I, MAYLYN M. BACOLOD, of legal age, Filipino and a resident of Block 33

Lot 10 Phase 2 Area 2 Kaunlaran Village, Navotas, fully conscious that I am
under oath and may face criminal liability for false, testimony or perjury, hereby
answer the following questions propounded and which I answer in tagalong to
Atty. Raul I. Bautista at DAR-Laguna, Legal Assistance Division, Brgy.
Pagsawitan, Sta. Cruz, Laguna, do hereby depose and state the following:

Atty. Bautista:

The testimony of the witness your honor is being offered to prove the
following facts:

1. That the witness is the attorney in-fact of the petitioner who has the
personal knowledge as to the fact of loss of TCT No. C- 3069.

2. That the herein petitioner is the lawful and registered owner of the subject
property.

3. That she shall testify on all the allegations of the complaint and other
matters relevant to the case; and

4. To identify documents.

Q1 : Sabihin mo kung sino ka at mga bagay na pagkakakilanlan tungkol

saiyo? (State your personal circumstances)?

A: Ako, MAYLYN M. BACOLOD, may sapat na taong gulang, mamamayang
Filipino, nakatira sa Block 33 Lot 10 Phase 2 Area 2 Kaunlaran Village,
Navotas.

Q2: Ikaw din ba si MAYLYN M. BACOLOD, and kinatawan ng petisyoner?

(Are you the same, MAYLYN M. BACOLOD, the attorney-in-fact of the
petitioner in this case?

Answer : Opo. (Yes, Sir).

Q3 : Mayroon ka bang pagpapatunay na ikaw ang kinatawan ng petisyoner?

(Do you have any proof that you are the attorney-in-fact of the petioner).

A : Opo, Sir. (Yes, Sir).

Q4 : What it is? (Ano iyon)?

A : Ang Special Power of Attorney (Natatanging Gawad Kapangyarihan)

mula po kayBen P. Latoja. ( The Special Power of Attorney executed by
Ben P. Latoja).

Q5 : If shown to you the Special power of Attorney you just mentioned, would
you be able to identify the same?

A : Opo sir

Q6 : I am showing you a Special power of Attorney executed by Ben P.

Latoja, what relation has this document to the one you just mentioned?

A : ito po ang tinutukoy ko

ATTY: Your Honor may we request that this Special Power of

Attorney executed by Ben P. Latoja in favor of Maylyn M. Bacolod be
marked as our Exh. “E”

Q7 :Patungkol saan ang petisyon na ito? (What is the petition all about)?

A : Issuance of second owner’s copy ng titulo na may bilang na TCT No. C-

3069.

Q8 : Ano dahilan mo at nag-file ka ng Petisyon)? (What made you file this

petition)?

A : Naghain kami petisyon dahil nawawala po ang titulo na may bilang TCT
No. C-3069.

Q9 : Mayroon akong ipapakita sa iyo na dokumento, maaari mo ba itong

kilalanin? (I am showing you document, can you identify it)?

A : Opo. Ito po yun titulong “nawawala ng owner’s copy” paksa ng petisyon.

(This is the title subject of this petition).

Q10 : Sino si Ben P. Latoja, ang petisyoner sa kaso na ito? (Who is Ben P.
Latoja, the petitioners in this case)?

A : Siya po yun nakarehistrong may-ari ng lupa. (He is the registered owner

of the property).

Q11 : Anong lupa sinasabi mo? (What property are you referring to)?

A : Ang lupang paksa ng petisyon na ito na iginawad ng Department of

Agrarian Reform na may sukat na 20,004 metro quadrado na napapaloob
sa TCT no C-3069 /CLOA no. 00939892 na matatagpuan sa Brgy.
Masaya (now Perez), Calauan, Laguna . (The land subject of this petition).

Q12 : Kilala mo ba ang petisyoner sa kaso na ito? (Do you know the petitioner
in this case)?

A : Opo, Sir. (Yes, Sir).

Q13 : Paano mo nakilala? ( How did you come to know her)

A : Kilala ko sila sapagkat ako po ang kanilang property custodian. (I am his

property custodian).

Q14 : Sabi mo ikaw ang kanilang property custodian, Kailan ka pa nagsimulang

kanilang property custodian? (You said that you are the property
custodian, When did you start as their property custodian)?

A : Noong pong September 15, 2015, Sir. ( September 15, 2015, Sir)

Q15 : Ano ang inyong tungkulin bilang property custodian? (What are your
functions as property custodian?

Q16 : Taga ingat ng mga titulo ng mga ari-arian ng petisyoner at taga-bayad ng

amellar.

Q17 : Balik tayo sa kaso,sinabi mo na nakapaghain kayo ng petisyon sapagkat

ang titulo na paksa ng petitisyon ay nawawala, Paano mo nalaman na ang
titulo TCT NO. C-3069 ay nawala? (How did you come to know that the
owner’s duplicate copy of the said TCT No. C-3069 was lost)?

