OCCUPATIONAL HEALTH AND SAFETY ACT, (Act No 85 of 1993)

CONSTRUCTION REGULATION 13

(1) A contractor must—

(a) ensure that all excavation work is carried out under the supervision of a competent person who has been appointed in writing
for that purpose; and
(b) evaluate, as far as is reasonably practicable, the stability of the ground before excavation work begins.

GENERAL DUTIES OF EMPLOYERS TO EMPLOYEES - Section 8 (2)

(e) Providing such information, training and supervision as may be necessary to ensure, as far as is reasonably practicable, the
health and safety at work of his employees;
(i) ensure that work is performed and that plant or machinery is used under the general supervision of a person trained to
understand the hazards associated with it, and who has the authority to ensure that precautionary measures taken by the
employer are implemented; and
(j) causing all employees to be informed regarding the scope of their authority as contemplated in Section 37(1)(b).

Duties and Responsibilities

1 Excavations to be barricaded at all times.

2 Proper access must be provided. Access ladder must be 900mm above the excavation.
3 Inspection of every excavation daily before use and recorded in the safety file.
4 Watchman to be placed for high risk activities, excavations deeper than 2 meters.
5 No machinery to work on or near the embankments.
6 Stockpiled material to be stepped back 1 meter from the edge.
7 Excavation signs must be dispayed.
8 Ensure that shoring and bracing is designed and constructed in a manner that renders it strong enough.
