Sub :- Regarding engagement of retired Govt. employees as clerk on
contract basis.

As per order issued by the Finance Department, Govt. of West Bengal under
Memo.No.10935-F(P) dated 05.12.2011 (at Flag-A), 60(sixty) posts for engagement of retired
Govt. employees as Clerk on contract basis was sanctioned for this Collectorate out of which
18(eighteen) retired Govt. employees were appointed and posted at different sub-divisions of this
district vide D.M.’s Order No. 413 dated 28.06.2012 (at Flag-B).

In the meantime, a good number of ASHCs/UDCs of this Collectorate have been


retired from Govt. service on superannuation. On the other hand, Panchayat General Election,
2013 is knocking at the door.

As such, it is felt necessary to appoint clerks on contract basis from the


empanelled retired govt. employees for one year and they may be posted at different sub-
divisions of this district.

The list of retired Govt. employees (Gr.-C) empanelled for appointment is placed
below for kind perusal (at Flag-C).

In terms of Finance Department, Govt. of West Bengal’s Memo.No. 10935-F(P) dated
05.12.2011 read with Memo.No.8432(23)-B-III-ISU/2P-171/11 dated 14.12.2011 of the Joint Secretary,
Land and Land Reforms Department, Govt. of West Bengal, the following retired persons are hereby
appointed to the post of CLERK for a period of 01(one) year w.e.f. the date of joining on purely contract
basis on the following terms & conditions.
1. The engagement will be on purely contract basis for a period of 01(one) year.
2. The Contract may be terminated at any time without assigning any reason thereof.
3. No claims for further extension of appointment in future will be entertained.
4. A consolidated contractual remuneration amounting to Rs. 10,000/- (Rupees ten thousand) only
per month will be paid as emolument.
5. An agreement in prescribed format will have to be executed on Non-Judicial Stamp worth Rs.
10/-(Rupees ten) only before the undersigned within 07(seven) days from the date of joining,
failing which the appointment will be treated as cancelled.
6. The appointment will be treated as cancelled if failed to join by 15.03.2013.
7. No TA/DA will be admissible.

AGREEMENT FOR ENGAGEMENT OF RETIRED EMPLOYEES AS CLERK
ON CONTRACT BASIS

This AGREEMENT is being made this day the _______________ between the District
Magistrate, Cooch Behar in the State of West Bengal being the FIRST PARTY and Sri/Smt.
___________________________________ S/O, D/O, W/O Sri ___________________________
(address for correspondence) being the SECOND PARTY in pursuance of Finance Department, Govt. of
West Bengal’s Memo.No. 10935-F(P) dated 05.12.2011.
WHEREAS the District Magistrate, Cooch Behar has engaged Sri/Smt.
___________________________ on contract under the terms and conditions set forth below.
And WHEREAS Sri/Smt _____________________________ has agreed to accept the same on
such terms and conditions. Now it is hereby agreed and declared as follows.

1. The District Magistrate, Cooch Behar shall engage Sri/Smt __________________________


as _____________________ for smooth functioning of different offices under his administrative
control in the interest of public service.
2. The engagement shall be for a period of 01(one) year w.e.f. the date of joining.
3. He/ She shall serve in such capacity and shall discharge such duties as may from time to time be
assigned to him by the superior officers in the office/section, where he or, she will be ordered
to join.
4. He/ She shall obey all lawful orders and directions of her superior officers in the office/section,
where he or she will be ordered to join and shall devote his/her whole time and attention to the
best of his/ her abilities in the discharge of his/her official duties.
5. He/ she shall not during his/her term of engagement in this establishment, carry on any
business, trade, profession other than the duties assigned to him/her from time to time.
6. He/She shall not lend money to or, obtain loan from any person/persons without the prior
written consent from the establishment.
7. In consideration of such loyal and faithful service, the office of the District Magistrate, Cooch
Behar or the head of the office where he/she has been ordered to join shall pay to his/her a
consolidated contract remuneration of Rs.10,000(Rupees ten thousand) only per month.
8. He/ She shall not without prior “NO OBJECTION” of the office of the District Magistrate,
Cooch Behar pursue any educational or, professional course or appear for any competitive
exam/job opportunity.
9. During the tenure of his/her engagement, he/she may be liable to be transferred to any other
office under the administrative control of the District Magistrate, Cooch Behar.
10. The engagement of Sri/Smt. _______________________________________ under this
AGREEMENT may however be terminated forthwith without any notice at any time in the
event of his/her conducting himself/herself in any manner prejudicial to the Government and
more particularly in the following cases.
i) Insobriety while on duty or in public place.
ii) Unauthorized absence.
iii) Persisting unpunctuality in attendance to office.
iv) Gross carelessness and in attention to or neglect of work or duties.
v) Disobedience of lawful orders of Higher authority and or insubordinations.
vi) Breach of trust or breach of confidence in reference to Official secrets of the Government.
vii) Fraud or misappropriation or any other defalcation.
viii) Breach of any rules and regulations of the Government.
ix) Breach of any of the terms of this AGREEMENT.
X) Misconduct as laid down in Sec.5 of the prevention of corruption Act 1947.
xi) Bigamy.

