MODULE TITLE: Performing Adjudication for Legal Cadaster

MODULE CODE: EIS CSM4 M03 0322

NOMINAL DURATION: 96 Hours

MODULE DESCRIPTION: This modules covers the knowledge, skill and attitude required for realizing legal
cadaster through performing ascertainment of ownership right and fixing the legal extent of ownership
by combining two modalities of ensuring legal cadaster: through negotiation and legal agreement
reached among involved parties (adjoining owners, witness, local representatives, adjudicators) and
fixing the boundary mark accurately through surveying maintaining the tolerance of legal cadaster

ASSESSMENT CRITERIA:

LO1. Apply Preliminary procedures for performing adjudication

 Awareness is created for the community regarding the importance of adjudication and the
necessity of providing authentic information for adjudication process and boundary
delineating together with local officials.

 Most communities are convinced and welcomed the adjudication process.

 The legal format is arranged as evidence of legal agreement reached among adjoining
owners.

 Marking peg is manufactured and arranged based on standard.

 The area of jurisdiction is delineated from orthophoto, cadastral base map or topography
map for easy identification of features.

 The adjudication index map is prepared and printed as per the standard.

LO2. Apply Adjudication/ascertainment of right to land process in case of Unclear boundary.

 Adjudication area is surveyed using orthophoto or ground surveying referencing from


the geodetic benchmark.

 Important manmade and natural features surveyed

 Adjoining owners are negotiated for the clear demarcation of their boundary.

 Local officials, elected committee and other dwellers of the community are called as a
witness for observing and signing on each demarcated parcel boundary amongst
adjoining owners.

 Adjoining owners are gathered in the process of demarcation of boundary.

 Peg/stone/color is fixed on the agreed adjoining owners’ boundary of the parcel and
surveying is performed accordingly by tying with the national grid by surveying
personnel.

 The legal format is signed by the legal owner, adjoining owners, witnesses, surveying
and legal registry technicians.

 Adjudication certificate is provided for each proprietor certifying the right to land if the
targeted neighborhood is regularized.

LO3. Readjust Land in regularizing old occupants

 Neighborhood Development Plan or structural plan of the area is obtained.


 Orthophoto of the land is obtained.

 Map is printed at the scale of 1:500 to 1:200 by overlaying structural or Neighborhood


Development Plan.

 Adjoining owners and neighborhoods’ are negotiated and signed for the clear demarcation
of their irregular boundary on the legal format prepared for the process.

 Land readjustment is performed on the neighborhood.

 A new subdivision plan is prepared according to land consolidation.

 Provision of new deed registers or title certificate certifying the right to land.

 Provision of temporary occupancy right if the land is developable land for land banking.