A : Nalaman lang po naming nawawala yun titulo na ito kung saan ito ay
nakalagay sa isang envelop matapos ang bagyong Maring.(We
discovered that the envelope containing the owner’s duplicate copy of the
Transfer Certificate of Title No. C-3069 was missing from our files after the
typhoon Maring).

Q18 : Natatandaan mo pa ba kung kailan ito nawala? (Do you ever remember
when it was loss, Ms. Witness?)

A : Last September 2017 po, noong tumama ang bagyong Maring sa
Zambales at isa ang bahay nila na nasalanta.

Q19 : Ano ang nanyaring sumunod?(What happened next Ms. Witness)?

A : Hinanap po naming mabuti yun titulo na nawawala pero walang nangyari
at hindi naming natagpuan.

Q20 : What did you do next Ms. Witness?(Ano ang sumunod ninyong
ginawa)?

A : Nagsagawa po si sir ng Sinumpaang Salaysay ng pagkawala ng

nasabing titulo, Sir. (Sir Ben Latoja executed affidavit of loss for the said
title, Sir).

Q21 : Meron akong ipapakita sa iyo na Sinumpaang Salaysay, ito ba iyon,

Ms. Witness? (I am showing you a document Ms. Witness, is this the
affidavit you are referring to)?

A : Opo, Sir. (Yes, Sir).

Q22 : Kilala mo kung kaninong pirma ang nakasaad sa ibaba ng

dokumentong ito, na nasa ibabaw ng pangalan ni Ben P. Latoja? (Can you
identify whose signature appears below above the name of Ben P.
Latoja)?

A : Pirma po sir Ben P. Latoja. (Signature of Ben P. Latoja).

Q23 : Paano mo nalaman kaniyang pirma iyan? ( How did you know that was a
signature of Ben P. Latoja)?

A : Kasama po niya ako nun isagawa niya ang affidavit at pinirmahan niya
sa harap naming ng Notaryo publiko. (I was with him when he signed the
affidavit of loss).

Q24 : Ano ang sumunod na nangyari Ms. Witness? (What happened next
Ms. Witness?)

A : Dinala ko po yun aking Sinumpaang Salaysay ni Sir Ben P. Latoja sa

Register of Deeds ng Sta. Cruz, Laguna para ipa- rehistro sa kanilang
talaan. ( I went to Register of Deeds to annotate Affidavit of Loss of
Ma’am Corazon Rosales).

ATTY: Your Honor, may we request that the Affidavit of Loss and the
Annotation at the page of the Transfer Certificate of title No. C-3069 be
marked as Exh “G“ and “F-1” respectively.

Q25 : Madam witness, you have said that the subject property covered by the
subject title has been declared for tax purposes and the Realty Tax had
been regularly paid, do you have any evidence of the same?

A : Opo, yun pong Tax Declaration no. 06-0014-01096 at Tax certificate na

iginawad ng Municipal treasurer ng Calauan, Laguna, Adelaida J. Salisi na
may petsang August 3, 2018.

Q26 : Im showing you Tax Declaration no. 06-0014-01096 at Tax certificate na

iginawad ng Municipal treasurer ng Calauan, Laguna, Adelaida J. Salisi na
may petsang August 3, 2018, kindly go over the same and tell us if these
are the documents you are referring to?

A : Ito po ang mga tinutukoy ko.

ATTY: Your Honor, may we request that the Tax Declaration no. 06-0014-
01096 at Tax certificate be marked as Exh “H“ and “H-1” respectively.

Q27 :Meron ka bang alam na ang kopya ng nawawalang titulo ay paksa ng

isang transaksyon o encumbrance na maaring makaapekto ninuman?

A : Wala po?

Q25 : Meron ka bang katunayan? (What is your proof Ms. Witness)?

A : Pagpapatunay po galling sa Registry of Deeds of Sta. Cruz, Laguna.

(The certification issued by the Registry of Deeds of Sta. Cruz, Laguna).

Q28 : Mayroon ako ipapakita sa iyo dokumento, ito ba iyong sinasabi mo

pagpapatunay? (I will show you a document, is this the certification you
are referring to)?

A : Opo, Sir. (Yes, Sir).

ATTY: Your Honor, may we request that the Certification issued by the
Registry of Deeds of Sta. Cruz, Laguna be marked as our Exh. “I”

Q29 : Ano ang iyong hiling sa Kagalanggalang na Hukom?(What is your

request to the Honorable Court)?

A : Hinihiling ko po sa Kagalang-galang na Hukom na mabigyan ng second

owner copy ang TCT No. T-3069. ( I pray that the second owner copy
under TCT No. T-3069 be granted by the Honorable Court. Sir).

Q30 : Do you confirm and affirm the truthfulness of the foregoing facts?

A : Opo Sir. (Yes, Sir).