For any matters proceeding or ground referred in this para 10, the decision of the District
Magistrate, Cooch Behar shall be final & binding on second party.

11. Any notice required to be served upon the PARTIES shall be taken to have been duly served
if the notice in writing is delivered by hand or by special messenger or it is sent by post/
registered post to the address of PARTIES as recorded.

12. The District Magistrate, Cooch Behar or, the head of the office where he/she has been ordered
o join shall act as the controlling officer for the purpose of drawing emoluments including
consolidated contractual remuneration during the tenure of his/her present terms of contract.

13. In future, the Government of India or the Government of West Bengal may, by any general
or specific order, modify the terms & condition of this contract or issues instruction having
bearing on the terms & conditions of this contract including the tenure there, then it shall be
binding on the Second Party, i.e. the contractual employee engaged to abide and in that case
the modified terms & conditions including tenure of the contract shall prevail to the extent they
are affected by the order/instruction of the Government of India/West Bengal as the case may be.

However, clarification towards admissibility of leave in respect of retired employees

Operator in treasuries of this district engaged on contractual
basis.

In pursuance of Govt. Order No. 10935-F(P) dated 05.12.2011, 29(twenty nine)


retired persons have been engaged as ‘Clerk’ on contract basis vide this office Order No. 413
dated 28.06.2012 & No. 159 dated 12.03.2013 and posted at different sub-divisions. Further, in
pursuance of Order No. 8154-F(Y) dated 25.09.2012, 12 (twelve) retired persons have been
engaged as ‘Data Entry Operator’ in treasuries on contract basis vide this office Order No. 135
dated 27.02.2013. .

In this connection, it is to mention that some information such as Date of Joining,


Agreement etc. in respect of the above contractual employees has not yet been received.
However, the said information is required for renewal of their contract.

In view of the above, if approved, Concerned SDOs and O/Cs of this Collectorate
may be requested to furnish the above information to this end at the earliest.

Sub :- Regarding extension of engagement of retired Govt. employees as clerk on
contract basis.
In pursuance of Finance Department, Govt. of West Bengal’s Memo.No. 10935-F(P)
dated 05.12.2011 read with Memo.No.8432(23)-B-III-ISU/2P-171/11 dated 14.12.2011 of the Joint

of LDC post have been made and at present this Collectorate is running with acute shortage of LDCs. As
such, services of the retired employees as Clerk on contract basis is absolutely necessary for smooth
running of official works of this Collectorate.
In view of the above, if approved, the above retired persons may be engaged as Clerk on
purely contract basis with consolidated contractual remuneration amounting to Rs. 10,000/- (Rupees ten
thousand) only per month for further period of 01(one) year as per existing Terms & Conditions to be
executed afresh by the concerned retired persons & they may be retained at their present place of posting.

In terms of Finance Department, Govt. of West Bengal’s Memo.No.10935-F(P)


dated 05.12.2011, 11(eleven) Retired employees have been engaged as ‘Clerk’ vide this office
Order No. 159 dated 12.03.2013 (Flag-A). Further, services of 16 (sixteen) ‘Contractual Clerk’s
already engaged vide this office order No. 413 dated 28.06.2013 have been extended vide this
office Order No. 381 dated 26.06.2013 (Flag-B).

