PEOPLE OF THE PHILIPPINES v.

PAUL ALIPIO
G.R. No. 185285
October 5, 2009
VELASCO, JR., J.:
FACTS:
Paul Alipio faced rape charges for allegedly assaulting AAA, a mentally challenged
woman, in June 2000 in Barangay San Francisco, Bulan, Sorsogon. Despite pleading not guilty,
the trial unfolded with testimonies from AAA, BBB (AAA's mother), and Dr. Imelda Escuadra
for the prosecution, countered by defense witnesses, including Norma de Leon, Dr. Chona C.
Belmonte, Saul Alipio (Paul's father), and Jose Genagaling.

ISSUE:
Whether the trial court erred by relying on the prosecution witnesses' testimonies,
rendering a guilty verdict despite alleged insufficient evidence to prove Paul Alipio's guilt
beyond reasonable doubt.

HELD:
The appeal lacked merit, with the Court of Appeals upholding the RTC's decision finding
Paul Alipio guilty of rape. The Supreme Court affirmed, stating AAA's mental condition didn't
disqualify her as a witness, and minor inconsistencies in her testimony didn't diminish her
credibility. The Court rejected Paul's plea of insanity due to insufficient evidence and sentenced
him to reclusion perpetua, along with civil indemnity and moral damages for AAA. Exemplary
damages were imposed to deter those with aberrant sexual tendencies. The Court of Appeals
decision was affirmed with modifications.
