes towards Mario was trying to fight as his
wife and children was panicking. The victim, Mario Gamayulo was brought to St.
Madona General Hospital. Dr. Heaven White attended the victim and tried to revive
him. But to no avail, Dr. Heaven declared that the victim is Dead-on-arrival at on or
about 5:10 PM of the aforementioned date.

10. The witness/reportee Jose Balintawak has given his sworn testament at the
Kidapawan City Police Station at or or about 4:30 PM regarding the killing transpired
on or about 4:30 PM, November 08, 2023 at Datu Ingkal Street Subdivision,
Kidapawan City.

11. After 12 hours has passed the suspect has been traced his location. The suspect
Luigi Sinagulo has given his sworn statement with his legal counsel, Atty. Palm Olive at
the Kidapawan City Police Station at 8:00 AM regarding the shooting incident that
transpired on or about 4:30 PM, November 08, 2023 Datu Ingkal Street Subdivision,
Kidapawan City.

12. After the suspect had given his sworn statement, he was then brought to Dr. Helen
Jolen for his Medical Examination, then the suspect was then brought to the lock up jail
of Kidapawan City Police Station.

IV. DISCUSSION:
13. Upon receiving the report, the duty investigator immediately conducted through
investigation. In the investigation, both parties have a respective statement related with
the incident. In the statement of Mrs. Gamayulo, she said that the victim was shouting
the name of the suspect, as she tries to go outside to look at it. She specifically saw
the manner in which the crime has been made as soon the sound of the gun has been
fired.

14. In the follow-up investigation, the investigator also found that all throughout what
happened, it is all motivated by revenge and anger. In the statement of the suspect
Luigi Sinagulo, it is confirmed that he has grudge at Mario. It is confirmed that Jose
resident in the place witness the events. The suspect stated that the reason for killing
his friend was by out of control anger that burst him that night which resulting to commit
the crime, hence, this crime is rotted to a long standing grudge which resulted to the
death of the victim.

V. CONCLUSIONS:
15. After a careful perusal surrounding this particular incident, Luigi Sinagulo (suspect)
displayed intent of killing through violation use of firearm, hence the proximate cause of
this incident resulted to the death of one Mario Gamayulo (victim), the suspect’s
intentional manner is the cause, and the victim and the suspect are aquintances,
therefore he is criminally liable.

16. This case is considered solved and closed.

 VI. RECOMMENDATIONS:
17. Wherefore, in view of the foregoing, the undersigned respectfully recommends that
this case has been closed. reffered to the office of the Kidapawan City Prosecutors
Office for the final desposition.