Out of the 11 (eleven) newly engaged retired persons, 07 (seven) employees


against Sl. No. 1,2,3,4,5, 9 & 10 have executed ‘Agreement’ on Non-Judicial Stamp as per
direction. In this connection, it is to mention that engagement in respect of Sri Sailendra Nath Pal
as ‘Clerk’ have been discontinued w.e.f. 25.03.2013 vide D.M.’s Order No. 190 dated
25.03.2013.

Further, all 16 (sixteen) ‘contractual clerk’s whose services was extended vide
this office Order No. referred to above have executed ‘Agreement’ on Non-Judicial Stamp as per
instruction.

Now, the above 7 + 16 = 23 (twenty three) agreements may kindly be signed by


the District Magistrate and may be preserved for future references.

As per order issued by the Finance Department, Govt. of West Bengal under
Memo.No.10935-F(P) dated 05.12.2011 (at Flag-A), 60(sixty) posts for engagement of retired
Govt. employees as Clerk on contract basis was sanctioned for this Collectorate .

In pursuance of the said order, 18(eighteen) retired Govt. employees were


appointed and posted at different sub-divisions of this district vide D.M.’s Order No. 413 dated
28.06.2012 (at Flag-B). Thereafter 11(eleven) retired Govt. employees were appointed and
posted at different sub-divisions of this district vide D.M.’s Order No. 159 dated 12.03.2014 (at
Flag-C).

In the meantime, a good number of ASHCs/UDCs of this Collectorate have


retired from Govt. service on superannuation as well as some of the Contractual Clerks have also
resigned from their service. On the other hand, Parliamentary Election, 2014 is knocking at the

dated 05.12.2011 read with Memo.No.8432(23)-B-III-ISU/2P-171/11 dated 14.12.2011 of the Joint
Secretary, Land and Land Reforms Department, Govt. of West Bengal, 11(eleven) retired persons were

In view of the above, if approved, the above retired persons may be engaged as Clerk on
purely contract basis with consolidated contractual remuneration amounting to Rs. 10,000/- (Rupees ten
thousand) only per month for further period of 01(one) year as per existing Terms & Conditions to be

Sub :- Regarding engagement of retired Govt. employees as ‘clerk’ on

As per order issued by the Finance Department, Govt. of West Bengal under
Memo.No.10935-F(P) dated 05.12.2011 (at Flag-A), 60(sixty) posts for engagement of retired
Govt. employees as Clerk on contract basis was sanctioned for this Collectorate .

In pursuance of the said order, 18(eighteen) retired Govt. employees were


appointed and posted at different sub-divisions of this district vide D.M.’s Order No. 413 dated
28.06.2012 (at Flag-B). Thereafter 11(eleven) retired Govt. employees were appointed and
posted at different sub-divisions of this district vide D.M.’s Order No. 159 dated 12.03.2014 (at
Flag-C).

In the meantime, a good number of ASHCs/UDCs of this Collectorate have


retired from Govt. service on superannuation as well as some of the Contractual Clerks have also
resigned from their service. On the other hand, Parliamentary Election, 2014 is knocking at the
door.

As such, it is felt necessary to appoint retired Govt. employees as ‘Clerk’ on


contract basis and if approved, notice/advertisement may be issued in News paper (Uttarbanga
Sambad)/ Website for walk-in-Interview to be held on 21.02.2014 at ADM(G)’s office chamber,
D.M.’s Office, Cooch Behar.

Sub :- Regarding engagement of retired person as ‘Clerk’ on contract basis.

In pursuance of Finance Department, Govt. of West Bengal’s Memo.No. 10935-F(P)


dated 05.12.2011 read with Memo.No. 8432(23)-B-III-ISU/2P-171/11 dated 14.12.2011 of the Jt.
Secretary, L&LR Department, Govt. of W.B., a walk-in-interview for Ex. Govt. employees for selection
to the post of ‘Clerk’ was held on 21.03.2014 in the office chamber of D.M./ADM(G). Thereafter, as per
evaluation sheets in respect of the said interview, 20(twenty) retired persons were appointed as Clerk on
contract basis vide this office order No. 158(A) dated 03.03.2014. Previous office Note in this regard may
kindly be seen in page No.10 &11 of this Note Sheet. But, due to press release of Parliament Election,
2014, the said order was kept in abeyance as per verbal instruction of the authority/ Dist. Magistrate,
Cooch Behar.
In the meantime, Parliament Election, 2014 has been over. Now, it is felt necessary to
appoint selected persons for smooth running of office works at the district Head Quarter as well as at the
office of the different SDOs and BDOs of this district.
In view of the above as well as to cope up further requirement at the office of the SDO,
Dinhata and Tufanganj, if approved, the following persons (22 Nos.) may be engaged as ‘Clerk’ on
contract basis as detailed below.

AGREEMENT FOR ENGAGEMENT OF RETIRED EMPLOYEES AS CLERK
ON CONTRACT BASIS
This AGREEMENT is being made this day the _______________ between the District
Magistrate, Cooch Behar in the State of West Bengal being the FIRST PARTY and Sri/Smt.
___________________________________ S/O, D/O, W/O Sri ___________________________
(address for correspondence) being the SECOND PARTY in pursuance of Finance Department, Govt. of
West Bengal’s Memo.No. 10935-F(P) dated 05.12.2011.
WHEREAS the District Magistrate, Cooch Behar has engaged Sri/Smt.
___________________________ on contract under the terms and conditions set forth below.
And WHEREAS Sri/Smt _____________________________ has agreed to accept the same on
such terms and conditions. Now it is hereby agreed and declared as follows.
1. The District Magistrate, Cooch Behar shall engage Sri/Smt __________________________
as _____________________ for smooth functioning of different offices under his administrative
control in the interest of public service.
2. The engagement shall be for a period of 01(one) year w.e.f. the date of joining.
3. He/ She shall serve in such capacity and shall discharge such duties as may from time to time be
assigned to him by the superior officers in the office/section, where he or, she will be ordered
to join.
4. He/ She shall obey all lawful orders and directions of her superior officers in the office/section,
where he or she will be ordered to join and shall devote his/her whole time and attention to the
best of his/ her abilities in the discharge of his/her official duties.
5. He/ she shall not during his/her term of engagement in this establishment, carry on any
business, trade, profession other than the duties assigned to him/her from time to time.
6. He/She shall not lend money to or, obtain loan from any person/persons without the prior
written consent from the establishment.
7. In consideration of such loyal and faithful service, the office of the District Magistrate, Cooch
Behar or the head of the office where he/she has been ordered to join shall pay to his/her a
consolidated contract remuneration of Rs.10,000(Rupees ten thousand) only per month.

8. He/ She shall not without prior “NO OBJECTION” of the office of the District Magistrate,
Cooch Behar pursue any educational or, professional course or appear for any competitive
exam/job opportunity.
9. During the tenure of his/her engagement, he/she may be liable to be transferred to any other
office under the administrative control of the District Magistrate, Cooch Behar.
10. The engagement of Sri/Smt. _______________________________________ under this
AGREEMENT may however be terminated forthwith without any notice at any time in the
event of his/her conducting himself/herself in any manner prejudicial to the Government and
more particularly in the following cases.
i) Insobriety while on duty or in public place.
ii) Unauthorized absence.
iii) Persisting unpunctuality in attendance to office.
iv) Gross carelessness and in attention to or neglect of work or duties.
v) Disobedience of lawful orders of Higher authority and or insubordinations.
vi) Breach of trust or breach of confidence in reference to Official secrets of the Government.
vii) Fraud or misappropriation or any other defalcation.
viii) Breach of any rules and regulations of the Government.
ix) Breach of any of the terms of this AGREEMENT.
X) Misconduct as laid down in Sec.5 of the prevention of corruption Act 1947.
xi) Bigamy.

For any matters proceeding or ground referred in this para 10, the decision of the District
Magistrate, Cooch Behar shall be final & binding on second party.

11. Any notice required to be served upon the PARTIES shall be taken to have been duly served
if the notice in writing is delivered by hand or by special messenger or it is sent by post/
registered post to the address of PARTIES as recorded.

12. The District Magistrate, Cooch Behar or, the head of the office where he/she has been ordered
o join shall act as the controlling officer for the purpose of drawing emoluments including
consolidated contractual remuneration during the tenure of his/her present terms of contract.

13. In future, the Government of India or the Government of West Bengal may, by any general
or specific order, modify the terms & condition of this contract or issues instruction having
bearing on the terms & conditions of this contract including the tenure there, then it shall be
binding on the Second Party, i.e. the contractual employee engaged to abide and in that case
the modified terms & conditions including tenure of the contract shall prevail to the extent they
are affected by the order/instruction of the Government of India/West Bengal as the case may be.

Sub :- Regarding ‘Agreement’ executed by the retired persons engaged as


‘Clerk’ on contractual basis.

In terms of Finance Department, Govt. of West Bengal’s Memo.No.10935-F(P)


dated 05.12.2011, 22(twenty two) retired persons have been engaged as ‘Clerk’ vide this office
Order No. 267 dated 27.05.2014 (Flag-A). Further, services of 07 (seven) ‘Contractual Clerk’s
have been extended for further period of 01(one) year vide this office Order No. 168 dated
05.03.2013 (Flag-B).

Out of the 22 (twenty two) newly engaged retired persons, 21 (twenty one)
employees have executed ‘Agreement’ on Non-Judicial Stamp as per direction except Sri Ajit kr.
Ghosh (against Sl. No. 14).

Further, all 07 (seven) ‘contractual clerk’s whose services was extended vide this
office Order No. referred to above have executed ‘Agreement’ on Non-Judicial Stamp as per
instruction.

Now, the above 21+ 07 = 28 (twenty eight) agreements may kindly be signed by
the District Magistrate and may be preserved for future references.

submitted intimation towards resignation dated 04.07.2014 followed by resignation dated
31.07.2014 through the Block Development Officer, Cooch Behar-I Dev. Block
communicated under Memo.No.1610 dated 01.08.2014. The Resignation and intimation

In this connection, it is to mention that Sri Adhikary was engaged as ‘Clerk’ on

Sri TarunKumar Das, Contractual Clerk attached to SDO’s Office, Mathabhanga


has submitted a prayer regarding non-payment of salary/contractual remuneration for the month
of July, 2014 and the same is placed below for kind perusal (at Flag-A).

In this connection, it is to mention that Sri Das was engaged as ‘Clerk’ on contract
basis vide this office Order No. 413 dated 28.06.2012 for a period of 01(one) year (Flag-B may
kindly be seen). His service was extended for a period of another 01(one) year vide this office
Order No. 381 dated 26.06.2013 (Flag-C may kindly be seen). The Service of Sri Tarun Kumar
Das as Contractual Clerk was further extended for a further period of 01(one) year vide this
office Order No. 331 dated 27.06.2014 (Flag-D may kindly be seen).

It reveals from the instant application submitted by Sri Das that the applicant has
submitted his Joining Report and Agreement in prescribed format on 04.07.2014 as per
instruction of this office Order No. 331 dated 27.06.2014 but SDO, Mathabhanga did not accept
his joining report & agreement. The applicant has also stated that he is giving his attendance and
discharging official duties as well.

In view of the above, if approved, SDO, Mathabhanga may be requested to


furnish detailed report incorporate-ng the following points to this office immediately for taking
further necessary action from this end.

1. Whether the incumbent concerned attended office w.e.f.. 04.07.2014 to till date and
performing his official duties or, not.
2. Whether the incumbent concerned submitted his Joining Report and Agreement in
prescribed format before the authority within due date as per instruction as laid down in
this office Order No. 331 dated 27.06.2014.
3. Whether salary/ contractual remuneration for the month of July, 2014 has been disbursed
in favour of the incumbent concerned or, not and if not, why?
4. Whether service rendered by the incumbent concerned is satisfactory or, not.
